MANDURAH MAGIC BASKETBALL ASSOCIATION MANDURAH BASKETBALL ASSOCIATION BY-LAWS Reviewed August 2014 MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 1 – Playing Rules 1.1 All competitions or games conducted by the Association shall be conducted in accordance with the official Rules of Basketball as adopted by Basketball Australia except where deemed inappropriate by MBA officials. 1.2 The MBA follows a no tolerance policy as indicated by the attachment: Mandurah Basketball No Tolerance Rules Rule 2 – Rules Interpretation 2.1 In any instance where a ruling is required as to the intent or purpose of any rule as included in the Official Rules of Basketball, or in the event of a dispute arising as to the interpretation of any rule, then the matter shall be determined by the Domestic Manager in conjunction with the CEO or MBA Board Rule 3 – Team Nominations 3.1 All teams desirous of participating in any competition conducted by the Association shall complete the entry forms as prescribed by the MBA Office. 3.2 Such entry forms complete with the registration fee shall be in the hands of the MBA Office on or before the due date as prescribed by the MBA Office. Entry forms received after the due date shall be invalid, except in special circumstances when MBA Office may accept such nominations as valid. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 4 – Player’s Uniforms 4.1 Each club will be nominated two primary colours and a third trim colour to form their respective uniforms for the MBA Domestic Competitions. Colours as follows: CLUB Falcon Fury Comet Bay Peel Predators MCC Freddies Tigers MBC Lakers PRIMARY COLOUR 1 PRIMARY COLOUR 2 TRIM COLOUR 4.2 The uniform shall be approved by the MBA office prior to registration. Top must be a singlet. All tops and shorts must be uniform in style and colour. 4.3 Each player shall be numbered on the front and back of his singlet with numbers 4 to 15 being the only acceptable numbers. Numbers fashioned from adhesive tape or other non-permanent material will not be accepted. Players who fail to comply will be judged to be out of uniform and not permitted to play until they are in proper uniform. 4.4 All players are to be in full uniform by the start of the season. Those not in full uniform will not be permitted to take the court. If any exceptional circumstances arise to prevent a person or team not being in uniform then an exemption may be granted by the MBA Office. 4.5 Referees, Referee Supervisor or the Stadium Manager shall have authority to prevent any player participating in any game if the player concerned is not clothed in the official uniform of the team. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 5 – Registration of Players 5.1 Teams will register every playing member of the team with the Association prior to the commencement of the season. 5.2 Such registration shall be considered to have been correctly effected when the registration form and registration fee as prescribed by the MBA Office shall have been duly received by the Office Manager. 5.3 All players are to be registered by the first playing date. Players not registered on the first or any subsequent fixture date will be unable to play until they are registered. 5.4 The Association shall maintain a register of all registered players, showing player’s names, dates of birth, email, contact number and addresses and the teams to which they belong. Such register shall be available at each and every meeting of the MBA Board. 5.5 No refunds shall be given after the completion of the first game of the season. If the team is withdrawn after fixtures are completed a $50.00 administration fee will be charged. 5.6 Teams may register new players during the season but must fill out all appropriate personal details and be added to the team registration form before being allowed to play. The new player must be in correct team uniform before being allowed to play. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 6 – Eligible Players 6.1 To be an eligible player within the meaning of these rules, a player shall comply with any definitions as prescribed by Basketball Australia and shall be a registered member of an affiliated Club, Team or Association in accordance with Rule 5 of these By-Laws. 6.2 All instances concerning the alleged participation of an ineligible player in a competition game shall be reported in writing to the Domestic Manager within 24 hours of the incident concerning, or may be brought to the notice of the Domestic Manager by any member of the Association. Such reports, which in all cases must be in writing shall be dealt with by the Domestic Manager in conjunction with the CEO. 6.3 It shall be the responsibility of teams to ensure that ineligible players do not participate in competition games. In an instance where it shall be proved that an ineligible player has so participated, then the Domestic Manager shall impose the penalty of a forfeit and removal of two (2) points with no points awarded for the game to the offending team. Rule 7 – Casual Players 7.1 A casual player will be permitted to take part in a game provided he has paid the general entry to the Mandurah Aquatic and Recreation Centre and filled in appropriate registration forms with the Stadium Manager prior to the commencement of the game. 7.1.1 Casual player fees are not part of registration fees. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 8 – Interchange of Players between Grades 8.1 Players shall be permitted to play in more than one grade of a competition in any one week of play under the following guidelines. 8.1.1 8.1.2 8.1.3 Must play for the same club Cannot player for a grade under their age appropriate grade Must be registered or a casual player for both teams 8.2 Movement of players between the teams shall not be permitted in any one grade during any season. 