Guidance Notes for Completion of Pre-Qualification Questionnaire (PQQ)

This questionnaire contains a set of STANDARD questions which we anticipate
will be used by buyers in most procurement exercises. These contain guidance
to bidders detailing what should be included in their response. These questions
are both pass/fail and scored and weighted questions. It is the buyers
responsibility to ensure that the questions included in the PQQ are relevant and
proportionate to the contract. These questions include Criminal Convictions &
Business Probity, Economic and Financial Standing, Insurance etc.

to bidders detailing what should be included in their response. These questions
are both pass/fail and scored and weighted questions. It is the buyers
responsibility to ensure that the questions included in the PQQ are relevant and
proportionate to the contract. These OPTIONAL questions focus more on
specialised areas such as Health and Safety Procedures, Quality Management
Procedures and Environmental Management Procedures.

The provisions of this PQQ questionnaire will not be appropriate for all
procurements and will need to be tailored to suit your particular procurement
exercise.
This PQQ should be used to determine a shortlist of bidders out of those who
expressed an interest in your procurement exercise. Those bidders who are
successful at the pre-qualification stage will then be invited to tender (in the
restricted procedure) or invited to negotiate (negotiated procedure), or to
participate in dialogue (competitive dialogue procedure).
There are strict limits on the questions which can be included at the selection
stage. Bidders should only be asked for information which allows the contracting
authority to assess:
whether the supplier should or may be rejected for the reasons listed in
Regulation 58 (including fraud, bribery, and insolvency) of the Public
Contracts (Scotland) Regulations 2015;
the economic and financial standing of the bidder; and
the technical and professional ability of the bidder.
It is not permissible at the selection stage to ask how the bidder will approach the
particular requirement, or any questions about the bidder’s pricing. You should
only request information which is to be used as part of the selection process.
You should ensure that, wherever possible, the PQQ is constructed in such a way
that small and medium sized enterprises are not excluded, in terms of how
financial standing and capability are measured. For example, requiring a minimum
turnover, or a minimum number of years of audited accounts, may exclude some
potential suppliers. Is this justifiable in terms of the particular requirement?
Questionnaire Responses
Only information provided as a direct response to the questionnaire will be evaluated.
Potential bidders should respond to the questionnaire on the basis that the
contracting authority has no prior knowledge of their organisation. Information and
detail which forms part of general company literature or promotional brochures etc.
will not form part of the evaluation process. Marketing material should not be
included.
Supplementary documentation may be attached to the questionnaire where bidders
have been directed to do so. Such material must be clearly marked with the name of
the organisation and the question to which it relates. Please note that the Authority
may require clarification of the answers provided or ask for additional information.

Bidders should be aware that erroneous or incorrect responses may result in their
removal from the tender list(s). In the event that this is only discovered once
invitations to tender have been issued, the bidder may be required to return the
tender documents which will be deemed void. In the case where the error or
misrepresentation is not discovered until after the contract is awarded, the Authority
reserves the right to terminate the contract and all costs incurred by us as a result of
the termination shall be recoverable from the provider under the contract.
Completed questionnaires must be submitted Via the online tender post box
submission facility contained within The Public Contracts Scotland Site (The National
Advertising Portal) http://www.publiccontractsscotland.gov.uk/
which allows the Council to receive tender responses from suppliers electronically in
a secure environment.
Tender responses are submitted through the portal and held in the secure Post box
until the deadline for responses has expired. Nominated members of the authority
then unlock the Post box to access the submissions.
Tenders by mail, email, fax or verbal will NOT be accepted
Submissions can be created, edited and submitted up to the stated tender deadline.
Questionnaires received by the Council after this date will not be considered

It is not advisable for suppliers to wait until the last moment before creating and
dispatching a response in case of any last minute problems.

The Online Questions & Answers facility allows Candidates to submit queries online.
Clackmannanshire council manage and respond to clarifications online and circulate
questions and answers to all Candidates that register an interest. Rather than
handling queries via email or telephone, all questions can be submitted and
responded to online and stored along with other notice details for easy reference.
Potential candidates are advised that their responses may be reproduced and that no
further indication or request prior to publication will be made.

