WIN YOUR ORDER – Spring 2016

OFFICIAL RULES
The SAQ “WIN YOUR ORDER – Spring 2016” Contest
1. CONTEST PERIOD
The “Win Your Order – Spring 2016” contest (the “Contest”) is conducted by the Société des
alcools du Québec (the “Organizer”). The Contest is held on the SAQ mobile application and on
the SAQ.COM website on these dates (the “Contest Dates”): April 15 to May 15, 2016 until 11:59
p.m. (hereinafter the “Contest Period”).
2. ELIGIBILITY
The Contest is open to residents of Quebec aged 18 and over who have a SAQ.COM account at
the time of entry. The following are excluded: the employees, agents and representatives of the
Contest Organizer, its advertising and promotional agencies, suppliers of prizes, goods and
services related to this Contest, as well as members of their immediate families (brothers, sisters,
children, father, mother, legal or de facto spouse) and the individuals with whom they reside.
3. HOW TO ENTER
3.1
To enter, purchase a product using the SAQ mobile application (the “Application”) or online
at SAQ.COM during the Contest Period, being sure to follow all instructions. When
payment has been validated by the SAQ, you will receive one entry for that day’s draw.
3.2
Entry coupons cannot be accumulated during the Contest Period. One entry is eligible only
for the daily draw on the day it is obtained, in accordance with paragraph 5.1 of these
official rules.
3.3
Limit. Entrants must comply with the following limit, failing which they could be disqualified:
one (1) entry per person per day of the Contest, regardless of the number of purchases
made on that day, wherever applicable.
4. PRIZES
4.1
Thirty-one (31) prizes are to be won during the Contest, at the rate of one (1) prize per
day during the Contest Period. Each prize is a cash prize corresponding to the value of
1
the purchase that results in a valid entry. The maximum prize value is two hundred and
fifty ($250) dollars. Should a winning entrant make more than one purchase on the same
day, the value of the prize will be for the amount of the transaction closest to $250,
always subject to the foregoing $250 maximum value per prize.
5. PRIZE DRAWS
5.1
In the week after the Contest ends, 31 random draws will be held at the Organizer’s
office in Montreal. Thirty one (31) eligible entries will be drawn from all valid entry forms
received during the Contest Period, with one (1) winner being selected for each of the
31 days of the Contest.
5.2
The odds of an entrant being selected as a winner will depend on the number of valid
entries received on the Contest Day for which the entry was recorded.
5.3
Limit of one (1) prize per person and per residence during the Contest Period.
6. AWARDING OF PRIZES
6.1
To be declared a winner, a selected entrant must:
a) Be reached by phone or email by the Organizer within five (5) business days of the
draw. A selected entrant reached by email must reply in accordance with the
instructions therein, if any. A prize notification email with an “undeliverable message”
may result in the Organizer disqualifying that entrant, at its sole discretion, or trying to
reach the entrant by phone;
b) Correctly answer a skill-testing mathematical question on the Waiver form sent by the
Organizer;
c) Duly complete and sign the Waiver form and return it to the Organizer by fax or in digital
format by email within fourteen (14) days of its receipt. The Organizer will, within fifteen
(15) business days of receipt of the duly completed and signed Waiver form, credit the
value of the purchase made by the entrant, up to a maximum of $250, to the credit card
2
used for the winning transaction effected on the SAQ mobile application or at
SAQ.COM.
d) On request and in a timely fashion, provide one piece of photo identification.
7. GENERAL CONDITIONS
By entering this Contest, all entrants agree to comply with these Contest rules, the conditions of
sale governing the use of the SAQ mobile application as well as the online conditions of sale of
the SAQ.COM program.
7.1
All transactions on the SAQ mobile application or SAQ.COM (the “transactions”) and
Waiver forms are subject to verification by the Organizer. The use of any software or
other mechanism or device for automated entries is forbidden. Transactions and Waiver
forms which are, as the case may be, incomplete, illegible, mutilated, fraudulent, not
providing the correct answer to the skill-testing mathematical question, or otherwise not
in compliance with these rules shall be automatically rejected and shall not entitle the
entrant to an entry or a prize. If such an entry coupon is selected and the Organizer or
its authorized agents are unable to reach the person whose entry is selected within five
(5) business days in spite of making all reasonable attempts, if a selected entrant fails to
return the completed and signed Liability Release form within the prescribed time, if an
entrant refuses a prize, contravenes in any way these official rules or does not comply
with conditions of the program, that individual will be disqualified and forfeit all rights to
an entry or to a prize. The Organizer will then proceed to select another entry coupon
until a winner is chosen or may, at its sole discretion, cancel the prize.
