The permit holder must manage and operate the facility to ensure that the activities do not
cause environmental pollution. The permit holder is required to carry out regular

South Tipperary County Council is satisfied that, on the basis of the information
available, that the waste activity, or activities, listed hereunder will comply with the
requirements of Section 5 (2) of the Waste Management (Permit) Regulations, 1998.
In reaching this decision, South Tipperary County Council has considered the application
and supporting documentation received from the applicant, all submissions received from
other parties and the report of its engineer.

CONDITION 1 SCOPE OF THE PERMIT

1.1
This permit is for the purposes of waste permitting under the Waste Management (Permit)
Regulations, 1998 only and nothing in this permit shall be construed as negating the permit holder’s
statutory obligations or requirements under any other enactments or regulations, including the Water
Pollution Acts, the A i r Pollution Acts, the Waste Management Act,the Litter Pollution Act, or the
Planning And Development Acts.
1.2
This Waste Permit is issued under the Waste Management (Permit) Regulations 1998 to Mr.Pat
O’Donnell, Ballyboe, Ballypatrick for a facility at, Ballyboe, Ballypatrick, Co.Tipperary. This permit
is strictly non-transferable

of the Waste Management Act, 1996.

CONDITION 2 MANAGEMENT OF THE SITE
The permit holder shall acquaint all staff, employees, lessees and agents, including replacement
personnel, o f the provisions and conditions of this permit.
2.2
A copy of the permit must be kept on site at all times.
2.3
Access to the site shall be controlled by the permit holder to ensure that there is no unauthorised
access.
2.4
The permit holder shall employ the besf available techniques in the avoidance and minimisation of
the production of new wastes on sites and in the recovery of waste brought on site.
2.5
Recovery activities shall only be undertaken by persons authorised to do so by the permit holder.
Comprehensive written operating instructions and procedures, a copy of which is to be sent to the
Permitting Authority, shall be prepared in respect of waste control to assist personnel with
responsibilities in the area. Employees shall receive training adequate to enable them to properly
execute their tasks in relation to pollution control.
2.6
Waste Acceptance Hours and Hours of Operation.
The facility shall only be operated during the hours o f 8.00 and 18.00 Monday to Friday inclusive
and 8.00 and 17.00 on Saturdays.
Waste shall not be accepted at the facility on Sundays or Bank Holidays.

2.7.1 The permit holder shall maintain a Facility Notice Board on the facility so that it is legible to persons
outside the main entrance to the facility. The minimum dimensions o f the board shall be 1200rnm by

2.8
South Tipperary County Council shall have unrestricted access to the premises at all reasonable
times on production of identification, if required, for the purpose o f its hnctions under the Waste
Management Act, 1996.
CONDITION 3: NUISANCES, EMISSIONS AND ENVIRONMENTAL
IMPACTS
3.1
The permit holder shall take adequate precautions to prevent undue noise, fumes,

dust, grit, untidiness, and other nuisances during the course of the works, which would result in a
significant impairment o f or a significant interference with amenities or the environment beyond the
site boundary
3.2
The road network in the vicinity of the site shall be kept free of any debris caused by
vehicles entering or leaving the facility. Any such debris shall be removed without delay. The permit
holder shall take adequate steps to ensure that no material of any sort can fall or be blown from
vehicles delivering waste to the site.
3.4
Vehicles shall not be allowed to queue or park on the public road. Provision shall be
made within the confines o f the site for turning o f vehicles. Adequate turning area is to be provided
within the site, which is capable of accommodating the tipper trucks using the site.
3.4
Emissions to Atmosphere
3.4.1 There shall be no emission to the atmosphere of environmental significance. The Permit
Holder shall ensure that all operations on-site shall be carried out in a manner such that air
emissions including dust andor odours do not result in significant impairment of or

significant interference with amenities or the environment beyond the site boundary.
3.4.2 Dust deposition arising out of activities on site shall not exceed 250mg/m2at the site
boundary averaged over 30days.
3.4.3 The building air extraction system feeding the proposed peat bed filter shall operate such that
a negative pressure is maintained within the building with respect to the external air pressure
at all times when waste or compost are contained within the building, The extraction system
and peat bed filter shall be operated and maintained in accordance with the manufacturers
recommendations and to the satisfaction of the Planning Authority
3.4.4 All effort should be made to ensure no malodours are created.