8.3 A player will be considered to have participated when his name is entered on the score sheet and he is physically present, in uniform and ready to play. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 9 – Eligibility of Players to Participate in the Final Series 9.1 To be eligible to participate in the final series of any competition conducted by the Association, players must have played in at least one third or above of the qualifying games. 9.1.1 Where a player has played in two or more grades during the qualifying rounds he shall be eligible to participate in both final series providing he has played the correct number of qualifying games in both grades. 9.1.2 In any instance where a player, through sickness, injury or other circumstances beyond his control shall be prevented from completing the required number of qualifying games, then the Domestic Manager shall have the power to waive the provisions of sub paragraph 9.1.1 above provided an application is submitted in writing and is in the hands of the Domestic Manager at least three (3) weeks prior to the commencement of the final series of the grade concerned. 9.1.3 For the purpose of this rule, it shall be the responsibility of all teams to carefully assess the eligibility of players before permitting them to participate in a final series. 9.1.4 Any protest or dispute concerning the eligibility of a player to participate in a final series shall be dealt with by the Domestic Manager as a matter of urgency. 9.1.5 A player will be considered to have participated in a finals game when his name is entered on the score sheet and he is physically present, in uniform and ready to play. 9.2 Byes do NOT count towards a game played during the season. 9.3 Registration of a game played will only be issued to the team who wins any forfeited match. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 10 – Competition Fixtures 10.1 The Domestic Manager shall be responsible for the compilation and publication of an official fixture list to cover all grades of any competition conducted by the Association. 10.2 Such an official fixture list shall not be altered or amended in any way, except by the Domestic Manager. 10.3 Where any team, because of extreme circumstance, requires to postpone or defer a scheduled fixture, application, in writing must be made to the Domestic Coordinator at least 48 hours prior to scheduled date and time of the fixture which is required to be postponed or deferred. If the request is made after this date the team will be forced to forfeit if they cannot attend the originally scheduled fixture and pay the forfeit fee as set out by the MBA Office. 10.4 Any competition game played in a place or at a time not in accordance with the official fixture list and not previously approved by the Domestic Manager shall not be taken into account when compiling the points table for the grade. Neither team shall be allowed points for that game and the game will be treated as a double forfeit. 10.5 Any team wishing to forfeit a game must notify the Domestic Manager at least 48 hours prior to scheduled date and time of the fixture. Failure to do so will result in a forfeit fee. 10.6 All forfeit fees must be paid before the next scheduled fixture. If failure to comply the team will be deemed unfinancial and will not be permitted to play until all outstanding monies are paid. Each game missed due to the above mentioned circumstances will incur a further forfeit fine for each game missed. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 11 – Competition Points 11.1 Competition points shall be allocated for each game completed in accordance with the official fixture list as follows: Win Bye Draw Loss Forfeit 3 points 2 points 2 points 1 point 0 points (for team forfeiting) 11.2 In the event of two or more teams being level on points at the end of the qualifying round, eligibility to compete in the final series shall be on head to head basis between the two competing teams. If a three way tie occurs the head to head will be between the three competing teams. If teams cannot be separated by a head to head comparison then percentage will be used to separate the teams. 11.3 If a team forfeits on more than three occasions throughout the season, the team will not be eligible to play in the final series. At the discretion of the Domestic Manager. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 12 – Final Series 12.1 The final series shall be played at the conclusion of the qualifying rounds and methods as hereinafter detailed may be used. 12.2 The finals series will be conducted as follows in each grade: Semi Final 1: Semi Final 2: Game 1 Game 2 1st versus 4th 2nd versus 3rd Grand Final Game 3 Winner Game 1 Vs Winner Game 2 13.2 Where a high number of team nominations to a particular division/age group make the division/age group unmanageable from a fixturing point of view, that division/age group may be split into two divisions labelled “A” and “B” (or by any other label deemed appropriate by the Domestic Manager) and run as two distinct competitions. Rule 13 – Referees & Umpires 13.1 It shall be the responsibility of the Domestic Manager to determine the method of appointment of referees and umpires for all games played under the jurisdiction of the Association. Teams may be required to provide referees. 