NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY NATIONAL ADMINISTRATION OF PENITENTIARIES GOVERNMENT DECISION No. 389 FROM MAY 27, 2015 TO APPROVE “NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF INMATES 2015 – 2019” Published in Official Gazette no. 532 and 532a from July 16, 2015 NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY GOVERNMENT DECISION No. 389 FROM MAY 27, 2015 TO APPROVE “NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF INMATES 2015 – 2019” NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY Under Article 108 from the Romanian Constitution, republished, The Government of Romania approves this decision, Article 1 It is approved the National Strategy for Social Reintegration of Inmates, 2015 – 2019, provided in annex, which is part of this Decision. Article 2 There are appointed the National Administration of Penitentiaries, institutions, local and central public administration authorities, with responsibilities in facilitating the social reintegration of inmates, to implement the provisions of this Strategy. Article 3 It is established the Inter-ministerial Commission for the coordination and implementation of the Strategy, herein referred to as the inter-ministerial Commission, a body with no legal personality. Article 4 The Inter-ministerial Commission’s role is to coordinate and monitor the implementation of the Strategy. Article 5 (1) The inter-ministerial Commission shall: a. coordinate and monitor the implementation of the Strategy in the institutions and local and central public administration authorities responsible; b. initiate actions to mobilize resources needed to implement the Strategy; c. ensure inter-ministerial communication and the harmonization of opinions; d. make recommendations and propose measures to institutions and local and central public administration authorities working in the field, to ensure coherence and efficiency of the process of implementing the Strategy; e. identify and propose public policies generated by this Strategy; NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY f. propose the establishment of working groups, composed by experts from institutions, local and central public administration authorities responsible; g. report annually to the Government on the progress of achieving the goals set in the Strategy through annual monitoring Report; h. it analyse and formulate proposals for the review of this Strategy, based on the interim evaluation Report, prepared by officials designated by Regulation referred to article 8 par. (1); i. analyse and formulate proposals for the strengthening of functional organizational and regulatory framework, established by this Strategy, based on the final evaluation Report, prepared by officials designated by Regulation referred to article 8 par. (1); j. The inter-ministerial Commission carries out any other tasks in order to achieve the purpose for which it was established. Article 6 (1) The Inter-ministerial Commission is composed of representatives with management position, at least of the level of director of the following public institutions: a. Ministry of Justice; b. Ministry of Labour, Family, Social Protection and Elderly; c. Ministry of Education and Research; d. Ministry of Internal Affairs; e. Ministry of Health; f. National Probation Directorate; g. National Administration of Penitentiaries. (2) The President of the Inter-ministerial Commission is the representative of the Ministry of Justice. (3) For the optimal functioning of the Inter-ministerial Commission shall appoint an alternate for each member. (4) The President and members of the Inter-ministerial Commission are appointed by order / decision by the institutions heads set in par. (1), within 30 days from the date of entry into force of this Decision. Article 7 (1) The Commission meets quarterly or whenever necessary, convened by the president or at the request of a member. (2) The meeting of the Commission may attend as guests, representatives of local and central public administration authorities, universities or NGOs and other specialists. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY (3) When deemed necessary, the Commission decides to set up working groups composed by experts from public institutions provided at article 6 par. (1), which shall provide it with data and information of interest to support the recommendations, measures and policies formulated by the Commission. Article 8 (1) The Commission decisions are adopted by a majority of present members, in accordance with the Regulation provision, approved by its decision, on the first working meeting. (2) The Technical Secretariat of the Commission is provided by National Administration of Penitentiaries. The duties of technical secretariat are set by the Regulation. Inmates – people sanctioned by the educational measure of placement in an educational centre or in a detention centre, persons sentenced to imprisonment or life imprisonment, people remanded in places of detention subordinated to the National Administration of Penitentiaries, hereinafter referred to as NAP. b. Social reintegration process – sequence of steps in support of the inmates, which aims the social reintegration, as follows: 1. Institutional stage – began on incarceration and lasts during the punishment, in a time that is complete approximately 90 days prior to release; 2. Preparation for release – starts 90 days before release and lasts until the day of release on parole term or, where appropriate, of release on term; 3. Post-detention – starts at the date of release on parole or of release. Meaning this Strategy, issues of relevance within the first 30 days, criminal elements such as: homelessness, lack of employment, lack of a regular income and it can be evaluated by the institutions involved for a period of 2 years after release, or until the fulfilment of the duration of the sentence. c. Institutional infrastructure – all the elements that constitute the technical and material support for the activities of institutions relevant to the social reintegration process. d. Institutional partners – collaborators involved in social reintegration, usually on the basis of cooperation agreements or partnership agreements, where appropriate, state institutions, NGOs, public or private. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY e. Place of detention – maximum security prisons, closed, semi-open and open prisons, prisons for youth, prisons for women, prisons-hospital, educational centres, detention centres, remand centres and special sections of pretrial subordinated to the National Administration of Penitentiaries. f. Social reintegration staff – staff in places of detention with tasks in the field of education, psychological and social assistance for the inmates. g. Other stuff – operational staff, medical staff, staff from other institutions and local and central public administration authorities with responsibilities in the social reintegration of inmates. h. Specialized department of social reintegration – specialized structure, established at the National Administration of Penitentiaries, which defines, coordinate, implements and evaluates the lines of action for the uniform application of penal policies in education, psychological and social assistance for the inmates in the detention places of the prison system. i. Individualized plan – individualized plan of evaluation, educational and therapeutic intervention, drawn for each convicted person according to the law for punishments enforcement and custodial measures. j. Activities and programs offer – activities