INSURANCE BENEFITS TERMS AND CONDITONS - DUBAI FIRST CREDIT CARD HOLDERS. We welcome you as a Dubai First Credit Cardholder to enjoy the various Insurance benefits provided by the Oman Insurance Company. We request you to go through the cover details in order to understand thoroughly the cover offered by us. FIRST SECURE/MAXIMUM ASSURANCE IMPORTANT NOTICE • The First Secure/Maximum Assurance benefits include Death, Permanent Total Disablement, Hospital Cash Benefit and Involuntary Loss of Employment. • First Secure/Maximum Assurance is free for the first month and thereafter a nominal rate will be applied on the total outstanding amount for the month. • Cover automatically starts from the date of activation of the Credit Card and or the date of inception of the policy whichever is later. • The Cardholder has the option to opt out of the scheme at any time. However, once opted out, the Cardholder will not be allowed to rejoin the scheme. • Cover will be applicable only for Primary Cardholders and shall exclude Corporate and Lodged Cards. However the outstanding balance under the supplementary credit card is also covered. • The Cardholder shall be of age between 18 to 65 but 18 to 59 years in respect of Involuntary Loss of Employment Cover. • Dubai First retains the right to vary, alter or amend these terms and conditions at any time without notice. • The cover is subject to the jurisdiction of the competent courts of Dubai, United Arab Emirates. • Dubai First reserves the right, at any time, to reject, discontinue or cancel the cover applicable without assigning any reason thereof • Dubai First is not at any time considered as an agent of Oman Insurance Company, the “Insurance provider”. Any claims or contestations or any insurance cover shall be negotiated directly with Oman Insurance Company, Dubai. • These terms and conditions are extract from the Master Policy issued to Dubai First by OMAN INSURANCE COMPANY. These terms and conditions are not the policy. • The territorial limit is ‘worldwide’ except in respect of Hospital Cash Benefit and Involuntary Loss of Employment cover for which the territorial limit is ‘UAE’. • Death or Disablement shall be due to bodily injury or illness but excluding the reasons mentioned in the exclusions. • Benefit payable in respect of Death, Permanent Total Disablement and Involuntary Loss of Employment shall be written off against the Cardholder’s total amount outstanding with Dubai First. Benefit written off against the Cardholder’s outstanding balance shall be deemed to be Benefit paid to the Cardholder. However Hospital Cash Benefit will be settled directly to the Cardholder • The Cardholder shall notify the Company immediately upon Reemployment but not later than 15 days from the date of Re-employment. Failure to notify the Company shall render the benefits provided under this cover fully recoverable without contestation. DEFINITIONS “Dubai First” means Dubai First Private Joint Stock Company, Dubai United Arab Emirates. ‘Card’ means Credit Card issued by Dubai First for which the benefits under this Policy shall apply up to agreed upon limit as determined by Dubai First from time to time. ‘Company’ means the Oman Insurance Company. ‘Policy’ means the insurance policy provided by the Company to Cardmember having Eligible Account. ‘Credit Card Agreement’ means an agreement between a Cardmember and Dubai First outlining the terms and conditions governing the usage of any card. ‘Accident’ means where the bodily injury is caused solely and directly by external violent means, is unexpected, unforeseeable and not attributable to the Cardholder’s intentional self-injury or suicide. ‘Insured’ means Dubai First, United Arab Emirates. ‘Benefit’ means the indemnity payable under the scope of this Cover in respect of Death or Permanent Total Disablement or Hospital Cash Benefit or Involuntary Loss of Employment of the Cardholder. ‘Cardholder’ means a Primary Account holder of the Credit Card Facility with the Insured who has not unsubscribed to the benefits under this Cover and has not been disqualified by the provisions of this Cover to be eligible to receive the benefits under this Cover. ‘Cover’ means the First Secure/Maximum Assurance Benefit offered by the Insured in association with the Company. ‘Cover Period’ means the period after Commencement Date during which the benefits under this cover shall apply. ‘Credit’ means the credit or other form of financial accommodation provided by the Insured to the Cardholder under the Credit Card Facility. ‘Credit Card Facility’ means the Insured’s Credit Card Facility which have been nominated as the facilities to which the benefits under this Cover are to apply. ‘Date of Event’ means any one of the following: 1. In respect of Death the date of death resulting from an accident or illness happening/manifesting after the Commencement Date and during the Cover Period. 2. In respect of Permanent Total Disablement the date of recognition of Permanent Total Disablement by a Competent Authority resulting from an accident or illness happening/manifesting after the Commencement Date and during the Cover Period. 3. In respect of Hospitalisation Cash Benefit the date of admission in the hospital after the Commencement Date and during the cover period 4. In respect of Involuntary Loss of Employment, the date of notice of termination served to the Cardholder after the Commencement Date and during the Cover Period. ‘Death’ means death by injury or illness. ‘Illness’ means a disease or sickness first occurring after the Commencement Date ‘Indebtedness’ means the total amount outstanding in the Credit Card Facility as on the Date of Event but excluding any Credit facility availed after the Date of Event subject to a maximum of the Cardholder’s credit limit. ‘Injury’ means bodily injury resulting from an Accident occurring after the Commencement Date. ‘Involuntary Loss of Employment’ means unemployment of the Cardholder arising out of the unilateral decision of the employer to terminate his employment contract without citing any reason or for any reason other than those excluded. ‘Maximum Coverage Age’ means the following age(s) upon attainment of which the Cover ceases in respect of the Cardholder i. Death, PTD and Hospital Cash Benefit: 65 years ii. Involuntary Loss of Employment: 59 years ‘Permanent Total Disablement’ (PTD) means either of the below as a result of the injury or illness arising out of a cause not specifically excluded under this policy· • Permanent Loss of sight of both eyes • Physical severance/amputation of two limbs • Complete and Permanent Paralysis • Totally Disabled and the Cardholder is rendered unable to earn income in any occupation, trade or profession for which the Cardholder could reasonably be expected to be suited through education, training or experience Provided that the disability shall be for a period of six consecutive months and that the Company is satisfied that the Cardholder will be so rendered indefinitely. However this time limit shall not apply to cases of physical severance/amputation of limbs. ‘Pre-existing Condition’ means illness, disease or sickness occurring or manifesting prior to the Commencement Date, for which advice or treatment was sought or obtained from a medical practitioner, chiropractor, naturopath, or any other practitioner of a similar kind within twelve months immediately prior to the Commencement Date. ‘Re-Employment’ means accepting and starting work for a new employer or the same employer under a new employment contract within 10 (ten) months from the date of actual unemployment. SCOPE OF COVER SECTION 1 - DEATH In the event of the Cardholder’s Death during the Cover Period due to injury or illness arising out of a cause not specifically excluded herein, the Company shall pay the Cardholder’s Indebtedness as on the Date of Event subject to a maximum of AED 100,000/-. SECTION 2 - PERMANENT TOTAL DISABLEMENT In the event of the Cardholder’s Permanent Total Disablement during the Cover Period due to injury or illness arising out of a cause not specifically excluded herein, the Company shall pay the Cardholder’s Indebtedness as on the Date of Event subject to a maximum of AED 100,000/-. Exclusions Applicable to Section 1 and Section 2 1. No Benefit under this Cover shall be applicable in respect of a Cardholder where the Event giving rise to a claim under this Cover occurs as a result of: (a) Death by suicide within 12 months from the Date of Commencement; (b) Illness occurring within 30 days of the commencement date; (c) Any deliberate self-inflicted injury and/or self-medication (without a proper prescription from a legally recognised medical practitioner); (d) The effects or complications arising from pregnancy; (e) Any accident occurring on or in or about any aircraft other than an aircraft in which the Cardholder was travelling as a bonafide passenger and which is operated by a licensed commercial or chartered airline; (f) Nuclear Radiation, Nuclear