Water
3.6.1 Un-contaminated surface water may be discharged to soak-pits on site.
3.6.2 All direct discharges of List 1 and List 11 substances as specified in Directive 76/464/EEC to
surface or groundwater (please see Appendix ) are prohibited.
3.6.3 Contaminated surface water may be spread in accordance with Nutrient Management P h s .
3.7
The permit holder shall ensure that waste activities on the site shall be carried out in
such a manner so as not to have an adverse effect on the drainage of adjacent lands, on watercourses,
on field drains or any other drainage system including the public roadway.

3.8
Any loose litter accumulated within the site and its environs shall be removed and appropriately
disposed o f at an appropriate facility on a daily basis.
CONDITION 4 ENVIRONMENTAL MONITORING
4.1
Authorised staff of South Tipperary County Council shall have access to the site at all reasonable
times, for the purpose of their functions under the Waste Management Act 1996, including such
inspections, monitoring and investigations as are deemed necessary by the council.
4.2
If so requested by South Tipperary County Council, the permit holder shall, at his own expense,
carry out such firther investigations and monitoring o f the facility as required by the Council. The
scope, detail, and programme, including report structure and reporting schedule, for any such
investigations and monitoring shall be in accordance with any written instructions issued by the
Council. In the event of pollution of waters in the vicinity of the site, or of leachate discharge onto
adjoining lands, input of waste onto the site shall cease, and remedial measures shall be carried Out
immediately as directed by the Council.

The Permit Holder shall carry out analysis on two samples o f mature compost product produced at
the site within twelve months of the date of commencement of operations. The analysis shall cover
the parameters listed in condition 5.7 below and in addition for purgable organic compounds.
Following receipt of the results of these analyses, the Permitting Authority will determine the
fiequency of further testing.
4.4
The Permit Holder shall undertake an ambient air-quality monitoring progamme at the request of the

CONDITION 5 THE COMPOSTING PROCESS
5.1
All wastes arising from the composting process shall be recycled or recovered as far as is practicable.
5.2
All waste management options utilised shall be agreed in advance with the Permitting Authority.
Residual wastes shall be disposed o f only to permitted or licensed facilities.
5.3
While awaiting disposal, all wastes and by-products shall be collected and stored in designated areas
protected against spillage and leachate run-of€. All waste materials delivered to site and partially
processed waste on site shall be handled within the building only.
5.4
Inert bulking materials may be employed in the composting process.

The volume of compost and waste material held at the facility shall not exceed 1,000 cubic metres at
any time.
The Permit Holder shall notify the Permitting Authority o f the name and address of any new source

The permit holder shall submit a report to South Tipperary County Council, which shall include the
information compiled in 3.2 and 3.3 above. In addition, the permit holder shall include in the report a
written summary of compliance with all of the conditions attached to the permit. This report shall be
submitted for the preceding calendar year by no later than 28 February o f each year andor within
one month o f waste activities ceasing on the site. The report shall be called an Annual
Environmental Report (AER).
7.5
The permit holder shall immediately notift South Tipperary County Council by telephone of
incident which OCCUTS as a result of the activity on the site, and which:
Has the potential for environmental contamination of surface water or gromd water, or
Poses a n environmental threat to air or land, or
Requires an emergency response by the Council
Full details shall be forwarded in writing on the nex? working day.

The permit holder shall make all records available to South Tipperary County Council staff at all
reasonable times, and shall provide any relevant information when so requested by an authorised
person o f South Tipperary County Council.

