Prior to any path works Landscape Plans showing the retention and reconstruction of the Concrete Channel for the east –west diagonal path and the retention, repair and reconstruction of the three red Brick Channel for the north-south path is to be provided and when endorsed by the Executive Director will form part of this permit. The Edge Type 3 detail is not approved. 2. Prior to the construction of the asphalt path and brick channel between trees 34 and 36 (Brachychiton populneus) a cross section of the path and channel to the edge of the Tree Protection Zone is to be provided showing existing levels and final levels to comply with Root Investigation comments regarding root protection and removal of excessive fill, and when endorsed by the Executive Director will form part of this permit. 3. From the commencement of works a Tree Report on the condition of trees 34, 35 36 and 37, and compliance with the endorsed Arboricultural Advice prepared by Treelogic is to be prepared at 4 Heritage Act 1995 4. 5. 6. 7. 8. 9. monthly intervals and provided to the Executive Director and when endorsed will form part of this permit. This permit shall expire if the permitted works have not commenced within two (2) years of the date of issue of this permit, or are not completed within four (4) years of the date of issue of this permit unless otherwise agreed in writing by the Executive Director, Heritage Victoria. The Executive Director is to be given five working days notice of the intention to commence the approved works. Approved works or activities are to be planned and carried out in a manner which prevents damage to the registered place / object. However, if other previously hidden original or inaccessible details of the object or place are uncovered, any works that may affect such items shall immediately cease. The Executive Director shall be notified of the details immediately to enable Heritage Victoria representatives to inspect and record the items, and for discussion to take place on the possible retention of the items, or the issue of a modified approval. All works must cease and this office be contacted if historical archaeological artefacts or deposits are discovered during any excavation or subsurface works. Should any munitions or other potentially explosive artefacts be discovered, Victoria Police is to be immediately alerted whilst the site is cleared of all personnel. The Executive Director is to be informed when the approved works have been completed. The development approved by this permit is to be carried out in accordance with the endorsed drawings, unless otherwise agreed in writing by the Executive Director, Heritage Victoria. NOTE THAT PERMISSION HAS BEEN GIVEN FOR INSPECTIONS OF THE PLACE OR OBJECT TO BE UNDERTAKEN DURING THE CARRYING OUT OF WORKS, AND WITHIN SIX (6) MONTHS OF NOTIFICATION OF THEIR COMPLETION. TAKE NOTICE THAT ANY NATURAL PERSON WHO CARRIES OUT WORKS OR ACTIVITIES NOT IN ACCORDANCE WITH THE PERMIT OR CONDITIONS IS GUILTY OF AN OFFENCE AND LIABLE TO A PENALTY OF UP TO 2,400 PENALTY UNITS ($286,680) OR 5 YEARS IMPRISONMENT OR BOTH, OR IN THE CASE OF A BODY CORPORATE 4800 PENALTY UNITS ($573,360). The Executive Director has issued a permit under section74 of the Heritage Act 1995. WHEN DOES THE PERMIT BEGIN? The permit operates from a day specified in the permit. WHEN DOES A PERMIT EXPIRE? A permit expires if * the development or any stage of it does not start within the time specified in the permit; or * the development or any stage is not completed within the time specified in the permit, or, if no time is specified, within two years after the issue of the permit. The expiry of a permit does not affect the validity of anything done under that permit before the expiry. WHAT ABOUT APPEALS? The applicant or the owner of a registered place or registered object may appeal to the Heritage Council against any condition of a permit imposed by the Executive Director on a permit issued under Section 74 of the Heritage Act 1995. An appeal must * be in writing; and. * be lodged within 6o days after the permit is issued.