Fission, Nuclear Fusion and/or Radioactive Contamination (g) Riot, civil commotion, strikes and war (whether war be declared or not), rebellion, insurrection, resurrection, popular rising, usurped power, terrorism (h) The influence of alcohol or drugs other than proper use of drugs prescribed by a legally qualified medical practitioner but this exclusion shall not apply to Death claim. (i) Due to Chronic Illness/Condition but this exclusion shall not apply to Death Claim. (j) Illness due to pre-existing condition but this exclusion shall not apply in respect of Death occurring after a continuous period of 6 months from the Date of Commencement. However, this exclusion is applicable only if the Company is able to substantiate ‘preexisting condition’ within 1 month from the date of submission of all required claims documentation to the Company. (k) (a) Acquired Immune Deficiency Syndrome (AIDS), AIDS related Complex (ARC) as defined by the World Health Organisation from time to time; or (b) The presence of the Human Immunodeficiency Virus (HIV) as revealed by the positive HIV anti-body or HIV test. 2. The benefits under this Cover shall not be applicable to the Cardholder where the Cardholder has received or have applied to receive a similar benefit covering the same interest under any other product or insurance in respect of the period for which the indemnity under this Cover shall apply. SECTION 3 - HOSPITAL CASH BENEFIT In the event of hospitalisation for a minimum period of 24 hours consequent upon the borrower falling ill or sustaining injury arising out of a cause not specifically excluded under this policy after the Commencement Date and during the policy period, the Company shall pay a daily indemnity of AED 200 per person subject to a maximum of 60 days. Exclusion applicable Hospitalization benefit i. Waiting Period : Accident : NIL Sickness : 3 days ii. Pre Existing Illnesses or conditions iii. Psychiatric Hospitalization iv. Home medical care v. Plastic surgery vi. No payment shall be made under this policy on the hospitalisation claim if such hospitatlisation has occurred as a result of: a. Motor cycling As a driver or passenger on machines with more than 150 cc engine capacity; or As a driver if the cardholder does not have a valid motor cycle licence b. Mountaineering or rock climbing that uses ropes or guides, bungee jumping, scuba diving, pot holing or organised team sports. c. Big Game Hunting, BMX Stunt Riding, Boxing, Free Climb Mountaineering, Go-Carting, Gymnastic, High Diving (other than from a purpose built diving board over a man-made swimming pool), Jousting, Martial Arts, Micro-lighting, Motor Rallies or Competitions, Outdoor Endurance, Outward Bound Courses, Safaris with guns, Show Jumping, Stunt Events, Underground Activities (other than as a part of an organised excursion or tour), Water Ski Jumping, White Water Rafting, Wrestling or any variations thereof. Competing in or practising for speed or time trials, sprints or racing of any kind. Taking part in expeditions or being a crewmember on a vessel. SECTION 4 - INVOLUNTARY LOSS OF EMPLOYMENT In the event of the Cardholder’s Involuntary Loss of Employment during the Cover Period due to reasons not specifically excluded herein, the Company shall pay 10% of the Indebtedness as on the Date of Event for that month subject to a maximum of AED 4,000/- or every month of unemployment up to a maximum of 12 months. Provided that: a. No Benefit is payable if the Date of Event falls within a period of 90 days after the Commencement Date. b. The Cardholder remains unemployed during the period for which the benefit under this policy is paid and shall provide all necessary proofs as may be called upon by the Company in order to substantiate his unemployment. c. The Cardholder/Insured shall inform the Company as soon as the Cardholder accepts an alternative job within ten months period from the date of his actual unemployment. In case, it is found that the Cardholder has been re-employed during the period he has been taking the monthly benefits, the entire claim will be void and Company reserves the right to recover the full amount paid to the Cardholder/ Insured as monthly benefit since the beginning of his unemployment. d. The Cardholder is eligible as per the eligibility conditions provided hereunder. e. The Company may at any time elect to pay the entire indebtedness amount and in the event that the Company elects to pay the entire Indebtedness amount any time after effecting the first monthly indemnity payment, the Company shall be liable for the accrued interest only up to the date of effecting the full and final settlement. If the Company elects to effect full settlement before effecting the first monthly indemnity payment, then the liability shall be limited to amount of Indebtedness only. Exclusion applicable to Involuntary Loss of Employment The benefits under this Cover shall not be applicable in respect of Involuntary Loss of Employment arising out of and/or attributable to and/ or in connection with the following: i. Cardholder who has not been continuously employed with the same employer for a minimum of 6 months ii. Cardholder who is on probation iii. Employment on a fixed term contract for less than 2 years or part time or temporary employment iv. Resignation or leaving by mutual agreement or voluntary unemployment or redundancy after voluntary breaks from employment in excess of normal holiday entitlement. v. Disability, sickness or accident or any other medical reasons (mental and/or physical) vi. Involuntary Loss of Employment which starts within 90 days of the Commencement Date vii. Where the Cardholder was aware of pending unemployment on or before the Commencement Date viii. Where the unemployment is a normal seasonal part of the employment or due to non-renewal of employment contract by the authorities ix. Where the Cardholder has neither been terminated nor become redundant but his/her salary or allowances is being withheld in part or in full for any reason of the employment contract x. Unemployment due to any of the following a. Misconduct b. Refusal to accept orders from the superiors c. Convicted in a crime d. Dishonesty or Fraudulent Act e. Non-performance or Under Performance xi. The period for which payment from the employer is received instead of working notice xii. Termination of employment due to voluntary retirement xiii. Company failure where a contributing cause was a natural catastrophic peril xiv. Emiratisation. GENERAL CONDITIONS APPLICABLE TO CREDIT SHIELD 1. The Cardholder shall furnish the Insured with any information the Insured may require (including details of the state of health) in respect of the Cardholder for the benefits hereunder. The Insured may, at its sole discretion, require the Cardholder to undergo a medical examination by a legally qualified medical practitioner in the manner the Insured deems required or fit. 2. The benefits under this Cover shall be extended only to Primary Cardholders and not to an additional or supplementary Cardholder. 3. No Benefits shall be paid in respect of a Cardholder who attains the Maximum Coverage Age specified. 4. The benefits under this Cover shall terminate upon the happening of any one or more of the following. i. Cancellation of the Cardholder’s Credit Card Facility. ii. The Cardholder having attained the Maximum Coverage Age iii. Upon payment of Benefit for Death or Disablement. iv. The Cardholder’s Credit Card Account becomes overdue for a period of 90 days. However, this Cover will be automatically reinstated once the Cardholder has paid his dues v. The Cardholder becoming unemployed either voluntarily or involuntarily. However, the termination shall be only in respect of Involuntary Loss of Employment; vi. 6 months prior to the Cardholder’s normal retirement date depending upon the age of the Cardholder and the law of the land where he is employed. However, the termination shall be only in respect of Involuntary Loss of Employment; vii. Cancellation of the benefits under this Cover by the Insured or the Cardholder at any time in accordance with the terms and conditions of this Cover. 5. The observance by the Cardholder of the terms of this Cover and the truth of the statements and the answers by the Cardholder in the proposal and other material information provided by the Cardholder shall be condition precedent to benefits applicable under this Cover. If the circumstances in which this Cover was extended to the Cardholder are materially altered without the written consent of the Insured, the Cover shall become null and void. 6. If any claim under this Cover is in any way fraudulent or unfounded, all benefits under this Cover shall be forfeited. 7. The maximum cumulative amount of Benefits payable under this Policy for any one person shall not exceed the amount stated in the herein irrespective of the number of policies in force or the number of Credit Card Facilities in respect of which the Cardholder has obtained a similar benefit as provided under this policy. 