The response should be submitted by an individual of the organisation, company or
partnership who has authority to answer on behalf of that organisation, company or
partnership.
If applying on behalf of a consortium, please list the names and addresses of all other
members of the consortium. Please note that the questionnaire will be evaluated on
the basis of the details supplied in the questionnaire and, if shortlisted, an Invitation to
Tender will be issued to the nominated lead organisation only. Contracts will normally
be entered into with the nominated lead organisation and all members of the
consortium, who will in these circumstances each be required to execute the contract
together with all ancillary documentation, evidencing their joint and several liability in
respect of the obligations and liabilities of the contract. It will be for members of the
consortium to sort out their respective duties and liabilities amongst each other. For
administrative purposes, any associated documentation will be sent to the nominated
lead organisation.
If a consortium is awarded this contract the members of the consortium will be
required to form a single legal entity before entering into, or as a term of the contract.
If sub-contractors are proposed to assist in the delivery of the service, please list the
business names and addresses.
In respect of an expression of interest which includes a consortium or subcontractors, it is the lead organisation that completes the entire questionnaire and, in
addition, arranges for each named organisation to complete the required parts and
attach them to the completed questionnaire.

Freedom of Information
The Freedom of Information (Scotland) Act 2002 designates Clackmannanshire
Council as a Scottish public authority and therefore subject to the provisions and
obligations in that Act. This means that any person who makes a valid request for
recorded information held by Clackmannanshire Council will be entitled to receive it,
unless all or part of that information can be withheld as a result of the exemptions in
that Act.
As part of our responsibility under the Act, Clackmannanshire Council may be
required to disclose any information held relating to your response to anyone who
makes a request under that Act. Such information may only be withheld if it meets
one or more of the exemptions or conditions in that Act. Information held cannot
simply be classified as “confidential" or "commercial in confidence" to enable it to be
protected from disclosure.

The 'Restricted - Commercial' header in these documents is part of

guidance for staff on the handling and storage of such documents, and is not an
indication that the information will be protected from disclosure in response to a valid

The information supplied by the Council in connection with this tender must be treated
as confidential1, however it may be disclosed by the Council for the purpose of
obtaining quotations required for the preparation of the tender and for insurance

Information may also be requested under the Data Protection Act 1998 and the
Environmental Information (Scotland) Regulations 2004. The Environmental
Information Regulations provide parallel access to documents regarding
environmental information. All documents detailing environmental information are
automatically exempt from disclosure under the FOISA, but will instead be disclosed
under the EIR. These regulations contain different rules for ‘commercial interest’ and
‘confidentiality’ exemptions as well as other applicable exemptions.

interested in providing the goods services or works as per section as per the
Explanation of the requirement, their professional advisers and other parties
essential to preparing responses to the PQQ and for no other purpose.
The contents of this PQQ, and that of any other documentation sent to you in respect
of this tender process are provided on the basis that they remain the property of the
Council and must be treated as confidential. If you are unable or unwilling to comply
with this requirement you are required to destroy this PQQ and all associated
documents immediately and not to retain any electronic or paper copies.
This PQQ is made available in good faith. No warranty is given as to the accuracy or
completeness of the information contained in it and any liability for any inaccuracy or
incompleteness is therefore expressly disclaimed by the Council and its advisers.

The Council reserve the right to make revisions to this PQQ. No additional time in
relation to submission deadlines for the PQQ will be granted, following notification of
any such revision, unless the participants are expressly notified of any extension by
Clackmannanshire Council.
The Council reserves the right to reject PQQs which are not submitted in accordance
with the instructions given.
Please note:
The Council reserves the right to cancel the tender process at any point. The
Council is not liable for any costs resulting from any cancellation of this tender
process, nor for any other costs incurred by those tendering for this Contract.
In the event that proceedings are brought against Clackmannanshire Council
the Council reserve the right to suspend the contract until such time as the
proceedings are finally determined or to terminate the contract on immediate
written notice to the Service Provider without any penalty or damages due to
the Council.
Candidates are deemed to understand fully the processes that the Council is required
to follow under relevant European and UK legislation, particularly in relation to Public
Contracts (Scotland) Regulations 2015, Procurement (Scotland) Regulations 2016
and the Procurement Reform (Scotland) Act 2014. Where Concessions and Utilities
are required the Concession Contracts (Scotland) Regulations 2016 and the Utilities
Contracts (Scotland) Regulations 2016 may also apply.

Candidate Selection and Evaluation Methodology
As part of the tender process, candidates will be required to pass a selection process
to ensure that they are suitably experienced to carry out the proposed works or
services under the contract. Candidates PQQ submissions will be evaluated on the
basis set out at below. Candidates who fail to pass the selection criteria will excluded
from further participation in the process.
Where Section 3 (Scored and Weighted) is used Candidates responses that meet the
requirements in Section 2 (Pass Fail) will be evaluated in accordance with the
scoring matrix and will be allocated a score on the basis of the weightings set out.
Candidates overall scores will be used as the basis for determining the candidates
are to be invited to tender.
A minimum of [four]/[five] candidates will be invited to tender. The Council may in its
absolute discretion invite more than the minimum number of candidates to tender2.