and educational programs, psychological support and social assistance for inmates and persons who executed sentence / custodial measures, existing within each institution and local and central public administration authorities with responsibilities related to the successive stages of the process of social reintegration. k. Recuperative steps – educational, psychological and social assistance approaches, individual or group, developed in successive steps of the process of social reintegration. l. Educational program, psychological support and social assistance – structured approach, consisting of all activities using methods and techniques of each aria of intervention, oriented to compensate needs or identified risks, in the context of facilitating social reintegration. m. Educational activities, psychological support and social assistance – semi-structured approach type assessment, counselling and information, knowledge oriented, self-awareness, personal development, skills and vocational stimulation, leisure and creation. n. Social economy structures – “private organization established on official bases, with autonomy of decision and freedom of membership, that produce non-market services for households and whose surpluses, if any, cannot be appropriated by the economic agents that create, control or finance them”. County agencies for employment – structures of the Agency for Employment, which provides mediation services, information and useful advice for the social reintegration process, where appropriate, inmates, their families or other interested parties. p. Centre for social inclusion – residential centre that provides people who executed a sentence/custodial sentence housing and household, for a specified period, in integrated system, with the granting of information services, counselling and social reintegration, in accordance with individual identified needs. q. Social housing – housing rent subsidy to be attributed to individuals or families whose economic situation does not allow the access to housing ownership or rental housing in market conditions. r. Environmental support – social structure (family, group, neighbourhood, team, community) in which inmates belong, structure in a system of affective relationships, socio-economic, political, cultural and other structures and networks for optimizing the proposed results. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY INTRODUCTION The international context, dominated by the economic crises, by the need for reallocation resources, requires a new approach to manage the inmates by each country. This revealed as emergency solution to repatriate inmates to countries of origin, decision requiring identification, at individual level, for instruments / management mechanism. Internally, the recession in recent years, corroborated with low jobs offer, educational offers and training insufficiently adapted to the needs of vulnerable groups, puts additional pressure on the society, which is also reflected in the upward dynamics of the crime rate (2008 – 171, 2009 – 159, 2010 – 195). The upward dynamics of inmates number in prisons (26.716 at December 31, 2009; 28.251 at December 31, 2010; 30.694 at December 31, 2011; 31.817 at December 31 2012; 33.434 at December 31, 2013) exercises also additional pressure on strategic decisions, which need to be undertaken and therefore systemically implemented. This pressure creates however the opportunity to identify and develop instruments / execution and post-execution management mechanism, providing the opportunity to increase the chances of social reintegration of inmates. The new judicial vision, imposed by the entry into force of the New Codes, marks the need to rethink, to reposition at the level of criminal policies, aiming a strategic horizon. Assuming implementation at the Executive level, the new concept of “social economy” is one of the priority actions that will require, in turn, a reposition of the emerging strategies, developed by the main actors involved in the operationalization of this concept, including National Administration of Penitentiaries. After the public release (February 02, 2010), from the National Administration of Penitentiaries, of the proposal to establish a working group, involving representatives of public institutions, NGOs or other civil society representatives, with possible role in post-detention assistance, in order to draft the “National Strategy for Social Reintegration of the Inmates”, were organized successive workshops which aimed at developing this project. In these coordinates, during three sessions of the extended working groups and seven sessions of subgroups, was drafted the “National Strategy for Social Reintegration of Inmates” (grounded and multi-annual plan of activities). The “National Strategy for Social Reintegration of Inmates” has been completed with the involving and consultation of the Ministry of Justice, penitentiaries, as well as institutional partners in the Annex 1A. The resulted form and the promotional activities established by the Department of Social Reintegration were presented in the working meeting of September 29, 2011, whose organization has received support from representatives of the National Administration of Penitentiaries and from representatives of public institutions and NGOs: Ministry of Justice, Ministry of Education and NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY Research, National Authority for Child Protection and Adoption of Ministry of Labour, Family, Social Protection and Elderly, National Agency Against Drugs, General Directorate of Bucharest Police, Humanitarian Service for Penitentiaries, “Rock of Ages” Foundation, “Criminal Justice Reform” Foundation, Association for Women Entrepreneurship Development, “Youth for Justice” Association etc. In the period of time October – December 2011, emphasis was placed on activities to promote the “National Strategy for Social Reintegration of Inmates”, by steps whose organizational framework was outlined by the specialized department and the implementation was ensured in all prisons: organizing meetings with institutional and organizational partners in the local community, where experts in social reintegration in each place of detention presented the “National Strategy for Social Reintegration of Inmates”; organizing public debates on the topic of the “National Strategy for Social Reintegration of Inmates” at the premises of the local universities; organizing meetings with local public administration by the representatives of education and psychosocial assistance service, being presented the “National Strategy for Social Reintegration of Inmates”; informing the media, in cooperation with the press officer of each unit, about the “National Strategy for Social Reintegration of Inmates” and the importance of the public awareness and promotion activities. The project received additions from the National Probation Directorate, co-opted, together with the Ministry of Labour, Family, Social Protection and Elderly, National Agency for Employment and the General Inspectorate of Romanian Police under the Ministry of Internal Affairs, in their efforts to finalize the project “National Strategy for Social Reintegration of Inmates”, intensified in February 2012 and completed in August 2012. In these coordinates, the draft Government Decision on approval the “National Strategy for Social Reintegration of Inmates” has been subject of public debate on the website of the Ministry of Justice, this stage ending at December 30, 2012. To finalize the Strategy was necessary to estimate