Having regard to Article 12(1)(l) of Decree-Law No 39 of 28 April 2009, converted with
amendments by Law No 77 of 24 June 2009;
Having regard to Directive EU 2015/1535 of 9 September 2015 of the European Parliament and
Council that establishes an informational procedure in the area of technical standards and
regulations as well as rules related to information society services (codification);
Having regard to Article 22(1) of Law No 289 of 27 December 2002, as amended, on measures
to combat the illegal use of equipment and gadgets for recreation and entertainment;
Having regard to Article 110(6), of the consolidated text of public safety laws (TULPS), as
described in Royal Decree No 773 of 18 June 1931 and subsequent amendments thereto, on the
characteristics of recreation and entertainment machines that provide cash prizes and, in
particular, those set forth in 6(b), which are only activated in the presence of a connection to a
processing system of the data transmission network pursuant to Article 14(a)(4) of Presidential
Decree No 640 of 26 October 1972, as amended;
Having regard to Article 14(a) of Presidential Decree No 640 of 26 October 1972, as amended,
which lays down the activation of the network of the Autonomous Administration of State
Monopolies for the electronic management of gaming machines, video terminals and lawful
gaming;
Having regard to the Directorial Decree of 23 April 2007, as amended by the Directorial
Decrees of 31 October 2007 and 4 December 2007, laying down the terms and procedures
relating to dealer communications for the determination of the one-off tax withdrawal (PREU);
Having regard to the Directorial Decree of 12 July 2007 on control methods for payments of the
one-off tax withdrawal owed on gaming machines;
Having regard to the Directorial Decree of 1 July 2010 as regards the methods of paying the
one-off tax withdrawal due on the gaming systems (VLT) under Article 110(6)(b) of the
TULPS;
Having regard to the Directorial Decree of 22 January 2010that introduced the technical and
operational requirements of VLT gaming systems under Article 110(6)(b) of the TULPS;
Having regard to Article 23c of Decree No 95 of 6 July 2012, converted with amendments by
Law No 135 of 7 August 2012, which provides for the incorporation of the Autonomous
Administration of State Monopolies into the Customs Agency, which is now the Customs and
Monopolies Agency;
Having regard to the Decree of 6 June 2014 on the application method of the 6 % surtax for
winnings over EUR 500;

Having regard to EU Directive 2015/849 of 20 May 2015 of the European Parliament and of the
Council on the prevention of the use of the financial system for money laundering purposes or
terrorist financing;
Having considered that it will be necessary to transpose EU Directive 2015/849 of 20 May 2015
into the legal system;
Having regard to Article 1(942) of Law No 208 of 28 December 2015, the so-called "2016
Stability Law";
Having considered the need to define and update the operational rules of devices and gadgets
for recreation and entertainment referred to in Article 110(6)(b) of the consolidated text of
public safety laws (TULPS) and subsequent amendments;
Having fulfilled the information procedure laid down by the EU Directive 2015/1535 of
9 September 2015 of the European Parliament and of the Council;
THE FOLLOWING DETERMINATION IS ADOPTED
Article 1
Definitions
1. The following definitions shall apply in this decree:
a.
ADM, the Customs and Monopolies Agency;
b.
licensee, the subject selected by the ADM, according to a public procedure for the
awarding of public activities and functions for the activation and operational
management of the network for the electronic management of legal gaming by means
of the recreational and entertainment devices referred to in Article 110(6) of the
TULPS;
c.
game, software present in the video terminal unit and possibly in part on the central
system, which graphically reproduces the outcome of each bet to each player, as
determined on the basis of the numbers produced by the RNG;
d.
jackpot, the set of progressive accumulations intended for winnings, derived from a
portion of amounts previously bet on video terminal units that contribute to the
accumulations themselves, as defined by the gaming system;
e.
ODC, Certification Body, certification body pursuant to Regulation (EC)
No 765/2008 of the European Parliament and of the Council of 9 July 2008, accredited
by a national accreditation body or other State;
f.
round, the set of one or more bets at the end of which any eventual winnings are
determined;
g.
bet, the operation of the player who starts a phase of the game that leads to an
outcome;

