REQUESTS FOR LEGAL ASSISTANCE POLICY
Any Board decisions for legal assistance shall be guided by the following:
1. The Board shall only approve requests which are made under provisions
of Article XIV of the By-Laws.
2. Members cannot commit CWEPA to any fee or expense without prior
notice, in writing, to the Board and without the Boards prior approval.
3. Members shall be responsible for paying all fees and expenses. CWEPA,
upon prior approval of the Board, shall reimburse the member as per
these policies or the By-Laws.
4. In matters regarding Civil service and personnel board changes,
reimbursement will be made at a rate of 80% of total costs or any amount
less than 80% as determined by the Board not to exceed $10,000. In
these matters regarding Civil service and personnel board changes,
members will be urged to determine the appropriate appeals process
related to the issue and exhaust all administrative remedies prior to
initiating court action. Members can obtain this information from the
Human Resources Office of the Department of Natural Resources.
5. Members must submit documentation for all fees and expenses incurred
for legal assistance. The Board shall have the right to reject any costs or
expenses not deemed appropriate to the action under consideration.
6. Members may be asked to submit written documentation or provide
testimony to the Board in support of any request for legal assistance.
Information provided to the Board will remain confidential and will only be
used to determine the validity of the members request and not to judge the
merits of the action.
