KQKY OVER PLAY OF THE DAY NEBRASKA LOTTERY ON AIR PROMOTION
A complete copy of these rules may be obtained at the offices of KQKY, 2233 Central
Avenue, Kearney, NE 68848, during normal business hours Monday-Friday or by sending a
self-addressed stamped envelope to the above address.
NRG Media, LLC its subsidiaries and affiliated companies (together, the "Company"), will
conduct KQKY HITS 106 OVER PLAY OF THE DAY (the “Contest”) substantially as
described in these rules. KQKY will award the prize and will offer opportunities to win in
other ways than over the radio. By participating, each participant agrees as follows:
The Company may conduct the Contest concurrently and simultaneously on several
participating stations owned and not owned by the Company, and the Company may add or
remove participating stations or change call letters of any participating station at any time
during the Contest as announced on the affected station. NRG Media, LLC d/b/a KQKY and
KQKY, Kearney, Nebraska are participating stations.
Description of Contest/Participation
No purchase necessary. OVER PLAY OF THE DAY CONTEST ON KQKY.
Nebraska Lottery Ticket Promotion: KQKY HITS 106 will promote to on air Listeners chances to win a
daily allotment of $1 Scratch tickets in OVER PLAY OF THE DAY CONTEST. KQKY will announce
the featured song of the day in the 6am Hour of the Murphy in the Morning Show. We will ask listeners
to keep track on how many times the song will play between 6am to 6pm. If the listener is correct on how
many times the song played in the 12 hour period they will win Nebraska Lottery Tickets by the number
of plays multiplied by 10. If the song plays 6 times between 6am to 6pm the winner will receive 60 NE.
Lottery $1 Scratch Tickets. If the song played 10 times they will receive a 100 Scratch tickets. Air talent
will prompt listeners to call. Caller 5 will win if they have correct answer. If they answer incorrect the
next caller will have the chance to win and likewise until a winner has been found.
Contest starts Thursday March 31, 2016 and ends Thursday June 9, 2016. Contest runs Thursdays
only during the contest period. Listeners can only win this contest once during the contest time
frame.
Winner will receive a determined number of $1 Scratch-off tickets from the Nebraska Lottery. Value of
the prizes may vary depending on whether any tickets are winning tickets. Winner may be subject to
taxes depending on the amount of winning ticket(s). Contestants and winner must be 19 to win.
All other NRG Official Rules Apply.
Eligibility and Limitations.
Participants, winner(s) and guest(s) must be legal US residents at least 19 years old as
determined by the Company unless otherwise specified and who reside in the Station’s
metropolitan statistical area as defined by Arbitron. Employees of Station, NRG Media, other
radio stations in Station’s metropolitan statistical area; their affiliates, subsidiaries,
successor companies; contest sponsors, advertising and promotion agencies, contest prize
suppliers, participating advertisers and Immediate Family Members of anyone so situated
are not eligible to participate in any contest on Station. “Immediate Family Members” shall
include spouses, siblings, parents, children, grandparents, and grandchildren, whether as
“in-laws”, or by current or past marriage, remarriage, adoption or guardianship, cohabitation or other familial extension, and any other persons residing at the same household
location, whether or not related. If minors are permitted to participate in the contest, a
parent or guardian of any participant who is a minor at the time of entry must sign a
release on behalf of the minor to be eligible to receive a prize, and Station reserves the
right to refuse to award a prize to or on behalf of a minor.
Contestants and Immediate Family Members of contestants who have won a prize on
Station within the last 30 days are not eligible to participate or win. For contests that extend
beyond 30 days, contestants and Immediate Family Members may win only one prize per
contest level or per contest, depending on the specific promotion. Entries from individuals
who determined to not be eligible to participate will be disqualified.