8. Disappearance Clause - If a Cardmember disappears during the currency of the Policy and their body is not found within one year after their disappearance and sufficient evidence is produced satisfactory to the Company that leads them inevitably to the conclusion that they sustained accidental bodily injury and that such injury caused their death, the Company shall forthwith pay the death benefit as provided herein and the person to persons to whom such sum is paid shall sign on undertaking to refund such sum to the Company if the Cardmember is subsequently found to be living. CLAIMS PROCEDURE APPLICABLE TO CREDIT SHIELD 1. Upon happening of an event giving rise to a claim under this policy, the Cardholder/Cardholder’s Legal Representatives shall follow the following procedure: a. Give immediate written notice to the Company but not later than 30 days from the Date of Event Within 48 hours at the latest within 5 days from the date of discharge from the hospital. b. The Cardholder or the Cardholder’s legal personal representative shall complete the standard claim form issued by the Company and submit with such evidence to substantiate the claim to the satisfaction of the Company as the Company may reasonably require; c. The Cardholder or the Cardholder’s legal personal representative shall submit the following documents: For Death Claims i. ii. Post mortem report (wherever legally required). iii. Police report (if death was due to an accident). iv. Medical report* with detailed diagnosis and cause of death if required by the Company when actual cause of death is not clearly mentioned in the death certificate. v. Copy of passport with visa page For Permanent Total Disablement Claims i. ii. Police report (if disability is due to an accident). iii. Medical report* with detailed diagnosis, cause of disability and details of treatment given. iv. Copy of passport with visa page. Death certificate issued by a competent authority in the relevant jurisdiction. Disability certificate from an authorised medical practitioner to assess disability. * from an Authorised Medical Practitioner. For Hospital Cash Benefit Claims i. ii. Medical Report from a licensed and registered medical officer iii. Discharge Summary. iv. Any other documents as may be required Police Report if applicable For Involuntary Loss of Employment Claims i. ii. Copy of passport with visa page iii. Salary slips for the 3 months preceding date of notice of termination The Company may also request for a copy of the labour contract from Employer if it is required to verify the period of employment contract. All papers as indicated above may be required to be produced in original (other than those surrendered to the authorities or Employer) for verification before the final settlement of claim. Notice of termination from the Cardholder’s employer (the “Employer”) BONUS COVERS FOR MASTER CARD HOLDERS. 1. ADDITIONAL FLAT LIFE COVER In the event of the death of a Cardmember due to any cause (natural or accidental) while insured, the company will subject to the terms and conditions of the policy pay to the legal heirs as follows: Platinum Cardholders – AED 75,000/- Gold Cardholders – AED 50,000/- Silver Cardholders – AED 25,000/- SPECIAL CONDITIONS ADDITIONAL FLAT LIFE COVER • A Cardmember is covered under the policy if he is holding a valid primary Card issued by Dubai First on or after the Commencement Date. A supplementary Cardmember i.e. Cardmember having a supplementary Card in his or her name, will not be eligible for cover under the policy. • In case a primary card member who has more than one Dubai First credit card the cover will apply on the basis of one card only. The card member will get the highest sum insured among the cards in force. • In case the Cardholder withdraws from Maximum Assurance, then he is not eligible for this benefit. • All other terms and conditions would be similar to the Maximum Assurance Benefit. 2. TRAVEL INCONVENIENCE INSURANCE. AND TRAVEL ACCIDENT IMPORTANT NOTICE • When a Cardmember buys a ticket for overseas travel using a card, the cardmember is automatically covered under travel inconvenience and travel insurance benefits. • If the Cardmember has paid for a portion of the cost of a ticket (subject to a minimum of 50%) using a Card, the benefit payable shall be limited to the same. • The travel insurance benefits detailed in the Policy are applicable for a maximum period of 60 days from the date of departure from UAE. • The travel Insurance benefits are applicable on international travel, outside United Arab Emirates. • In case the Cardholder withdraws from Maximum Assurance, then he is not eligible for this benefit. DEFINITIONS For the purpose of this Travel Cover, the following definitions shall apply unless the context otherwise requires: Common Carrier whenever used in these terms and conditions means any land, water air conveyance operated under a valid license for the transportation of passengers. Hospital Means a place that (1) hold a valid license (if required by law), (2) operates primarily for the care and treatment of sick or injured persons, (3) has a staff of one or more physicians available at all times, (4) provides 24 hour nursing service and has at least one registered professional nurse on duty at all times, (5) has organised diagnostic and surgical facilities available to the Hospital on a prearranged basis, and (6) is not, except incidentally, a clinic, nursing home rest home or rest home or convalescent home for the aged or a facility operated as drug and/or alcohol treatment centre. Injury means bodily injury caused solely and directly by violent, accidental, external and visible means occurring during the period of cover. Medical Necessary Means, at the Company’s sole discretion when the Physician’s recommendation is (a) consistent with the symptoms, diagnosis and treatment of the Insured person; (b) appropriate with regard to standards of good medical practice ; (c) not primarily for the convenience of the Insured person Physician Means a licensed practitioner of the healing arts acting within the scope of their license. The attending physician may not be (a) the Insured Person (b) the Insured Person’s spouse or (c) a person who is related to Insured Person or Insured Person’s spouse, in any of the following child, parent or sibling Pre-existing Condition - means a condition for which medical care, treatment, or advice was recommended by or received from a Physician with a two year period preceding the effective date of cover, or a condition for which hospitalization or surgery was required within a five year period preceding the effective date of cover. Reasonable and Customary Charges Means a charge which (a) is charged for treatment, supplies or medical services medically necessary to treat the Insured Person condition (b) does not exceed the usual level of charges for similar treatment, supplies or medical services in the locality where the expense is incurred and (c) does not include charges that would not have been made if no insurance existed. Schedule Means the schedule of benefits attached to and forming part of these terms and conditions. Serious Injury or Sickness Means Injury or sickness certified as being dangerous to life by a qualified medical practitioner. Sickness Means an illness or disease, which first manifests itself and is contracted while the Policy is in effect requiring treatment by a physician. Terrorism Means the use or threatened use of force or violence against person or property, or commission of on act dangerous to human life or property or commission of an act that interferes with a disrupts on electronic or communication system undertaken by any person or group, whether or not acting on behalf of or in any connection with any organisation, government, power authority or military force, when the effect is to intimidate, coerce or harm a government, the civilian population or any segment thereof, or to disrupt any segment of the economy Valid Means those card members to whom the benefit of the policy shall apply as determined by Dubai First from time to time. War Means war whether declared or not, or any warlike activities including use of military force by any sovereign nation to achieve economic, geographic, nationalistic political racial religious or other ends. GENERAL EXCLUSIONS APPLICABLE TO TRAVEL COVER The Policy does not provide benefits for any loss resulting in whole or in part from or expenses incurred for. 1. Suicide attempted suicide or intentionally self-infected injury or sexually transmitted conditions, Acquired Immune Deficiency Syndrome (AIDS) Human Immune deficiency Virus(HIV) 2. Service in any armed forces or units auxiliary thereto (any premium paid to the Company for any period not covered by the Policy while the Insured Person is in the service will be returned pro-rata 3. Participation in any professional, semi-professional, or interscholastic team sports or any bodily contact sport, being under the influence of drugs, alcohol intoxicants unless prescribed by a Physician and taken as prescribed. 