Whilst exclusion is always to be regarded as a strategy of last resort, the Principal is
entitled to exclude a learner from school if there is a foreseeable risk of the learner
endangering the learner or other learners or staff or, in some cases damaging
property. When possible, twelve hours’ notice will be given to the parents and the
Local Authority.
If a learner is excluded from the school they will need to attend a reintegration
meeting with their parents or carer. This meeting is held by a member of Senior
Leadership Team (SLT) and takes place to ensure the school is confident that the
incident will not take place again and that appropriate support is in place to ensure
this.
Any learner that has had two or more exclusions in one term of a placement will
have their placement classed as at risk and a placement meeting will be arranged by
the school. The aim of the meeting would be to determine whether continued
placement at the school would be in the best interest of the learner and the school.
If it is deemed that the learner’s placement would not be in the best interest of the
learner and the school, the school will work with the placing authority to ideally give
at least six weeks’ notice to the parents and placing authority that the school is no
longer meeting the learner’s needs and that alternative arrangements may need to
be considered. However if a placement puts the security, well-being and health and
safety of the staff, learners and/or school stakeholders at risk then the school may
give as short as two weeks’ notice to hold an emergency placement meeting.
Baston House School is an independent school and the decision of an independent
school to exclude a learner is not open to any public law remedy. The Department of
Education (DfE) guidance on exclusions does not apply at independent schools.
Annual Review Meetings will remain the usual mechanism for identifying and
ensuring appropriate provision.
