A WIN / WIN TELECOMMUTING PERFORMANCE AGREEMENT I, _________________________________, the undersigned, agree to the following terms and conditions under which my immediate supervisor and I will conduct our telecommuting work arrangement during the period from _____________ to _____________. We both understand that this Agreement is a performance target, and that the best work done while telecommuting occurs in an atmosphere of flexibility rather then rigidity. 1. My immediate supervisor and I will meet (circle one) daily / weekly / monthly to establish new assignments, performance goals, and deadlines for me to pursuer, and to evaluate how well I am meeting / have met those established for me. Each set of current goals is considered part of this Agreement. 9. It is also understood that: a. Before I begin to telecommute on a regular basis, my supervisor and I must have a Telecommute Application on file at Employee Benefits – Commute Options & Parking Section (COPS). b. There are no distinctions in rates of pay and benefits between telecommuting and nontelecommuters; c. Telecommuters shall be given the same opportunities as non-telecommuters for promotion and career development, including access to additional training; d. Telecommuters shall have regular opportunities to meet their telecommuting and nontelecommuting colleagues in their organizations in order to minimize any feelings of isolation or exclusion; e. Telecommuters shall have the same rights and access to representation as their colleagues; f. Telecommuters may use their personal computer equipment and/or software for telecommuting, at their own expense, provided that it is compatible with City computers and “virus” free; g. The City retains the right to inspect home offices and computer equipment/software for safety, adequacy and security; h. The schedule worked by a telecommuter need not be the same as that of the principle office, provided that their schedule is given prior approval by the telecommuter’s supervisor; i. A telecommuter is covered by Workers’ Compensation Insurance regardless of the location of his/her workplace and work hours, provided that the work location and schedule were given prior approval by the telecommuter’s supervisor; j. Accidents at a telecommuter’s home to persons who are not employees if the City of Los Angeles or, if they are employees and are not engaged in City work activities, are the responsibility of the telecommuter. k. Telecommuters are responsible for protecting City information in their possession and which is accessible through use of equipment in their possession, regardless of their work location. Any 2 l. m. n. o. sensitive information in a telecommuter’s possession must be given at least the same or equivalent physical protection as would be used or available in the telecommuter’s principal office; Telecommuters shall not use City-provided equipment or software to perform work for any other employer; Hours an employee is credited as telecommuting must be used exclusively for City-related duties; such time may not be used performing duties for another employer, self employment, or voluntary/charitable functions; Telecommuting shall not be used performing duties for another employer, self employment, or voluntary/charitable functions; The City is not responsible for the portion of home utilities costs or space rental that is attributable to a telecommuter’s telecommuting activities.
