ARTICLE 3, Application
These laws are applicable to:
a) Every person operating RPAS with weight over 4.4Lbls (2kg) under 55Lbs
(25kg)
b) Every person operating RPAS with weight under 4.4Lbs (2kg) (even
recreational)
c) Every agent or entity from the Dominican state operating RPAS in military
activities of public interest. (Security, health, firefighting, civil defense,
agriculture, etc.)
d) RPAS operators to which this law is not applicable must get a special
authorization from IDAC. (Appendix C)
e) Every person or entity that desires to hire the services of RPA operations
must hire a person that has authorization from the department of operations
of the Direccion the Normas de Vuelo (DNV) of IDAC
-This is a temporary resolution and will be applicable until IDAC sends a new
resolution, regulation or if the ICAO adopts and publishes regulations over the
technical requisites related to the operation of RPASARTICLE 4, Technical characteristics of RPAS
a) The maximum takeoff weight (MTOW) will be up to 55Lbs (25Kg) including
accessories, but not considering parachute weight, if it has one.
b) The rotors used for RPAS must be made from flexible materials that in case of
impact would break. In case of multi-rotor RPAS the rotors must have a
protection system.
c) The RPAS must be factory built and must have technical and operation
instructions.
d) The RPA can have an emergency parachute.
e) The RPA must be operated manually and you must maintain line of sight.
Chapter II. GENERAL RULES
ARTICLE 5, RPAS with weight over 4.4Lbs (2KG)
Every person or entity that wants to operate RPAS with weight over 4.4LBs (2KG),
must obtain previously an authorization from the Department of Operations of IDAC
for which it must demonstrate that:
a) Registry card of the RPA (given by IDAC)
b) Sworn declaration of social responsibility, which is only needed when there
is more than one person or entity involved in the operation of RPA, either as
proprietary, operator or contractor of the services. (Appendix A)
c) Credentials of the operators
d) Proof of insurance.

I. Once obtained, the authorization is valid as long as it is not renounced,
suspended or canceled by IDAC. The failure to comply partially or totally with
the contents of this resolution will cause the suspension or cancelation of such
authorization.
II. Every person or entity that wishes to operate RPAS must have obtained
previously a credential of operator as established on chapter 4 of this
resolution.
III. Every person that operates an RPA must have in person:
a. Credential of operator of RPA.
b. Authorization of operation or RPA issued by IDAC.
c. Registry card of the RPA.
ARTICLE 6, Rules of operation of RPA
Every person or entity that operates RPAS must:
a) Operate in visual meteorological conditions (VMC) and maintain line of sight.
b) Assure before the flight that the RPAS and control system are in safe
operating conditions.
c) May operate in class G airspace without ATC authorization.
d) Not exceed, during the total flight time or operation, 80% of the autonomy
established by the manufacturer, or last more than 60 minutes. The transfer
of controls must not be done with the RPA in flight.
e) Maintain 20m (66ft) of vertical separation and 30m (99ft) from obstacles and
people not involved in the operation during the take off, landing phase and
during flight without posing a risk in the operation according to the
characteristics of the RPA.
f) Maintain separation with other RPAS in the area and coordinate with the
other operators.
g) Give right of way to manned aircraft during its phases of flight as well as
maintaining separation with such aircraft.
h) Not operate between sunset and sunrise unless the RPA has a lightning
system such as the one required by IDAC for aerial navigation obstructions,
and can be seen at least 1NM (1852m) away.
ARTICLE 7, Restrictions to operations of RPAS of weight more than 4.4Lbs (2Kgs)
Every operator of RPAS during the operation will not:
a) Put in risk the life or safety of people or public and private property.
b) Violate the rights of other people in its privacy.
c) Operate recklessly or dangerously that will post a risk to other aircraft in the
ground or in the air.
d) Operate at a distance of less than 5NM of the extension from the edge of a
runway or at a total distance of less than 5NM parallel to the edge of a
runway of an airport.
e) Unless previously authorized by the controlling authority, operate in
prohibited, restricted or dangerous zones published by the IDAC in the
following website,

