Participation Agreement, Release of Liability,
Waiver of Claims and Assumption of Risk
- READ BEFORE SIGNING BY SIGNING THIS DOCUMENT YOU MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
In consideration of my (or my child’s) participation in ice skating, figure skating, ice hockey, curling or any other activities
(collectively known as “Activities”) at Florida Panthers IceDen, a skating facility in Coral Springs, Florida owned and
operated by Incredible Ice, LLC d/b/a Florida Panthers IceDen (“Ice Facility”), I agree to and acknowledge the following:
ASSUMPTION OF RISK: I am aware that Activities involve certain inherent risks, dangers and hazards which can result
in serious personal injury or death. I am also aware that Activities contain dangers to other parties. As such, I hereby
freely agree to assume and accept all known and unknown risks of injury arising while participating in or attending
Activities.
RELEASE AND INDEMNITY: In consideration for allowing me to participate in Activities at Ice Facility, or any other
building owned and/or operated by Incredible Ice LLC d/b/a Florida Panthers IceDen (“Ice”), Florida Panthers Hockey
Club Ltd, Arena Operating Company, Ltd., Sunrise Sports & Entertainment LLC, I agree, to the fullest extent permitted by
law, to the following:
1. TO WAIVE ALL CLAIMS that I have or may have against Ice, Florida Panthers Hockey Club, LTD, Arena
Operating Company, LTD, Sunrise Sports and Entertainment, LLLP, and/or their respective owners, agents, officers, staff,
contractors, and physicians (collectively known as “SSE Parties”) arising out of Activities at Ice Facility or at any Facility
owned or operated by any of the SSE Parties.
2. TO RELEASE Ice and the other SSE Parties from all liability for any loss, damage, injury or expense that I (or
my family) may suffer arising from any cause whatsoever, including negligence or breach of contract on the part of Ice or
the SSE Parties in the operation, supervision, design and/or maintenance of Ice Facility or any other owned or operated
by any of the SSE Parties (“SSE FACILITY”).
3. TO INDEMNIFY Ice and the other SSE Parties from and against any and all claims, liabilities, losses, damages,
and costs (including reasonable attorney’s fees), resulting from any injury caused in part or in whole by my (or my child’s)
negligence or willful misconduct at Ice Facility or any other SSE Facility.
BINDING EFFECT OF AGREEMENT: In the event of my death or incapacity, this Agreement shall be effective and
binding upon my heirs, next of kin, executors, administrators, assigns and representatives.
ENTIRE AGREEMENT: In entering into this Agreement, I am not relying upon any oral or written representatives other
than what is set forth in this Agreement.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I
AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE INCREDIBLE ICE, LLC d/b/a FLORIDA
PANTHERS ICEDEN AND THE SSE PARTIES.