4. Participation in a felony, riot, crime, misdemeanor or civil commotion 5. Participation in a contest of speed using a motorized vehicle or bicycle. 6. Operating or learning to operate any aircraft; or performing duties as a member of the crew on the aircraft. 7. Participation in skydiving/parachuting, hang gliding, bungee jumping, scuba diving, mountain climbing, potholing or while riding on a motorcycle. 8. War, civil war, invasion, insurrection, revolution, use of military power or usurpation of government or military power. 9. While piloting any aircraft; driving or riding as a passenger in or on (a) any vehicle engaged in any race, speed test or endurance test (b) any vehicle being used for acrobatic or stunt diving. 10.Congenital anomalies 11.Terrorism, including any action taken in hindering or defending against an actual or expected incident of Terrorism 12.The use, release or escape of nuclear materials that directly or indirectly results in nuclear reaction or radiation or radioactive materials. 13.The dispersal or application of pathogenic or poisonous biological or chemical materials; or 14.The release of pathogenic or poisonous biological or chemical materials. CLAIMING THE TRAVEL BENEFITS Claims Forms: The Claim form that the Insured Person needs to complete shall be furnished to the Cardmember by the Company on notification of a potential claim. Time for filing claims forms: Completed claim forms and written proof must be furnished to Oman Insurance Company within 90 days after the date of such loss. Failure to furnish such proof within 90 days shall not invalidate or reduce any claim if it was not possible to give proof within such time. However, in no event will any claim be honored if proof of loss is not received within 18 months from the date of loss. Supporting Documents: Original copies of the supporting documents as mentioned in each insured benefit section must be submitted along with the claim form. SCOPE OF TRAVEL COVER. 1. COMMON CARRIER ACCIDENTAL DEATH The Company will pay the principal sum shown in the Schedule if injury to the Insured Person results in loss of life, injury must occur while the Insured Person is riding as a passenger in or on boarding or alighting from, a Common Carrier whilst an international travel and the ticket must be purchased using a Card. The loss of life must occur within 180 days of the date of the accident which caused injury. 2. FLIGHT DELAY The Company will pay benefits for flight delay, subject to the maximum shown in the schedule, if the Insured Person’s flight is delayed for four or more hours due to a covered hazard. Benefits are subject to per hour maximum shown in the Schedule up to a maximum of eight hours of delay. DEFINITIONS Equipment Failure means any sudden, unforeseen breakdown in the Common Carrier’s equipment that caused a delay or interruption or normal trips. Inclement Weather means any severe weather condition, which delays the scheduled arrival or departure of a Common Carrier. Strike means any labor disagreement, which interferes with the normal departure and arrival of a Common carrier. COVERED HAZARDS A. Delay of a Common Carrier caused by Inclement Weather. B. Delay due to Strike or other job action by employees of a Common Carrier scheduled to be used by the Insured Person; or C. Delay caused by Equipment Failure of a Common Carrier. EXCLUSIONS Any delay due to a Covered Hazard, which was made public or known to the Insured person prior to the purchase of the ticket. 3. BAGGAGE DELAY The Company will pay the Insured person, up to the maximum stated in the Schedule, if the Insured Person’s Checked Baggage is delayed or misdirected by a Common Carrier for more than 4 hours from the time Insured Person arrives or the destination as per the ticket, other than the final destination, until the time it arrives. The Insured Person must be a ticked passenger on a Common Carrier. Additionally all claims must be verified by the Common Carrier who must certify the delay or misdirection. DEFINITONS Checked Baggage Means a piece of baggage, which was checked in and in the custody of a common carrier and for which a claim check has been issued to the Insured Person Common carrier. LIMITATION If upon further investigation it is later determined that Insured person’s baggage checked with the Common Carrier has been lost, any amount claimed and paid to Insured Person under his baggage delay policy section will be deducted from any payment due to the Insured Person under the baggage loss policy section. 4. COMMON CARRIER BAGGAGE LOSS The Company will pay benefits if the Insured Person’s baggage which is in the care, custody and control of a Common Carrier, is lot due to theft or due to misdirection by a Common Carrier while the Insured Person is a ticketed passenger on the Common Carrier during the flight. The Company will pay the Insured Person, up to the maximum shown in the schedule. All claims must be verified by the Common Carrier. The maximum amount to be reimbursed per bag is 50%. A combined maximum limit of 10% of the amount stated in the schedule is applicable for the following: Jewellery, articles consisting in whole or in part of silver, gold or platinum furs, articles, trimmed with or made mostly of fur, and cameras, including camera equipment, computers and electronic equipment. LIMITATION Benefits for baggage and personal effects will be in excess of any amount paid or payable by the Common Carrier responsible for the loss. Benefits for baggage and personal effects will be in excess of all other valid and collectible insurance. If at the time of the occurrence of any loss there is other valid and collectible insurance in place, the Company will be liable only for the excess of the amount of loss, over the amount of such other insurance, and any applicable deductible. EXCLUSIONS Benefits will not be provided to any loss of 1. Animals, birds, or fish; 2. Automobiles or automobile equipment, boats, motor, trailers, motorcycles or other with a Common Carrier 3. Household furniture 4. Eyeglasses or contact lenses 5. Artificial teeth or dental bridges 6. Hearing aids 7. Prosthetic limbs, 8. Musical Instruments 9. Money or Securities 10.Tickets or documents 11.Perishables and consumables. Benefits will not be provided for any loss resulting (in whole or in part) from 1. Wear and tear or gradual deterioration 2. Insects or vermin 3. Inherent vice or damage 4. Confiscation or expropriation by order of any Government or Public Authority 5. Seizure or destruction under quarantine or custom regulation 6. Radioactive contamination 7. Usurped power or action taken by governmental authority in hindering combating or defending against such an occurrence 8. Transporting control band or illegal trade 9. Mysterious disappearances 10.Breakage of brittle or fragile articles, cameras, musical instruments radios, and similar property 5. EMERGENCY MEDICAL ACCIDENT AND SICKNESS EXPENSE The Company will reimburse expenses arising out of hospitalization as per terms in the schedule of benefits subject to any deductible for covered medical expenses incurred overseas by the Insured Person which are not due to a pre-existing condition up to the maximum stated in the Schedule of Benefits for the treatment of an Injury or Sickness sustained by the Insured Person while this policy is in effect. All expenses must be incurred within 26 weeks of the date the Insured Person’s coverage terminates as determined by Dubai First from time to time. DEFINTIONS Covered Medical Expenses means expenses incurred overseas due to hospitalization by the Insured Person for services and supplies which are recommended by the attending Physician: They include. The coverage of medical expenses shall include the following benefits. 1. The services of a Physician 2. Hospital confinement and use of operating room 3. Anesthetics (including administration), X-ray examinations or treatments, and laboratory tests, 4. Ambulance service, and 5. Drugs, medicines, and therapeutic services and supplies. LIMITATIONS Benefits will not be provided for any loss or expense incurred after or upon return to the Insured Person’s country of residence. MEDICAL COVER EXCLUSIONS. 