Terms and Conditions for Cummins Twitter competition
1. The Promotor:
The Promotor is Cummins Ltd, Yarm Road, Darlington, DL1 4PW UK (Company Registration
Number: 573951).
2. The Competition:
a. The title of the competition is CUMMINS #28.
b. Win pair of day tickets to the Goodwood Festival of Speed on Sunday 2nd July 2017 by
answering 28 questions about the #28 Cummins Diesel Special during the month of June
2017.
3. How To Enter:
a. The competition will run from June 3rd 2017 to June 26th 2017 (the “Closing Date”)
inclusive.
b. All competition entries must be received by the Promotor by direct tweet to @Cummins
Europe by no later than midnight on the Closing Date. All competition entries received
after the Closing Date are automatically disqualified.
c. To enter the competition, simply answer the 28 questions asked by @CumminsEurope
about the #28 Cummins Diesel Special during the month of June by replying directly to
each tweet. Some questions may be asked on the same day.
d. There is no entry fee and no purchase is necessary to enter this competition.
e. The Promotor will not accept: (i) responsibility for competition entries that are unclear,
incomplete, corrupted, or delayed in transit, regardless of cause, including, for example, as
a result of any equipment failure , technical malfunction, systems, satellite, network, server
computer hardware or software failure of any kind, or (ii) proof of transmission as proof of
receipt of entry to the competition.
f. By submitting a competition entry, you are agreeing to be bound by these terms and
conditions.
g. Those who answer all 28 questions correctly will be entered into a draw and the winner
will be selected at random.
4. Eligibility:
a. The competition is only open to all residents in the United Kingdom aged 18 years or over,
except:
i. employees of the Cummins Group (“Cummins Group” shall mean
the group of companies owned or controlled, directly or indirectly,
by Cummins Inc. of Columbus, Indiana, U.S.A.);
ii. employees of agents or suppliers of the Cummins Group;
iii. members of the immediate family or households of (i) and (ii) above.
b. All entrant must follow @CumminsEurope on Twitter in order to be eligible to win the
prize.
c. In entering this competition, you confirm that you are eligible to do so and eligible to claim
the prize. The promotor may require you to provide proof that you are eligible to enter the
competition.
d. The Promotor will not accept entries which are:
i. automatically generated by computer;
ii. completed by third parties or in bulk;
iii. illegible, have been altered, reconstructed, forged or tampered with; or
iv. incomplete.
e. Any entries containing offensive or inappropriate content will be removed.
f. Only one entry will be accepted per person. Multiple entries from the same person will be
disqualified. Entries on behalf of another person will not be accepted and joint submissions
are not allowed.
g. The Promotor reserves the right to disqualify you if your conduct in contrary to the spirit
or intention of the prize competition.
5. The Prize:
a. The prize is two day tickets to the Goodwood Festival of Speed on Sunday 2nd July 2017.
b. Travel to and from the Goodwood Festival is the responsibility of the winner.
c. The Promoter is not responsible for inaccurate prize details supplied to any entrant by any
third party connected with this competition.
d. The prize is not transferable, re-saleable or exchangeable. There is no cash alternative.
e. The Promotor reserves the right to replace the prize with an alternative prize or equal or
higher value if circumstances beyond the Promotor’s reasonable control makes it necessary
to do so.
6. Winner Announcement:
a. The winner will be notified by DM on Tuesday 27th June (the “Announcement Date”).
b. Once the winner has claimed the prize, the Promoter will notify the winner when and where
the prize will be delivered.
c. The Promoter’s decision in respect of all matters to do with the competition
will be final and no correspondence or discussion will be entered into.
7. Claiming The Prize:
a. If you are the winner of the prize, you will have 24 hours from the Announcement Date to
claim the prize by emailing [email protected].
b. The Promotor will make all reasonable efforts to contact the winner. If the winner cannot
be contacted if is not available, or does not claim the prize within the specified period, the
Promotor reserves the right to offer the prize to the next eligible entrant selected from the
correct entities that were receive before the Closing Date.
c. The Promotor does not accept any responsibility if you are not able to take up the prize.
8. Limitation of Liability:
Insofar as is permitted by law, the Promotor or its agents will not in any circumstances be
responsible or liable to compensate the winner or accept any liability for loss, damage, personal
injury or death occurring as a result of taking up the prize except where it is caused by the
negligence of the Promotor or its agents or that of its employees. Your statutory rights are not
affected.
9. Twitter:
This competition is in no way sponsored, endorsed, administered by or associated with Twitter.
You understand that by entering into this competition you are providing your information to
the Promoter and not to Twitter. The information you provide will only be used for
communications associated with this competition or for further brand communication if the
entrant has specifically opted into receive such communications.
10. Data Protection And Publicity:
a. By entering into this competition, you agree that any personal information provided by you
with the competition entry may be held and used only by the Promotor or its agents and
suppliers to administer the competition.
b. If you are the winner of the competition, you agree that the promotor may use your name,
image, town or county of residence and answers to the 28 questions to announce the winner
of this competition and for any other reasonable and related promotional purposes.
11. General:
a. If there is any reason to believe that there has been a breach of these terms and conditions,
the Promotor may, at its sole discretion, reserve the right to exclude you from participating
in the competition.
b. The Promotor reserves the right to hold void, suspend, cancel, or amend the prize
competition where it becomes necessary to do so.
c. These terms and conditions shall be governed by English law, and the parties
submit to the exclusive jurisdiction of the courts of England and Wales.
