Terms and Conditions
1.
Information on how to enter forms part of the terms and conditions ("Terms and Conditions"). Entry into "Ricky’s
Biggest Game of Cricket Competition" ("Competition") is deemed acceptance of these Terms and Conditions. This
Competition is not valid in conjunction with any other offer.
Competition Period
2.
The competition commences on Monday 15 August 2016 at 9:00 am AEDT and closes on Friday 9 December 2016 at
5:00 pm AEDT (“Competition Period”).

The Competition will be advertised on, but not limited to, the Ponting Foundation website - pontingfoundation.com.au,
Facebook page @pontingfoundation and Twitter site @PontingFdn.
Eligibility to Enter

Entry is open to all residents of Australia who purchase a ticket to Ricky’s Biggest Game of Cricket (via the approved
entry manner described in clause 6), an event to be held in Launceston on Saturday 27 January 2017 (“the Event”).
However, employees and the immediate families of the Ponting Foundation Ltd, 1/189 Rouse St, Port Melbourne VIC
3207, (ABN 60 479 686 852) (“Promoter”) and its associated agencies and companies, or any organisation or individual
associated with the provision of the Major Prizes, are not eligible to enter.

All entrants must be available on the evening of 27 January 2017.
How to Enter
6.
To participate in the Competition, entrants must purchase a ticket (or tickets) to the Event online on the Ticketmaster
desktop website by Friday 9 December 2016 at 5.00pm AEDT (“Purchase”).
7.
Tickets purchased from Ticketmaster agencies or via its mobile app will not provide entry to the Competition.
8.
When purchasing a ticket online through the Ticketmaster website in accordance with paragraph 6 of these Terms and
Conditions, purchasers will be asked to nominate a team that they will be following at the Event (“Team Category”).
The Team Category will dictate which team the winners represent.
9.
One winner will be randomly selected by the Promoter from purchasers who nominate Hawthorn. One winner will be
randomly selected by the Promoter from purchasers who nominate North Melbourne.
10. You are not required to make a donation or raise funds for a valid entry, however, we encourage you to raise funds for
the Ponting Foundation Ltd at your discretion.
11. This is a game of chance; skill plays no part in determining the Winners. The Promoter’s decision in relation to any aspect
of the competition will be final and binding on every person who makes a Purchase. No correspondence will be entered
into.
12. A Purchase that does not comply with these Terms and Conditions will be deemed invalid.
13. The time of each Purchase will, in each case, be the time that each Purchase is successfully made in accordance with
paragraph 6 of these Terms and Conditions. The Promoter accepts no responsibility for any late, lost or misdirected
Purchases due to technical disruptions, network congestion or for any other reason.
14. Each valid Purchase received during the Competition Period will be eligible for selection of one of the Major Prizes
within their nominated Team Category.
15. The Major Prizes will be awarded to the two Winners. However, in a dispute, a Major Prize will be awarded to the
account holder of the telephone or email account used to submit the winning purchase. The Winners will be contacted
via their respective telephone numbers or email accounts and will be requested to verify their details (including date of
birth and address).
16. Should purchasers’ contact details change during the Competition Period, it is the purchaser’s responsibility to notify
the Promoter. A request to access or modify any information provided should be directed to the Promoter. The
Promoter accepts no responsibility for inability to contact a winner because a purchaser has not notified the Promoter
of a change in contact details during the Competition Period.
17. All reasonable attempts will be made to contact each Winner. As the Major Prize is event based, if the Winner(s) does
not respond to the Promoter’s request to claim the prize and the prize(s) remain(s) unclaimed by the Winner(s) or
unallocated or forfeited for any reason, by Friday 16 December 2016 at 2:00 pm AEDT, the Major Prize(s) will be reallocated to the purchaser(s) drawn from the Purchases excluding the purchaser(s) who has/have failed to claim the
Major Prize(s) (“Unclaimed Prize Winner(s)”).

