STATEMENT OF PURPOSE GENERAL BY-LAWS Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 1 of 27 STATEMENT OF PURPOSE 1. Corio Bay Basketball Association Inc. is hereinafter called "The Association". 2. The purposes of The Association are to have effect from the date upon which it became incorporated (17th October 1994) pursuant to the Associations Incorporation Act 1981 are as follows:- (i) To encourage, promote and expand the game of basketball. (ii) To build, control and guide basketball clubs under the Association. (iii) To raise funds as a non for profit organisation to promote the game of basketball. (iv) To promote, assist in promoting and secure the holding of meetings, conventions, conferences, raffles, appeals and competitions to promote the game of basketball. (v) To propose, support or oppose any law, by-law or measure which may or might effect the promotion or holding of any meetings, conventions, conferences, raffles, appeals and competitions to promote the game of basketball. (vi) To print and publish or secure the printing and publication or any books, brochures, leaflets, newspapers, periodicals of other matter which the Association may think desirable for the promotion of any of the objects of the Association. (vii) To choose and manage teams of basketball players to represent the Association. (viii) To settle all questions or disputes on any matter relating to basketball that may be submitted to the Association for its adjudication and determination. (ix) To apply for, obtain, renew, or surrender any license and any permit or authority ancillary thereto in accordance with the provisions of the Liquor Control Act 1987 (Victoria). (x) To apply for, obtain, renew or surrender registration of any trademark which can be registered under the Trade Marks Act 1955 (Australia) and which relates to the name of the Association or to any name suitable for use as a Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 2 of 27 team name and which is associated with basketball and/or with the Association. (xi) To license any other incorporated or unincorporated club to use any such trademark on such terms as the Association deems fit and in particular to enter into arrangements or agreements with the Corio Bay Basketball Club Inc. for the use of the name "Corio Bay Stingrays” and all or any of the trademarks, patent and copyrights associated with such name. (xii) Solely for the purpose of carrying out the aforesaid objects to do any of the following:(a) To purchase, lease, hire or otherwise acquire any real or personal property, which may be deemed necessary or convenient for any of the purposes of the Association. (b) To construct; maintain and alter any buildings, houses or other works necessary or convenient for the purposes of the Association. (c) To take any bequest or gift of property, whether subject to any special trust or not for any one or more of the objects of the Association. (d) To take such steps by personal or written appeals, public meetings or otherwise as may from time to time be expedient for the purpose of procuring contributions to the funds of the Association by way of donations, grants, annual subscriptions or otherwise. (e) To permit any basketball courts and rooms of the Association to be used by other sporting Associations, youth bodies, schools or the like at the discretion of the Association provided that such use shall be subject to the playing and training rights of clubs playing basketball in competitions controlled by the Association. (f) To sell, lease, mortgage, dispose of, hire out or otherwise deal with all or any of the property of the Association. (g) To borrow and raise money in such manner as the Association may think fit. (h) To undertake and execute any trust or any agency business which may seem directly or indirectly conducive to any of the objects of the Association. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 3 of 27 (i) To subscribe to any local or other charities and to grant donations for any public purpose. (j) To establish and support, and to aid in the establishment in support of any other Association formed for objects similar to those of the Association and the Model Rules of which prohibits the distribution of its income and property among its members to an extent at least as great as is imposed on the Association by its rules and/or by the Associations Incorporation Act 1981 (Victoria). (k) To do anything authorised by the said Associations Incorporation Act 1981 and which is not in conflict with these purposes. (l) To do all such other lawful things as are incidental or conducive to the attainment of the objects of the Association. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 4 of 27 BY-LAWS 1. The name of the Incorporated Association is Corio Bay Basketball Association Inc. (in these rules called "the Association"). INTERPRETATION 2.(i) In these rules, unless the contrary intention appears -"Admission fee" means the fee determined by the Committee from time to time to be paid by persons, whether or not they are members, for admission to the Association premises for the purpose of playing in and or watching basketball matches or training. "Association premises" means the whole of the land and buildings owned or controlled by the Association at the corner together with such other land and/or buildings as may be occupied by the Association from time to time in carrying out its purposes. “Committee” means the Committee of management of the Association as defined in the Model Rules of the Association. “Model Rules” means the approved Constitution of the Corio Bay Basketball Association. "Financial year" means the year ending on 30th June in each year. "General meeting" means a general meeting of voting members convened in accordance with the Model Rules and includes an Annual General Meeting. “Committee meeting” means any meeting of Committee members of the Committee of Management also known as the Executive Committee. "Levy" means a financial contribution payable by members generally or by any class of members, other than an admission fee, membership fee, annual subscription, playing fee or payment for goods or services supplied. "Licensed premises" means such part of the Association premises as may from time to time be the subject of any license and or permit issued to the Association pursuant to the provisions of the Liquor Control Act. "Liquor Control Act" means the Liquor Control Act 1968 of Victoria (as amended) or any corresponding Act repealing, replacing or amending the same. "Member" includes members of all classes of membership as hereinafter provided and shall be deemed individual members. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 5 of 27 “Voting Member” includes any club with voting rights as determined in the Model Rules and is represented by a club official nominated beforehand, approved and recognised by the Committee. "Membership year" means that year ending on 31st March in each year. "Ordinary member of the Committee" means a member of the Committee who is not an Officer of the Association under Rule 30 hereof. "Playing, match or team sheet fee" means the fee determined by the Committee from time to time to be paid for the right to play basketball in a competition conducted by the Association. "Secretary" shall include an acting Secretary. "The Act" means the Associations Incorporation Act 1981. "The Regulations" means the regulations under the Act. (ii) Words or expressions contained in these rules shall be interpreted in accordance with the provisions of the Acts Interpretation Act 1958 and the Act as in force from time to time. (iii) In these rules expressions importing the singular shall include the plural, expressions importing the masculine gender shall include the feminine gender, and vice versa in each case. (iv) The rules of an incorporated Association constitute the terms of a contract between the incorporated Association and its members. The Association rules are to be read in conjunction with the Model Rules and the relevant season’s Participation Guide as part of the operating policy of the Association. INDIVIDUAL MEMBERSHIP 3. The first members of the Association shall be those persons who are honorary life members or financial members of Corio Bay Basketball Association Incorporated on the day the Association becomes incorporated under the Act. 4. (i) The Association shall consist of the following classes of members: (a) Ordinary members; (b) Junior members being persons who have not attained the age of 18 years; (c) Social members; (d) Honorary life members; (e) Honorary members; (f) Voting members (this is a club and is not classed as an individual member under this clause, however it is covered in the model rules of the Association) and Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 6 of 27 (ii) No person shall be allowed to become an honorary life member, honorary member or other member of the Association or be relieved of the payment of the annual subscription except by those possessing the qualifications defined in these rules and subject to the conditions and regulations defined herein. APPLICATION FOR MEMBERSHIP 5. (i) A natural person (not a voting member) who is approved for membership as provided in these rules is eligible to be an ordinary member, a junior member or a social member of the Association on payment of the membership fee (if any) and annual subscription payable under these rules. (ii) A person who is not a financial member of the Association at the due time of the Membership Year (or who was such a member at that time but has ceased to be a member) shall not be admitted to ordinary membership or junior membership – (a) Unless he/she applies for membership as provided in sub clause (iii); and (b) His/her admission as a member is approved by the Committee if deemed necessary. (iii) An application of a person for membership of the Association: (a) Shall be made by recording the person’s name and date of application; (b) Shall be recorded for the Secretary of the Association; and (c) Shall be accompanied by the membership fee (if any) and the amount of annual subscription applicable to the class of membership to which the person named therein has applied to be admitted, which amount is not refundable. (iv) The name and date of birth of persons applying to be admitted as ordinary members or junior members of the Association shall be displayed in a conspicuous place on the Association premises. (v) A record shall be kept by the secretary of the number of members as well as the number of voting members of the Association. (vi) Individual members of the Association are not classified as voting members; voting members are the clubs as determined in the Model Rules that qualify for voting membership of the Association as dictated in the Model Rules. (vii) Each voting member (club) is represented by a nominated official of that club who has been approved by the Committee to represent said club and vote on behalf of its members, such voting rights as dictated in the Model Rules. (i) Ordinary members of the Association shall pay an annual subscription of any amount as determined by the Committee from time to time. (ii) Junior members of the Association shall pay an annual subscription of any amount as determined by the Committee from time to time. (iii) Social members of the Association shall pay an annual subscription of any amount as determined by the Committee from time to time. (iv) While the Committee holds any licence pursuant to the Liquor Control Act, then in the event that the Association wishes to fix an annual subscription of less than $10.00 for a class of membership, such subscription shall not become effective unless and until the same is approved by the Liquor Control Commission. (v) Any alteration to an annual subscription approved by the Committee shall not be deemed to be or require any amendment to the rules of the Association. (vi) The Committee may determine to charge a membership fee which shall be payable by the applicant for a class of membership at the time of such application. (vii) If a person shall be accepted to membership on a date later than six months after the commencement of the Association's then current membership year the Committee shall have power in its discretion to fix the amount of subscription for the balance of that year proportionately to the unexpired portion thereof. (viii) If any member shall fail to pay his annual subscription within three months after the same has become due and payable or shall fail to pay any levy within the time determined by the Committee therefore, the Committee shall have power to terminate his membership and no member whose membership has been so terminated shall be re-admitted to membership except upon application and full payment of membership and approval by the Committee where deemed necessary. JUNIOR MEMBERS 7. Junior members under 18 years of age shall not be entitled to vote at or propose motions to a general meeting of the Association, or to be a member of the Committee, or to propose any other person as a member of the Committee. (i) (a) Social members shall be entitled to use all social amenities offered by the Association and have rights of ordinary members, however are ineligible to play in any official game or represent any team of the Association in basketball. (b) Social members shall be eligible for nomination and subsequent appointment to any Committee or sub-Committee of the Association. HONORARY LIFE MEMBERS 9. (i) The Association may at a general Committee meeting elect to honorary life membership of the Association any person who:(a) Has given outstanding service to the Association over a period of not less than ten years; or (b) has given such singular and outstanding service to the Association