13.2 Referees and Umpires must be dressed in the appropriate uniform as prescribed by the Association. Referees or Umpires who are out of uniform may incur a monetary penalty as prescribed by the Domestic Manager. This penalty is to be exacted on the Referee or Umpire’s match payment for all games that they are out of uniform. Rule 14 – Timekeepers & Scorers 14.1 Each team shall be responsible for providing one bench official for each game played in any grade of competition conducted by the Association. Such duty personnel shall operate in accordance with the official rules of basketball. A game will not proceed unless there is a minimum of one scorer per team. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 15 – Score Sheets & Equipment 15.1 Score sheets for all games conducted by the Association shall be supplied by the Association, and it shall be the responsibility of each captain or coach to ensure all the necessary team details thereon are correct, prior to the scheduled commencement time of the game. 15.2 It shall be the responsibility of the Association to provide all necessary court equipment for all games conducted by the Association. Rule 16 – Trophies & Awards 16.1 The Board shall have the power to allocate trophies to various grades and to decide upon awards for meritorious performances during competitions conducted by the Association and to make special recognitions for services rendered to the Association. Rule 17 – Financial Status 17.1 All teams shall remit to the Association such fees as may be prescribed from time to time by the MBA Office. 17.2 Such fees shall be in the hands of the Office Manager on or before the prescribed date, and any team not having remitted the fees shall be considered non-financial as from midnight on the prescribed date and be subject to such penalties as determined by the MBA Office. 17.3 A non-financial group, club, team or affiliated centre shall not be permitted to participate in any competition conducted by the Association. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 18 – Charges, Protests & Disputes 18.1 Any team shall have the right to lodge with the Domestic Manager a report in the nature of a charge or protest, or give notice of a dispute in relation to the conduct of any competition match, or the eligibility of any player taking part in the match, the behaviour of any player taking part in the match, or the result of the game in question. A bond of $100 shall accompany said protest. 18.2 Such a report shall include a comprehensive account of the incident or happening giving rise to the charge, protest or dispute, shall name the teams or players concerned and the referee and umpire in control of the game and shall be in the hands of the Domestic Manager within 24 hours of the completion of the game in question. 18.3 The Domestic Manager in conjunction with the CEO, if it deems it necessary, will refer the matter to the Tribunal. MANDURAH MAGIC BASKETBALL ASSOCIATION Rule 19 – Tribunal Rules 19.1 Tribunals. (a) The Board shall appoint a tribunal panel for each season. The tribunal panel shall consist of the Tribunal Chairman and two other persons. The tribunal shall be known as the Mandurah Basketball Association (Inc) Tribunal (hereafter referred to as “the Tribunal”) and shall consist of the Tribunal Chairman, one other panel member and one member of the Board. In the event of the Chairman’s absence, the Tribunal may be chaired by another panel member. In the event of only one panel member being available, the panel member will act as Chairman and the other two positions will be filled by Board members. (b) To avoid a conflict of interest panel members shall not be current referees. (c) The Tribunal shall operate in a manner as provided for by the Constitution or By-Law of the Association and as prescribed by specific guidelines by the Board. (d) The Tribunal shall exercise the following functions: (i) Hear and determine all charges brought before it resulting from reports made by game officials. (ii) Hear and determine any other matter reported to it. (iii) Impose such penalties as it deems appropriate upon players, team officials, coaches, teams and game officials. The range of penalties shall include but not be limited to fines, games suspensions and suspended sentences. (e) Jurisdiction of the tribunal relates to any event occurring in the vicinity of a stadium where an Association fixture is being played, within 24 hours of it being played (whether that be before or after). MANDURAH MAGIC BASKETBALL ASSOCIATION 19.2 Reports Procedures (a) Any reports that generate out of a game must be notified to the Domestic Manager along with a copy of the referee(s) reports (s) contained on the prescribed Report Form. Such notification shall be in writing (and/or facsimile) and shall be provided no later than 24 hours after the time at which the incident occurred. (b) The Domestic Manager, subsequent to referring a report to the Tribunal, notify the parties to the report that such a referral has taken place and shall provide to the parties a copy of any documentation which he considers material to that report. (c) Non-compliance with report procedures shall not invalidate a report nor a hearing or penalties that may arise pursuant to such a report. (d) Any member of the Board is empowered to submit a report for any incident which they considered may be detrimental to the Association for the purpose of convening of a Tribunal. 