1. Services, supplies or treatment, including any period of Hospital confinement, which were not recommended, approved and certified as Medically Necessary by a Physician 2. Routine physicals or other examinations where are no objective indications or impairment in normal heath and laboratory diagnostic or X-ray examinations except in the course of a disability established by the prior call or attendance of physician 3. Elective, cosmetic or plastic surgery, except as a result of an accident 4. Dental care, except as a result of injury to sound natural teeth caused by accident while the Policy is in effect 5. Congenital anomalies and conditions arising out of or resulting there from 6. Expenses incurred in connection with weak, strained or flat feet; corns, calluses or toenails; 7. The diagnosis and treatment of acne 8. Deviated septum, including sub mucous resection and /or other surgical correction thereof 9. Organ transplants that competent medical professionals consider experimental 10.Everyday child care including exams and immunizations 11.Expenses which are not exclusively medical in nature 12.Eyeglasses, contact lenses, hearing aids, and examination for the prescription or fitting thereof, unless or Sickness has caused impairment of vision or hearing 13.Treatment provided in a government Hospital or services for which no charge is normally made 14.Mental nervous or emotional disorders or rest cures 15.Pregnancy and all related conditions, including services and supplies related to the diagnosis or treatment of infertility or other problems related to inability to conceive a child; birth control, including surgical procedures and devices 16.Pre-existing Condition for which medical care, treatment, or advice was recommended by or received from a Physician within a two-year period preceding the effective date of cover or a condition for which hospitalization or surgery was required within a five-year period preceding the effective date of cover. 17. Medical expenses covered under any workers compensation policy 18.Medical expenses incurred as the result of alcohol and/or drug abuse, addiction or overdose. 6. PERSONAL LIABILITY DEFINITONS Business includes trade profession or occupation Bodiliy Injury means bodily harm, Sickness or disease, including required care, loss of services and death that results. Occurrence An accident, including continuous or repeated exposure to substantially the same general harmful condition, which results, during the policy period in Bodily Injury or Property Damage Property Damage Physical injury to, destruction of or loss or use of tangible property. Residence Premises The dwelling where Insured Person resides. PROPERTY DAMAGE If a claim is made or a suit is brought against the Insured Person for Property Damage caused by an Occurrence to which this cover applies, the Company will pay to the amount stated in the Schedule towards the damages for which the Insured person is legally liable MEDICAL PAYMENT TO OTHERS. The Company will pay the necessary medical expenses that are incurred or medically ascertained within one year from the date of accident causing Bodily injury. Medical expenses reasonable charges for medical, Surgical, X-ray, dental, ambulance, Hospital, professional nursing, prosthetic devices and funeral services. This cover does not apply to the Insured Person or regular residents of the Insured Person’s household. As to others, this cover applies only if the Bodily injury is caused by an act of or omission of an Insured person Exclusions 1. Liability which is expected by or intended for the Insured person 2. Liability arising out of or in connection with a Business (includes trade, profession or occupation) engaged in by the Insured Person. This exclusion applies but is not limited to an act or omission, regardless of its nature or circumstance, involving a service or duty rendered, promised, owned or implied to be provided because of the nature of the Business 3. Liability arising out of the rental or holding for rental of any part of any premises by the insured person 4. Liability arising out of the rendering of or failure to render professional services 5. Liability arising out of a premises, water craft or aircraft that is owned by, rented to or rented by Insured person. 6. Liability arising out of the ownership maintenance use loading or unloading of motor vehicles, all other motorized land conveyances, water craft or aircraft 7. Liability arising out of the transmission of a communicable disease by the Insured person. 8. Liability arising out of sexual molestation, corporal punishment, or physical or mental abuse 9. Liability arising out of the use, sale, manufacture, delivery, transfer or possession by any person of a controlled substance or control band as defined by any appropriate authority 10.Liability under any contract or agreement. 11.Property Damage to Property owned by the Insured Person. 12.Property Damage to property rented to occupied or used by or in the care of the Insured person. 13.Bodily Injury to any person eligible to receive any benefits voluntarily provided or required to be provided by the Insured person eligible to receive any benefits voluntarily provided or required to be provided by the Insured person under any Workmen’s Compensation law, non-occupational disability law or occupational diseases law; or Legal actions raised by any family member or traveling companion or family member of a traveling companion against the Insured person. 7. ASSISTANCE The Assistance Service will provide the following Services as described below. Medial Assistance- As soon as the Assistance Service is notified of a medical emergency resulting from accident or sickness to the Insured Person, the Assistance Service will contact the medical facility or location where the Insured Person is located and confer with the Physician at the location to determine the best course of action to be taken. If possible and if appropriate, Insured Person’s family Physician will be contacted to help arrive at a decision as to the best course of action to be taken. The Assistance Service will then organize a response to the medical emergency, doing whatever is appropriate, including, but not limited to, recommending or securing the availability of services of a local physician and arranging hospital confinement of the Insured Person where, in its discretion, the Assistance Service deems such confinement appropriate. Medical Evacuation- When in the opinion of the Assistance Services medical panel, it is judged medically appropriate to move the Insured Person to another location for treatment or return the Insured Person to the Insured Person’s residence or country of citizenship, the Assistance Service will arrange the evacuation, utilizing the means best suited to be so, based on the medical evaluation of the seriousness of the Insured Person’s condition, and these means may include air ambulance, surface ambulance, regular airplane, railroad or other appropriate means. All decision as to the means of transportation and final destination will be made by the Assistance Service. Repatriation- The Assistance Service agrees to make the necessary arrangements for the return of Insured Person’s remains to the Insured Person’s country of citizenship in the event Insured Person dies while this service agreement is in effect as to the Insured Person. Legal Assistance- If the Insured Person is arrested or is in danger of being arrested as the result of any non-criminal action resulting from responsibilities attributed to the Insured Person, the Assistance Service will, if required, provide the Insured Person with the name of an attorney who can represent the Insured Person in any necessary legal matters. Lost Luggage or Lost Passport- If the Insured Person, outside the Insured Person’s country of residence, notify the Assistance service that Insured Person’s luggage or passport has been lost, the Assistance service will endeavor to assist the Insured Person by contacting the appropriate authorities involved and providing direction for replacement. General Assistance- The Assistance Service will serve as a central point for translation and communication for the Insured Person during emergencies. The Assistance Service agrees to provide to the Insured Person advice on the contacting and using services available from consulates, government agencies, translators and other service providers that can help with travel problems. In addition, the Assistance Service will provide insurance coordination, verifying coverage of Insured Person, guaranteeing payment to the medical provider based on the confirmation of benefits, a charge to credit card (s) and coordinating the payments, documentation and translation to ease claim filing when Insured Person returns to place of residence. Pre-Departure Services- Prior to the Insured Person departure, the Assistance Service will provide hazard information about foreign locations, information about immunization requirements and passport or visa requirements, general information about whether and State Department and Private Service warnings about travel to certain locations. The Assistance Service will also arrange for special medical care en-route (i.e. dialysis, wheelchairs etc.). Emergency Travel Agency- The Assistance Service agrees to provide the Insured Person with 24-hour travel agency service for airline and hotel reservations. The Assistance Service will also arrange payment to the Insured Person’s airline tickets and other travel services, using Insured Person’s credit cards. Prepaid ticket pickup at airline counters or ticket delivery