h.
telematic network linking the gaming system and the control system, the hardware
infrastructure and data transmission software created licensee and entrusted to said
licensee to operate, which allows the connection and communication between the
gaming system and the control system;
i.
hall, environment dedicated to housing games by means of video terminals;
j.
game session, the set of operations performed on a video terminal unit, starting from
when the credit of the video terminal unit passes from zero to a value greater than
zero, and ends with the delivery of a ticket or the exhaustion of said credit;
k.
control system, the processing system for the management and control by the ADM,
of all of the data and information provided by the gaming system, as well as for
requests and/or communications to the gaming system;
l.
gaming system, the technological platform required for games to be offered through
video terminal units. The components of the gaming system are:
1)
central system, the set of computerised systems that allow the management and
control of the gaming system. The components of the central system are:
i.
the audit system, the set of computerised systems that store the data
exchanged and related transactions in real time between the components of
the central system, the hall system and video terminal units;
ii.
accounting system, the set of computerised systems to store accounting data
relating to the gaming system, each game, video terminal unit, hall and
ticket;
iii.
gaming management system, the set of computerised systems to control the
correct operation of gaming software and the management of distribution
operations of authorised games on each video terminal unit, potentially also
by means of the hall system;
iv.
RNG (Random Number Generator), the random number generator used in
determining the outcome of each bet;
v.
cross-ticketing, where applicable, the set of functions that allow the
interoperability between the tickets of different gaming systems of the same
licensee;
2)
backup and recovery system, the set of computerised systems physically located
on a site other than that in which the central system is located, which ensure the
operational restoration of the entire gaming system through redundancy, disaster
recovery solutions and backups, and at least one copy of the databases in the
shortest time as possible, of not later than 24 hours;
3)
hall system, where applicable, the computerised system that manages the
operations to and from the individual video terminal units, including those

relating to communication, accounting and potentially the generation and
validation of tickets distributed by video terminal units, even automatically;
4)
video terminal units or VLT (Video Lottery Terminals), each entertainment
device referred to in Article 110(6)(b) of the TULPS, whose operation is only
permitted if it is connected with the central system directly or through the hall
system, including peripheral devices required for the game to take place. This
includes devices for the insertion and dispensing of coins and/or banknotes and/or
tickets, as well as of the reading/writing devices of smart cards, software and
hardware devices for game operation and the data transmission connection;
5)
telematic network linking to the gaming system, the hardware and software
data transmission infrastructure that allows the connection and communication
between all of the components of the gaming system;
m. ticket, proof of identity suitable for starting a round and/or for the collection of the
nominal value stated, once validated by the gaming system;
n.
winnings, the amount earned by the player at the end of a game, following the
winning outcome of one or more bets;
Article 2
Technical characteristics, minimum requirements and operational method of the gaming system
1. All of the components of the gaming system must be synchronised through a single source,
using the Coordinated Universal Time (UTC) as a reference.
2. The gaming system must be equipped with the following security features able to guarantee
protection against unauthorised access and the unalterable nature of game data.
3. The gaming system must identify each bet, game and game session.
4. Each game must ensure returns in winnings of a percentage not less than 85%. The
verification of this percentage during operation, both with reference to the gaming system
as well as each individual game, is performed through monthly monitoring from the
minimum number of games that allow compliance with the minimum rate of return.
5. The gaming system must ensure a real-time dialogue between all of its components.
6. By means of the central system, the gaming system must ensure the following for the
exercise of supervision and control:
a.
the distribution and the proper functioning of the individual authorised games, as well
as their installation, removal, enabling and disabling;
b.
the real-time distribution of the numbers produced by the RNG, excluding the
possibility of them being stored before their use;
c.
storage and tracking of game data in real time;