that election to an honorary life membership is considered by the Association to be appropriate notwithstanding that such service has not continued over a period of ten years. (ii) An honorary life member shall not be required to pay any membership fee, annual subscription, admission fee or levy. (iii) An honorary life member shall be entitled to vote at and propose motions to any general meeting of the Association, and to be a member of the Committee, and to propose any other person as a member of the Committee. (iv) ‘Life’ membership is in reference to the life or existence of the Association, therefore allowing nominations for posthumous honorary life membership. HONORARY MEMBERS 10. (i) The Committee may elect to honorary membership of the Association for a fixed period not exceeding two years any person who in the opinion of the Committee will give outstanding service to the Association or towards the carrying out of the objects of the Association during the period of honorary membership. (ii) Honorary membership may be renewed from time to time as the Committee thinks fit. (iii) An honorary member shall not be required to pay any membership fee, annual subscription, admission fee or levy during the period of honorary membership. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 9 of 27 (iv) An honorary member shall not be entitled to vote at or propose motions to a general meeting of the Association, or to be a member of the Committee, or to propose any other person as a member of the Committee. RIGHTS OF MEMBERS 11. A right, privilege, or obligation of a person by reason of his membership of the Association:- (i) Is not capable of being transferred or transmitted to another person; (ii) Terminates upon the cessation of his membership whether by death, resignation or otherwise. RESIGNATION EXPULSION AND DISCIPLINE 12. (i) A member of the Association who has paid all monies due and payable by him to the Association may resign from the Association by first giving one month's notice in writing to the Secretary of his intention to resign or by not renewing the annual membership fee in the following year. (a) The member then ceases to be a member; and (b) The Secretary will keep record in the register of members only of those whom are current financial members in any particular year. 13. (i) Subject to these rules, if the Committee is of the opinion that a member has refused or neglected to comply with these rules, or has been guilty of conduct unbecoming a member or prejudicial to the interests of the Association, the Committee may by resolution – (ii) (a) Fine that member an amount not exceeding $500; or (b) Suspend that member from membership of the Association for a specified period; or (c) Expel that member from the Association. A resolution of the Committee under sub-rule (i) does not take effect unless(a) At a meeting held in accordance with Model Rules, the Committee confirms the resolution; and (b) If the member exercises his right of appeal to the Association under this rule, the Association confirms the resolution in accordance with this rule. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 10 of 27 (iii) A member of the Committee to confirm or revoke a resolution passed under sub-rule (i) must be held not earlier than 14 days, and not later than 28 days, after notice has been given to the member in accordance with sub-rule (iv). (iv) For the purposes of giving notice in accordance with sub-rule (iii), the Secretary must as soon as practicable, cause to be given to the member a written notice(a) Setting out the resolution of the Committee and the grounds on which it is based; and (b) Stating that the member, or his or her representative, may address the Committee at a meeting to be held not earlier than 14 days and not later than 28 days after the notice has been given to that member; and (c) Stating the date, place and time of that meeting; and (d) Informing the member that he or she may do one or both of the following– (e) (v) (vi) (i) Attend that meeting; (ii) Give to the Committee before the date of the meeting a written statement seeking revocation of the resolution; Informing the member that, if at that meeting, the Committee confirms the resolution, he or she may not later than 48 hours after that meeting, give the Secretary a notice to the effect that he or she wishes to appeal to the Association in general meeting against the resolution. At a meeting of the Committee to confirm or revoke a resolution passed under sub-rule (i), the Committee must – (a) Give the member, or his or her representative, an opportunity to be heard; and (b) Give due consideration to any written statement submitted by the member; and (c) Determine by resolution whether to confirm or to revoke the resolution. If at the meeting of the Committee, the Committee confirms the resolution, the member may, not later than 48 hours after that meeting, give the Secretary a notice to the effect that he or she wishes to appeal to the Association in general meeting against the resolution. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 11 of 27 (vii) If the Secretary receives a notice under sub-rule (vi), he or she must notify the Committee and the Committee must convene a general meeting of the Association to be held within 21 days after the date on which the Secretary received notice. (viii) At a general meeting of the Association convened under sub-rule (vii) – (ix) (a) No business other than the question of appeal may be conducted; and (b) The Committee may place before the meeting details of the grounds for the resolution and the reasons for the passing of the resolution; and (c) The member, or his or her representative, must be given an opportunity to be heard; and (d) The Voting Members present must vote by secret ballot on the question whether the resolution should be confirmed or revoked. A resolution is confirmed if, at the general meeting, not less than two-thirds of the Voting Members vote in person, or by proxy, in favour of the resolution. In any other case, the resolution is revoked. 