7.2
Prizes must be accepted as awarded and may not be transferred, in whole or in part, to
another person or substituted for another prize.
3
7.3
A selected entrant acknowledges that when the prize has been awarded, the Organizer
takes no responsibility for problems or issues that could arise from acceptance or use of
the prize.
7.4
The Organizer does not guarantee that access to the SAQ mobile application and the
SAQ.COM site will be uninterrupted or error-free during the Contest Period.
7.5
The Organizer takes no responsibility for a malfunction of the SAQ mobile application
and SAQ.COM site or for any transmission problems or other technical failure, including
but not limited to the malfunction or absence of any network, server, service provider,
hardware or software, or any network or server transmissions or communications that
are defective, incomplete, illegible or deleted that may limit or prevent a person’s
participation in the Contest;
7.6
The Organizer takes no responsibility for damages or loss that could result, directly or
indirectly, in whole or in part, from the use of the SAQ mobile application or the
SAQ.COM site and the transmission of information for the purposes of this Contest.
7.7
By entering or attempting to enter this Contest, all selected entrants release and hold
harmless the Contest Organizer, its parent company, any company, corporation, trust or
other legal entity controlled by or affiliated with them, as well as their respective
directors, officers, associates, employees, agents, representatives, successors and
assigns (collectively, the “Released Parties”) from any and all liability relating to
participation in the Contest and acceptance and/or use of the prize.
7.8
By participating in the Contest, entrants authorize the Organizer or its authorized agents
to use, if need be, the entrant’s name, image, photo or other likeness, place of
residence, voice and/or statements regarding the prize for advertising purposes in all
media without further notice or compensation.
7.9
The Contest is subject to all applicable federal, provincial, and municipal laws.
7.10
The Organizer reserves the right to disqualify a person or cancel an entry if an individual
enters or attempts to enter this Contest by using means that do not comply with the
4
Rules or are unfair to other entrants (i.e. exceeding the authorized number of entries). In
such cases, the entrant could be reported to the competent authorities.
7.11
Any attempt to sabotage the legitimate conduct of the Contest constitutes a violation of
civil and criminal laws. In such cases, the Organizer reserves the right to exclude that
person’s entry and to demand damages as permitted by law.
7.12
Should a computer system or any other issue result in failure to register all Contest
entries before the end of the Contest Period, or if the Contest were to end, in whole or in
part, before the date stipulated in these official rules, the Organizer may, at its sole
discretion, proceed with a random draw from all eligible entries duly registered during
the Contest Period or, as the case may be, up to the date of the event that put an end to
the Contest.
7.13
In all cases, the Organizer cannot be obliged to award a prize other than in compliance
with these official rules.
7.14
No communication or correspondence will be held between Organizers and entrants
during this Contest other than that which is stipulated in these rules or initiated by the
Organizer. Personal information collected from entrants for the Contest will be used only
for the administration of the Contest. No communication, commercial or otherwise,
unrelated to this Contest, will be sent to the entrant except by prior agreement.
7.15
Waiver forms are the property of the Organizer and will not be returned to entrants
under any circumstances.
7.16
If a section of these Contest Rules is declared invalid or unenforceable by a court of
competent jurisdiction, that section shall be considered invalid; all unaffected sections
will remain valid to the extent permitted by law.
7.17
In the event of discrepancy between the French and English version of these rules, the
French version shall prevail.
7.18
For the purposes of these rules, an entrant is the individual whose name appears on the
billing address provided upon payment of a purchase on the SAQ mobile application or
5
at SAQ.COM. When awarded, the prize will be credited to the credit card that generated
the winning Contest entry.
7.19
Decisions by the Organizer and/or its authorized agents regarding this Contest are final
and without appeal in all matters, subject to a ruling by the Régie des alcools, des
courses et des jeux du Québec on any issue under its jurisdiction.
8. Régie des alcools, des courses et des jeux
8.1
Subject to approval by the Régie des alcools, des courses et des jeux du Québec, if
required, the Organizer reserves the right, at its sole discretion, to cancel, terminate,
modify or suspend the Contest, in whole or in part, should human intervention or an
event occur that could alter or affect the administration, security, impartiality or conduct
of the Contest.
8.2
A dispute concerning the organization or conduct of a publicity contest may be
submitted to the Régie des alcools, des courses et des jeux for a ruling. A dispute
pertaining to the awarding of a prize may be submitted to the Régie only for the purpose
of helping the parties reach a settlement.