the financial impact of the proposed measures, which resulted in a report that described the budgetary implications, depending on the financial resources that were provided for each of the strategic objectives and their subscribed activities. The analysis was conducted within the project “The return of former prisoners into to labour market and their integration into society” and was assumed by the United Nations Development NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY Program, by contracting two experts. Final estimation of the financial impact was realized in 2013, at the end of the project “The return of former prisoners into to labour market and their integration into society”,. Social reintegration of inmates is a process that has its beginnings in execution phase. An essential role of the prison service is to prepare inmates for post-detention. To achieve this goal is necessary to correlate the needs of inmates with the educational programs, psychological support, social assistance and social inclusion approach. Also, for the success of social reintegration is necessary the contest of local community, in their dual quality: partners of prison service and beneficiaries of the whole process of social reintegration of inmates or those who served custodial sentences. The prison administration, through the National Administration of Penitentiaries and subordinated units, as public institutions of national interest, contributes to the protection of public order and national security by guarding, escorting, surveillance, enforcement of the detention regime and organise of the educational activities, psychological support and social assistance for social reintegration of inmates. In these coordinates, the National Administration of Penitentiaries and its subordinated units constantly evaluates the educational needs, psychological support and social assistance of inmates, this process constitutes the basis of the strategy for their social reintegration. Individualization and planning of the execution by organizing activities for school training, professional training, educational programs, psychological support and social assistance constitutes current approaches assumed to all places of detention to achieve the educational function of punishment or executed the custodial measures. Legislation on penal matters requires the responsibility of the penitentiary institution, educative centres and detention centres, to organize and conduct educational, cultural, therapeutic activities, psychological support, social assistance, school training and professional training during detention, to facilitate social reintegration of persons in custody. Preparation for release and social reintegration begins immediately after the placement in the place of detention, the setting a detention regime requires drawing a Plan of evaluation, educational and therapeutic intervention for each person convicted. The inmates receive individually recuperative interventions, the minors, young people (aged 18-21) and vulnerable women, from the perspective to adapt the educational approaches, psychological support and social assistance to their psychosomatic particularities and personal development needs. The specific activities educational, psychological and social assistance, coordinated by specialized personnel, exclusively during execution of sentence, are a necessary condition but not sufficient for social reintegration. The quality standards in the training of professionals involved in implementing this Strategy and the resources allocated to this area lead to increasing the chances of reintegration of a person deprived of liberty into society, with reduced risks of relapse. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY Since the inmates belong to community, the partner institutions, in fulfilling their duties, considers a priority to create an articulated inter-institutional mechanism, to ensure, in a shared vision, the crossing through successive stages of social reintegration process. Ministry of Labour, Family, Social Protection and Elderly, through the institutions under its authority, the National Agency for Employment and the National Authority for Child Protection and Adoption, is involved and supports the social reintegration of inmates and those who executed sentence / custodial measures, by organizing vocational training courses and facilitating employment or monitoring the child rights in places of detention and post-detention. Ministry of Internal Affairs, through its subordinated institutions, is involved in facilitating the social reintegration, through involvement in post-detention stage, based on its responsibilities in terms of powers conferred by the law. Conducting, in cooperation with other institutions and local and central public administration authorities, the campaigns and projects for crime prevention it is also one of the priorities assumed by the Ministry of Internal Affairs, in the general context of the social reintegration and the reducing of the risk of relapse. Recuperative activity requires the creation and development of a community support framework to facilitate the social reintegration, by establishing partnerships between the public and private sectors. The cooperation between prisons and institutions, local and central public administration authorities, NGOs with responsibilities in facilitating the social reintegration of inmates, enrol within the guidelines of international and European framework, by providing norms, values and universal principles, applicable to the treatment of beneficiaries. In the context of inter-institution cooperation, it is necessary to establish bases of conducting common projects of recuperative intervention, an essential role belonging to the institutions and civil society organizations. By maintaining the contact between inmates and support environment, and wider, with community, it aims, on the one hand, to reduce the negative effects of detention and, on the other hand, to the community involvement in the process of social reintegration. Developing mechanisms to facilitate the social reintegration creates an opportunity to attract foreign funds, by promoting common projects to improve detention conditions and the assistance provided to the persons kept in custody. Getting results when working in collaboration depends on diversification of the common approaches, the active involvement of the parties and the sustainability acquired after completion of the projects with external funds. To ensure visibility and continuity of the actions undertaken at the institutional partners, it requires constant media coverage and promotion of the performed activities, including with the support of civil society. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY In the absence of a corresponding legal framework for an inter-institutional system, interactive, articulated and functional, to continue the educational approaches, psychological support and social assistance in detention / internment, the results obtained will reduce efficiency, which requires, necessarily, promotion and implementation of “Strategy for social reintegration of inmates”, assumed at national level. It is necessary a new approach oriented to the continuation and concretization of the steps to social inclusion, initiated in detention, by contribution of institutions, local and central public administration authorities, NGOs, that working or having the vocation to work in the field of post-detention. Such an approach aims to create the necessary institutional framework for social reintegration of inmates, emphasizing the active role that institutional factors and the community should achieve it, through a convergent action, in relation to the desideratum of social reintegration of the persons with criminal records. Thus can be identified and mobilized the resources needed to support the efforts of the inmates and the persons who had executed imprisonment to regain a stable social role and to stop the social assistance. LEGAL FRAMEWORK Taking into account the international and European regulations on human rights and child rights, criminal law reform, along with international norms and standards, we can define a larger view on framework sources of settlement on custodial and non-custodial sanctions. Government Decision (HG) No.870/2006 on the approval of the Strategy for the Improvement of the system for the elaboration, cooperation and planning of public policies for central public administration; 17. Law No.252/2013 on the organization and functioning of the probation system as amended and supplemented; 18. Minister of Justice Order No.2199/C/2011 approving the Regulation on conditions for organizing and running educational, cultural, therapeutically, psychological counselling and social assistance activities, educational and professional training; Cooperation Protocols 1. Protocol on cooperation No.57914/17.09.2012 between the Ministry of Education and Scientific Research and the National Administration of Penitentiaries No.61557/05.10.2012. Defining the problem Current regulation do not refer in a complete and sufficiently systematic manner to the issues of cooperation and complementarity in providing the assistance granted to the inmates by the prison employees, along with the probation NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY officers, central and local public authorities and nongovernmental organizations with a role or vocation to activate in postprison assistance(NGOs) as well. Even if there is a connection between penitentiaries and other public authorities regarding some activities which are meant for the benefit the inmates, taking into account the up-to-date regulations, the needs of the prison population (compared to the actual premises of social reintegration) claim the necessity of a regulatory framework and an inter-institutional system, so as to provide an addition of interactivity and functionality. Criminal policy pays a decisive role by establishing clear competences and responsibilities of the stakeholders involved, in terms of developing the cooperation and complementarity framework of the institutions, public authorities and NGOs active in the field of post-prison assistance. On the basis of ‘The National Strategy for Social Inclusion of the Inmates’ stands a series of documents, as follows: The diagnostic analysis of the penitentiary system-year 2008, The Prime Ministers’ Control Body report, The plan of measures for improving the prison system-year 2008, The National Administration of Penitentiaries’ study ‘ Evaluating the current situation in the field of social reintegration-year 2009’; studies conducted in the framework of outsourced projects: ‘The strategy for employment and developing skills through learning and running activities for freedom’-The study of the Regional Research Institute of Lombardy, ‘Increasing opportunities for social inclusion of the detainees ,through a better society informing , as well as improving penitentiary activities’ and ‘The return of former inmates on the labour market and their integration into society’. In the study conducted in the penitentiary system in 2009, ‘Evaluating the current situation in the field of social reintegration’, were assessed the main domains strongly influencing the efficiency of the educational activities, psychological counselling and social assistance, as follows: human resources , working in committees ,the contents and educational activities, psychological counselling and social assistance, cooperating with NGOs, the working tools used by the reintegration stuff in its activity. The study conclusions, which are nowadays available, mostly regarding human and material resources, highlighted the following: Human resources are insufficient by reference to the workplaces provided for the social reintegration branch; Taking into account the efforts which are continuously made to ensure the existence of the minimum standards on the number of spaces and their adequate accommodation, related to the entire prison system, there have been outlined significant differences between prisons, which claim the establishment of the same standards all over the units of the system. The involvement of inmates in the educational programs, which was considered really useful during the reintegration process by the specialists in the field; In the prison system there are numerous protocols, mostly signed with public institutions, their activity being considered useful and diversified as regards the variety of programs that can be carried out with the participation of the inmates. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY The instruments used in carrying out activities and educational programs, psychological counselling and social assistance are not applied in a standardized manner in the analysis of each inmate, as to fundament the same individualized recuperative interventions. Among the above mentioned documents, we also outline the conclusions of The study of the Regional Research Institute of Lombardy adopted within the project ‘The strategy for employment and developing skills through learning and running activities for freedom’, which strike four main aspects that strongly influence nowadays social-professional reintegration of the inmates, as follows: The culture and perception the outsiders have on inmates; The legislation; The social reintegration support systems; The social networks. The report on the results of the sociological research undertaken in the final evaluation of the project ‘Increasing opportunities for social inclusion of prisoners through a better society informing and a global improvement of the activities carried out in prisons’ marks out that incarceration and detention leave a mark on each inmate’s social evolution, his relation with the outside world having a significant weight in social reintegration. These links with the outside have been monitored by applying questionnaires on prisoners, with items targeting family relationships, behavioural changes occurring during detention and social reintegration prospects as well. One of the studies conducted within this project ‘Prisoners’ views regarding the Romanian penitentiary environment’, developed over a period of three years ( 2009-2011), indicates, in the final evaluation period, an increase in the percentage of prisoners who say that labelling and people’s prejudices it’s a major difficulty in the social reintegration process ( 35% in 2011 from 30.5% in 2010 and 29% in 2009).The study reveals as well, that, in the opinion of prisoners, the lack of a job represents one of the most important problematic issues faced after liberation. Within the project ‘The return of former inmates on the labour market and their integration into society’ it was carried out a Report on the functional aspects of the reintegration of former inmates on the labour market (2011), in which there are advanced two important references: NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY The limitation of the positive effects of the social reintegration programmes correlates with the lack of cooperation between partners and the agencies