by mail or courier will also be arranged by Assistance Service for the Insured Person. Emergency Cash Transfers and Advances- The Assistance Service will arrange for cash payments to the Insured Person through a variety of sources, including credit cards, hotels, banks, consulates and Western Union. The Assistance Service provides this service to supplement the facilities to the Insured Person’s credit cards. Credit Card transactions performed by the Assistance Service are subject to confirmed credit. Disclaimer of Liability- In all the cases the medical profession or any attorney suggested by the Assistance Service shall act in a medical or legal capacity on behalf of the Insured Person only. The Assistance Service assumes no responsibility for any medical advice or legal counsel given by the medical professional or attorney. The Insured Person shall not have any recourse to the Assistance Service by reason of its suggestion of a medical professional or attorney or due to any legal or other determination resulting there from The Insured Person is responsible for the cost of services arranged by the Assistance Service on behalf of the Insured Person or a covered family member. The Assistance Service will access this policy and/or other insurance policy benefits to which the Insured Person may be entitled, and/or other insurance policy benefits to which the Insured Person may be entitled, and/or Insured Person’s credit cards or other forms of financial guarantees provided by the Insured person, in order to facilitate payment of such services. DEFINITIONS For the purpose of this policy, the following definitions shall apply unless the context otherwise requires: • ‘Covered Purchase’ means an item purchased by a Cardmember and paid for by using an Eligible Account. For a purchase to be considered a Covered Purchase, the entire purchase amount for the item must have been made through the Eligible Account by a single transaction. • ‘Due Diligence’ means the performance of all vigilant activity, attentiveness and care that would be taken by a reasonable and prudent person in the same or similar circumstances in order to guard and protect a Covered Purchase from loss, theft or damage. • ‘Eligible Account’ means the account with respect to the Card issued by the Dubai First for which benefits under this Policy shall apply as determined by Dubai First from time to time. • ‘Mysterious Disappearance’ means the vanishing of a purchased item in an unexplained manner where there is an absence of evidence of a wrongful act by a person or persons. • ‘Theft’ means a loss, which involves the disappearance of a Covered Purchase from a place following violent entry and/or exit. • “Fire” means that the item insured should be damaged by actual fire, which would include the following: (a) There should be actual ignition; and (b) It should happen under accidental circumstances. • Riot, strike and malicious damage” means loss of or damage to the property insured directly caused by: - (a) The act of any person taking part together with others in any disturbance of the public peace (whether in connection with strike or lockout or not) (b) The action of any lawfully constituted authority in suppressing or attempting to suppress any such disturbance or in minimizing the consequences of any such disturbances; (c) The wilful act of any striker or locked out worker done in furtherance of strike or in resistance to a lock out resulting in visible physical damage by external violent means; or (d) The action of any lawfully constituted authority in preventing or attempting to prevent any such act or in minimizing the consequence of any such act. SCOPE OF COVER The policy shall cover items purchased (except as per exclusions hereinafter referred to as “Insured Items”) for accidental or physical loss or destruction due to any of the following perils: (a) Fire (duly supported by a civil defense/police report) (b) Riot, strike and malicious damage. (c) Theft (duly supported by police report); and (d) Accidental damage due to unforeseen circumstances beyond control of the user. The indemnity to Dubai First/Cardmember shall be provided on the following basis- a) If the Insured item is repairable, repair cost charged by the appropriate dealers service centre less any applicable excess. The dealer’s service centre shall be advised to the Cardmember by the retailer from where the purchase was made. b) If the item is not repairable or is a total loss, the Company shall issue a credit note for the amount payable (the insured value less any applicable depreciation). However, the amount of indemnity shall is no case shall exceed the present new market value of any item on the date of loss or the sum insured less depreciation, whichever is lower. The Company shall pay the repair charges less any excess to Dubai First. In case of repair charges the Policy shall carry a flat excess of Dhs 175/- for each claim. b) In case of total loss, the depreciation shall be charged on the following basis. Within 3 months of purchase NIL After 3 months to 6 months of purchase 10% After 6 months to 9 months of purchase 15% After 9 months to 12 months of purchase 20% The report issued by any dealer service center authorized with regard to repairs and/or total loss shall be binding on all concerned. PERIOD OF COVER The Policy cover shall apply for one year from the date of any eligible purchase provided that any eligible account has not been terminated for whatever reason and the Policy remains in force. TERMINATION OF COVER A Cardmember>s coverage shall terminate from the date the Cardmember is no longer eligible to participate as determined by Dubai First from time to time. EXCLUSIONS 1. Covered Purchase does not include: a. Boats; b. Motorised vehicles (including but not limited to airplanes, automobiles and motorcycles) or their motors, equipment and accessories (including but not limited to communication devices intended solely for use in the vehicle); c. Any item which, when purchased, has been used, altered or is second-hand. d. Land or buildings (including but not limited to homes and dwellings); e. Travellers cheques, tickets of any kind, negotiable instruments, bullion, rare or precious coins, cash or its equivalent, stamps, collectable items, custom dental appliances and dwelling; f. g. Plants or animals; Items intended for business or commercial use; h. Consumables and perishables; i. Items which the Cardmember damages through alteration (including cutting, sewing or shaping); or j. Services (including but not limited to the performance or rendering of labour or maintenance, repair or installation of products, goods, property or professional advice of any kind). 2. Theft of, or damage to, jewellery, cameras or video recording equipment contained in baggage is not covered unless carried by the Cardmember by hand or under the personal supervision of the Cardmember or the Cardmember>s travelling companion previously known to the Cardmember. 3. Coverage is not provided for theft or damage caused by a. Fraud, failure to follow the manufacturer’s instructions, abuse, wear and tear, gradual deterioration, seepage or ingress of water, moisture, humidity, change in atmospheric conditions including change in temperature, b. Moths, vermin, inherent product defects, c. War or hostilities of any kind including but not limited to invasion, rebellion or insurrection, terrorism, civil war, usurped power, popular rising; any weapon of war employing atomic fission or radioactive force, whether in time of peace or war d. Nuclear reaction or nuclear radiation or radioactive contamination, all whether controlled or uncontrolled, and whether such loss be direct or indirect, proximate or remote, or be in whole or in part caused by, contributed to or aggravated by the perils insured against in this Policy; e. Confiscation by any government, public authority or customs official; f. g. Act of God (including but not limited to flood, hurricane and earthquake); h. Mysterious Disappearance including leaving unattended, forgetting to pick up and leaving in car/taxi/bus or any other public transport or place i. Property while in the care, custody or control of any third party other than as permitted under exclusion 2. j. Normal wear and tear, damage resulting from atmospheric or climatic conditions, moisture and sweat damage, gradual deterioration, inherent defects or loss or damage caused due to cleaning or repairing or renovating any Covered Purchase. Losses arising from illegal activity or acts; 4. Coverage is not provided for loss or damage when the Cardmember fails to exercise Due Diligence to avoid or diminish loss or damage to Covered Purchases. 5. Coverage is not provided in respect of scratching, denting, discoloration of painted or polished surface. 6. Items stolen from public places are not covered unless they are locked wherever and whenever circumstances permit. Stolen items are not covered unless they are reported as stolen, within 36 hours, to the police or an appropriate authority where the incident took place. 