SEALED BID PROCEDURES
Bids must be submitted in a sealed envelope with the word “BID” written in the bottom left corner of the
front of the envelope. Bids must be sent by United States Postal Service to:

All envelopes with bids will be opened at the Board of Directors meeting, which starts at 7:00 p.m., on
February 8, 2008. In the event of identical bids, the earlier postmark will be accepted. Each bid must be
submitted in a separate envelope. Each bid must be accompanied by a check or money order made out to
“CCPOA” in the amount of $200.00.
Successful bidders not in attendance at the Board Meeting will be notified in writing within ten days after
the opening of the bids. The $200.00 deposit will be applied to the accepted bid price; the balance must be
received by CCPOA within 21 days after the successful bidder has been notified. If the balance is not
received by CCPOA within the allotted time, the $200.00 deposit will be forfeited and the next higher bid
will be accepted. Checks from unsuccessful bidders will be returned within ten days after the opening of the
bids.
(Another selection of foreclosed CCPOA lots will be offered for sale by sealed bid in May or June of 2008
after the 6-month waiting period mandated by State law has expired.)

Notification of Proposed CCPOA Bylaws Changes
Since our Bylaws were rewritten in 1987, the Board feels they should to be updated in certain areas where you, the
Property Owner, need to be further protected. Proposed changes listed on the 2008 ballot will make this Board and future
Boards more accountable in the operations of Cape Carancahua Property Owners’ Corporation business. In some
instances, the changes will hold Board members personally liable. Below is a brief outline of the proposed changes and
the need therefor:
Amendment No. 1 prevents your Board of Directions or any Board member from expending funds not budgeted or
approved by vote of the Property Owners.
Amendment No. 2 prevents your Board of Directors or any Board member from signing any contract that will obligate
future Boards’ expenditures without a vote from the Property Owners.
Amendment No. 3 insures that all Property Owners are notified in writing well in advance of any meeting where Property
Owners are required to vote.
Amendment No. 4 further insures accountability by all members of the Board of Directors.
Amendment No. 5 establishes specified reserve funds for specific expenditures so that, when needed, the Board will have
the necessary funds without having to place a special assessment on Property Owners. It will further insure the Property
Owners’ assets are protected and their services are ongoing.
Amendment No. 6 insures fairness in the maintenance fees charged on newly-proposed lots due to new Texas laws that
increase the minimum size of subdivision lots. This will not affect any current Property Owners or the maintenance
charged now.
Amendment No. 7 mandates that future elections be conducted by an outside firm to insure election fairness.
Amendment No. 8 prevents future Boards from selling, transferring, or otherwise disposing of our recreational areas.

These proposed Bylaw changes will be listed in their entirety, along with the list of candidates running for the 2008 Board
of Directors, on the 2008 ballots you will receive in a few days. Your ballot must be returned, in the addressed envelope
provided, to the accounting firm of Bumgardner, Morrison, & Co., L.L.P. before 5:00 p.m., March 1, 2008, or handed to a
member of that firm before 2:15 p.m. on March 9, 2008, at the Annual Meeting of the Corporation, when the balloting is
announced “closed”. Ballots must be signed in accordance with CCPOA Bylaws, Art. V., Sect. 1 (a). Ballots mailed or
delivered to the CCPOA office will be invalid and will not be counted. .




2008 annual maintenance fee statements will be mailed shortly. The envelope will be marked “Statement”.
The next CCPOA Board of Directors meeting will be held at 7:00 p.m. on Friday, February 8, 2008.
The next CCPOA Property Owners’ quarterly meeting will be held at 2:00 p.m. on Sunday, February 10, 2008.
The 2008 Property Owners’ annual meeting will be held at 2:00 p.m. Sunday, March 9, 2008
