REPUBLIC OF ALBANIA THE ASSEMBLY The commission regarding Legal issues, Public Administration and Human Rights Assembly document REPORT ON THE HEARING SESSION HELD WITH THE PRESENCE OF THE INSPECTOR GENERAL OF THE HIGH INSPECTORATE OF DECLARATION AND AUDIT OF ASSETS FOR THE 2009 ACTIVITY The commission regarding Legal Issues, Public Administration and Human Rights, in its meeting of 01/04/2010, held the hearing session concerning the reporting of the High Inspectorate of Declaration and Audit of Assets, which is a legal obligation pursuant to article 39 of the law no 9049, dated 10/04/2003, "on declaration and audit of assets, of financial liabilities of those elected and of some public officials", amended. The Inspector General Mr. Adriatik Llalla, who participated in this meeting, submitted to the members of the commission a summary of the annual report of the institution. The commission heard also the report about the activity of this institution which was presented by the relator Mr. Genti Strazimiri. The members of the commission made numerous questions and held discussions regarding the submitted report and about the 2009 activity of HIDAA. The commission, in compliance with article 103 of the Assembly Regulation, discussed about the Draft Resolution presented by the relator of the commission in cooperation with the Monitoring Service of Independent Institutions, and after approving it, decided to submit it to the plenary session for approval according to the text attached to this report. RESOLUTION ON THE WORK ASSESSMENT OF THE HIGH INSPECTORATE OF DECLARATION AND AUDIT OF ASSETS FOR 2009 The Albanian Assembly, - - - Taking into consideration the fight against corruption and the conflict of interests as one of the major challenges and a priority of this majority; Reaffirming the irreplaceable role of the High Inspectorate of Declaration and Audit of Assets in disclosing, identifying and preventing the conflict of interests and practises of corruptive enrichment; Assessing the achievements and effective results of the High Inspectorate of Declaration and Audit of Assets in preventing as well as solving cases of conflict of interests and disclosing the attempts of hiding assets, for 2009; Having as its objective that the fight against corruption comes up with clear, strong and irrevocable results, for a full establishment of an anti corruptive culture of governing; Observes that HIDAA, for 2009: - - - Has exercised determinately its legal powers administrative provisions and bringing cases at the Prosecuting Authority, pursuant to the law, against officials who have refused to declare their private interests, who have concealed their assets or have made false declarations or who have violated the law regarding the conflict of interests; Has shown a good will and has become a pioneer in strengthening the interinstitutional cooperation with liable and specialised structures in the fight against corruption and economic crime in the country as well as abroad; Has proceeded with training sessions with entities foreseen by the law, with regard to the settling of the conflict of interest and the declaration of assets aiming in this way to enhance performance of the administration officials in central and local institutions. For 2010 it requires that: - HIDAA should strengthen, hereinafter, the capacities for the administration of the conflict of interest in public institutions; It should recommend the necessary amendments in legislation in settling juridical - - - - - consequences deriving by situations of conflict of interests and punishing officials or people involved, who are responsible for this conflict of interest; It should strengthen public relations as well as promoting its activity, with the purpose of making people aware and educating them through law enforcement examples and also increase the public trust in the efficiency of its anti corruptive mechanisms; It should strongly and determinately require from the authorities of penal prosecution the effective proceeding of officials disclosed by it of being involved in conflict of interest or in assets’ concealment; It should publicly or directly inform the Assembly about cases when liable authorities, correspondingly the General Prosecution, the High Council of Justice or the Ministry of Justice neglect work or have a low performance in prosecuting and punishing cases of conflict of interest or assets’ concealment that have been disclosed by it; It should strengthen instruments of administrative investigation, especially in public life sectors, in which corruption is more expanded and the public trust is lower; It should proceed with the strengthening of cooperation and support of the civil society, media and the public at large for providing information with regard to charges about law violation related to the declaration of private assets interests or as well as about cases identifying conflict of interests.
