Information on ‘How to Enter/Bid’ and the prize form part of these Conditions of Entry. All persons submitting a bid and participating in this Auction are deemed to have accepted these Conditions of Entry. Bidders must be at 18 years or older and are responsible for ensuring his or her familiarity with the Terms and the Conditions of Entry at the time of participation and before placing a bid. 2. These Conditions of Entry are drafted in accordance with The Australian Consumer Law (ACL) and the Competition and Consumer Act 2010. Decisions in relation to any aspect of these Conditions of Entry and the Auction is final and binding on every person who enters / bids. No correspondence will be entered into. Annie Smithers is responsible for determining whether a person is an eligible bidder. The final bid will be confirmed and the money received in trust before the ‘winning bid’ is announced. PROMOTIONAL PERIOD 3. The Auction commences 08 September 2014 at 00:01 AEST (Australian Eastern Standard Time) and final bids close 18 November 2014 at 23:59 AEDST (Australian Eastern Daylight Savings Time). PRIZE 4. Prize: Annie Smithers will prepare and cook Christmas Lunch for up to a maximum of 20 people. The Lunch includes all food, the lunch does not include any beverages or alcohol. Food, travel and other basic costs will be taken from the final sum, wages will not be taken from the sum. All profit* will be donated to The Florey Institute. (see condition 14). 5. The “Christmas Lunch by Annie Smithers” will be awarded to the highest bidder. 6. The winning bid will be confirmed and money received in trust, prior to the formal winners announcement on 25 November 2014. Winner may opt to have their personal details disclosed under the Australian National Privacy Principles in the Privacy Act 1988. 7. TO ENTER: Visit www.dufermier.com.au and follow the prompts to place your bid. Participants may place as many bids during the campaign as they wish. All required details (name, age, email address, phone number) must be filled in to qualify. Bid updates will be published on Annie Smithers’ website; dufermier.com.au each week. The bids will be updated each day for the final 3 days of bidding. 8. The winner will then have their prize confirmed in writing by email. 9. Decisions made by Annie Smithers in relation to any aspect of these Conditions of Entry and the Auction are final and binding on every person who enters. No correspondence will be entered into. ENTRY REQUIREMENTS & VERIFICATION: 10. All bids may be subject to verification by Annie Smithers, including documents to establish eligibility to bid, including but not limited to evidence of age, residence or identity. 11. Annie Smithers may, with absolute discretion, disqualify any participant and declare any or all entries made by a bidder/s invalid if the bidder/s; tampers with the entry process; tampers with the operation of the online auction; or is found to be using multiple aliases or submitting false bids, or acts in a disruptive manner; or fails to establish their entitlement to participate in the auction; or acts in violation of these Conditions of Entry. 12. Entries are deemed to be received at the time of receipt in the auction database and NOT time of transmission by the Entrant. No responsibility will be taken for late or misdirected bids. Incomplete, indecipherable or illegible bids, bids which are not in the required format or which contain offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to be included in the auction. ANNIE SMITHERS CHRISTMAS AUCTION BIDDING FORM 13. Response times may vary and are subject to network coverage and availability, the number of bids received and/or other technical problems beyond the control Annie Smithers. LUNCH CONDITIONS: 14. The Lunch includes Annie Smithers and appropriate staff (if required) attending the home of the highest bidder to prepare and cook Christmas Lunch on the 25 December 2014. The lunch includes all food only. The winning bidder must provide a kitchen and dinnerware, cutlery, etc for lunch to be served. The travel costs to and from the winning bidders home and basic food costs will be taken from the winning sum. All remaining profits will be donated to the Florey Institute towards neurological research. 15. The “Christmas Lunch Prize” must be taken as stated. It is not transferable or exchangeable and cannot be taken as cash. It cannot be sold, scalped, auctioned, raffled, pledged, or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If a prize is obtained through any of these methods, it will not be honored. 16. Unless expressly stated within these Conditions of Entry, all other expenses become the responsibility of the winner. In the event that for any reason the winning bidder does not take the whole or part of the prize, then that whole or part of the prize will be forfeited by the winner. Neither cash nor other form of compensation will be supplied in lieu of the forfeited whole or part of the prize. REPRESENTATIONS / EXCLUSIONS OF LIABILITY 17. These Conditions of Entry do not exclude or limit the application of any statutory provision; including a provision of The Australian Consumer Law (ACL) and the Competition and Consumer Act 2010. If for any reason the Christmas Lunch is unable to be redeemed, the winner will receive a prize, as determined in the absolute discretion of the Promoter of equivalent value. If a the winning bid is deemed not to comply with the terms and conditions, the bid will be declared invalid and the next highest bid will be awarded Christmas lunch prize. GENERAL: 18. If for any reason the Auction is not capable of running as planned, including because of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond control, which corrupt or affect the administration security, fairness, integrity or proper conduct of this auction, Annie Smithers reserves the right to cancel, terminate, modify or suspend or recommence the auction. 19. CAUTION: Any attempt to deliberately undermine the legitimate operation of this Auction may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, Annie Smithers reserves the right to refer the matter to law enforcement authorities and/or to seek damages or such other civil remedies as the Promoter may determine from time to time to the fullest extent permitted by law. PERSONAL INFORMATION: 20. This auction is bound by the Australian National Privacy Principles in the Privacy Act 1988. All entries become the sole property of Annie Smithers. Personal information may be used by Annie Smithers and du Fermier for the purpose of conducting this auction. All Entrants consent to the storage of their Personal Information on Annie Smithers’ / du Fermier’s database and this may be used for future promotion, marketing and publicity purposes. Entrants' personal information may be passed to contractors to assist in conducting this auction only. 21. Entrants can request access to update or correct their Personal Information held by du Fermier, ‘optout’ of receiving information via the website, or request that they not receive further promotional communications by contacting du Fermier via email or their website. Should an entrant’s contact details change during the promotion period, it is the entrant's responsibility to notify changes. 22.