Current Operating Environment
Clackmannanshire Council operates predominantly in a thin client desktop
environment using thin client terminals. There are a number of users with local
desktop computers, if required, due to local software needs, e.g., GIS and Drawing
applications. The desktops computers also run a thin client to connect to the server
farm for access to the majority of Council applications.
The standard specification of the Intel based server estate, is quad Xeon processors
with varying memory resource (1Gb-32Gb RAM), 72Gb – 144Gb RAID and SCSI disk
configurations, RAID and SCSI controllers, running on a Microsoft Windows 2003 /
2008 / 2012 64bit Server R2 operating system with Citrix Presentation Server v5.x.
The network features an Ethernet 10Gb backbone with 100/1000Mb connections to
most workstations. Ip v4 is typically used with cat 5e cabling. Some IP Telephony is in
use and shares these connections.
The Council currently runs various operating systems, but mostly AIX, Linux and
Windows. The local desktop operating systems are MS-Windows XP, Microsoft Vista
and Microsoft Version 7&8. Application database platform should be either; SQL
Server (2008), Oracle (11g) or Lotus Notes (v7, v9) based.
Solutions should be capable of running in a virtualised environment. The host
operating system must be; Microsoft Windows Server, Linux or Unix AIX 7.1.
Whereas, the client side, if any, must be supported in Citrix Thin Client environment,
Presentation Server 5.x , running on Microsoft Windows 2003 / 2008 / 2012 server
64bit, standard edition R2 and Microsoft Windows 2008 / 2012 server 64bit. Printing
should be, if relevant, a true windows printing application utilising the default windows
printer, if not the application must be able to print on a Gestestner MP C3000 Aficio
multifunction device using appropriate pcl5e 64bit printer software, additional printer
models in use are 3500 and 4500. Authentication, as a preference should be utilising
Active Directory.
Remote Support is available via Citrix Access Gateway 2 Tier Authentication including
keyfob. Availability is on best endeavours basis (Mon - Fri 09:00 – 17:00hrs GMT).

Specification – The specification details the Council’s requirements and standards
for this contract, including the scope and specific details of the activities we require. It
should present you with a clear, accurate and full description of our needs, so that
you can propose a solution to meet them. You must read the specification carefully; if
you are not sure about what is being asked for, contact the named contact for this
tender for clarification.
Standing Orders – The Council’s rules and procedures that govern its activities,
including procurement of goods, works and services.
Tender – An official written offer to an invitation that contains a costed proposal to
perform the works, services or supplies required, and is provided in response to a
tendering exercise. This normally involves submission of the offer in a sealed
envelope to a specified address by a specified time and date.

Important Information to Candidates
2.1.1 This pre-qualification questionnaire has been published in order to comply with
the duties incumbent on the Council under relevant European and UK
legislation, particularly in relation to Public Contracts (Scotland) Regulations
2015, Procurement (Scotland) Regulations 2016 and the Procurement Reform
(Scotland) Act 2014. Where Concessions and Utilities are required the
Concession Contracts (Scotland) Regulations 2016 and the Utilities Contracts
(Scotland) Regulations 2016 and Local Government in Scotland Act 2003.
The value of the products or services required by the Council fall below the
relevant EU threshold and the Council has assessed that no cross border
interest is or is likely to exist
2.1.2 The Council will assess all submissions objectively and in accordance with the
criteria set out in the advertisement, however the selection of candidates and
award of the contract is entirely within the Council's discretion. It is expressly
declared that the Council are under no obligation to accept any tender,
regardless of whether the submission is either the lowest price tendered or is
the most economically advantageous tender.
2.1.3 Any reference to the provisions of the Public Contracts (Scotland) Regulations
is to ensure that the Council fulfils its statutory duty under the Local
Government in Scotland Act 2003 (the "2003 Act") to achieve best value. In
applying the terms of the Public Contracts (Scotland) Regulations 2015,
Procurement (Scotland) Regulations 2016 and the Procurement Reform
(Scotland) Act 2014. Where Concessions and Utilities are required the
Concession Contracts (Scotland) Regulations 2016 and the Utilities Contracts
(Scotland) Regulations 2016 as principles for assessment of tenders, the
Council is using a recognised consistent and fair approach to comply with its
duties under the Regulations. The Regulations do not constitute (either
expressly or impliedly) a term of the contract or the procurement exercise save
as prescribed for by law. Furthermore, the fact that the Council has sought
offers from candidates for the performance of the goods and/or services set
out herein does not give rise to a contractual obligation on the Council (either
expressly or impliedly) to consider the tenders in line with the published
requirements or to award the contract to any candidate. Any decision to award
a contract is at the Council's entire discretion, subject to any over-riding
requirement of public law.
2.1.4 The Council has prepared this Pre Qualification Questionnaire (PQQ). The
Council will not accept any responsibility or liability for advising any recipient of
any changes or additions to the information contained in this PQQ, or any
other information relating to the project that comes to their attention.
2.1.5 Although every care has been taken in preparing the PQQ, no representation,
warranty or undertaking, expressed or implied is, or will be made, and no
responsibility or liability will be accepted by the Council or by any of its officers,
employees, servants, agents or advisers ("Connected Persons") as to the
accuracy or completeness of the PQQ or any other written or verbal