19. The Winner of Major Prize #1 will represent the Hawthorn team. The Winner of the Major Prize #2 will represent the
North Melbourne team.
20. The Winners will be required to attend the Event at their own cost. All travel and accommodation costs are the
responsibility of the Winners. Any ancillary, additional or incurred costs associated with redeeming a Major Prize are
not included. All ancillary costs and other expenses including meals for the Winners and their guests are the
responsibility of the Winners.
21. The Promoter may invalidate a Winning Entry if the Winner(s) is/are no longer able, for any reason, to attend the Event.
22. Prizes are strictly non-transferrable and non-negotiable, and may not be replaced or refunded.
23. By accepting a Major Prize, the Winners agree they are subject to any, and all, terms and conditions of the Promoter.
24. The Promoter makes no representation as to the safety conditions or other issues that may exist during the Event.
25. If a Major Prize is unavailable, for whatever reason, including due to adverse weather on Friday 27 January 2017, the
Promoter reserves the right to withdraw the Major Prize and the Major Prize is forfeited by the Winners in full and no
compensation will be made subject to state regulation.
26. A Major Prize must be taken as offered. A Major Prize, or any unused portion of a Major Prize, are not exchangeable or
cannot be redeemed as cash. The Promoter accepts no responsibility for any variation in a Major Prize.
General Provisions
27. If for any reason this Competition is not capable of running as planned, including due to infection by computer virus,
bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter,
which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the
Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take
any action that may be available, and subject to any written directions from a regulatory authority, to cancel, terminate,
modify or suspend the Competition.
28. If your Entry is selected as a winning Entry, validation of your Entry will be undertaken by the Promoter. Methods of
validation (without limitation) will be determined by the Promoter in its complete discretion. If an Entry is judged to be
a winning Entry, the Winner will be notified as per the terms and conditions herein.
29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory
consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied
warranties under similar consumer protection laws in the State and Territories of Australia (“Non-Excludable
Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the
Promoter (including its respective officers, employees and agents) each excludes all liability (including negligence), for
any personal injury; or loss or damage (including loss of opportunity); whether direct, indirect, special or consequential,
arising in any way out of the Competition.
30. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter
(including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for
any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under
the Promoter’s control); (b) any theft, unauthorised access or third party interference: (c) any entry or prize claim that
is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason
beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and
Conditions; (e) any tax liability incurred by a Winner or entrant; or (f) use of the prize.
31. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to
any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to
the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a
regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
32. The Promoter collects personal information about you to enable you to participate in this Competition but no further
use of this information will be made without prior consent.
33. In consideration for the Promoter awarding the prize to the Winners, each Winner hereby permits their image and/or
voice, as recorded, photographed or filmed during their participation in the prize to appear in connection with Ricky’s
Biggest Game of Cricket and the Ponting Foundation or the advertising or marketing thereof, in any media whatsoever
throughout the world and the Winners will not be entitled to any fee for such use.
34. You consent to the Promoter collecting your personal information for the purpose of conducting and promoting this
Competition (including but not limited to determining and notifying the Winners and prize fulfilment). Your personal
information may be disclosed to third party service providers for this purpose. Your personal information including the
Winners’ names may be published on the Ponting Foundation’s website. For purposes of public statements and
advertisements The Promoter will only publish the respective Winner’s surname, initial and State. A request to access,
update or correct any information should be directed to the Promoter. If you are not willing for this to occur you cannot
participate in the Competition.
35. The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering the
Competition, you (the entrant) are taken to consent to the Promoter's privacy policy which contains information,
amongst other things, about how you may access personal information that is held by the Promoter about you and seek
correction of such information. See http://pontingfoundation.com.au/privacy-policy/ to view the Ponting Foundation’s
APP Privacy Policy in full. Our APP Privacy Policy also contains information about how you may complain about a breach
of the APPs, or a registered code that is binding on our organisation and how the Ponting Foundation Limited will deal
with such complaints. We may disclose your personal information to related entities and third party service providers
outside Australia.
36. The words “include”, “includes” and “including” are not words of limitation in these Terms and Conditions.