involved, but also with the inefficient implementation of the programme and specific activities’ components. For example, programs intended for reintegration on the labour market should contain: - training courses for work/employment; - professional training courses; - controlling the prisoner at work and supervising his activity by a case manager; The development of an inter-institutional network, cooperation between institutions, probation services, public agencies, community and social services, NGOs and private companies should be imposed as a standard practice, with the establishment of a scheme for an informational exchange among professionals in different areas of activity, involved in the process of social reintegration. Among the recommendations of the experts involved in drafting the report we notice the following: - - the growth of opportunities for open prisoners to attend courses at upper secondary level education in community; the maintenance of budgetary funding for training courses intended for prisoners through the National Agency for Employment, the Chambers of Commerce and Industry of Romania’s increasingly involvement in the working reintegration of the inmates; the development of a cooperative relationship between prison and probation, the development of a common database; the promotion of a legislative act in order to inter-institutionally regulate the conditions and opportunities for social reintegration of the inmates. At an European level , in the framework of the Strategic Forum in Berlin, there were outlined in 2012 some recommendations formulated in the ‘ Ex-Offenders Community of Practice’ project, subsequent to the organized workshops and seminars, so that, for the social reintegration of the former inmates, should be taken into account alongside a unique strategy at EU level, the following: The partnership between public institutions and non-governmental organizations NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY ‘Ex-Offenders Community of Practice’ project recommends that all the relevant services should be involved in the social reintegration process of the former inmates. They should be supported through formal agreements if they consider it appropriate, as well as implemented in the European institutions, at the level of national Governments, among service providers, at a local and regional level, for all the public institutions and non-governmental organizations, regardless of the level. ‘Ex-Offenders Community of Practice’ project recommends that all who work with the inmates and former inmates should be trained in a manner as current and efficient. This process will include increasing awareness and cutting out the prejudices existing through the public opinion, supporting service providers as well as natural or legal persons that can be receptive to working with this category of person (incumbents), regardless of age. Evaluation It is also recommended that the detailed and systemic assessment of each inmate should be made by specialized institutions in the domain (with specific attributions), in an early stage so as each inmate/detainee/prisoner can benefit from the most suitable support during detention , during the period of preparation for release and in the post-detention stage as well. Contact with family/community The project recommends that the maintenance and strengthening of the links with families – through stuff training, creating a penitentiary culture oriented towards the involvement of families in supporting the inmates during detention and after liberation as well – should be a priority of the social reintegration process and a contribution to reducing the risk of relapse. Initiative on employment, training and education ‘Ex-Offenders Community of Practice’ project recommends, as a priority of the social reintegration process, the growth of the employment rate, both by providing training, appropriate education and gaining work experience, keeping positive links with employers and training providers, as well as through anti-discrimination legislation and practice. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY In conclusion, the main areas of concern/issues within the social reintegration domain (in the current stage of the criminal policy in Romania), contained in the documents listed above and that give the basic directions of this Strategy, are organized into the following directions: An institutional and inter-institutional capacity adapted to an advanced (highly-performance) reintegration process social Insufficient human resources to include all inmates and post-detainees (persons who served imprisonment/custodial sentences) in regenerative approaches for the identified needs , based on the undertaken qualitative and quantitative standards; The social reintegration domain has qualified staff, but the number is insufficient to ensure the involvement of all prisoners and post-detainees in regenerative approaches, as well as to increase the quality of the carried out activities. The progress registered in the development of the regulatory/normative, methodological and instrumental framework in the assistance of the inmates is encumbered by an acute shortage of human resources in all social reintegration structures included in the penitentiary system. The insufficient number of specialists negatively influences the execution path of the sentenced persons, because of the absence or low quality of the interventions provided, with direct effects on the relapse risk. From the perspective of continuous professional training, it is necessary to diversify the curriculum of training or retraining courses intended to the personnel involved in the educational, psychological and social assistance of the inmates, as a prerequisite for increasing the qualitative standards of the activities related to the reintegration process. So, the integrated approach needs a constant identification of the training needs registered in all public authorities and institutions with responsibilities in successive stages of the social reintegration process of inmates and post-detainees (former inmates). Insufficient material and financial resources allocated for the social reintegration process of the inmates and former inmates The material and financial means involved in the social reintegration domain/field are insufficient in terms of specific activities, the quality and quantity of the results being closely dependent on their existence and usage level. Budgetary funds allocated for the educational, psychological and social assistance activities, included, according to The National Administration of Penitentiaries and its subordinate units, in the budgetary article No.57.02.02 ‘Material social aid’-(Revenue and grants) are used only for the purchase of school supplies, teaching materials for the educational process and for other social rights of the detainees. Given that before 2011 there were not explicitly provided funds for the social reintegration field, reported to 2011 and 2012, the situation concerning the allocated budget is thus: NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY - 2011: 60.000,00 compared to the forecast called for 175.000.00; - 2012: 40.088,00 compared to the forecast called for 139.361,00; - 2013: 34.754,00 compared to the forecast called for 153.936,00. According to the central statistics at the level of The National Administration of Penitentiaries in Romania, at the end of the year 2013, the average monthly expenditure for a detainee were 2.462 RON, under the terms of an actual of 33.053 incarcerated detainees on 31.12.2013. The