ANNOUNCEMENT
SUBJECT: Completion and submission of debt verifications
It is very important that the preparation and submission of proofs of debts and proxies for the Bankruptcies and
Liquidations of Companies Section be done correctly in order to avoid the various legal and operational problems.
Otherwise it is possible that the proofs of debts will not be received and will be returned, or will not be taken into account
when voting on "Meeting of Creditors" and / or not be taken into consideration for the payment of dividends.
For the above reasons and for the verifications to be correct should always:
The proof of debt be made under oath and one (1) Euro stamp must be attached on the form.
Proxies must be signed before and witnessed by the Registrar of Court or the Official Receiver or Certified Registrar.
The proof of debt to be completed correctly, the name of the debtor / bankrupt and identity card number or the full name
and number of the Registered Company in Liquidation, depending on the case.
Please fill in the name and full mailing details of the creditor and the shareholder and contact details.
On the proof of debt, complete name and full mailing details of the person authorized submitting proof of debt and contact
details.
Specific and general proxies should be completed by name and full mailings of the authorized person and creditor or
shareholder and contact details of their representative.
All proofs of debts must be accompanied with all the necessary proofs and evidence.
For example, decisions of the courts and / or account statements and / or invoices or agreements etc.
The proofs of debts are necessary to be completed by detailing any securities that may be held by creditors (mortgages,
Memo, etc.) and clearly point out, both the amount of the security assessment and the amount of debt / liability, and also
clearly state the remaining amount for the proof of debt , after deducting the estimated value of the security.
On the proofs of debts forms should be reported any personal guarantees given by third parties on the debt / obligation of
the insolvent company or to the debtors / bankrupts loans. For such guarantee there should be special reference to the
existence of such security, but not deducted from the value of the amount verified on to the proof of debt.
