THE ERASMUS MUNDUS ACTION 2, STRAND 1, Lot 8, Latin America European Community Mobility Programme- Grant Agreement 2014-0874/001-001 GRANT AWARD AGREEMENT The Erasmus Mundus Partnership Programme fosters co-operation in the field of higher education between the European Union and Third-countries through a mobility scheme addressing student and academic individual exchanges. The grant is implemented jointly by the Coordinator, the Humboldt-Universität in charge of the joint selection of candidates, the overall financial management of the project and the award of the grant. The Host University mentioned above, is in charge of the academic matters related to the grant including the acceptance of Grantees for study and research stays. Additionally, for Doctoral, Postdoctoral and staff exchange and other cases where applicable, the Home University is involved in the learning or other agreements concerning the programme of work of the Grantee. The Grantee shall agree with his/her Host and (where applicable) Home University a working programme for the period of his/her grant at the Host University. The Grantee shall abide all state and university rules and regulations at this institution. In particular, she/he must participate fully in all course/study components during the entire period of the grant, including the participation in exams, necessary resits and evaluations. All activities shall be duly documented as appropriate. 2. The grant including coverage of insurance and travel will be paid by Humboldt-Universität Berlin upon submission of a confirmation statement, to be sealed and signed by the Host University indicating the actual arrival date and the bank details form. Scholarship grants do financially support exclusively the period of studies at the Host University only. Such periods shall be specified in the reporting by the Grantee. Grantees shall seek the permission to leave from the Host University coordinator in all cases of leave during the grant period except for the periods of regular holidays. Doctoral students outside structured programmes, post-docs and academic staff on exchange shall inform the Host University coordinator by e-mail in case of leave from the agreed places of work at the host university. Grant Award Agreement-EULAlinks-SENSE - 1 3. Grantees shall report on their activities as agreed upon individually with the Home and Host University. Generally, the Grantee shall report to the Host University after the completion of each semester, a final Report has to be submitted no later than 4 weeks after the completion of the grant period. The Report shall include the following documents and surveys: • Letter of Confirmations indicating the actual arrival and departure date: sealed and signed by the Host University; • Copy of Learning Agreements duly signed by the Home and Host Universities within the first month after arrival, and a copy of the Transcript of Records by within the first month after the completion of the grant period; • Copy of transcript of records for the reporting period; • Boarding cards of both arrival and departure dates to be handed over handled or sent by registered mail to the Host University: • Report shall be placed by the Grantee on its moodle management box after each reporting period. The detailed guidelines will be published at the Consortium’s web pages 4. 5. 6. 7. 8. • The Grantee shall promptly notify the Coordinator, including the Home and Host University, on any circumstances which may materially affect the grant. Any changes or interruptions of the agreed programme, changes of the study programmes and institutions where the work is carried out, changes of the academic supervisors, as well as changes in the envisaged travel schedules shall be agreed with the Host Institution in writing (e-mail). The Consortium shall have the right to withdraw from the grant if its start has been delayed by the Grantee with respect to the enrolment- and commencement dates communicated by the Host University. The Grantee shall immediately inform the Host University if s/he envisages problems in meeting such dates for visa problems, due to illness, etc. The Host University will decide if the reasons stated can be accepted and, if appropriate, on new deadlines. The Consortium may terminate the grant and stop any further payments if the report on the progress of work and/or international collaboration with the Host University does not give evidence of the sound execution of the program of work/studies including any breaks for personal reasons. It may also be terminated at any time in case of non-compliance with the terms and conditions of the grant, wrong or false information in the application, disrespect of the rules of law, principles of international cooperation or any action which may seriously affect the reputation of the European Community, the Home or the Host Universities. After termination the obligation to provide the Final Report and study documents shall remain valid. Moreover, any payment the consortium shall be subject to the receipt of the respective funds for funding the grants by the European Commission. The Consortium reserves the right to interrupt payments in case of temporary absence of funds by the European Commission for the project or to terminate this Grant Award agreement in case of persistent absence of funding for the project. Grantees are obliged to respect the agreed period of studies/ research at the Host University. It is essential that in all cases of stays of 10 months or longer this period is accomplished fully at the Host University. In all cases problems are envisaged (because of interruptions of the stay, etc.) to meet this requirement, the Grantee shall immediately consult with the Host University to decide on appropriate measures in order to comply. Grantees shall not accept any other mobility grant during the period of the current EMA2 grant without the written confirmation by the Consortium represented by the Coordinator. If any such grant is offered, s/he must immediately inform the Coordinator seeking permission before acceptance. Failing to do so, renders the present EMA2 grant void and it must be fully reimbursed. Grant Award Agreement-EULAlinks-SENSE - 2 9. Grant payments shall be treated as advances until the acceptance of the Final Report. The grant must 10. 11. 12. 13. 14. 15. 16. be reimbursed fully, or, as to be decided by the Consortium, partially, - If the grant has not been used for carrying out the programme at the agreed places of work; - If its use for the agreed purpose cannot be substantiated, in particular if no evidence of the due participation in courses, exams, etc. can be shown; - If the agreed duration of work at the Host University is not respected. The Consortium reserves the right to withhold up to 10% of the total grant as a retention which falls due after acceptance of the Final Report. In case the Grantee leaves unpaid debts to the host university or e.g. Housing Office, the Consortium shall be entitled to cover the Grantee’s unpaid debts e.g. to the Host University, Housing Office or library from the remaining 10% of the grant and to pay them on the Grantee’s behalf. The application documents submitted to the Consortium, the call announcement outlining further terms and conditions to the mobility scheme and in particular the approved work programme shall form an integral part of this Agreement. The conditions of this grant shall only be changed in writing by agreement of the parties concerned. The Grantee agrees that the Coordinator at her/his Host institution has the right for full access to any of her/his personal study related data (e.g. in the faculties, central university data bases etc), and to submit them to the Host Coordinator, the Consortium Coordinator and any auditor to the program. The Grantee shall make known the EMA2 support wherever applicable, including in any published diploma or thesis works as well as any other publications related to results of the scientific work during the grant. The Law of Germany governs this Agreement and it is subject to the jurisdiction of this country. However, the Coordinator shall have the right to decide on the application of the Law of the country of the Host or Home University, Grantee’s home country or the country of her/his permanent residence and its respective jurisdiction at the time the legal dispute commences. The Host university will support the grantee in the due completion of all academic and administrative commitments related to the scholarship, and offers all opportunities to him available for program students to the extend they are common. Special offers and arrangements are annexed to the present contract. The grant agreement automatically terminates and no costs may be incurred under this grant award agreement after the 14.07. 2016, the termination date of the Consortium´s Funding Agreement with EACEA. 17.
