Mary had a check in meeting with her team on the budget at month two and it seemed to be on
track. The matter is now entering month four and last week the 6th deposition was just
completed (with four more scheduled in the next month) and the 4th reply brief was filed. The
engagement is already over the fourth month budget by $250k and it is still ongoing. Mary met
with a few associates from the team and was informed that throughout the matter, Wiley made
numerous requests for additional work that is reflected in the current legal fees. Mary has
determined this work was out of scope.
How should this be handled? What should be done to prepare for a discussion with the client to
address the out-of-scope work they requested? What should be the firm’s strategy/approach for
discussing and handling the scope changes?
