Subdivision 1. Members. (a) The commissioner of health shall establish the health​

facility complaints and patient protection working group. The working group shall consist​

of at least 25 members appointed as follows:​

(1) one representative appointed by Stratis Health;​

(2) one representative appointed by the Minnesota Alliance for Patient Safety;​

(3) two representatives of the membership leaders of the Minnesota Alliance for Patient​

Safety appointed by the Board of Directors of the Minnesota Alliance for Patient Safety;​

(4) the ombudsman for long-term care or a designee;​
1.14
(5) the ombudsman for mental health and developmental disabilities or a designee;​

(6) the commissioner of health or a designee;​

(7) the commissioner of human services or a designee;​

(8) one representative appointed by the Minnesota Elder Justice Center;​

(9) two providers of older adult services, one appointed by LeadingAge Minnesota and​

(19) two members of the house of representatives, one appointed by the speaker of the​
house and one appointed by the minority leader.​
(b) The appointing authorities under this subdivision must complete their appointments​
no later than July 15, 2017.​

Subd. 2. Duties; recommendations. The health facility complaints and patient protection​

working group must consider ways of improving the reporting and investigation of reports​
2.9
of maltreatment of vulnerable adults by the Office of Health Facility Complaints, and​
2.10
consider ways of implementing proven safety and quality improvement practices and​
2.11
infrastructures for long-term services and supports. In developing its recommendations, the​
2.12
working group shall consider at least the following:​
2.13
(1) immediate interim actions that can be taken by the Office of Health Facility​
2.14
Complaints in order to immediately improve systems for processing reports and complaints​
2.15
forwarded to the office;​
2.16
2.17
(2) implementing data collection and data analysis requirements to identify systemic​
issues and trends found while investigating maltreatment reports;​
2.18
(3) data analysis requirements to provide more fine-grained analysis of reports and​
2.19
investigations by provider self-reports, consumer maltreatment reports, and regulatory​
2.20
compliance complaints;​
2.21
(4) disseminating findings of systemic issues and trends to providers and caregivers;​
2.22
(5) improving reporting and investigation workflow by, for example, outsourcing​
2.23
functions, centralizing or integrating reporting between the Minnesota Adult Abuse Reporting​
2.24
Center and Office of Health Facility Complaints, improving staff resource utilization, and​
2.25
published decision trees for providers and regulators;​

(6) developing collaborative work processes between law enforcement and the Office​
of Health Facility Complaints;​
(7) integrating the functions of the Office of Health Facility Complaints into other​
functions of the Department of Health;​

(8) staffing the Office of Health Facility Complaints 24 hours a day, every day; and​

(9) developing methods for improving patient safety in long-term care settings by, for​
2.32
example, implementing data analytics capable of identifying early trends in patient safety,​

encouraging root-cause analysis following adverse patient safety events, and sharing best​

practices and training protocols among providers.​

Subd. 3. Meetings. The commissioner of health must convene the first meeting of the​
3.4
working group no later than August 15, 2017. The representative of Stratis Health shall act​
3.5
as chair. The meetings of the working group shall be open to the public.​

Subd. 4. Compensation. Members of the working group serve without compensation​
and shall not be reimbursed for expenses.​
Subd. 5. Administrative support. The commissioner of health shall provide​
administrative support and arrange meeting space for the working group.​

Subd. 6. Report. The commissioner of health shall submit a report providing the​

recommendations of the working group, including any draft legislation necessary to​
3.12
implement the recommendations, to the chairs and ranking minority members of the​
3.13
legislative committees with jurisdiction over health by January 15, 2018. If the working​
3.14
group continues its work after the submission of its initial recommendations, the​
3.15
commissioner of health shall submit a second report containing the working group's​
3.16
supplementary recommendations and draft legislation.​

Subd. 7. Expiration. The health facility complaints and patient protection working group​
expires on June 30, 2019.​
Sec. 6. APPROPRIATION.​
$50,000 is appropriated in fiscal year 2018 from the general fund to the commissioner​

of health for the health facility complaints and patient protection working group and is​
3.22
available until June 30, 2019. This is a onetime appropriation."​