share structure of the elements of the present expenditure is the following: - personnel expenditure: 71,54%; - goods and services expenditure: 17,33%; - capital expenditure: 1,53%; - health insurance contributions (for the inmates): 3,39%; - other expenses: 6,21%; We mention the fact that the total employees of the penitentiary system was, at the same reporting date, 12.208 persons, of which, only 639 specialists in the social reintegration field, an insufficient number in the general context of reforming the criminal executional path, in which there were sanctioned the balancing of the custodial function through the social reintegration function of the penitentiary service, the individualized approach to the recuperative intervention and designing a progressive and regressive system of the punishment execution. Although personnel expenditure occupy an important share, total expenditure for ensuring inmates’ custody, in absolute value, can be reduced by streamlining the social reintegration activities, with direct effect on reducing recidivism rate, at present being estimated that between 60% and 80% of the total prison population of Romania returns to prison. The expenditure issue cannot be neglected, since in NAP’s evidence there are 111 decisions of the European Court of Human Rights, in cases concerning prison living conditions and prisoners’ rights failure, the total amount spent on indemnifying prisoners rising over 970.000 Euros and 10.000 Swiss francs. These data are updated in real time, as provided by the Ministry of Finance. Insufficient adaptation of the regulatory framework to the social reintegration needs, in terms of ensuring the resources and the necessary services’ continuum, with clearly defined responsibilities of the central and local public institutions involved. Social reintegration involves an efficient interinstitutional cooperation mechanism that can imply the assumption, at an institutional management level, of the priorities related to the sustenance of the social reintegration process of the inmates, information exchange, as well as developing, application and, from case to case, review of some interinstitutional procedures. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY Developing educational, psychological counselling and social assistance programs Standardizing the social reintegration domain is in the ongoing process, being necessary to strengthen the implementation and, where necessary, review of the programs and activities offering, in the field of education, psychological counselling and social assistance, as well as of the work methodology , and to continue into procedures. The absence of a coherent social-professional reintegration policy, adapted to the needs of prisoners and labour market requirements, allowing them to access a diversified range of training programs and find a job. Most of the prisoners have a low level of education and professional training and, implicitly, diminished chances to be integrated into the labour market. Criminal record affects the credibility of those who served custodial sentences against employers, thus being excluded from the labour market. The existence of prejudices and stereotypes that hinder the social reintegration process and which would require raising public awareness by reflecting the unrolled activities during detention , as well as running crime prevention campaigns, including inmates. The negative perception of the society towards inmates and former inmates is based on distorted information, leading to a significantly negative impact. However, society should realize that the social reintegration of the inmates is essential, taking into account that the return of former inmates in prison, firstly requires committing new crimes that majorly affect the community. Facilitating post-detention assistance (systemic level) The absence of an informational platform that allows correlating information on inmates and former inmates, sharing/common access for the institutions and public authorities with responsibilities on social reintegration , as well as assuring an optimal informational flow by updating the data for all the assisted cases, for the successive stages of the social reintegration process. Inconsistency in ensuring , at a widely integrated level, the continuity of all recuperative steps initiated during detention, in the context of the absence of an inter-institutional, articulated mechanism, made to ensure the involvement, at a national level, of the social actors enabled to facilitate the social reintegration process. The absence of a regulatory framework that allows the development of social enterprises, focused on those intended to former inmates. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY The absence of adjusting the regulatory framework so as to stimulate the involvement of local public authorities, economic operators and other individuals or legal persons (legal entity), public or private, in sustaining the social-professional reintegration of the inmates. The absence of adjusting the regulatory framework so as to govern the functioning and administration of the social inclusion centres by public or private social services providers, in order to provide/assure former inmates/people who served custodial sentences, in an integrated system, temporary hosting, information, counselling and social reintegration in the post detention stage. Insufficient development of social support, to facilitate access to training programs and other type of services intended to assure the regular assistance in the post detention stage (medical and social assistance), including meditation for family and community reintegration. Inconsistency in a systematic promotion of the social reintegration of the inmates, as a result of a poor collaboration and a distinct reflection on the contribution of the institutions, local and central public authorities and nongovernmental organizations regarding this process. OBJECTIVES Reconfiguring the inter-institutional collaboration aims to provide a continuum of social services, individualized and systematic assistance and counselling interventions, adapted to the needs of the inmates or former inmates. These activities would address both the specific needs of the preparation for release stage and the ones specific to the post detention stage as well. In this regard, additional to the efforts invested by the local and central public institutions and authorities, civil society’s representatives’ incentives is beneficial/profitable for developing support networks in the community, thus continuing the recuperative efforts initiated during detention. The intervention areas correlated to the above mentioned concerns, suppose, in terms of creating the prerequisites for facilitating social reintegration and thus reducing the risk of relapse/recidivism, the following: - Adapting the educational, psychological and social assistance programs to the needs of the inmates; Diversifying the educational and social assistance programs and activities offering in order to involve a larger number of prisoners; Empowerment and community awareness of the importance of the social reintegration of the inmates and former inmates; Facilitating post detention assistance; Regulating, providing and accessing some services or specialized centres to support inmates’ or former inmates’ social reintegration efforts, focusing on the support of the proximate communities. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY In implementing this Strategy it is necessary the involvement of the nongovernmental institutions and organizations with role in assisting the inmates and former inmates in the successive stages of social reintegration, social partners that are found in Annex 1. Vision By implementing’ The National Strategy for Social Inclusion of the Inmates’, respecting the values of humanism, integrity, loyalty, professionalism, respect for the law, openness to community, will be ensured a coherent social reintegration system for the inmates, with institutionalized involvement and community support, ready to meet the intricate needs of the beneficiaries and society as well. Mission Organizing and unrolling educational, psychological and social assistance activities both by local and central public authorities and institutions, and nongovernmental associations or organizations, that contribute to the reintegration intro society of the prisoners and former prisoners, taking into account the need to protect citizens. In this context, there have been established 3 main strategic objectives that will be implemented in specific objectives, activities provided with people in charge, deadlines and output indicators. I. Developing institutional and inter-institutional capacity in the social reintegration domain intended to prisoners and former prisoners Career orientation, the maximum use of resources and the improvement of the organizational climate stand out as major concerns regarding institutional management with direct implications on the quality of the results obtained locally or systematically in the field of the social reintegration of the inmates and former inmates. Successively, it is required to unitary proceed and develop some institutional policies so as to facilitate the social reintegration process. Thus, we pursue the following: - Developing personnel’s proficiency; Institutional infrastructure development and institutional cooperation; Changing the regulatory framework in order to improve the continuum of services in the social reintegration field; Developing and implementing institutional procedures. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY The expected result by achieving this objective consists in preparing the prisoners, educationally, psychologically and socially for a social professional reintegration or, from case to case, for receiving them in a post detention assistance circuit. II. Facilitating post detention assistance to a systemic level In the Romanian society we find a generalized tendency of the state institutions to act in a small frame, in the absence of a systemic cooperation framework, intended to bring consistency and efficiency to the institutional and inter-institutional actions. Facilitating post-detention assistance can be achieved by conjugating efforts and recognizing, in the social reintegration process, the active role that the central and local public institutions and authorities, nongovernmental associations and organizations have. Attracting and involving the central and local public institutions and authorities, nongovernmental associations and organizations in the post-detention process, in a concerted effort, are absolutely necessary for the social reintegration process, with lasting effects, of the post-detainees. Through this goal, we follow: Developing and strengthening partnerships between local and central public authorities and institutions, nongovernmental associations and organizations and local communities, so as to facilitate the social reintegration of the former-inmates; the involvement of the local authorities in providing social support measures, so as to facilitate access to training programs and other types of services offered in the post detention period, as an assistance measure, inclusively regarding meditation for family and community reintegration. Ensuring the continuity of the interventions for the former-inmates by taking over the cases and providing assistance in the post-detention stage. Analysing and, from case to case, modifying or filling the regulatory framework concerning the establishment, organization and functioning of social enterprises intended to create jobs for vulnerable groups, inclusively for former inmates. Analysing and, from case to case, modifying or filling the regulatory framework concerning the establishment, organization and administration of the social inclusion centres. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY Analysing and, from case to case, modifying or filling the regulatory framework needed in stimulating the involvement of the local public administrations, economic operators and other individuals or legal persons (legal entity), public or private, in sustaining the social-professional reintegration of the inmates. The expected result by reaching this goal is to ensure the organizational and functional regulatory framework so as to support inmates in the post-detention stage to assume and exercise autonomous social roles. STRATEGIC OBJECTIVE I Developing the institutional and inter-institutional capacity in the social reintegration domain intended to prisoners and former prisoners 1.1. Training and professional training of the personnel involved in the social reintegration domain affected to detainees. Deadline: annually, 1 year after the approval of the Strategy; Result: Personnel with a high level of professional training and specialization, from the perspective of an integrated approach in terms of the reintegration process of the inmates; 1.2. Institutional and inter-institutional infrastructure development Deadline: until the end of implementing the Strategy; Result: an up-graded institutional and inter-institutional infrastructure that supports the integrated approach of the social reintegration process of the inmates. 1.3. Analysing and, from case to case, modifying or filling the regulatory framework intended for assuring the continuity of the services provided to the inmates, as amended and supplemented. Deadline: periodically, until the end of implementing the Strategy (2019); Result: a common regulatory framework, ensuring the continuity of the services provided to the inmates, as amended and supplemented. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY 1.4. The development, reviewing and implementation of some institutional procedures referring to the involvement and collaboration of the local and central public authorities in the social reintegration process. Deadline: until the end of implementing the Strategy; Result: A developed and implemented institutional procedures handbook/manual . STRATEGIC OBJECTIVE II Developing educational, psychological and social assistance programs during detention and informing the public as well 2.1. Improving the education, psychological and social assistance insured to the inmates. Deadline: until the end of implementing the Strategy (2019); Result: Inmates with abilities, skills and educational, psychological and social competences that rise up their social reintegration chances. 2.2.Raising public awareness and sensitivity on the issue of the social reintegration of the inmates. Deadline: until the end of implementing the Strategy (2019); Result: an informed and sensitized public on the need of socially reintegrating the inmates. STRATEGIC OBJECTIVE III Facilitating post-prison assistance at a systemic level 3.1. Developing and strengthening partnerships between local and central public authorities and institutions, nongovernmental associations and organizations and local communities, so as to facilitate the social reintegration of the former inmates; Deadline: until the end of implementing the Strategy (2019); NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY Result: protocols and partnership agreements, signed, of, from case to case, amened and supplemented. 