The permit holder shall pay a n annual contribution of €350 to South Tipperary County Council
towards the cost o f inspecting, monitoring or otherwise performing any fimctions in relation to the
permit activity. The Permit Holder shall pay to South Tipperary County Council this amount within
30 days of receipt of this permit and thereafter on an annual basis. In the event that the fiequency or
extent of monitoring or other h c t i o n s carried out by South Tipperary County Council needs to be
increased for whatever reason the permit holder shall contribute such sums as are determined by the
LA to defiay costs.

The nominated authority may at any time revicw, and subsequently amend the

The permit holder shall not export waste frcm the Statc unIess such export is
fully in compiiarice with the rcquiwment6 of Council Regulations (EEC) No.
259193 of I February, 1993 on the Supervision and Control of Shipments of
Waste within, into and out of the Europcm Community, and appropnale
national provisions arising b i n thc implementation of those regulations
including SI No. 149 (1998).
2.6
The pennit trolder shall be €miliarwith the rcquiremcnts placed on holders of
household or conimurcial waste arising from any bye-laws made under section
35 of the Wastc Management Act, 1996 by the local authorities in whoso area
thc collcction activity is bcing carried out, and shall keep a copy OF all such
byelaws at the address of thc principal place of business,
Where bye-laws referred to in condition 2.6 have becn made by OW or more
of the relevant local auihoritics, the ycrmit holder shall not collcct waste from
holders unlcss it has bcenpresented in accordance with the requirements of the
bye-laws in force in a particular local zuthorily area. .4ny costs arising from
thc implementation of the yrovjsions of such bye-laws shalI be borne by tlic
permit holdcr,
2.8
The permit holder shall idcntiFy all hazards associated with the waste being
collected, and shall bc familiar wilh best practice regarding its 5afe movement
and handling and shall sdnpt all necessary, reasonablble and practicable safety
meusurcs accordingly.
2.9
A documented Emergency Response Proccdure, which shall address any
emergency situation hat may arise shall be maintaiiied by the permit holder
arid be available for inspection. This procedure shall include for an eincrgcncy
response uiu t. replacement vehicles, clean-up equipment, etc in order to
niiiimisr: Uie effects of ffic emergency on fhc enviroimmt. The pcrmit holder
shall submit as part of the first Annual Environmental Report (AER aa detailed

INDUSTFUAL WASTE
1.
The persnit holder shall submit details by tlie 1'' October, 2002, for the writtcn
agreement ofthe Nominated Authority, for the immediate iniplerncntation of a
system for the separate colleclion of dry recyclables from all commercial and
industrial facilitics. Dry recyclables are tu be segregated in accordancc with
the Waste Managemcnt (Packaging) Regulations 1997 and are to include all
packaging waste such as cardboard, glass, alumiiliumltin cans, stecl drums,
plastics, timber ctc. Provisions for 0 t h ~dry recyclabks, not defincd as
packaging, such as mcta,ls, precious metals, plastic components, newspapers,
magazines, office paper etc. are also to bc included in thc delails submittcd.
2.
The permit holder shall submit detaik by the 1'' April, 2003, for the written

local authority immediately aftcr the occurrence of the incident in accordatice
with the requircments of condition 4.2. The procedure for dealing with this

The records maintained by the permit 'holder in accordance with condition 4.3
shdl be made available for inspection by an authorised person of any of the
relevant local authorities at the address ofthe principal place ofbushess of the
permit holder during nonnal office hours.

The pennit holder shall, not later than 28* February in each year furnish to the
noarainaled authority summary information in relation to the waste collection
activities of the permit holder in the p r e c d h g calendar year or part thereof.
This insormation, known as the Annual Enviroimental Report (AER), shall be
provided in an approved electroiik format. The AER shall contain the

industrial facilities. Dry recyclables are ta be segregated h accordance with