7. Items stolen from unattended vehicles are not covered. 8. No cover is in force prior to the delivery and personal acceptance, by the covered person or other designated person, of a consumer product in perfect condition. 9. Electrical or Mechanical breakdown or derangement and also any malfunction covered under the Manufacturer’s warranty. 10.Intentional act or wilful neglect; overloading of the instrument & experiments or attempted self-repair or use of tools and accessories not compatible with the unit purchased. 11.Consequential Losses of any kind including loss of software of any kind. CONDITIONS Notification of Claims Immediate notice of loss or damage shall be reported to the Company but not exceeding 45 days from the date of loss or damage. Failure to give notice within 45 days from the date of the incident will result in a denial of the claim. The Cardmember shall take all reasonable measures to protect, save and/or recover the property and at their own cost shall surrender the damaged property to the Company when required. Non-Contribution Clause Coverage is limited only to those amounts not covered by any other insurance or indemnity, up to the original purchase amount. In no event will this coverage apply as contributing insurance. This «Noncontribution» Clause will take precedence over the «Non-contribution» Clauses found in other insurance or indemnity language. Claims Forms The Company, upon receipt of a notice of claim, will furnish to the Cardmember the necessary forms for filing the claim. Proof of Loss Written proof of loss including any required information necessary to support a claim must be furnished to the Company at its said location within seventy five (75) days (or to be advised) after the date of the incident. The Company will only pay claims that are completely substantiated in the manner requested within six (6) months from the date of loss. The Cardmember shall attach all requested documentation, including a legible copy of the credit card charge slip/Credit Card Account statement showing the Covered Purchase and/or store receipt and police report or other proof of loss. Pair and Set Clause With respect to Covered Purchase which consist of articles in a pair or set, the Company’s liability shall be limited to the cost of any particular part(s) which may be stolen or damaged, unless the articles are unusable individually and cannot be replaced individually; provided, however, liability for items of jewellery or fine arts consisting of articles in a pair, set or collection will not be more than that cost of any particular parts which may be lost or damaged without reference to any special value which such article or articles may have as part of such pair, set or collection. Misrepresentation Coverage as to an Cardmember shall be void if, whether before or after a loss, the Cardmember has concealed or misrepresented any material fact or circumstances concerning this insurance or the subject thereof, or the interest of the Cardmember therein, or if the Cardmember commits fraud or false swearing in connection with any of the foregoing. Right to Recover from Others If the company makes payments, it is entitled to recover such amounts from other parties or persons. Any party or person to or for whom the Company makes payment must transfer to the Company his or her rights of recovery against any other party or person. The party or person transferring such right must do everything necessary to secure these rights and must do nothing that would jeopardise them. 2. HOUSEHOLD INSURANCE IMPORTANT NOTICE. The terms of the Important Notice contained in the terms and conditions for Dubai First Purchase Protection insurance shall apply to these terms and conditions. DEFINITIONS • The Definitions contained in the terms and conditions for Dubai First Purchase Protection Insurance shall apply to these terms and conditions. • Household items” means items under ownership of Cardmember at his residence • “Insured Residence” means the address given by the Cardmember to Dubai First to cover the Policy. SCOPE OF COVER The policy shall cover household goods at the Insured Residence for the principal Card member for the following perils. 1. Fire (duly supported by a civil defence/police report. 2. Lightning 3. Riot and Strike damage due to Civil Commotion 4. Storm and Tempest 5. Flood and Inundation 6. Impact damage including damage due to own vehicles. 7. Malicious Damage 8. Aircraft damage and other articles dropped there from 9. Earthquake, Fire and Shock 10.Explosion 11.Bursting and Overflowing of tanks/pipes/apparatus; and 12.Burglary and Housebreaking due to violent and forcible entry (duly supported by final police report. LIMITS OF INDEMNITY INCLUDING SUPPLEMENTARY CARD. GOLD CARD HOLDERS. Up to a maximum Annual limit of Dhs 25,000 /- for each covered cardmember SILVER CARD HOLDERS Up to a maximum Annual limit of Dhs 10,000 /- for each covered cardmember EXCESS/DEDUCTIBLE An Excess of Dhs 1000/- each of every claim for Silver Cardholders and an Excess of Dhs 1,500/- each and every claim for Gold Cardholders. Period of Cover The policy cover shall apply for one year from date of activation of any Card provided that such Card has not been terminated for whatsoever reason and the Policy remains in force. Termination of Cover A Cardmember’s cover shall terminate from the date the Cardmember is no longer eligible to participate as determined by Dubai First from time to time. EXCLUSIONS The Company shall not be liable in respect of 1. Loss or damage or bodily injury caused by war, invasion, act of foreign enemy, hostilities or war-like operations (whether war be declared or not). Mutiny, insurrection, rebellion, revolution, conspiracy, military or usurped power. 2. Loss or damage directly or indirectly caused by or arising from or in consequence of or contributed to by ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel. 3. Loss or damage occasioned by cessation of work, by confiscation, commandeering requisition or destruction of or damage to the property by order of the government or any public municipal or local authority of the country or area in which the property is situated or occasioned to property by its own fermentation, natural heating or spontaneous combustion or by its undergoing any heating or driving process. 4. Consequential loss or damage of any kind or description. 5. Loss or damage caused by depreciation of wear and tear 6. Loss, destruction or damage caused by or arising from the leakage, spilling or excluding of liquids, oils or materials of a like nature or articles of a dangerous or damaging nature. 7. Loss, destruction or damage due to or arising out of or directly or indirectly connected with or traceable to the Card member, his servants or agents having caused or suffered anything to be done or to be left undone whereby the risks hereby insured against were or are increased. 8. The action of moth or vermin or of any process of clearing repairing or restoring 9. Loss or damage caused by mechanical/electrical failure or breakdown 10.Loss or damage caused due to delay confiscation or detention by any customs authorities or other Government officials or authorities or 11.The Company shall not be liable in respect of loss of cash, jewellery, precious stone, antiques deeds, bonds, bills of exchange, promissory notes, cheques, stamps manuscripts, medals, coins, motor vehicles or livestock. CONDITIONS 1. If at the time of any loss, damage or liability covered by the policy, there shall be any other insurances such loss, damage or liability or any part thereof, the Company shall not be liable to pay or contribute to the loss. 2. On the happening of any event giving raise to a claim under the policy, the Company shall be entitled to enter the building where the loss or damage has happened and to take and keep possession of the property insurance 3. On the happening of any event giving raise to a claim under the policy, the company shall be entitled to undertake in the name on behalf of the Cardmember the absolute conduct, control and settlement of any proceedings and to take proceedings at its own expense and for its own benefit but in the name of the Cardmember to recover compensation or secure indemnity from any third party in respect of property and/or liability covered under the policy. 4. If any claim under the policy shall be in any respect fraudulent or if any fraudulent means or devices are used by the Cardmember or anyone acting on this behalf to obtain any benefit under the policy all benefits hereunder shall be forfeited. 