General Terms and Conditions
1. KIB-TEK shall not be bound to accept the lowest or any particular tender, and reserves the right of
accepting /rejecting the whole or any portion or all the tender work without assigning any reason
whatsoever. In the event of a cancellation of a tender, no parties can claim compensation of
reimbursement. However, if the tender is going to be repeated a second tender cost will not be asked.
2. If the Purchasing Commission is not satisfied with the lowest bid, it is entitled to bargain with the
related company. In case of any dispute on this issue, KIB-TEK is entitled to apply Article One .
3. Offers may be made in Turkish Lira or in foreign currencies. Bids, made in a foreign currency will be
converted to Turkish Lira according to the Central Bank rate on the closing date of the bid.
4. VAT will not be included in the quotation (bidding) and quotation shall be written both in fi gures and
words. Failure to comply with these requirements or any erasures, deletions or corrections shall cancel
and invalidate the bid. Bids written in pencil shall not be taken into consideration.
5. The quotation shall be given as the unit price, total price and general total price. However, assessment
will be made according to the unit price.
6. All those participating in the tender must submit certificate of conformity to international standards
such as BS, IEC, DIN or equivalent TSE standards. Certificates must have a clear profile of their
country of origin and trademark. Recommended materials should be the manufactures of a company
based in Turkey, any European Union member country, any EFTA member country, Australia, Canada,
the USA or Japan. Manufactures of Multinational firms, which manufacture plants not based in
abovementioned countries shall not be accepted.
7. According to Article 35 (2), (3) and (4) of the Public Procurement Act, if the goods/materials are not
delivered timely and accurately, except in the event of Force Majeure, KIB-TEK, shall ask a delay
penalty of 0.2% (two per thousand) for each calendar day .
The delay penalty in any case shall not exceed 10% of the total value of materials. In the event of a
delay exceeding 30 days, KIB-TEK reserves the right to cancel the order with a written notice and
sought another supplier, and claim and receive any extra expenses incurred thereby in addition to the
existing penalty. The liquidated damages set forth in this clause (article) shall be the buyer’s sole and
exclusive remedy and the supplier’s only liability for the delay. Force majeure conditions, which can
partially or completely block the implementation of the contract are extraordinary events or
circumstances beyond the control and mistake of the parties. They are listed below.
a. Fire.
b. Flood, floods, hurricanes, earthquakes and other natural disasters.
c. Epidemic diseases.
d. War.
e. Mobilization.
f. Sabotage or other factors that prevent production.
g. Embargo .
h. Government cuts (savings).
ı. Damage to transport vehicle through accident, fire, shipwreck or ship protes t.
For accepting force majeure conditions as an excuse for time extension; it should
be documented by the relevant official bodies.
8. KIB-TEK will pay the total amount of the materials/goods, to be delivered in accordance with the
terms and conditions of the tender, within 45 (forty-five) calendar days following the necessary
counting and affirmance time limit of 15 (fifteen) days. In case of failure to make payment within
this period, a delay penalty of 20% for Turkish Lira and 6% for foreign currency will be paid for
every invoice by KIB-TEK for each calendar day. Firms that quote in foreign currency will issue
invoices also in foreign currencies. Payment to TRNC firms will be made in Turkish Lira accord ing
to Central bank’s buying rate of exchange and to foreign firms with the currency in their quote.
9. Offers at least 45 days from the date of submission of bids will be optional.

10. Delivery must be no later than 90 (ninety) days. If the delivery date given by all those participating in
the tender exceeds 90 days, KIB-TEK may also consider those offers. However, it is not obligatory to
finalise them.
11. The place of delivery will be given as CIF TRNC. The price of the materials concerned mus t be
communicated to KIB-TEK together with the shipping and insurance costs.
12. The winning bidder company should submit the weight list and transportation cost for the
list of
materials decided to be purchased in line with the terms of the tender, to KIB-TEK appropriately. If
the winning company will not deliver the materials to KIB-TEK with a single delivery, additional
amount for customs, documents, internal transport, handling and middleman charges, for the invoice
or invoices other than the first invoice, will be paid by KIB-TEK and deducted from the total payment
to the company. Delivery to be made in line with this article, cannot change the deadline given.
13. If there are missing documents or information, 72 hours or extra time can be given by KIB-TEK for
completion. If this period is exceeded, the contract may be cancelled.
14. KIB-TEK reserves the right to make a partial purchase in any given offer. In that case new conditions
to arise will be considered.
15. Bids should be sent, e.g. no later than 06/10/2015 until 10 o`clock to the email address
[email protected] or can be delivered in a sealed envelope , labeled as "Swivel Joint and spare
parts Tender" in the Tender Box located at KIB-TEK Central Office. Bids should be submitted no
earlier than 5 calender days, prior to the bid deadline.
16. The bidder companies shall be liable to and fulfill the provisions of both the General Adminis trative
Terms and Conditions and if there is the Technical Terms and Conditions .
17. The bidder companies has the right to submit their own terms and conditions, but they should inform
KIB-TEK about these while giving their offer. Failure to do this, shall be construed as waiver of t his
right. If there are conflicting situation Technical and General Administrative Terms and Conditions
herein shall prevail. However, KIB-TEK reserves the right to accept or refuse the bidders’ terms and
conditions while assessing the bids.
18. Bidder companies or individuals are obliged to comply with all of the above conditions and
acknowledge and approve them by signing, sealing and submitting this document.
