The Maltings, 29 Main Street, Barrowden
Thank you for your letter of 13 July 2016 regarding the Parish Council’s concerns
surrounding the Planning Approval and Discharge of Conditions relating to the above
property.
The Parish Council has considered your response carefully and taken expert advice on the
matter. On the basis of that advice we are advised that Rutland County Council may have
acted unlawfully in its handling of planning and discharge of conditions in respect of the
southern extension.
It is our contention that
1 Approval was never given in writing to the developer to change the roofing material
from artificial Colleyweston to artificial slate tiles. The developer has now
withdrawn that request, opening the way for enforcement of the original
planning condition and thus requiring replacement of the artificial slate tiles.
2 A planning application under Section 73 of the Town and Country Planning Act 1990
should have been requested by the planning authority for the change to slate on
the southern extension, as this was at least a minor change, especially
considering the siting of the Maltings within a Conservation Area and between
two Listed Buildings, including a Grade 2* building.
3 The Section 73 request 2016/0301/FUL was for a small change to wording relating to
the re-use of the original Colleyweston slates and had no bearing on any other
matter.

We therefore wish to raise the complaint to Level 2 of the Rutland County Council
complaints procedure and request that the complaint is heard by someone independent of
the Planning function at Rutland County Council.
