Consultation Process

• comments received by 11 August 2010 will be considered
by Reference Group
• proposed Charter will be presented to the Minister for
Health, with consultation report, by 1 October 2010

In developing the Charter, the Commissioner
must have regard to the following principles

How will HCSCC use the
Charter?
Section 85 of the Health & Community
Services Complaints Act (2004) says that:
(1) in determining whether a health or community
service provider has acted reasonably, HCSCC must have
regard to:
a) the Charter; and
b) the Charter principles (section 22); and
c) the generally accepted standard that would be
expected of a health or community service provider,
and may have regard to any other matter or information that
HCSCC considers relevant.
(2) HCSCC must in making a decision, take into account the level
of resources reasonably available to the health or community
service provider.

service provider’s actions
were reasonable
• What they did was reasonable
- HCSCC takes no further action
• What they did was unreasonable
- Outcome may include: an apology, future
plan for service user, action to prevent it
happening again, recommendations for
service improvement, monitoring progress.
Ongoing role of the
HCSCC
Section 9 (1) of the Health & Community
Services Complaints Act (2004) requires
HCSCC to:
(a) to prepare and regularly review the Charter; and
(d) to provide information, education and advice in
relation to(i) the Charter; and
(ii) health and community service rights and
responsibilities.
It is likely that these functions will be completed in conjunction
with the HCSCC Advisory Council.