19.3 Tribunal Hearings (a) Subsequent to referring the report to the Tribunal, the Domestic Manager in conjunction with the CEO shall convene the Tribunal. The Tribunal shall meet at a time specified by the Domestic Manager in the week immediately following referral of a report or other matter. (b) In the case of the finals, reportable incidents must be dealt with prior to the involved team’s next game. (c) The Tribunal shall both consider the report and shall examine all relevant evidence available. The Tribunal is empowered on examination of the evidence to make further charges which may come to light. (d) The Tribunal may call for any evidence considered necessary to make a determination on the report. This may or may not include interviewing the persons involved in the report or witnesses to the report. Such evidence may include verbal evidence, Statutory Declarations and other writings as well as video-tape evidence. The Tribunal hearing may proceed in the absence of any persons. (e) A game official who lodges a charge against a player or official of a team, or against a team shall attend at the Tribunal hearing of the charge. In the case of a report by the Board a board member shall attend the hearing. MANDURAH MAGIC BASKETBALL ASSOCIATION (f) Any player, coach or official of any team against whom a charge has been lodged shall attend at the Tribunal hearing of the charge. Refusal to appear without valid reason will incur an automatic guilty penalty. (g) Any player, coach or official of any team or game official against whom an alleged offence has been committed and in respect of which a charge has been lodged shall attend the Tribunal hearing of the charge. Refusal to appear without valid reason could result in charges being annulled. (h) Any player, coach or official of a team or any game official who is required but is unable to attend the Tribunal hearing of a charge shall submit written evidence which must include the reason for non-attendance at the tribunal hearing. Any person who fails to comply with this provision may be liable to suspension or disqualification as a player or official or both or to a fine not exceeding one thousand dollars ($1,000) as the tribunal may determine. (i) Any person who as required by these rules attends a hearing of a Tribunal and in the course of giving evidence at the hearing wilfully endeavours to mislead the Tribunal shall be deemed to the guilty of misconduct and shall thereupon be liable to suspension or disqualification as a player or official or both or to a fine not exceeding one thousand dollars ($1,000) as the Tribunal may determine. (j) Any person who attends a hearing of a Tribunal and acts in an unseemly manner shall also be deemed to be guilty of misconduct and shall thereupon be liable to suspension or disqualification as a player or official or both or to a fine not exceeding one thousand dollars ($1,000) as the Tribunal may determine. 19.4 Game Penalties MANDURAH MAGIC BASKETBALL ASSOCIATION (a) Where the Tribunal applies a suspension as a penalty, such penalties should be specified in terms of a particular end date for which the penalty will apply and includes any fixture conducted by an affiliated WABF member over that period. (b) Penalties applying to player/coaches shall apply concurrently to the individual both as a player and a coach. (c) Penalty guidelines will be considered by the Tribunal. 19.5 Appeal of Tribunal Findings or Penalties (a) Any person/persons or team found guilty by the Tribunal may within twenty four (24) hours of notification of the finding, appeal against the finding or the severity of the penalty. Such appeal must be lodged with Domestic Manager in writing and must clearly specify the grounds upon which it relies. A bond of one hundred dollars ($100) must accompany any appeal for it to be considered. (b) Such appeal shall be dealt with by the Board within five (5) days of lodgement. No further appeal shall be permitted after consideration by the Board unless new evidence not previously considered is introduced. If the appeal is upheld, the bond will be refunded. If the appeal is dismissed and the Board considers the appeal is not of a frivolous nature, the Board may refund the appeal bond. (c) Until such time as an appeal is heard, the penalty will stand unless otherwise determined by the Board. (d) No appeal will be considered unless any fines associated with the matter being appealed have been paid. Rule 20 – Jurisdiction MANDURAH MAGIC BASKETBALL ASSOCIATION 20.1 For the purpose of these By-Laws, members of teams or Associations are considered to be within the jurisdiction of the Association while they are in the precincts of any court or building being hired or used by the Association for the purpose of conducting any match or competition, or any other business of the Association, and also while any player or official is representing the Association at any games or series, wherever it may be played. 20.2 A member of any team selected by the Association to visit other States or to participate in games in other centres, whether such games are organised by the Association or not, are deemed to be within the jurisdiction of the Association from the time the team departs from Mandurah until such time as all members return to Mandurah. Rule 21 – Liquor Restrictions 21.1 A member of an affiliation team or Association shall not convey liquor into any building or premises being used by the Association for the purpose of conducting any match or competition, neither shall any person as aforesaid consume liquor on the premises mentioned in this except with the expressed permission of the Board, such permission having been previously obtained in writing and accompanied by any licence required by the Licensing Court. Rule 22 – Infringements 22.1 The Board shall have power to impose such penalties as may be decided upon by a majority present at a meeting of the Board, upon any team or Association or member of a team or Association, in the event of an infringement of these rules. An official record book of infringements is to be maintained and available at the stadium at all times. Rule 23 – Amendments 23.1 The Board shall have the power to alter or amend these By-Laws at any meeting of the Board and provided that the resolution to so alter or amend the changes is voted in favour of.
