WILLFUL PARTICIPATION, ACKNOWLEDGEMENT OF RISK, WAIVER OF LIABILITY AND
INDEMNIFICATION AGREEMENT FOR RED RIBBON RIDE TRAINING RIDE
I choose to participate in one or more noncompetitive training events promoted by the Red Ribbon Ride, in connection with
my participation in the Red Ribbon Ride charity fundraising event. My participation in the Red Ribbon Ride training events
is my own idea and is of my own free will without any compulsion whatsoever.
I understand that while participating in the Red Ribbon Ride training events I will be using public streets and facilities where many
hazards exist. I understand that accidents may occur during these events and that I may be seriously injured or killed as a result. I
represent that I am in good health so as to allow me to take part in the Red Ribbon Ride training events.
As lawful consideration for being permitted by Minnesota Fighting AIDS on Bikes to participate in the Red Ribbon Ride training
events, I hereby for myself, my heirs, administrators, personal representatives and assigns, forever release and discharge Minnesota
Fighting AIDS on Bikes, African American AIDS Task Force, The Aliveness Project, Clare Housing, Hope House of St. Croix
Valley, Minnesota AIDS Project, One Heartland, Park House, Rural AIDS Action Network, and the training ride leader(s) or
other Riders on this event, their owners, shareholders, directors, officers, employees and agents (collectively the “Released Parties”)
from any and all liabilities, losses, costs, claims, demands or causes of action (collectively “Liabilities”), that I may hereafter have for
death, injuries and damages arising out of my participation in the Minnesota Red Ribbon Ride training events, whether caused by any
negligence, active or passive, of the Released Parties or otherwise.
This agreement will not apply to willful, wanton recklessness or intentional acts of the Released Parties.
I acknowledge that the Released Parties have never expressly or impliedly assumed any responsibility for me during the Red Ribbon
Ride training events. I hereby personally assume all risks in connection with my participation in the Red Ribbon Ride training events
and any other activity connected therewith.
I acknowledge that I alone am responsible for my personal safety, the condition of the bicycle I will be riding, and all personal
property, I bring with me during the Red Ribbon Ride training events. I understand that I am solely responsible for my bicycle and
personal property, which means that none of the Released Parties will be responsible for the safekeeping or custody of any such
property. I hereby for myself, my heirs, administrators, personal representatives and assigns, forever release and discharge the
Released Parties of any liability that may arise out of any act I commit resulting from my participation in the Red Ribbon Ride training
events.
Because bicycle riding is dangerous, I agree to ride safely at all times. I also agree to wear a helmet certified by ANSI, Snell, CPSC,
or ASTM, whether during the ride itself or on training rides.
I have carefully read the above release and agreement prior to its execution, and I am fully familiar with the contents thereof. I agree
that this release and agreement will be governed by Minnesota law and is intended to be as broad and inclusive as permitted by the law
of Minnesota, and that if any portion of it is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.
This release shall be binding upon myself, my heirs, administrators, personal representatives and assigns, forever.
I UNDERSTAND THAT THIS IS AN IMPORTANT LEGAL DOCUMENT. BY SIGNING BELOW, I
REPRESENT THAT I HAVE READ THIS DOCUMENT CAREFULLY AND IN FULL, THAT I AGREE TO
ALL OF ITS PROVISIONS, AND THAT I SIGN THIS AGREEMENT OF MY OWN FREE WILL.
I hereby warrant that I am at least 18 years of age and have the right to contract in my own name.