Winners must provide proof of age, photo identification, and a valid taxpayer identification
number or social security number before any prize will be awarded. Station reserves the
right to deny awarding the prize if the winner fails to provide satisfactory identification, as
determined in Station’s sole discretion. In addition, winner agrees to execute an affidavit of
eligibility, indemnification and release of liability regarding winner’s participation in the
contest and receipt and use of the prize before any prize is awarded. Prizes may only be
claimed at Station’s studio during office hours Monday through Friday between 8:00 am and
5:00 pm, unless alternate arrangements are agreed upon by winner and Station. Winner
assumes the risk of the alternate method of claiming the prize. Prizes cannot be claimed by
a third-party on behalf of the winner. Prize is deemed forfeited if not claimed by winner
within 30 days of winning or within its period of usability. Forfeited prizes will be disposed
of at the discretion of Station management. All federal, state and local laws and regulations
apply. Winner is solely responsible for all federal, state and local taxes including any sales
taxes. Prior to the delivery of any prize, Station reserves the right to collect from the winner
any taxes or fees it deems appropriate. Any person winning over $600 in prizes during any
one year period will receive an IRS form 1099 at the end of the calendar year, and a copy of
such form will be filed with the IRS. Any additional costs relating to the prizes, and incurred
as a result of accepting the prizes, are the sole responsibility of the winner. Failure to
execute any required documents or comply with any of the terms will result in forfeiture of
the prize.
Publicity; Use of Personal Information.
By participating, all participants and winner(s) grant the Company exclusive permission to
use their names, characters, photographs, voices, and likenesses in connection with
promotion of this and other contests and waive any claims to royalty, right, or remuneration
for such use. By participating in the Contest, participants agree that the Company may
disclose to third parties personal information obtained from participants in the Contest,
including but not limited to name and city of residence, and use such information for
marketing and other purposes on a worldwide basis in perpetuity.
All entry blanks, forms devices and materials, as well as all the information contained on or
within, gathered during the course of entry, shall become the sole property of the Company
to be used, disposed of or destroyed at the discretion of the Company. Such use may
include, but is not limited to, enrolling entrant in one or more of the Company’s listener
clubs and sending entrant correspondence and solicitations with regard to such clubs.
Further NRG Media, LLC is not responsible or lost, mutilated, illegible, misdirected, late,
stolen, incorrect or incomplete entries. KQKY and NRG Media are not responsible for any
deletion, defect, delay in operation or transmission, or communications line failure.
Release.
By participating in the Contest, each participant and winner, their heirs and assigns
indemnifies, holds harmless and waives any and all claims of liability against the Company,
NRG Media LLC, Nebraska Lottery, parent, related, affiliated and subsidiary companies and
their employees, agents, members, affiliates, officers, volunteers or sponsors of each, the
Contest's sponsors and their respective employees and agents, for any claim, demand,
cause of action, personal injury, death or loss which may occur from the conduct of, or
participation in, the Contest, or from the use of any prize. In order to receive a prize,
participants must sign an official waiver form provided by the Company.
Conduct and Decisions.
By participating in the Contest, participants agree to be bound by the decisions of Company
personnel. Persons who violate any rule, gain unfair advantage in participating in the
Contest, or obtain winner status using fraudulent means will be disqualified.
Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited, and
anyone behaving in such manner will be disqualified from entering the contest and asked to
leave any event associated with the Contest. The Company will interpret these rules and
resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest
and the Company's decisions concerning such disputes shall be final. If the conduct or
outcome of the Contest is affected by human error, any mechanical malfunctions or failures
of any kind, intentional interference or any event beyond the control of the Company, the
Company reserves the right to terminate this Contest, or make such other decisions
regarding the outcome as the Company deems appropriate. All decisions will be made by
the Company and are final. The Company may waive any of these rules or terminate the
contest in its sole discretion at any time. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER
INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND
NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITE, OR
UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL
AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE
RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPATE TO THE FULLEST EXTENT
PERMITTED BY LAW.
9. Miscellaneous.
Each winner must submit proof of eligibility and sign the Company's release form to claim
the prize. No purchase necessary to participate or win. Void where prohibited. Odds of
winning depend upon the number of participants. The Company may substitute prizes,
amend the rules or discontinue the Contest at any time as announced on the Station(s). The
Company disclaims any responsibility to notify participants of any aspect related to the
conduct of the Contest. Written copies of these rules are available during normal business
hours at the business offices of the Station(s) and by mail upon written request with a
stamped, self-addressed return envelope. All entries become the property of the Company
and will not be returned. To be removed from our direct mail, email or fax lists, visit the
main office of the Station during regular business hours, or send a self addressed stamped
envelope with contest name to (Company address)
10. Compliance with Law.
The conduct of the Contest is governed by the applicable laws of the Unites States of
America, which take precedence over any rule to the contrary herein. Station(s) shall follow
the applicable laws for conducting contests, including notice to the state attorney general or
consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific
on-air disclaimers, providing specific written information about the Contest, etc. as required
by local and state law.
