How Often Should We Change a
Constitution?

– More than 11,000
amendments have been
proposed
– The U.S. Constitution has
been amended only 17
times since the first 10-which make up the Bill of
Rights-- were ratified in 1791.
• More than 120 amendments
since 1968
– Amendments are integrated
within specific Articles as
opposed to listing at the end of
the document. .

Who decides?
• The voters decide if a proposal is added to the Florida
Constitution.
• Requires 60% of voters to approve the proposal (Article XI,
Section 5(e) Florida Constitution).
– Changed from a simple majority (50%+) approval in 2006;
amendment to the FL Constitution sponsored by the FL
Legislature
• Once passed by the voters, it is included in the Florida
Constitution.

What does the Florida Constitution
Revision Commission do?
• Every 20 years the Commission is appointed to:
– Adopt rules of procedure
– Examine the Florida Constitution
– Hold public hearings
– File recommended changes to the Florida Constitution for voter
consideration in next general election (Art. X, Sec 2(c))
• Recommendations are placed directly on the ballot for voter
consideration without automatic judicial review

1977-1978 FCRC
• The 2017-2018 FCRC is the third CRC in state’s history
• First FCRC: 1978
– Chaired by Sandy D’Alemberte
– Eight proposals; none adopted
– 1978 Ballot issues included declaration
of rights (mini ERA), legislative single
member districts and reappointment
commission, executive cabinet
restructuring, merit selection of trial court
judges, and more

1997-98 Commission
• Chaired by Dexter Douglas
• Nine proposals on ballot
• Eight were successful including:
– Creation of fish and wildlife conservation
commission (72% passage)
– Restructuring of state cabinet (56% passage)