d.
solutions that make rapid access to game data possible in a structured form through
use of databases;
e.
automatic verification procedures to be performed at least once daily on the integrity
of the software installed on each component of the gaming system, inclusive of the
software installed on each video terminal unit, comparing the strings generated by
the automatic verification tests with those on the central system;
f.
constant monitoring of the correct operation of components of the gaming system;
g.
the performance of blocking procedures, foremost in automatic mode, for all of the
components of the gaming system, in the vent of events that signal malfunctions
and/or attempted tampering, inclusive of those for the modification of installed
software as detectable by the integrity test;
h.
the interruption and/or the restoration of all of the components of the gaming system;
i.
the validation of the ticket issued within 90 days preceding that in which it was
presented for cashing in by the player. For tickets brought in later, when permitted,
validation may only be allowed through mechanisms made available to the ADM;
j.
the cancellation of tickets for which a reprint was made, ensuring the unique
association between the ticket cancelled and that replaced;
k.
the reconstruction of the games played on each video terminal unit, not necessarily
in graphic format.
7. The gaming system must make available all of the information stored for the last 6 months,
and the accounting information referred to in paragraph 13, for the last 2 years, available in
real time. After said period of time, such information, if not available in real time, must be
transferred to a special non-rewritable device that ensures its readability, and kept for at
least the following 5 years.
8. The RNG can be created with software and/or hardware devices, and must reside in the
central system; in order to determine the outcome of each bet, the random numbers to be
generated must respect the properties of randomness, statistical independence,
equiprobability, non-repeatability, unpredictability and non-deductibility; the random
numbers and the results therefrom may not be accessible before being used by the gaming
software on the video terminal unit.
Statistical tests required to determine compliance with the aforementioned properties must
meet a 99% confidence level.
9. The electronic network linking the gaming system must include features and technologies
at least similar to those available in current broadband connections. This network can be
created on existing connections through the use of virtual private networks (VPN), and must
be exclusively dedicated to the transmission and reception of data between the components
of the gaming system.
10. The communication protocols between the components of the gaming system must
guarantee dialogue confidentiality through the use of cryptographic algorithms, with a level

of protection at least equivalent to that provided by the TLS protocol with 1024-bit RSA
and 3DES. The protocols used must implement error detection techniques and recovery
mechanisms, and guarantee the inalterable nature of contents.
11. The telematic network linking the gaming system and the control system must include
features and technologies at least similar to those available in current broadband
connections.
12. The gaming system must communicate with the control system according to the methods
described in the specific communication between the control system and the gaming
system, without the interposition of any application component that is capable of processing
the sending/routing of messages.
13. The gaming system must send the control system accounting information on a daily,
monthly and yearly basis as regards the day, month and year preceding the year of
transmission, as provided for in the communication specifications. This information shall
particularly concern the total of the amounts wagered for the rounds, the winnings earned,
broken down by game and the amounts deposited and disbursed, broken down by:
a.
gaming system;
b.
hall;
c.
video terminal unit.
14. The gaming system must provide for the implementation of parametric functions that allow
for:
a. the determination of a surcharge, calculated by applying a predefined percentage for
each winning exceeding a set amount; the display of such surcharges on the video
terminal unit, to be made explicit to the player when winning occurs;
b. updating of text-based and/or graphic information to be printed on the ticket, pursuant
to Article 8(3)(a), (b) and (c), where applicable;
c. display information to the player as regards exceeding an amount or time threshold
played during the game session;
d. the cashing in of the ticket only after its validation by the central system, directly in
the hall when its nominal value is less than the limit provided for by law; if the
nominal value is equal to or greater than the limit provided for by law, it must be
cashed in at the licensee's location.
15. The gaming system must allow the viewing of the detail of money deposited as well as
amounts bet and lost in the game session on the video terminal unit at the player's request.
16. If the gaming system includes a cross-ticketing function, it must:
a. maintain a separate and independent accounting by other gaming systems with which
it can interoperate by means of an exchangeable ticket;

b. use a single and unambiguous identification criterion of the ticket, such that the ticket
includes the identifying information of the gaming system that originated it as well as
that of the hall in which it was issued.
17. The gaming system must allow the following operations only upon authorisation by the
control system:
a. installation and termination of a hall system;
b. handling and variation of a hall system;
c. installation and termination of a video terminal unit;
d. modification of identifying data of a video terminal unit;
e. handling and variation of a video terminal unit;
f.
installation and enabling of a game on video terminal units;
g. creation of a jackpot;
h. transfer of the amounts accumulated in the form of a hall jackpot, game jackpot
and category jackpot that have not been disbursed, if any;
i.
any insertion of credit on video terminal units only following the passing of tests
of the eligibility hall in which they are located.
18. The gaming system must be located in Italy or in any other Member State of the European
Economic Area.
Article 3
Information to be stored in the gaming system
1. The game system must be capable of storing information relating to the following by
means of the central system:
a.
the identification codes of the gaming systems and associated individual components,
as well as the halls assigned by the control system and potentially also by the gaming
systems;
b.
the bets, rounds, game sessions, winnings gross and net of the surcharge referred to
in Article 2(14)(a), jackpots and their accumulated amounts as well as the amounts
deposited and disbursed in analytical form for each game, video terminal unit hall,
and for the entire gaming system;
c.
the data referred to in Article 8(3)(d), (e), (f), (g) and (i) for each ticket, as well as
their status;
d.
all status changes (including connections, disconnections, being turned on and off) of
each component of the gaming system, indicating the time stamp of the event;