information made available to any interested party or its advisers. Any liability,
however arising, is expressly disclaimed.
2.1.6 Data provided by the Council to interested parties will be given in good faith
but interested parties will have to make their own investigations and
interpretation. No liability will be accepted by the Council for the accuracy or
completeness of that data.
2.1.7 Neither the receipt of this PQQ by any person, nor any information contained in
it or distributed with it, or subsequently communicated to any interested party
or its advisers is, or is to be taken as, constituting the giving of investment
advice by the Council.
2.1.8 No information contained in this document or any other written or verbal
information made available to any interested party or its advisers shall form the
basis for any warranty, representation or term of any contract by the Council
with any third party.
2.1.9 Nothing in this document is, or should be, relied on as a promise or
representation as to the future. The Council reserves the right, without
principle, to change the procedure for the project competition or any of the
proposals or information in relation to the project.
2.1.10 The Council reserves the right to cancel the tender process at any point. The
Council is not liable for any costs resulting from any cancellation of this tender
process, nor for any other costs incurred by those tendering for this Contract.
In the event that proceedings are brought against Clackmannanshire Council
under the Public Contracts (Scotland) Regulations 2015, the Council reserve
the right to suspend the contract until such time as the proceedings are finally
determined or to terminate the contract on immediate written notice to the
Service Provider without any penalty or damages due to the Council.
By submitting a tender, candidates are deemed to understand fully the
processes that the Council is required to follow under relevant European and
UK legislation, particularly in relation to Public Contracts (Scotland)
Regulations 2015, Procurement (Scotland) Regulations 2016 and the
Procurement Reform (Scotland) Act 2014. Where Concessions and Utilities
are required the Concession Contracts (Scotland) Regulations 2016 and the
Utilities Contracts (Scotland) Regulations 2016, the Local Government
(Scotland) Act 1973 and the Local Government in Scotland Act 2003.
2.1.11 The Service Provider must not commit any breach of the Employment
Relations 1999 Act (Blacklists) Regulations 2010 or section 137 of the Trade
Union and Labour Relations (Consolidation) Act 1992, or commit any breach of
the Data Protection Act 1998 by unlawfully processing personal data in
connection with any blacklisting activities. Breach of this clause is a material
default which shall entitle the Purchaser to terminate the Contract with
immediate effect.

2.1.12 This document is for use by candidate/s who are interested in providing the
goods or services set out at section 5 of the PQQ, their professional advisers
and other parties essential to preparing responses to the PQQ and for no other
purpose.
2.1.13 The contents of this PQQ, and that of any other documentation sent to you in
respect of this tender process are provided on the basis that they remain the
property of the Council and must be treated as confidential. If you are unable
or unwilling to comply with this requirement you are required to destroy this
PQQ and all associated documents immediately and not to retain any
electronic or paper copies.
2.1.14 This PQQ is made available in good faith. No warranty is given as to the
accuracy or completeness of the information contained in it and any liability for
any inaccuracy or incompleteness is therefore expressly disclaimed by the
Council and its advisers.
2.1.15 The Council reserve the right to make revisions to this PQQ. No additional time
in relation to submission deadlines for the PQQ will be granted, following
notification of any such revision, unless the participants are expressly notified
of any extension by Clackmannanshire Council.
2.1.16 The Council reserves the right to reject PQQs which are not submitted in
accordance with the instructions given.