5. The Policy does not cover a. Loss of theft during or after occurrence of a fire b. Loss or damage to property occasioned by its own fermentation, natural heating or spontaneous combustion, or by its undergoing any heating or dying process c. Loss or damage occasioned by or through or in consequence of a.The burning of property by order of any public authority or b.Subterranean fire d. Loss or damage directly or indirectly caused by or arising from or in consequence of or contributed to by nuclear weapons material; or e. Loss of or damage to any electrical machine, apparatus, fixture or fitting (including electric fans, electric household or domestic appliances, wireless sets, television sets and radios) or to any portion of the electrical installation arising from or occasioned by over-running excessive pressure, short circuiting self-heating or leakage of electricity from whatever cause (lighting included) 6. The Cardmember shall exercise all reasonable precautions for the maintenance and safely of the properly. CLAIMS PROCEDURE Notification of Claims Immediate notice of loss or damage shall be reported to the Company but not later than exceeding 30 days from the date of loss or damage. Failure to give notice within 30 days from the date of the incident will result in a denial of the claim. The Cardmember shall take all reasonable measures to protect, save and/or recover the properly and at their own cost shall surrender the damaged property to the Company when required. Claims Forms The Company, upon receipt of a notice of claim, will furnish to the Cardmember the necessary forms for filing of the necessary claim. 3. TRAVEL INCONVENIENCE AND TRAVEL ACCIDENT INSURANCE Please refer to travel cover available for master card holders. 4. LIFE INSURANCE DEFINITIONS ‘Cardmember’ means the holder of a primary Card issued to eligible accounts as determined by Dubai First from time to time. ‘Maximum Sum Insured’ means (i) GOLD CARD AED 50,000 (ii) SILVER CARD AED 20,000/ Limit per Cardmember THE BENEFITS The benefits provided for under the policy are as hereunder. Death due to any cause In the event of the death of a Cardmember due to any cause (natural or accidental) while insured, the company will subject to the terms and conditions of the policy pay to the legal heirs 100% of the Maximum Sum Insured per Cardmember. 1. The insurance cover under the policy is 24 hours worldwide 2. The cover includes aircrew, pilots of Emirates Airlines or other airlines while on duty as paid employees. 3. The Policy is extended to cover Cardmembers taking part or engaged purely and solely for pleasure purposes in motorcycling mountain or rock climbing necessitating the use of ropes, guides winter sports polo, hunting show jumping caving or pot holing boxing or other martial arts. ELIGIBILITY Medical underwriting for all new Card member: New Joiners must submit a satisfactory heath declaration prior to enrolment which will be subject to the Company’s prior approval. Non-disclosure or concealment of accurate medical condition on the health declaration, will affect the Cardmember’s entitlement to this life insurance cover protection. CONDITIONS 1. A Cardmember is covered under the policy if he is holding a valid primary Card issued by Dubai First on or after the Commencement Date. A supplementary Cardmember i.e. Cardmember having a supplementary Card in his or her name, will not be eligible for cover under the policy. 2. Minimum age for entry in scheme is on the Cardmember’s 18th birthday and the maximum age for granting cover will be 64th birthday but insurance cover will cease as soon as the Cardmember attains age 65 3. No Claim is payable arising out of war, invasion, act of foreign enemies, hostilities or warlike operations (whether war be declared or not), civil war, mutiny, civil commotion assuming the proportions of a amounting to a popular rising, military rising, insurrection, rebellion, military or usurped power or any act of any person acting on behalf of or in connection with any organization actively directed towards the overthrow of or the influencing of any government or ruling body by force, terrorism or violence or sabotage, Unless the Cardmember was a non participating victim of the situation described above. 4. In the event of a death of the Cardmember, the Company would pay the compensation to the legal heirs of the Cardmember.. 5. If written notice is given by Dubai First to the Company that the Policy is to be cancelled, the Policy shall terminate on the date of receipt of such written notice by the Company or any subsequent date of cancellation specified by Dubai First. 6. The Cover for a Cardmember shall terminate on a) Termination of the Credit Card Agreement. b) Closure of any Card account of any reason c) The transfer of the Cardmember’s indebtedness to another person. d) The date on which any Card account becomes overdue by 60 days or a complaint is filed with authorities about non-payment of the dues or the Cardmember is declared as absconding or a judgment is entered in any Court with respect to any indebtedness of a Cardmember or e) The Cardmember having attained age 65 7. In case a primary card member who has more than one credit card the cover will apply on the basis of one card only. The card member will get the highest sum insured among the cards in force. 8. These terms and conditions shall be governed by the UAE laws and the courts in could not be amicably settled. 9. All monetary amounts specified in the Policy are expressed in the currency Dirhams, referred to herein as U.A.E. 10.Disappearance Clause If a Cardmember disappears during the currency of the Policy and their body is not found within one year after their disappearance and sufficient evidence is produced satisfactory to the Company that leads them inevitably to the conclusion that they sustained accidental bodily injury and that such injury caused their death, the Company shall forthwith pay the death benefit as provided herein and the person to persons to whom such sum is paid shall sign on undertaking to refund such sum to the Company if the Cardmember is subsequently found to be living. CLAIMS PROCEDURE 1) In the event of a claim it must be notified to the Company as soon as possible but in any event not more than 90 days after the occurrence of the incident giving rise to the claim, together with any supporting evidence required by the Company from time to time. 2) The Company shall have the right to require satisfactory evidence of age before any benefit is paid in respect of any claim under the policy. If it shall be established that at the time the Cardmember first became insured here under his age was under stated and that at such time his true age was 65 years or more, or that Cardmember would have attained 65 years of age prior to the anniversary of the Commencement Date for that Cardmember the liability of the Company shall be limited to a return of the Premium paid in respect of that Cardmember. 3) In the event of death of a Cardmember the following documents will be submitted to the Company by the Cardmember. A. An official letter signed by the Card member intimating the claim. B. Original official death certificate or copy duly attested should be submitted supporting the claim provided death occurs with the UAE. C. In the case of death occurring outside the UAE, the original death certificate must be submitted, duly notarized and attested by the UAE embassy of the country where the death took place. Subsequently, the same should be attested by the embassy of the country in the UAE and Ministry of Foreign Affairs in the UAE. D. Copy of the passport with the UAE visa page. The Visa of the Cardmember should be valid and should no have been expired for more than 6 months of the date of death. The above documents will have to be verified by the Company E. In the event a death certificate or the Medical report is not available as the case may be, the Company shall request for any other form of proof of death as it may consider appropriate that can satisfy the Company as to (a) the date and (b) the cause of death of the insured person. F. Latest 3 months Dubai First Card statements. EXCLUSIONS No benefit will be payable if Death occurs either directly or indirectly as a result of any of the following causes: a. Active participation in a war or in warlike perils. Cover does not cease when terrorist activity is involved as along as the insured person is not an active Participate. Active Participant in warlike operations means an active member of the military forces eg. Army, navy air force, territorial army or police or any other special forces activated by government or other public authorities to defend law and order in the case of warlike operation, or any other person who takes up arms in an active or defensive role. Warlike operations means hostilities mutiny, riot, civil commotion, civil war, rebellion, revolution, insurance conspiracy military or usurped power and martial law or state of siege b. Passive war cover is excluded if an insured person is permanently assigned to a country after war has been declared in that country or after it has been recognised as a war zone by the United Nations or where there are warlike operations as described 1.1 as above. Permanently means on assignment of more than twenty eight days