e.
the software integrity checks of each component of the gaming system, indicating the
time stamp, expected and calculated value and the outcome of the comparison;
f.
the accesses to each component of the gaming system and attempts to access system
components, indicating the time stamp of the event as well as the credentials used;
g.
individual operating blocks, malfunctions and failures, as well as relative maintenance
operations for each component of the gaming system, indicating the time stamp of the
event and its duration;
h.
interventions permitted and carried out on the software and/or hardware of each
component of the gaming system;
i.
messages exchanged with the control system, including the unique identifier, content
and time stamp of sending and reception;
j.
details of cross-ticketing transactions, with the indication of:
- the identification codes of the gaming systems and associated individual
components involved, as well as the halls assigned by the control system and
potentially also by the gaming systems;
- timestamp and type of each operation comprising the transaction;
- identifier and face value of the ticket relating to the transaction
k.
the games available on each video terminal unit, with an indication of their status;
l.
to video terminal units with games in progress, with details of the same;
m. the daily, monthly and yearly totals for each gaming system, game, hall, hall system,
and video terminal, on the:
- the number of games played,
- Total amount of money inserted with detailed information on the methods used;
- total amount of money bet;
- total amount of winnings, with a separate indication of those won as a jackpot;
- total amount disbursed with detailed information on the methods used;
- total amount of validated tickets.
n.
changes of location of video terminals, with the indication of the time stamp of the
event;
o.
the number of video terminals installed in each hall;
p.
detail for each game session as relates to the:
- unique identifier;
- time stamp of the start and end;

- unique identifiers of the games that comprise the game session;
- amounts collected;
- amounts dispersed;
q.
detail for each game, as to the:
- unique identifier;
- time stamp of the start and end;
- amount wagered;
- amount of any winnings;
- detailed data of any jackpot won;
r.
detail for each round, as to the:
- time stamp of the start and end;
- gaming operations;
- random numbers generated by the RNG that determined the outcome of the bet
and symbolic representations of the outcome as shown to the player, inclusive of
any participation in secondary or bonus games;
- result;
s.
insertion/disbursement operations of credit, including with regard to the hall system,
indicating the following data:
- time stamp;
- type of payment instruments used;
- denomination of any banknote/coin inserted;
t.
the jackpots, including those already paid, with details as relates to:
- identification codes assigned by the gaming system and control system;
- identification code of the games and/or hall that contribute to the jackpot;
- time stamp of the events related to the jackpot, indicating at least its creation and
disbursement;
- percentage of the amounts deposited allocated to the jackpot;
- type of jackpot;
- total amount of deposits;
- number and amount of bets made to be used in the accumulations;
- unique identifier of the game that led to the eventual winner;
- identification codes assigned by the gaming system and control system of the
video terminal unit and the hall at which winnings in the form of a jackpot were
earned.

Article 4
Monitoring Tools
1. For supervision and control purposes, the gaming system must provide and make
monitoring tools available that enable real-time access to information on the status of the
components of the gaming system as well as information stored at the central system
pursuant to this decree.
2. By means of real-time dialogue functions and user-definable time intervals for each
component of the gaming system, monitoring tools must offer an analysis of the following,
potentially selectable through the topology of the system itself:
a. the ability to perform searches on all of the information stored by using appropriate
search criteria;
b. the ability to view the result of queries made;
c. the ability to export the result of queries directly into spreadsheets, or alternatively
into a text file with field separators such as to facilitate its subsequent import into
spreadsheets.
3. The monitoring tools of the gaming system must ensure the return of the requested
information through appropriate queries made within a maximum time frame of 48 hours.
Article 5
Cross-ticketing function
1. If present, the cross-ticketing function must:
a. be a component of the central system of each gaming system involved, made in a
scalable manner, and must implement that laid down by the guidelines in order to
perform cross-ticketing;
b. ensure communications reliability and security mechanisms at least equal to those
provided for in the gaming systems, as well as error handling;
c. allow the complete independence of communications between the various gaming
systems involved;
d. provide the real-time management of transactions;
e. ensure the complete traceability of operations;
f.
ensure that the accounting systems of the gaming systems involved remain consistent
even in the presence of communication failures in the management of transactions
related to the exchange of tickets;
Article 6
Hall features

