VisitBrighton Partnership Programme
Terms and Conditions of Partnership
(For the period of 1st April 2016 – 31st March 2017)
General Conditions (All Partners)





The Partnership year runs from 1 April 2016 to 31 March 2017.
Partnership is not transferable.
Partners must abide by all existing Equalities and Health & Safety legislation.
VisitBrighton is part of Brighton & Hove City Council.
Payment of fees: 30 days upon issue of the invoice in April 2016. Partners who fail to settle accounts by the designated date
will cease to be part of the Partnership programme.
VisitBrighton reserves the right to remove any Partner from the Partnership programme if more than three written complaints
of a similar nature are received in any twelve month period.
Partners will still be liable for the total annual subscription whether or not their details are published on www.visitbrighton.com.
Partners must provide a URL link to www.visitbrighton.com from their own website.
VisitBrighton does not give refunds on Partnership subscriptions.
VisitBrighton reserves the right to decline organisations onto the Partnership programme.
Language schools must sign and return the Language Schools Code of Practice.






Accommodation Providers – Additional Terms & Conditions
All accommodation providers wishing to be a VisitBrighton Partner must:

Have their own terms and conditions available to view for customers booking through VisitBrighton channels and ensure that
any terms & conditions of booking are made clear to the customer prior to arrival.
Advise VisitBrighton of any online accommodation bookings made via VisitBrighton.com or the VisitBrighton Contact Centre
that have been cancelled for any reason.
If using a property management system, it is the provider’s responsibility to ensure their external systems are updated, manually
if necessary, in the event of a cancellation.
Ensure that availability and pricing information provided to VisitBrighton is up to date.
Contribute monthly statistics on occupancy.
Be inspected to achieve a star rating from either VisitEngland or the AA OR inspected under the Local Accommodation
Scheme OR, otherwise, must sign and agree to abide by the VisitBrighton Accommodation Charter.
If you have to cancel a booking that you have already accepted, you are in breach of contract. If you cannot accommodate a
guest who has made a booking, you must find them alternative accommodation of the same or higher standard.
The guest is entitled to claim damages as compensation for any losses incurred in finding alternative comparable
accommodation (e.g., extra taxi fares or any extra accommodation costs). However, the guest has a legal duty to keep losses to
a minimum, so if your establishment is a bed and breakfast they cannot book into a five star hotel and expect you to pay the
difference.







Accommodation Booking Commission

10% (Inc. VAT) commission is payable on all accommodation bookings made via VisitBrighton booking channels – in person, the
Contact Centre, the Conference Delegate Accommodation Bureau, and all online bookings through www.visitbrighton.com.
Commissionable rates must be given to VisitBrighton.

Images



All images should be supplied in high resolution and landscape format, where possible.
Partners must supply at least ONE image (maximum of six) for their page on www.visitbrighton.com.
Partners’ pages on www.visitbrighton.com will not be published without images.

Image Permission Rights for VisitBrighton
By signing this VisitBrighton Partnership Terms & Conditions document, Partners accept the following image permission rights
declaration:








I/we warrant that the information provided is true and accurate and if published will not constitute an offence under the Trade
Descriptions Act 1968 or the Consumer Protection Act 1987.
I/we warrant that each image which I/we have supplied may be used by national and regional tourist boards, including
VisitEngland and VisitBritain (nationally and internationally) and other Tourist Information Centres and that, where relevant, the
consent of any individual featured in an image has been obtained for such use.
In addition I/we agree that the image may be supplied to other carefully selected third parties for tourism-related purposes.
I/we guarantee that for any images supplied featuring minors, signed consent and permission from their parents/guardian has
been obtained.
I/we guarantee that for any images supplied in which individual(s) are clearly recognisable, have obtained their expressed
permission to publish.
I/we accept that it cannot be guaranteed that the image supplied will be published or used in either the form submitted or at all.
I/We warrant that I/we are authorised to supply the image and that it does not infringe any existing copyright or other
intellectual property right. 1/We further warrant that the image is accurate and if published, will not constitute an offence under
the Trade Descriptions Act 1968, the Consumer Protection Act 1987 or breach any codes of practice relating to advertising or
sales promotion.
I/We undertake to indemnify local, national and regional tourist organisations and any third parties to whom the image is
supplied against any loss, damage or proceedings arising from breach of these warranties.
