 REQUEST A DRIVING SAFETY COURSE
To be eligible for a Driving Safety Course, you must make your request in person or in writing on or before the
response date on your citation. A Driving Safety Course will not be granted after the response date.
DSC applies to the following traffic offenses that involve operation of a motor vehicle:
● Section 472.022, T.C.; (Obeying Warning Signs)
● Subtitle C, Title 7, T.C.; (Rules of the Road)
● Section 729.001(a)(3), T.C. (Operation of Motor Vehicle by Minor)
You are eligible to take a DRIVING SAFETY COURSE if:
 You do not have a CDL license currently or at the time of offense
 You have liability insurance and a valid TX driver’s license.
 You are NOT charged with speeding in excess of 24 mph over the speed limit.
 You are NOT charged with a violation occurring in a construction zone, AND
 You have NOT taken a Driving Safety Course within the last 12 months to dispose of a citation.
If eligible for a DRIVING SAFETY COURSE, provide the following to Municipal Court:
1. Required fee: money order only: Payable to City of Midlothian

2. A copy of your valid Texas Driver’s License
3. A copy of your liability insurance card.
4. A completed driving safety request (see A below)
5. A completed driving safety course affidavit (see B below)
I am entering a plea of guilty/no contest , waive my right to a jury trial and acknowledge and hereby waive
any discover pursuant Art 39.14 ccp. I request a 90 day extension to complete a driving safety course. I
understand that this plea enters a guilty judgment and this judgment will be removed and no conviction will appear
on my record upon submitting required proof of completion of the course. I further understand failure to comply
will result in assessment of the fine and a conviction on my driving record.

Driving Safety Course Affidavit
Now comes the defendant in the above named and numbered case and requests that he/she be granted a 90 day
extension to complete the Driving Safety Course and that in support of the defendants application world show the
court the following:
1. I am not in the process of taking a Driving Safety Course for another citation (under Art 450511 CCP)
2. If I have taken driving safety under this section , I completed that course at least 12 months before the date I
received this citation.

Mail or deliver completed request with the five (5) items above to Municipal Court on or before your court response

HELPFUL INFORMATION
First,
Obtain your driving record from the Texas Department of Public Safety (form attached to the last page of this packet
OR order from DPS website.) Beware of ordering driving records from independent/private vendors. Use only Tads official website
The original DPS driving record is the ONLY record accepted by the court. You may request your record
by mail for a $10 fee (form provided by court) OR order online at www.texasonline.com for a $12 fee and
print your form immediately. Be sure to select the correct type of record, 3A is the only record accepted by
the court. This process may take 6-8 weeks so be sure to make your request immediately. .
JUVENILES AND MINORS - We have had some reports that juveniles and minors were unable to order their driving record online and must use
the form when ordering. We have not confirmed this with DPS however if you have questions, you can contact DPS at 512-424-2600.
Second,
Locate a driving safety course approved by the Texas Education Agency.
You may attend an actual class, rent a video from a local video store, or take an online course as long as it is
approved by the Texas Education Agency. Do not wait until the last week to take your class, most courses
mail certificates completion to you. It can take up to two weeks to get your certificate mailed to you. ALL

Third,
MAIL OR BRING certificate and driving record for dismissal no later than C79
Upon completion of the driving safety class, you will be mailed a certificate of completion marked "court
copy", sign, and return the original “court” copy along with your original driving record within deferral
period. It is your responsibility to return all correct paperwork to the court on or before C79. Documents
stating you passed your test or you are awaiting your certificate to be mailed will not be accepted as proof of
completion. The “court copy” ORIGINAL CERTIFICATE OF COMPLETION is MANDATORY FOR
DISMISSAL.
Extensions are not allowed for any reason!!! Requesting your driving record immediately and locating your
class within a timely manner will aid you in reaching dismissal. It is your responsibility to make sure all
forms are received by the court within your deferral period. If mailing your forms, it is always a good idea to
send them certified.
Return ORIGINAL driving record and ORIGINAL course certificate of completion to the court at 1150 N
Hwy 67 Ste 200 Midlothian TX 76065, either by mailing forms or by delivering them in person. Be sure to
sign your course certificate.