1. The hall system, if present, must be installed in the hall and uniquely identified within the
gaming system. If the hall system has automatic management features, such system must
be equipped with:
- acceptor/dispenser of banknotes;
- acceptor/dispenser of tickets;
- acceptor/dispenser of coins;
- access to name-based game accounts referred to in Article 9(2)(c);
- name-based prepaid cards referred to in Article 9(2)(d);
Printing a ticket through hall systems must involve the insertion of banknotes and/or coins,
prepaid cards and information on the identification of the gaming account;
2. Any wireless connections present within the hall must have the safety features laid down
for the safety of the telematic network linking to the gaming system, and must provide
for appropriate protocols for performing mutual authentication and encryption between the
wireless unit and the authentication server, ensuring the integrity and confidentiality of the
data transmitted.
3. In addition to being adequately sized in order to ensure the proper operation of all of the
video terminal units installed, the connection between the central system and the
individual hall must be appropriately redundant in order to ensure high reliability.
4. The hall must be uniquely identified with a code assigned by ADM and potentially also by
the gaming system.
5. The hall must be equipped with CCTV video surveillance systems.
6. The hall must be suitable for the purpose of housing games through video terminal units.
Article 7
Video terminal units
1. Each video terminal unit must:
a.
be uniquely identified with a code assigned by the control system and potentially also
by the game system, ensuring its display on the terminal itself;
b.
provide for the automatic verification of the integrity of software of the video
terminal unit on at least a daily basis, applying hashing algorithms to at least 256 bits
to the file types listed below, at minimum:
i.
the game software and its related configuration files;
ii.
the dialogue software with its internal components;
iii.
the firmware of internal components;
iv.
the communications software with other components of the gaming system;

v.
the software that implements the management capabilities and configuration of
the device itself.
c.
include suitable mechanisms to prevent intrusions, tampering and unauthorised access;
d.
include the sending of appropriate messages to the central system, proceeding with
the automatic disabling deposits being made in the game in correspondence with the
occurrence of the following events:
e.
i.
the lack of connection required for the operation of the video terminal unit
with the components of the gaming system;
ii.
removal or malfunctioning of the peripheral devices of the video terminal unit,
including components required for the proper display of the phases of the game,
and if the paper needed to print the ticket is not present;
iii.
intrusion, tampering and unauthorised access, including those aimed at the
modification of software installed;
include adequate safeguards and mechanisms that guarantee the traceability of access:
i.
the protection of internal components of the video terminal unit, including the
logic area;
ii.
access detection with subsequent communication to the central system, by
means of sensors even able to record that performed in the absence of an
external power supply;
iii.
the impeding of the execution of processes or services on video terminal units
outside of those permitted for the operation of the gaming system;
iv.
the inability to install software other than those referred to in paragraph 1(b)
locally on the video terminal unit by means of writing access to fixed and/or
removable memory;
v.
the inability to change the configurations or settings of the video terminal unit,
including but not limited to those relating to processes or services, the BIOS
(Basic I/O subroutine) of the logical unit, date, time, currency, etc.
Article 8
Ticket
1. The ticket must be validated by the central system for cashing purposes.
2. The ticket can only be cashed in after its validation by the central system, directly in the
hall when its nominal value is less than the limit provided for by law; if the nominal value
is equal to or greater than the limit provided for by law, it must be cashed in at the
licensee's location.
3. The ticket must at least contain the following information:

a. the "Legal and Responsible Gaming" and "minors are forbidden from gaming" logos;
b. the wording "Balduzzi warning" as regards gambling addiction;
c. statement concerning the ability to view the chances of winning on the ADM website;
d. unique identifier of the ticket, also in alphanumeric format;
e. the nominal value of the amount in letters and numbers;
f.
an indication of the total amount deposited, bet and won, with the latter both gross and
net of the surtax on winnings referred to in Article 2(14)(a), as well as the number of
games played in the game session at the end of which the ticket is printed;
g. official issuance in Italian date and time;
h. The words "ticket may be cashed in the hall or at the licensee's location within 90 days
of its issuance date, or after solely upon request to the ADM;
i.
identifier of the video terminal unit or the hall system of issuance, the hall, gaming
system, and an indication of the licensee;
j.
in the event of reprinting, permitted only if the ticket is not yet validated by the central
system and is simultaneously cancelled, the words "Replacement Ticket" shall appear in
addition to all the information on the ticket already issued;
k. It must not contain any type of advertisement.
Article 9
Operating features of the game
1. The minimum and maximum costs of a single round are respectively EUR 0.10
(zero/10) and EUR 10.00 (ten/00);
2. Payment instruments permitted for gaming on video terminals are:
a. euro coins;
b. euro banknotes;
c. money available in euros on name-based game accounts;
d. money available in euros on name-based prepaid cards that are not issued by a
bank and not connected to any payment circuit, but strictly for use for the game;
e. tickets not yet validated, bearing a face value in euro and issued by a gaming
system in operation within Italy;
f.
money resulting from winnings in euro not yet disbursed by a video terminal
unit.

