WHAT YOU NEED TO KNOW TO REGISTER
AS AN AGENT
INTRODUCTION
The University of Washington (UW) is committed to operating its athletics program in full compliance with NCAA rules
and the laws of the State of Washington while protecting
the eligibility of UW student-athletes. As a part of that
commitment, the UW athletics department has developed
policies and procedures designed to ensure that individuals wishing to provide professional representation to UW
student-athletes abide by all applicable NCAA rules and
the State of Washington Uniform Athlete Agent Act (the
“Washington Agent Act”).

AGENT REGISTRATION POLICY
This brochure is designed to provide agents and other
interested individuals with basic information related to
UW’s agent policies and registration process. This brochure is designed to serve only as a quick reference to
some of the most important rules and laws that govern the
conduct of agents within the State of Washington. It remains the agent’s responsibility to understand and follow
all of the applicable rules and laws at all times.
Thank you for your cooperation and for taking the time to
read the information contained in this brochure. We hope
that you share our commitment to compliance and protecting the eligibility of UW student-athletes and amateur
status. If you have any questions regarding NCAA rules or
UW’s agent policies and procedures, please contact the

A. Application
C. Approval
Agents wishing to contact and represent UW studentathletes must submit to the UW compliance office a fully
completed and signed Agent Registration Application.
The act of submitting the application constitutes an agreement by the agent to follow all applicable NCAA rules, UW
policies and Washington state laws related to agents.
Please contact the compliance office or visit the compliance website to obtain a copy of the application.
When an agent’s application is approved, the
agent’s name, application and brochures/contact
information shall be included in a portfolio of approved registered agents housed in the compliance
office and available for review by all UW studentathletes.
B. Review and Response
Within 14 days of receiving the agent’s application, the
UW compliance office shall notify the agent in writing as
to whether the application has been approved or denied
or whether additional information is needed. Grounds for
denial of an application (or revocation of an approved
application) include, but are not limited to, the following:
•
Conviction of a crime involving moral turpitude or any
other crime that would be a felony if committed in the
State of Washington.
•
Committing any act (or failing to act in a manner) that
has ever resulted in: (i) any sanction on a studentathlete or educational institution; (ii) any suspension
or declaration of ineligibility of a student-athlete to
participate in intercollegiate athletics.
•
Making any materially false, misleading, deceptive or
fraudulent representation as an agent or in the application for licensure/registration as an agent in any
state.
•
Engaging in conduct prohibited by UW, the Pac-10
Conference, the NCAA or the State of Washington.
•
Having licensure/registration as an agent revoked,
suspended, denied or refused for renewal in any
state.
After an agent receives notice from the UW compliance office that the application has been approved,
the agent shall be permitted to have contact with the
UW student-athletes identified in the application. If
the agent wishes to have contact with other UW
student-athletes not named in the application, the
agent first must provide written notice to the UW
compliance office before contact is allowed.
D. Renewal/Update Obligation
An agent’s registration with UW shall be valid for two
years from the date of notice of acceptance by the
compliance office. It is the agent’s obligation to renew the registration before the expiration of the twoyear period by submitting an updated application.
Note: During the two-year period that the agent’s
registration is valid, if there are any material
changes to the information disclosed in the registration application, it is the agent’s duty to immediately
update the information with the UW compliance
office.

Important: The UW prohibits any contact between an
agent and any UW student-athlete unless the agent has
disclosed all of the information required by the State of
Washington Agent Act and the agent’s registration application has been approved by the UW compliance office.

DUTIES AND OBLIGATIONS OF THE AGENT
Agents are required to abide by all applicable UW policies, NCAA rules and the Washington Agent Act at all
times. Some of the most important policies, rules and
laws are summarized below:
An agent may not engage in any conduct that would
jeopardize the eligibility of a UW student-athlete, including the following:

An agent may not enter into any contract (oral or
written) with a student-athlete with remaining eligibility for the purpose of marketing the studentathlete’s athletics ability or reputation in a particular
sport. This prohibition applies even if the agent
only agrees to represent the student-athlete in the
future after his or her eligibility is exhausted.
An agent (or any other person associated with an
agent) may not provide any benefits or gifts to a
student-athlete with eligibility remaining or to any of
the student-athlete’s family or friends. Impermissible gifts and benefits include, but are not limited to,
transportation, money, clothing or gifts of any kind,
regardless of value.
An agent must not pre-date or post-date any contract
for representation with a UW student-athlete and may
not ask or allow a UW student-athlete to waive any
rights afforded to the student-athlete under the Washington Agent Act.
If a UW student-athlete with remaining eligibility voluntarily chooses to forego his or her remaining eligibility
and enter into a contract with an agent:

The contract must meet all of the requirements set
forth in the Washington Agent Act, including the
requisite written warning to the student-athlete
about the impact that signing the contract will
have on his or her eligibility.

The failure to abide by the UW policies, NCAA rules
and Washington Agent Act as they relate to UW student-athletes may result in the following actions taken
against the agent:

with a UW student-athlete, the agent and the student-athlete must provide the UW Director of Athletics and the student-athlete’s head coach with
written notice of the potential contract and a copy
of the athlete agent disclosure form.

a UW student-athlete, the agent and the studentathlete must provide the UW Director of Athletics
and the student-athlete’s head coach with written
notice of the existence of the contract.
Note for lawyers and financial advisors:
At the first contact with a UW student-athlete, the agent
must provide to the student-athlete a fully completed
and accurate athlete agent disclosure form as required
by the Washington Agent Act.

NCAA rules permit student-athletes to consult and
financial advisors and receive legal and financial advice. However, if the lawyer or financial advisor engages in any marketing of the student-athlete’s athletics ability or plays any role in negotiations for a contract, he or she will be considered an agent by the UW
and the NCAA and the student-athlete will lose his or
her amateur status
An agent may not provide false or misleading information to UW or to any UW student-athlete or fail to provide information required by UW or the Washington
Agent Act.
An agent must keep copies of all correspondence between the agent and a UW student-athlete and provide
copies to UW upon request.