14. (i) The grievance procedure set out in this rule applies to disputes under these Rules between – (a) A member and another member; or (b) A member and the Association. (ii) The parties to the dispute must meet and discuss the matter in dispute, and, if possible, resolve the dispute within 14 days after the dispute comes to the attention of all of the parties. (iii) If the parties are unable to resolve the dispute at the meeting, or if a party fails to attend that meeting, then the parties must, within a reasonable time, hold a meeting in the presence of a mediator. (iv) The mediator must be – (a) A person chosen by agreement between the parties; or (b) In the absence of agreement – (i) In the case of a dispute between a member and another member, a person appointed by the Committee of the Association; or Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 12 of 27 (ii) in the case of a dispute between a member and the Association, a person who is a mediator appointed or employed by the Dispute Settlement Centre or Victoria Department of Justice. (v) A member of the Association can be a mediator. (vi) The mediator cannot be a member who is a party to the dispute. (vii) The parties to the dispute must, in good faith, attempt to settle the dispute by mediation. (viii) The mediator in conducting the mediation must – (a) Give the parties to the mediation process every opportunity to be heard; and (b) Allow due consideration by all parties of any written statement submitted by any party; and (c) Ensure that natural justice is accorded to the parties to the dispute throughout the mediation process. (ix) The mediator must not determine the dispute. (x) If the mediation process does not result in the dispute being resolved, the parties may seek to resolve the dispute in accordance with the Act otherwise at law. REGULATIONS DEALING WITH THE CONDUCT OF PLAYERS, TEAM OFFICIALS, REFEREES AND SPECTATORS The Tribunal 15. (a) The Association’s Tribunal shall operate in accordance with the Tribunal By-Laws as laid down by Basketball Victoria. The Tribunal By-laws are incorporated as part of these By-laws (b) Tribunals shall usually be held on Mondays at 7.00pm, or at a special time or day, at the request of the Association. (c) The Tribunal shall have the power to suspend, disqualify, fine or otherwise deal with any player, club or affiliated Association official, score bench official, or spectator over any incident arising before, during or out of, any game played under the jurisdiction of the Association or with any matter delegated to the Tribunal by the Association. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 13 of 27 (d) It is the duty of the game officials in any match to report any person who commits any reportable offence as outlined on the Basketball Victoria Report sheet. (e) It is the obligation of any person, to obey the directions given by the Stadium Supervisor, Association Committee member, Referee or Referees Supervisor. It is the duty of officials/employees to take charge of the stadium when basketball is being played. It is the duty of officials/employees to report any misconduct to the Tribunal. REGULATIONS RELATING TO CLUBS/TEAMS & REGISTRATIONS Registration of Clubs/Teams 16. Each Club/Team is to register by completing the entry requirements, paying the prescribed registration fee and lodging the registration and Fee with the Association by the due date (Registration Fees to be determined by the Association prior to each season). 17. The Association may reject the entry of a team due to: (i) Unpaid fines (ii) Proving unreliable in previous seasons (iii) Previous withdrawal from fixtured competition (iv) Non-payment of prescribed fees (v) A CBBA board or committee decision taken in the best interest of basketball for this association (vi) Failure to comply with competition rules 18. Teams may withdraw their entry at any time prior to their inclusion in a fixture without penalty 19. Once teams have been included in a grading fixture or season fixture, all fees paid as required under Section 16 are forfeited. Registration of Players 20. A player is deemed to be a registered member of a member club by being included on one (1) match scoresheet and by taking the court during that game. They are not deemed to be a member of the association until they comply with the requirements set out in these by-laws. Tournaments and Exhibitions 21. Any affiliated Club/Team desiring to take part in an interstate or intrastate tournament or exhibition must apply in writing to the CBBA Committee for permission before the proposed date of the trip. The application must give details of the management of the trip and an assurance that it will be properly Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 14 of 27 conducted. This also includes all representative sides under the control of the Association. The Association may refuse this request in the best interests of Basketball at Corio Bay. 22. Any affiliated Club/Team desiring to conduct a publicly advertised exhibition match or tournament, must apply in writing to the Executive Committee for approval before the proposed date of the match or tournament. PENALTY: In the event of non-compliance with sections 21 or 22, an offending Club/Team can be liable to suspension or fine, or both, as decided by the Executive Committee. Grading Fixtures 23. The first five (5) rounds of each season shall be known as the Grading Phase. The results shall be used by the CBBA to determine the divisions to be conducted within that competition. All regulations of these by-laws are to be applied to Grading Phase games except where specified otherwise. 24. Subject to Section 20, the CBBA Committee may determine that a Grading Phase is not applicable to a competition. The CBBA Committee will determine the conditions for the first five (5) rounds of these competitions. If no conditions are set by the Committee, these rounds shall be conducted as per these by-laws. 25. Promotion and relegation of teams from one season to the next as well as after the Grading Phase will be at the discretion of the Competition Manager and the CBBA Committee. REGULATIONS CONCERNING REFEREES 26. The appointment of a panel of referees to control CBBA games shall be made by the Committee and/or the Association Basketball Director. Referee rosters may be altered in conjunction with the Referees Supervisor and/or Association Basketball Director and Competition Manager. 27. All complaints or comments are to be directed to the Association Executive Committee in writing. The Committee in consultation with the Association Basketball Director may refer any complaint to a VBRA Tribunal if deemed necessary, to investigate complaints of incompetence, misconduct, or nonattendance on the part of any appointed referee. The Tribunal is authorised to take disciplinary action against referees who are found to have offended. 28. Referees appointed to games conducted by the Association are to be properly attired in accordance with the Corio Bay Basketball Association’s dress standards for referees. Failure to observe this requirement will lead to a fine being imposed or being removed from the roster for continued breaches. 