3. The amounts of each bet can solely be accumulated in part for subsequent disbursement
as winnings from a jackpot.
4. The outcome of each bet must be independent of other bets; the maximum winnings
for each round, excluding winnings from jackpots, is of EUR 5 000.00 (five
thousand/00).
5. The maximum winnings resulting from the hall jackpot amount to EUR 100 000.00
(one hundred thousand/00).
6. The maximum winnings resulting from the jackpot amount to EUR 500,000.00 (five
hundred thousand/00).
7. The maximum winnings resulting from a category jackpot amount to EUR 100 000.00
(one hundred thousand/00) if referred to rounds played on devices in a single hall and
EUR 500 000.00 (five hundred thousand/00) if referred to rounds played on
equipment in one of more halls.
8. Winnings and residual credits can be disbursed, subject to validation by the game
system, by means of the following:
a. credit in euros on name-based game accounts;
b. credit in euros on name-based prepaid cards that are not issued by a bank and
not connected to any payment circuit, but strictly for use for the game;
c. tickets issued by the gaming system, displaying a face value in euro.
9. In order for the player to begin a round, the following conditions must occur:
-
availability of sufficient credit, amounting to at least EUR 0.10;
-
the start of a bet.
10. To begin a bet, the following conditions must occur:
-
a sufficient betting amount at least equal to EUR 0.10, or part of it, must be
destined to one or more of the options provided for by the game rules, with the
resulting display of the decrease of the amount;
-
start of the game.
11. For the conclusion of a bet, one of the following conditions must occur:
-
creation of a winning outcome with the consequent display of the same and the
increase of the amount available for the continuation of the game;
-
losing outcome.
12. For the conclusion of a round, one of the following conditions must occur:
-
the completion of at least one bet whose total amount is at least EUR 0.10;
-
achievement and display of the maximum winnings according to the game rules;

-
unavailability of credit required for the continuation of the game;
-
choice on behalf of the player to not proceed with the options provided by the
game;
-

13. Bets cannot be cancelled by the player. In the event of interruption of the game by the
gaming system due to technical problems, the player's credit will be updated with the
information present on the central system, which will recognise the credit used only if
the central system has not generated random numbers and the resulting outcomes.
14. Bets for which the central system has not generated random numbers due to
interruption of the game by the game system for problems of technical nature and their
relative results must nevertheless be stored in the central system, but are not required
to be accounted for the purpose of transmission to the control system.
Article 10
Jackpot
1. Amounts paid in the form of jackpots constitute winnings.
2. Winnings intended for jackpots should result from progressive accumulations resulting
from a portion of the previously bet sums on games that contribute to the jackpot. It is
possible to establish a minimum threshold of deposits required necessary to enable the
provision of a jackpot.
3. The gaming system defines the deposit accumulation criteria of the amounts to be
allocated to the jackpot.
4. The gaming system may not allow the viewing of accumulated amounts not able to be
disbursed in the form of jackpots on video terminal units.
5. Jackpots are divided into:
a. system jackpots, which feature:
- contribution of the amount as a part of all bets placed on the games installed on
the gaming system;
- disbursement following a round performed on any of the games installed on the
gaming system;
b. hall jackpots, which feature:
- contribution of the amount as a part of all bets made on video terminal units in
the hall;
- disbursement following a round performed on a video terminal unit of the hall;
c. game jackpots, which feature:

