XBOX 360 BOXING DAY CASH BACK PROMOTION TERMS & CONDITIONS
1. Information on how to claim and details of the Xbox 360 Boxing Day Cash Back Offer (Offer) form part of these terms and
conditions. By participating in this promotion, customers agree to be bound by these terms and conditions. Accordingly, the
Promoter will not fulfil any claims that do not comply with these terms and conditions.
2. The Offer is available to Australian residents who have purchased a new Xbox 360 4GB console from any Australian retailer,
other than auction website retailers, between 25 December 2013 and 31 December 2013 (Eligible Purchase) (Promotion
Period).Customers under 18 years of age must have parental/guardian approval to redeem this offer, and further, the
parent/guardian must read and consent to all terms and conditions.
3. Employees of the Promoter, participating retail outlets, channel partners of the Promoter (which includes distributors, subdistributors, resellers, retailers and system integrators), associated agencies and members of their immediate families are
ineligible to participate in this Offer.
4. For the purposes of this promotion, pre-ordering an Xbox 360 4GB console through an Australian retailer will not be deemed
an Eligible Purchase. Further, the Offer is not available for products that are still awaiting arrival into store or delivery to the
customer.
5. A person can only claim the Offer once.
6. To make a claim, you need to:
make an Eligible Purchase during the Promotional Period;
register your details online via www.xbox360cashback.com.au during the Promotional Period;
fill out the claim form online (Online Claim Form);
submit your Online Claim Form via www.xbox360cashback.com.au , along with a scanned copy of your Eligible
Purchase receipt during the Promotional Period. If you do not have the ability to submit a copy of your Eligible Purchase
receipt online, you will print out the Online Claim Form and mail this, along with a copy of your Eligible Purchase receipt
to: Xbox 360 Cash Back Offer, PO Box 6246, BAULKHAM HILLS BC NSW 2153, by 31 January 2014;
e. Your $100 cash back will be deposited into your nominated bank account as stated on the Online Claim Form by 28
February 2014.
7. The claim is not completed until the Promoter has received the Online Claim Form and copy of store receipt at the specified
post box or online, and the Promoter accepts the claim is valid as it meets the terms and conditions of the promotion.

8. For customers to claim the Offer, the Online Claim Form must contain an Australian postal address. If an Online Claim Form
contained an address outside of Australia, it will be rendered invalid, and the customer cannot make a claim using this particular
Online Claim Form.
9. Any banking account details, as set out on the Online Claim Form, will only be used by the Promoter to transfer money from
the Promoter into your account. It is the responsibility of the claimant to provide correct banking details. The Promoter is not
responsible for any delays in payment or errors due to factors outside of its reasonable control, including delays or errors in the
financial system or errors in the supplied account details. The claimant accepts this as a condition of this promotion. If incorrect
banking details are provided by a claimant and a trace is required to locate funds, there will be a charge (which varies by banking
institution) which will be payable by the claimant.
10. All claims are subject to a verification check by the Promoter. The Promoter reserves the right to verify the validity of all
claims.
11. Failure by the Promoter to enforce its rights contained within these terms and conditions at any stage does not constitute a
waiver of those rights.
12. Any costs associated with claiming the Offer are the responsibility of the customer.
13. The Promoter will not accept liability for any claims that are not received by the Promoter, are lost (whether in transit or
otherwise) or damaged. The Promoter's decisions on all matters pertaining to this promotion are final and binding and no
correspondence will be entered into.
14. These terms and conditions do not, nor do they purport to, limit, exclude or modify any non-excludable
statutory guarantees as provided under the Competition and Consumer Act 2010 (Cth) or any other warranties (whether express
or implied) under any state or federal legislation which cannot be excluded.
15. The Promoter assumes no responsibility for, and the claimant releases the Promoter from responsibility for, any failure to
receive a claim or for inaccurate information or for any loss, claim, damage or injury to person or property (including computer
systems and servers) as a result of the claimant's participation in this promotion or the conduct of the promotion generally or as
a direct or indirect result of an entrant's error, any technical problem of any kind including communications or network failure,
unauthorised access to, transferring or theft of data, whether caused by the claimant or associated with the equipment or
programming used in the conduct of this promotion. If, because of any such problem, this promotion is not able to be conducted
as planned and/or the promotion's administration, security, fairness or integrity are compromised or affected, the Promoter
may cancel, terminate, modify or suspend the promotion and/or disqualify any person involved in interfering or tampering with
the conduct of this promotion in any way.
16. Personal information from all claims will be collected and used for the purposes of conducting this Offer (which includes
disclosure to third parties for the purpose of processing and conducting the offer). By completing and submitting an Online
Claim Form you consent to the Promoter using your personal information as described and for promotional purposes including
sending electronic messages. The Promoter will only use your personal information for promotional purposes outside those
