Vehicle Donation Policy Ex. Committee Review: 8-8-16. Board Approved: 8-18-16 INTRODUCTION: Family Promise of Southern Chester County has identified a major challenge for families in our program as lack of transportation which impacts many people who live in poverty. Families are limited in the type and location of employment due to lack of transportation and may enter our program with no reliable vehicle for use in acquiring and retaining full time employment or attending training or education program, especially in southern Chester County where public transportation is extremely limited. Therefore, it is FPSCC desire to support families successfully moving to self-sufficiency in obtaining dependable vehicle through donations. POLICY: FPSCC may accept the donation of certain vehicles based on pre-donation inspection by a FPSCC approved and Pa. licensed auto repair mechanic to determine the cost of repairs to ensure the care would be a safe and dependable vehicle. Cars accepted for repair shall be provided to families in good standing based on need and capacity to maintain a vehicle. PROCEDURE: Accepting Donation: All potential donated cars must first be pre-inspected to estimate the cost of repairs by a FPSCC selected mechanic. Based on estimates to ensure a dependable and safe vehicle, FPSCC staff shall determine if investment required vs. car value/age is reasonable. FPSCC staff must determine sufficient funds exits for FPSCC to repair the vehicle and a storage availability. Title transfer requires certification to the Title Transfer Service that the person signing for FPSCC is authorized and a copy of our Pa Certification of Exemption as charitable not required to pay taxes. Upon accepting the donation and transferring title to FPSCC, FPSCC shall secure IRS form 1098-C for completion and provide donor a copy and file one copy with the FPSCC corporate 990 Tax Return. Families Eligibility: Family must be part of the FPSCC program and staff determines family has met substantial progress on goals set for stable housing and family stability. The family cannot have a current vehicle. One family member must have a valid, current driver license. One family member must have a stable job. Family agrees to purchase state minimum required insurance for vehicle prior to transfer (proof required). Family agrees to make payment toward repair cost of $250, plus registration and transfer fees for the vehicle. Staff may reduce based on extreme hardship circumstances. Family must sign an “Assumption of Risk, Release and Hold Harmless Agreement” prior to title transfer. Said document also states the family is accepting the vehicle “as is”. (See attached.) ASSUMPTION OF RISK, RELEASE AND HOLD HARMLESS AGREEMENT NOTE: THIS IS AN IMPORTANT DOCUMENT THAT MAY AFFECT YOUR RIGHTS. READ IT CAREFULLY BEFORE SIGNING. THIS RELEASE AGREEMENT (the “Agreement”) is made by and between FAMILY PROMISE of SOUTHERN CHESTER COUNTY (“FPSCC”) and _____________________________________ (“Buyers”) this _____ day of ________________, 2016. WHEREAS FPSCC has agreed to sell to Buyers, and Buyers have agreed to purchase from FPSCC, for _____ Dollar ($) a vehicle described as a _________________________________ with a VIN of ____________________________, in its AS-IN condition. NOW THEREFORE, to induce FPSCC to agree to sell the above-described vehicle to Buyers, to the maximum extent permitted by law, and intending to be legally bound, the parties agree as follows: Buyers agree to purchase the above mentioned vehicle in its AS-IS condition. FPSCC does not know the history of the vehicle and does not warrant or certify as to the condition, drivability, suitability, or safety of the vehicle. Buyers hereby represent that they have personally inspected and examined the above-mentioned vehicle. Buyer hereby acknowledges that Buyers have not relied upon any representation or warranty made by FPSCC or FPSCC's representatives, if any, as to the condition of the vehicle. Buyers further agree to: (1) assume all the responsibilities, including but not limited to fees, costs, repairs, risks, and hazards, including personal injury and/or damage to my personal property, that result, relate, or arise from Buyer’s ownership, use, and operation of the vehicle; (2) voluntarily and knowingly forever release FPSCC, its agents, employees, representatives, officers, and directors from and against any and all causes of action, claims, suits, rights or demands, known or unknown, which arise as a result of any losses, damages, expenses, personal injury or death, arising from Buyers use, operation, and ownership of the vehicle; (3) agree to indemnify and hold harmless FPSCC, its agents, employees, representatives, officers, and directors of, from, and against any and all loss, claims, suits, damages, and judgments, fees, costs (including attorneys’ fees), arising from Buyers’ negligence, including gross negligence and willful and wanton conduct, resulting or arising from Buyers’ purchase of the above vehicle; and (4) Buyers indemnify and hold FPSCC harmless for any breach by Buyers of this Agreement, including any fees and costs (including attorneys’ fees and court costs) attributed to such breach.