3.2. Ensuring the continuity of the interventions for the former-inmates by taking over the cases and providing assistance in the post-detention stage. Deadline: until the end of implementing the Strategy (2019); Result: Cases included in an integrated support circuit. 3.3. Analysing and, from case to case, modifying or filling the regulatory framework concerning the establishment, organization and functioning of social enterprises intended to create jobs for vulnerable groups, inclusively for former inmates. Deadline: 2 years after the approval of the Strategy; Result: a developed and implemented regulatory framework. 3.4. Analysing and, from case to case, modifying or filling the regulatory framework concerning the establishment, organization and administration of the social inclusion centres. Deadline: 2 years after the approval of the Strategy; Result: a completed and implemented regulatory framework. 3.5. Analysing and, from case to case, modifying or filling the regulatory framework needed in stimulating the involvement of the local public administrations, economic operators and other individuals or legal persons (legal entity), public or private, in sustaining the social-professional reintegration of the inmates. Deadline: 2 years after the approval of the Strategy; Result: a developed and implemented regulatory framework. GENERAL PRINCIPLES NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY The implementation of this Strategy is based on models of good practice highlighted at an international and European level in the field of the social reintegration of the inmates and it is subsumed to the following general principles: The principle of participation and transparency- all parties involved contribute effectively to implementing the Strategy. The civil society is being informed on the implementation process. The principle of continuity and coordination- during the implementation of the Strategy there are assured both updating current policies at a sector level and coordination with other initiatives. The principle of responsibility- implementing the current Strategy is a process oriented to achieving results. The responsibility of achieving the desired results belongs to all the parties involved. The principle of ensuring public security and citizen safety- in implementing this Strategy, there is aimed to increase the public confidence in the undertaken recuperative efforts, subscribed to the educational function of custodial sentences. The principles of orientation towards individuals- in implementing this Strategy, during the successive stages of the social reintegration process, interventions are customized according to the identified individual needs. The principle of cooperation, coherence and multi-disciplinarity - in implementing this Strategy, institutional partners cooperate, according to the provided responsibilities in the successive stages of the social reintegration process, so as ensuring a coherent and multidisciplinary approach in materializing all the activities subscribed to the assumed objectives. The process of deferring inmates’ legal rights and the confidentiality of personal data- in implementing this Strategy, the institutional partners assure the deference of all legal rights and fundamental liberties of the inmates, with the requirement of protecting their personal data. The principle of ensuring efficiency in resource use and allocation- in implementing this Strategy, there is aimed to obtain the highest results using the allocated resources. The principle of promoting equal opportunities in accessing the promoted measures in order to facilitate social reintegration- there are provided the conditions for accessing regenerative approaches and the promoted measures in this Strategy, for each inmate, considering their specific individual needs. The principle of the activities’ sustainability- this Strategy claims for an integrated and sustainable post prison assistance services in community. MONITORING, EVALUATING, REVIEWING The tool which ensures the implementation of this Strategy is ‘The National Implementation Plan’ that contains the strategic goals and specific objectives, activities, deadlines, people in charge and result indicators. NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY Monitoring and reporting the implementation of this Strategy is performed by the Inter-ministerial Commission, according to the specific regulations, based on The National Implementation Plan. By monitoring the Strategy it is aimed to analyse the achievements of this Strategy, reflected in the Annual Monitoring Report. By evaluating this Strategy there is aimed to assess the impact of the targets’ achievement. The result of the activity evaluation takes the form of an intermediary and final evaluation report. The revision of the Strategy is based on the interim evaluation report. The final evaluation report leads to the formulation of some proposals intended to strengthen the regulatory framework , established in this Strategy. By reviewing the Strategy, based on the influences of the intern and extern factors, there is aimed to continuously adapt the objectives, activities and resources so as to achieve the targets. By incarnating the objectives and activities prefigured in this Strategy, each responsible local and central public institution or authority has to assure their transposition in its own specific schedule documents. BUDGETARY IMPLICATIONS Budgetary implications are estimated depending on the financial resources allocated to each goal/strategic objective and their subscribed activities. LEGAL IMPLICATIONS Implementation of the "National Strategy for the social reintegration of persons deprived of liberty” implies, in terms of legal implications, the followings: 1) Analysis of the regulatory framework to ensure continuity of services offered in the field of social reintegration: Studies highlight effective practices in other European countries and recommends completion of certain legal provisions applicable in the field of social inclusion, social care and employment, to improve access of inmates and people who served custodial sentences at a broader range of social services and administrative facilities compared to what is available at the present time. - Law no. 76/2002 regarding the system of unemployment insurance and the stimulation of job occupation, with subsequent amendments and additions; - Law no. 116/2002 regarding the prevention and fighting against social exclusion, with subsequent amendments and additions; - Government Decision no. 377/2002 for approving the measures for granting access to measures of stimulating job occupancy, with subsequent amendments and additions; - Government Ordinance no. 129/2000 on adult vocational training, republished, with subsequent amendments and additions. 2) Review and, if necessary, amending and completing the necessary regulatory framework regarding: - establishment, organization and operation of social enterprises for creating jobs for vulnerable groups, including people who served custodial sentences; NATIONAL STRATEGY FOR SOCIAL REINTEGRATION OF PERSONS DEPRIVED OF LIBERTY - establishment, operation and administration of social inclusion centres (e.g. development of minimum, specific standards); - stimulating the involvement of local governments, economic agents, individuals, businesses, the public and private, to support the social reintegration of the inmates.