29. Referees are to ensure that players do not take the court wearing items that may cause injury. Rules of Basketball (Article 13.2.5) Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 15 of 27 30. Referees will be responsible for ensuring that when players enter the court they are in correct uniform as per these By-Laws. 31. Rates of payment of officials will be determined by the Association annually. These rates may be based on the VBRA rates in force at that time. REGULATIONS GOVERNING CORIO BAY BASKETBALL ASSOCIATION INCORPORATED PREMIERSHIP GAMES Timing and game regulations 32. Premiership points will be allotted as follows: Win: 3 points Bye: 3 points Draw: 2 points Loss: 1 point Walkover/Forfeit: -1 point NOTE: Notified Forfeits MUST be at least 48 hours in advance of the game. 33. A walkover/notified forfeit fine will be decided by the CBBA Committee prior to each season. This fine is to be paid by the offending side prior to playing in any further games to be eligible to receive premiership points. Any team with outstanding fines may be removed by the CBBA from the competition any point during the season. 34. All competitions shall apply the GBNC Heat Policy when applicable. This shall be displayed throughout the centre when determined necessary by the Competition Manager. 35. The games will be conducted under Official rules of the Australian Basketball Federation with the following modifications: (i) A team can only commence a game with a minimum of four players. This excludes competitions below Under 12 age group and the Daytime Social competition (ii) For each minute or part thereof that a team is late, their opponents are awarded one (1) point per minute (or part thereof) up to 10 minutes thereafter the game will be declared a walkover. (Final scores to be shown as 10 -0) Late start points are to be awarded to teams BEFORE the commencement of the game. In the event of an error and the points are not put on, the scoresheet may be amended at the first break in play following the discovery of the error. Points may not be added after the conclusion of the game regardless of the time of the discovery of the error. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 16 of 27 (iii) The game clock is to be started at the scheduled time for commencement of the game provided the referee is ready at the centre. If referees are late attending a game, and the players from either team are not in attendance, the game clock shall be set as if the game started at the scheduled time. If both teams are in attendance, the game clock shall be started when the referees arrive to take charge of the game. (iv) It is the responsibility of the individual player to ensure that their name is entered on the scoresheet prior to the start of each game. Any participant who does not complete their name in full will cause the offending team to forfeit the game in which they played and the player at fault shall be reported to the tribunal. (v) The following timing rules shall be used in all grading and regular season games unless specified in Section 37. Unless specified otherwise, the clock is to stop on all whistles in the last minute of the first half and the last 3 minutes of the second half. Draws are permitted in the following competitions: (i)All junior competitions: 2x 20 minute halves and 2 minutes for half time (ii) Primary School Competitions: 2x 17 minute halves and 2 minutes for half time (iii)All senior competitions: 2 x 20 minute halves and 2 minutes for half time (vi) 36. The following timing rules shall be used in all finals matches. (i) All Junior finals shall consist of 2 x 20 minute halves with 3 minutes for half time. The clock shall stop on the last 1 minute of half time, last 3 of the second half and all time outs. No draws shall be permitted, with 3 minutes overtime to be played until there is a winner. (ii) All Primary School Competition finals shall consist of 2 x 17 minute halves with 3 minutes for half time. The clock shall stop on the last 1 minute of half time, last 3 of the second half and all times outs. No draws shall be permitted, with 3 minutes overtime to be played until there is a winner. (iii) All senior finals shall consist of 2 x 20 minute halves with 3 minutes for half time. The clock shall stop on the last 1 minute of half time, last 3 of the second half and all time outs. No draws shall be permitted, with 5 minutes overtime to be played until there is a winner. All junior competitions shall have the following modifications: (i) No zone shall be permitted. A team found to be running a zone shall be given a warning by the referee. Should the team Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 17 of 27 continue to implement a zone defence, that team shall be penalized with a technical foul on the coach. Repeat infractions of this rule shall result in technical fouls. Should a coach be disqualified for breaching the rule, they shall be reported to the tribunal. (ii) In Under 9 competitions, teams shall be required to drop back behind the half way line before they are permitted to play defence. This shall be administered by the match official. (iii) In all Junior and Primary School Competitions, teams that are leading by 20 points or more shall be required to drop back behind the halfway line before they are permitted to play defence. Should a team breach this rule, a warning shall be given by the referee. Should the team continue to breach this rule, that team shall be penalized with a technical foul on the coach. Repeat infractions of this rule shall result in technical fouls. Should a coach be disqualified for breaching this rule, they shall be reported to the tribunal. COMPETITON REGULATIONS (SPECIAL COMPETITIONS) 37. The following competitions shall have the following special regulations applied: (a) Geelong Championship Mens and Womens shall consist of 4x 10 minute quarters with 1 minute for quarter and three quarter time and 2 minutes for half time. Referees will be required to complete 3-2-1 votes for each regular season game as well as awarding a Grand Final MVP. No draws shall be permitted with 3 minutes overtime to be played until there is a winner. (b) Under 9 competitions shall consist of 2x 15 minute halves with a 10 minute half time. The game shall be administered by a match official whose duties shall be determined by the Basketball Director and/or Referee Supervisor. During the 10 minute half time the court coach shall conduct a training session with both teams. This competition shall use a size 5 ball and shall not use the scoreboard, ladders or finals. The season shall conclude with a round robin. (c) Half time in all senior games conducted on a Sunday night shall involve a half time shot taken by one member of each team. If made, the shooter shall receive a weekly prize as determined by the Basketball Director. All weekly winners shall return on Grand Final night and participate in a shoot off. The first shooter to make a shot shall win a prize as determined by the Basketball Director. Finals 38. Before the commencement of each season the Committee will specify the number of teams and the finals system used for each competition. In the event of the Committee failing to set a specified number of teams and/or finals system, the four leading teams shall comprise the final four which will play a final round in accordance with the “Page System”. Ties for positions will be decided on percentage. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 18 of 27 Playing Regulations 39. (a) Each team MUST supply competent scorers for their own game. Failure to supply a scorer will incur a 10-point penalty. The scorer must remain for the entirety of the game. If for any reason a team is unable to provide a scorer for any portion of the game, then the 10 points shall be applied by the referee. (b) No scorer points start are to be awarded to teams BEFORE the commencement of the game. In the event of an error and the points are not put on, the scoresheet may be amended at the first break in play following the discovery of the error. Points may not be added after the conclusion of the game regardless of the time of the discovery of the error. If the infraction occurs during the game, the scoresheet shall be amended at the first break in play following the infraction. Note: To meet this By-law a team should preferably have an independent person [i.e.: a non-player (this does not mean a coach)], to operate the time clock or control the scoresheet. If no other persons are present, then it can be mutually agreed that a player or a coach may operate the time clock or control the scoresheet. Scorers are considered to be officials for the duration of the match and as such shall not coach or barrack while on the score bench. Scorers will be required to assist the referees in controlling the match when asked to do so by the referee in charge. 40. (a) A senior player who is not wearing the team’s correct uniform will be penalised two (2) points per uniform violation. (b) A junior player who is not wearing the team’s correct uniform will be penalised two (2) points per uniform violation. (c) Violations shall not be awarded during the Grading Phase of the season. Violations shall also not be awarded in the Daytime Womens competition. (d) The point penalty is to be applied before the game. In the event of an error and the points are not put on, the scoresheet may be amended at the first break in play following the discovery of the error. Points may not be added after the conclusion of the game regardless of the time of the discovery of the error. If the infraction occurs during the game, the scoresheet shall be amended at the first break in play following the infraction. Uniform Regulations 41. (i) Permitted numbers (4-15) (20-25) (30-35) (40-45) (50-55) (ii) Shoes which mark the playing surface must not be worn. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 19 of 27 (iii) Players will not be permitted to take the court wearing any item, which in the opinion of the referee is considered dangerous. The following are NOT permitted: Finger, hand, wrist, elbow or forearm guards, casts or braces made of leather, plastic, pliable (soft) plastic, metal or any other hard substance, even if covered with soft padding. Equipment that could cut or cause abrasions (fingernails should be closely cut). Headgear, hair accessories and jewellery. Wedding Rings may be worn if taped. Short must not have pockets. The following are permitted: Shoulder, upper arm, thigh or lower leg protective equipment if the material is padded so as not to cause injury to other players. Knee braces, if they are properly covered. Protector for a broken nose, even if made of a hard material. Spectacles, if they do not pose a danger to other players. Headbands, maximum 10cm in width, made of non abrasive unicolour cloth, pliable plastic or rubber. (iv) Short sleeve T- Shirts / Muscle tops worn under singlets must be the same colour as the singlets or predominant colour of the singlets. (v) Member clubs of the Association that play in club uniforms must have the colours & design voted on by their club members and approved by the Association to be considered registered club uniforms. (vi) The Association will officially approve and retain a sample of all member club uniforms for authenticity. (vii) Numbers must be of the same colour and must be clearly visible on both sides. Taped or texta numbers are not acceptable. (viii) A vertical stripe down the side of the singlet or shorts if different to the rest of the team is not acceptable. (ix) Shorts must be of the same colour and shade. I.E Try boys shorts are not considered black shorts. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 20 of 27 (x) Garments worn under the uniform, such as skins, are permitted to be worn provided they do not protrude below the bottom of the shorts/singlet. Garments such as full length skins are not permitted to be worn unless a medical certificate is provided to the Competition Manager in advance. (xi) The full uniform shall consist of singlets and shorts. NOTE: On any dispute that may arise relating to this By-law the definition of dangerous item/s will be as laid down in Rule 4 Article 13.2.5 of The Official Rules for Basketball. (b) Club teams that have registered Club uniform colours & design will be given preference over non-club teams that have uniforms of a similar colour. Non-club teams will be required to wear an alternative coloured singlet or top. (c) When teams have uniforms of the same colour, or near colour, the first named team on the score sheet shall be required to wear alternative coloured singlets (or tops) for that match. The referee of the game shall determine whether a clash occurs. (d) The team wearing the alternative coloured singlets are to return these to the Stadium Supervisor at the conclusion of the game. Failure to return the singlets (or tops) after use will incur a fine, the amount of the fine will be determined by the CBBA, but in any case will not exceed the replacement cost of the singlets (or tops). Senior Playing Regulations 42. (a) Senior players who have taken the court for any part of FIVE (5) games in a higher division of a Senior Competition are ineligible to take part in any lower division games in that competition. Senior players can only play ONE (1) game per night in a senior competition. The result of playing more than 1 game per night is a forfeit given and the offending player shall be reported to the tribunal. Please note that for the purposes of this rule, any competition deemed a mixed competition or a Championship competition are exempted from this rule. Junior Playing Regulations 43. (a) Junior players should be encouraged to play in the age group for which they are eligible to compete. (i) Junior club teams & independent teams shall enter in their correct age group, & in the division that is equal to that team’s ability. The CBBA Committee may grade a team up or down in the divisions in their correct age group. In the event of the CBBA Committee grading a team to the next higher age group then that team shall play in the appropriate division according to their skill level. (ii) Individual players in club teams or independent teams may play out of their age group and up one age group. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 21 of 27 (iii) The Association discourages juniors playing up more than one age group and juniors are only permitted to play in the senior competition if they are 14 years of age at the time of playing. In circumstances that are exceptional the Committee shall arbitrate upon application from the affected individual. (iv) A Player may request to play in a lower age division, application shall be made to the Committee, and the decision shall be at the discretion of the Committee, based on the player’s skill & physical ability. (v) Junior players who take the court for any part of FIVE (5) or more games in a higher division in any individual age group will be ineligible to play in that lower age division. (Example: A player may not play more than 5 games in Tuesday Under 14 A-Grade and then play in the Saturday Under 14 B Grade competition). (vi) The CBBA reserves the right to restructure any competitions when it believes that it is in the best interests of basketball to do so. The CBBA shall call for applications from all affected players to participate in a draft, from which teams will be allocated to member clubs. The creation of teams through the draft shall be performed by a sub-committee commissioned by the CBBA. Representative Rule 44. (a) All representative players from the Corio Bay Stingrays Representative Program are awarded the following points: (i) Any Stingrays Representative first team player is classed as a 2 point player (ii) Any Stingrays Representative second or subsequent team player is classed as a 1 point player (iii) Any player defined as a home grown player will have their point allocation halved. Home grown players are defined in Section 44(c). (b) No junior team may have anymore than six (6) points on their playing list for the duration the season. Once a player has played for the team, their points are included in the team list regardless of how many games they play. (c) For the purposes of rule 44(a) (iii), a home grown player is defined as: (i) Any player who has qualified for finals in accordance with the CBBA By-Laws with the same club for four (4) consecutive seasons directly prior to the season. (ii) For the purposes of Section 44(c) (i), this means that the final of the four (4) consecutive seasons must be the one that directly proceeds the current season. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 22 of 27 (d) A representative player is defined as any player selected into the Corio Bay Stingrays Representative Program. This includes first, second and third side players. This means that a player who represents another association is not covered under this rule. (e) A player keeps their points allocated to them under Section 36 (a) only in the same age group as that in which they play representative basketball. (f) In the event a player ceases playing within the Corio Bay Stingrays Representative Program, that player maintains their point allocation until the end of the current CBBA season. (g) In the event a player is added to the Corio Bay Stingrays Representative Program after the announcement of the teams is not considered to be a representative player for the purposes of Section 36 (a) until the beginning of the new domestic season. Playing Regulations (Special Condition) 45. In the situation where a club team, playing in its correct age Division is dominating that particular Division, the Committee may, following consultation with the Club concerned, request that Club to self regulate that team. The Association reserves the right to intervene, where a club fails to act, in the opinion of the Association and in the best interests of the competition. The Association shall also maintain a right to instruct Clubs to re-organise teams in any age Division to meet the Association’s Objectives as stated in these rules, to ensure reasonable competition. CBBA Memberships 46. (a) All players are to have a current CBBA Membership. It is the team’s responsibility to ensure that all players have a CBBA Membership. (b) Players who purchase their Basketball Australia registration from other associations must show proof of purchase when affiliating with the CBBA. (c) After a fifth game played, no player shall be eligible to participate without a current CBBA Membership. Grading games shall be included for the purposes of this rule. Any team found to have played an unregistered player shall incur a walkover. Three walkovers given by any team as a violation of this rule will be reviewed by the CBBA and the team may be removed from the competition. (d) Any player who takes the court without a valid CBBA Membership does so at their own risk and are aware that they are not covered by BV Insurance. Mixed Rules Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 23 of 27 47. (a) Mixed teams consist of at least 2 males and 2 females taking the court. The 5th member can be either male or female. Teams may commence the match with only 1 male or female as long as they have 4 players to start the game with. You can not have more than 3 members of one sex on the court at any one time. (b) Key Way Restrictions: Southern Key - Females are prohibited from entering this area. Northern Key - (key closest to the main entrance) – Males are prohibited from entering this area. (c) Both males and females can shoot from outside either key (d) Ten point player rule - Each player is restricted to scoring 10 points for the game. Once all players from a particular team on the score sheet have scored 10 points, each individual may then score in multiples of 4. Myths and Legends Rules 48. (a) All players must be over the age of 35 at the beginning of the season. (b) Each team is permitted no more than two (2) players between the ages of 30 and 35 on the court in any one game. (c) Per sections (a) and (b), GBNC staff are permitted to ask any player within this competition for proof of age. Any player who refuses or is unable to provide proof of age can be prevented from taking the court. (d) Any team found to be in breach of sections (a) and (b) will incur a walkover. Daytime Womens Rules 49. Each team within this competition will be permitted to have one male over the age of 50. It is expected that all males that participate in this league do so for the purposes of inclusion, participation and fair play. This competition is not classified as a mixed competition for the purposes of these by-laws. Sin Bin Rules 50. Any player who incurs two (2) Technical Fouls, for any reason, is to be ejected from the game. 51. Any player who incurs a Technical Foul as a result of verbal abuse towards an official or who disputes a decision of a referee must leave the court for a period of five (5) minutes playing time [Sin Bin]. The five minutes does not include the break between quarters or halves. A second Technical Foul for a Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 24 of 27 similar offence will lead