- contribution of the amount as a part of all bets made on a game installed on the
game system, even limited to one hall;
- disbursement following a round performed on the same game installed on the
game system, even limited to one hall;
d. category jackpot that is other than those previous, characterised by:
- contribution of the amount of the parts of certain bets made on games installed
on the gaming system or on the video terminal units of a hall;
- disbursement following a round performed on any of the games installed on the
gaming system or on video terminal units of a hall;
6. In respecting the minimum rate of return in winnings of every single game, they may
not be considered jackpots.
7. In all cases communicated by the ADM, the gaming system must provide the
possibility to increase the system jackpot, if applicable, through the accumulated
amounts, in the form of a hall jackpot, game jackpot and category jackpot, not paid
out.
Article 11
Game features
1. Every single game must:
a. be uniquely identified with a code assigned by the control system and potentially
also by the gaming system;
b. not display images or content contrary to public order;
c. not violate the current legislation governing copyright, trademarks and patents;
d. not display graphics and modes typical of regulations of games for which it is
licensed with other concessions of the ADM;
e. allow the player to view the following information, at minimum:
i.
a demo mode that offers an exemplification of the rules of the game for a
period of time sufficient for its understanding, which can be activated even
before the insertion of the credit;
ii.
the "Legal and Responsible Gaming" and "minors are forbidden from
gaming" logos;
iii.
game instructions in text and/or graphic format;
iv.
indications of the minimum and maximum cost of a single round;
v.
the possible winning combinations and their associated winnings, with an
indication of the maximum achievable winnings, with the exception of the
jackpot;

f.
return in winnings, even in cases in which the player's decisions affect the outcome
of the bet, a percentage of the amounts played no less than 85 % following a
statistical analysis of the winnings allocation algorithm;
g. be characterised by a volatility index that ensures that the indeterminacy on the
percentage of bets made allocated to winnings, due to statistical fluctuations, has a
unilateral confidence interval whose lower end is greater than or equal to 85 %
with a confidence level of 95 %, calculated based on 5 000 000 (5 million) games.
Article 12
Regulations on performing the technical inspection for compliance
1.
Those who are qualified and intend to install a gaming system and its relative games
within Italy for the bet collection of a game must request a technical verification of
compliance from an ODC or SO.GE.I. S.p.A., providing that which is necessary.
2.
The technical inspection of compliance shall, at least, verify compliance with the
provisions of in this Decree, using, at minimum, the following methods:
a) as relates to the gaming system:
i)
ii)

analysis of the source code;
documentary analysis with reference to each component;
compliance test with reference to each component;
statistical tests on samples extracted by the RNG;
verification of the correct communication between the gaming system and the
control system;
b) relative to the game:
i)
ii)

analysis of the source code;
document-based analysis;
analysis of the mathematical model;
verification of the distribution methods of winnings;
compliance testing;
verification of proper integration with the gaming system;
The technical verification of compliance determines the assessment findings for the
purposes of communication to the applicant, identifying:
a) as relates to the gaming system:
i)
ii)
iii)
iv)
v)
identification data;
files deemed critical;
the results of statistical analyses performed on the RNG;
the identification of components;
the types of jackpots available;
b) relative to the game:

the result of analyses conducted;
the rate of return in winnings to the player;
the probability of winning;
4.
In the event in which modifications are wished to be made to a gaming system that is
already successfully verified, a request to an ODC or SO.GE.I. S.p.A. must be made in
order to ascertain the compatibility of the changes with the technical rules set out in this
decree, and the former shall proceed with a new technical verification of compliance,
where necessary.
5.
Bet collection of a game via a gaming system as well as through its related games solely
takes place following a communication by the ADM of the positive outcome of the audit or
its results, and must comply with that specified in the communication.
6.
If any malfunction and/or modifications of the gaming system is found in respect to that
specified in the notice referred to in paragraph 5 above, ADM shall only require the
changes to the gaming system deemed strictly necessary for their resolution, within a
defined time and only if the problems encountered allow for the continuation of bet
collection.
7.
Any expenses specifically associated with technical inspections for compliance remain the
burden of the applicant.
Article 13
Regulatory updates
1.
This measure will take effect from the date to be communicated at a later time, with a
specific decision of the Customs and Monopoly Agency and taking account of the
necessary technical time for the update;
2.
By means of a special provision, the Customs and Monopolies Agency shall proceed to
update the technical rules referred to in this decree for new legal provisions that require
additions or modifications;
3.
The measure referred to in paragraph 2, which is to be adopted within 60 days of the entry
into force of the new legislation, will also define the start date of the new rules, taking into
account the technical times required, investments made and the relevant certification
methods, and will be submitted to the EC informational procedure in the sector of technical
standards and regulations.