f) Operate without checking valid NOTAMS published by IDAC and available
online or in the FIS offices of airports.
g) Operate more than one aircraft and or RPA simultaneously.
h) Operate at night without special authorization.
i) Operate at a distance of more than 500m (1650ft) from a visual slope and an
altitude of more than 121m (400ft) from the surface of the operator.
j) Throw objects from the air.
k) Operate under the influence of drugs and or alcohol.
l) Operate in fire areas where firefighting aerial services are in operation.
m) Operate in class A airspace.
n) Operate in class B, C or D or under the lateral limits of the surface of class E
without previous authorization from ATC.
o) Operate at a speed over 87Knt (100Mph).
p) Maintain a visibility of less than 3SM (5Km) from the control station.
q) Operate over people not involved directly in the operation.
r) Operate from a vehicle or aircraft in movement unless its from a water
vehicle.
s) Operate negligently or imprudently.
t) Operate knowing or has reason to know of any physical or mental condition
that might interfere with the safety of the operation.
u) Pose a danger or a threat to other people or properties.
v) Allow dropping objects that pose a risk to people or property in the surface.
ARTICLE 8, RPAS with weight under 4.4Lbs (2Kg)
Every person or entity who wishes to operate RPAS with weight of less than 4.4Lbs
(2.2Kgs) will not need previous authorization from the department of operations of
IDAC, but it must meet the following:
a) The RPA must be built of flexible materials that in case of impact can break or
bend representing minimal threat to any person or object.
b) The RPA must be operated manually and must keep within line of sight and
cannot exceed 1500ft (455m) of distance from the operator.
c) Every RPA operation must be under visual meteorological conditions.
d) The operator of the RPA must assure before the flight that the RPAS and
control system are in safe operating conditions.
e) Operations are limited to class G airspace only.
f) It is the responsibility of the operator to assure the safe operation of the RPA
according to the characteristics of the RPA.
g) It is the responsibility of the operator to maintain separation with other
RPAS in the area and coordinate with the other operators.
h) The RPA must not exceed 30Knt of speed and an altitude of 400ft (121m)
over terrain. RPA must also maintain a distance of no less than 5NM of any
airport.

ARTICLE 9. State RPAS
Every agent or entity from the Dominican state operating RPAS on activities of
border patrol, police, firefighting, security support, rescue mission support, fishing
patrol, meteorological surveillance, military or intelligence operations, reckoning,
support to natural disaster or other operations similar to the ones stated may:
a) Regulate its own flight operations of RPAS
b) Regulate the locations from where the RPA takes off, lands or is operated.
c) Coordinate with the Direccion de Navegacion Aerea (DNA) of IDAC when the
operations might interfere with the civil aerial operations.
CHAPTER IV. Credentials of operator
Article 12. Operator credentials
Every owner of an RPA with weight over 4.4Lbs (2Kg) but less than 55Lbs (25Kg)
must get an RPA operator credential issued by IDAC.
- For obtaining the operator credential, the owner must do all the procedures
through the Departmento de Licencias Aeronauticas (DLA) from the
direction of flight regulations of IDAC.
ARTICLE 14. Requirements for obtaining an RPA operator credential
To obtain an RPA operating credential you must:
a) Be at least 18 years of age
b) Be able to read, speak and understand Spanish.
c) Provide a simple sworn declaration of instruction received and practice
respecting the RPA model that will be operated (Appendix B)
d) Pass a written exam for aeronautical knowledge concerning RPA operations,
the minimum passing grade is 70%.
ARTICLE 15. Responsibility of holder of RPA operator credential
The holder of the RPA operator credential must operate the RPA only in lane of sight
conditions according to the stated in the regulation.
ARTICLE 16. Duration and renewal of RPA operator credential
The duration of the credential of RPA operator is 24 months.
In order to renew the credentials the holder must pass a written exam for
aeronautical knowledge concerning RPA operations with a minimum grade of 70%
ARTICLE 17. License conversion
The IDAC might accept an RPA license conversion or license applicable to the
operator of RPA that has obtained a license in a different country or from a different
issuing agency.

CHAPTER V. Responsibilities and sanctions
ARTICLE 18. Responsibilities of RPA operator
Every person or entity involved on the operation of RPAS must meet with all the
dispositions, legal requirements, taxes, municipal, health, environment or insurance
that the public entities require according to the respective regulations.
ARTICLE 19. Sanctions
Any violation of the dispositions contained on this regulation, the law of civil
aviation, the aeronautical regulations or airport regulations will be sanctioned by
the IDAC through the department of administrative sanctions and the division of
safety as stated by the Reglamento Aeronautico Dominicano (RAD 20) and the
inspectors manual for the application of RAD 20 (IDAC 4000). All this without the
detriment of the sanctions imposed by the authority,in case of harm to a third party.