to the player being ejected from the game and subject to possible Tribunal action. Note: Game referees are required to: Instantly penalise any obvious form of dissent, such as disputing calls, critical comments towards Referees or their calls & bad language with a Technical Foul. A second similar offence results in the player being disqualified from the game. (A ‘similar’ offence involves more criticism, dissent etc. resulting in a second Technical Foul) The player who is sent to the Sin-Bin is allowed to be substituted Finals Eligibility 52. (a) Before the commencement of each season the Committee will specify the number of games a player must play for their team to be eligible for finals. These games must be played prior to finals being played. All registered players in the team receiving a WALKOVER shall be credited with playing that game. In the event of the Committee failing to set a specific number of games for finals eligibility then that number shall be set at 5 games. NOTE:-Byes and walkovers do not count toward the number of games played for finals eligibility unless the player takes part in both the game before and after the bye round. (b) For junior players, to be eligible to play in the finals in both the age for which they are eligible to play and in a higher age division, those players must have taken the court in five (5) games in the lower division and in five (5) games in the higher age division. Clearances 53. (a) If a player registered with an affiliated Club desires to transfer to another affiliated Club, that player shall-apply to their former Club for a clearance through the Committee. This shall apply to both senior & junior players. (b) The clearance window will open on the day after the season’s grand final and will close the day after the current Round 5. No clearances will be accepted either before or after these dates. (b) Applications for a clearance must be lodged with the players existing Club and the Club must deal with the clearance within two weeks. In the event it isn’t processed within the two weeks the players’ clearance will be deemed granted unless a satisfactory reason is provided to the Committee by the club. The agreed process for applying for a clearance is to be adhered to, i.e.:(1). Obtain form from online, CBBA or current club Official. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 25 of 27 (2). Complete & have the new club official sign the acceptance section. (3). Return this to the current club official to process. (4). Club either grants or refuses clearance & forward onto the CBBA Office. (c) If that Club refuses the clearance then that player may lodge an appeal with the Committee. This appeal must be accompanied by supporting evidence which must pertain only to the reasons for seeking the clearance. The supporting evidence must be of sufficient detail to allow the committee to assess the appeal. (d) Appellants also have the right to appeal to the BV Regional Appeals Board if they are unhappy with the result of their appeal under Section 53 (c). (e) Players shall not be entitled to play for another Club until their clearance is granted or an appeal has been conducted & the appeal upheld. (f) Should a player be refused a clearance, & subsequently be unsuccessful in an appeal, then that player may stand out of basketball for a period of 20 regular playing weeks, from the date of initial application, to receive an automatic clearance from their former club. (g) Players applying for a clearance must reconcile any outstanding financial obligations with their former Club prior to playing with their new Club. (h) If any affiliated Club team disbands, all the players concerned will still be attached to that Club. Should the Club be unable to place the players in that team, in another of that Club's teams, then all those players shall be granted a clearance or a Permit, subject to these By-Laws. (i) Should a player not compete in a CBBA competition for a period of 12 months then that player shall be automatically declared unattached. (j) All clearances must be lodged with the Association. Approval of clearances must be confirmed by the CBBA. Players shall not presume that a clearance has been granted. (k) A team found to be playing a player, without a clearance, shall lose the premiership points that the team gained for any games that the uncleared player took part in. 54. (a) No official or player of an affiliated Club shall be permitted to offer any inducement to a player of another club, in an attempt to gain that players clearance. (b) Club/team officials & players must first obtain the permission of the Club Secretary of the player concerned prior to interviewing any player regarding a transfer to their Club/team. Corio Bay Basketball Association – By-Laws (Approved 26/06/2013) 26 of 27 The Association shall refer all cases of complaint to the Independent Tribunal for Investigation. The Tribunal will have the power to apply any appropriate penalty for proven breaches of these By-Laws. (c) Teams are not prohibited from requesting a player from another Club or independent team to act as a non-playing coach. Protests 55. (a) Any team wishing to lodge a protest in respect of any game must endorse the scoresheet in the presence of the Referee, signing the intention to protest. The official protest must be lodged in writing with the Association Basketball Director within 7 days of the game. The parties concerned shall be entitled to attend an arranged meeting of the Association Committee at which the protest shall be heard. (b) Members of the Committee connected with either team shall take no part in the proceedings. Any member of the Committee, who was involved as an Official, shall not take part in any decision made in relation to an appeal. Use of Equipment 56. (a) Any person found abusing or damaging equipment belonging to the Association in the Geelong Basketball Netball Centre Stadium shall be subject to disciplinary action enforced by the Committee. (1) A summary of the type of abuse/damage and the penalties are: Ball abuse (violently kicking/slamming into wall etc) -4 weeks banned from the stadium (automatic); -Replacement cost if damaged beyond repair/or cost of repair. (2) Grabbing nets/rings (not during game) -4 weeks banned from the stadium (automatic) -Replacement cost if broken/or cost of repair. (3) Breaking backboards -4 weeks banned from the stadium (automatic); -Replacement cost or cost of repair. Unusual Situations 57. Should any matter arise for which provision has not been specifically made or is ambiguous in these By-Laws, the Association’s Executive Committee of Management shall to the best of their abilities take such action as is necessary to protect the interests of the Association and the conduct of basketball. The CBBA Committee may also act as they see fit on any issue that arises that they feel are in the best interest of basketball.
