Strengthen Access to Justice Initiatives Planned for 2016 Status Update and Next Steps 2.1.1 Development of a National Policy and strategic action plan on Legal Aid. Main component COMPLETE: The National Policy was approved by the Cabinet of Ministers, on 30th March National Policy was developed and approval from the Cabinet of Ministers, secured. 2.1.2 Support the implementation of prioritized recommendations from the Strategic Action Plan aligned to the National Legal Aid Policy. TO BE COMMENCED The specific priority recommendations would be identified upon finalization of the strategic action plan (related to 2.1.1) 2.1.3 Support the capacity development of the Legal Aid Commission TO BE COMMENCED A Review of the services provided by the Legal Aid Commission (2010-2015) will be conducted (as recommended in the Policy). 2.1.4 Conduct outreach initiatives on legal aid for the general public IN PROGRESS A series of TV/Radio panel discussions (with the participation of legal officers from the LAC , BASL, and sector specialists) on prioritized legal topics are being organized. Consultant in place; Strategic action plan is being finalized (received comments from stakeholders including the Legal Aid Commission members). Sector specific small research grants awarded to lawyers in order to build capacity and inform policy. Cabinet approval secured to amend the penal code, evidence ordinance and criminal procedure code to substitute and revise redundant terms. Amendments to be drafted by the Legal Draftsman’s Department. Once amendments are passed by the Parliament the consolidation can be completed and printed. Consolidation of civil procedure code about to commence. All laws/amendments submitted to the consolidated. Cabinet approval secured to amend the legislation Consolidation of the Civil Procedure Code – IN PROGRESS 4.2.6 Conduct a study on the existing sentencing practices in Sri Lanka (reviewing decided cases in the high court) IN PROGRESS Completed all case research within the High Courts (8 districts) and the Court of Appeal. Strengthen the capacity of MWCA to lead development of National Policy framework and National Action Plan (NAP) to address GBV (3.1.1). Main activity COMPLETEDThe National Policy Framework and National Plan of Action (NPoA) to address SGBV was approved by the Cabinet of Ministers on 7th June 2016. • Complete translation and printing in Sinhala, Tamil and English. • Conduct the Launch and media briefing • Conduct a donor meeting • Implement NPoA under the medium term budgetary framework 2017 – 2019. 3.1.3. Translate Print and disseminate the NAP to address SGBV, make accessible the soft copy of the NAP in the Sinhala and Tamil languages. IN PROGRESS NPoA sent for translation. Strengthen the capacity of the staff of the Women and Children's units (including WDOs) using the newly developed standard training programme on Women's Rights/ Child Rights/ SGBV/legal framework Planning in progress, training TO BE COMMENCED Training to be undertaken in Ratnapura and Batticaloa 3.2.4. Conduct awareness programmes on prevention of underage marriage and sexual and gender based violence in identified Divisional Secretariat Divisions in the 3 area models IN PROGRESS Knowing her through song programmes to be held for three-wheeler drivers and garment factory workers. Support the mapping and development of curriculum, training modules and training techniques on SGBV for all justice sector institutions and actors. Discussion in Progress. Training TO BE COMMENCED. Training rolled-out on the SGBV manual done by UN and Sri Lanka Police 3.3.2. Strengthen the Women and Children's desks of the Police in the 3 area models ensuring availability of female offices, with trilingual language abilities and relevant knowledge. Equipment/ Complete 2014. Batticaloa students have almost completed the course. NISD Diploma IN PROGRESS Anurdhapura and Colombo students are still in progress. 3.3.3 Identify and develop a strategic plan to address service delivery gaps within the Attorney General’s Department and the judicial system with reference to SGBV/ rape cases. Feedback received from AG’s DepartmentTO BE COMMENCED Rate of payment has to be clarified by the AG and support is needed to followup. 3.3.5. Strengthen legal aid and CSOs to prevent and respond to women victim-survivors of GBV in the three area models IN PROGRESS Agreement signed with Women in Need. Legal services provision on going. Network/ referral meetings and para legal training to commence. Furniture Strengthen Social Integration Initiatives Planned for 2016 Status Update and Next Steps 5.2.2 Conducting mobile clinics to issue legal documentation in selected marginalized sectors Two mobile clinics COMPLETED. 2 -3 TO BE COMMNED in Q3. 2- 3 mobile clinics will be conducted in Ganga Ihala Korale in Kandy district and Yatiyanthota in the Kegalle district. 5.2.10 Support an assessment of language gaps in selected geographic multi-ethnic hotspots and in key service delivery sectors. IN PROGRESS Draft report will be discussed finalized with the Ministry very soon. 6.1.5 a) Sensitize the public/school numerically small ethnic groups IN PROGRESS Book being designed. Completed chapters to be submitted by the 15th of September. Translations into Tamil and Sinhala /English and Tamil will be done accordingly. The book will be printed in English Tamil and Sinhala. IN PROGRESS Programme on “Role of University students as change agents for National Coexistence” will be conducted- end of August. children on d) Support interaction and understanding to promote co-existence among University students, through inter-university activities (i.e. street drama competitions, exchanges, debate etc). Strengthen Social Integration Initiatives Planned for 2016 6.2 a) Support the strengthening and operationalization of existing "Language Societies" to serve as "Coexistence Groups" in selected two districts Status IN PROGRESS Update and Next Steps Five proposals submitted by Social Integration (SI) officers/SI coordinators have been selected to bed implemented at each DS level with the aim of promoting coexistence in Anuradhapura, Batticaloa and Ratnapura district. Additional funds (if available) will be utilized to conduct mobile clinics. 6.4.4 Ensure sustained engagement with the empowered Women Leaders IN PROGRESS Project proposals are being reviewed. Implementation of activities will be in September 6.5.1 Follow-up and where possible scale-up the dialogue between young journalists to serve as change agents for Co-existence IN PROGRESS Three programmes on “Conflict Sensitivity in Reporting” will be conducted in Jaffna, Killinochchi and Batticaloa in the month August or beginning of September 2016 6.5.3. (a) Follow-up activities on the " Youth As Change Agents for Social Cohesion and Transformation" initiative conduct in 2015 IN PROGRESS • • Seed grant activity proposals will be submitted to the Ministry by last week of July 2016 Activity implementation is expected in September in collaboration with CBOs located in Anuradhapura and Batticaloa and SI officers/SI coordinators of respective DS Divisions. Risks and Challenges • Risk of allocated financial resources not being utilized in a timely and meaningful manner. -Several activities with large budgetary allocations remain to be commenced. - The donor deadlines for completion of these activities are September 2016 respectively. and December - Several activities pending completion this year are tied to agreements by the IP with other government entities. During the Quarterly Review it was flagged that there are currently delays in reaching these agreements. • During the Quarterly Review meeting for the 2nd quarter, was held on 11th July, updated were reviewed against the revised M&E frameworks. It was noted that systematic monitoring of progress against indicators is low in some Projects. - Identified indicators need to be continually tracked with quantitative and qualitative data to back them up. Funds have been allocated for M&E and so should be utilized for this purpose. • Specific Operational Challenges - Treasury not fully issuing the Cash advances to the Ministry of Justice, in keeping with the request from the Ministry. This impacts upon timely utilization of the funds. • Delays in the full establishment of the Board of the National Authority on Victim and Witness Protection.
