Driving Safety: a. If you believe that a Vehicle is unsafe to drive due to an "easily" correctable problem (as determined solely by Carhood), for example, a flat tyre, Carhood will work with you to remedy this issue quickly. If you remain uncomfortable with the Vehicle after a fix is performed by a certified, licensed mechanic, you may return the Vehicle to the original pickup location to exchange vehicles, based on availability. Hands-Free: a. Renters must not operate devices that require one or both hands while driving, including but not limited to mobile phones, mobile computers, or devices that allow texting. You must follow any applicable local laws and regulations relating to mobile phone use. 26. Seat Belts: a. The driver and all passengers must wear a seat belt at all times and Renters must also comply with all child restraint laws for children under the age of 7 years. Where requested in advance, Carhood will provide an approved child seat in the rental vehicle. Carhood will take all reasonable care when installing the seat but accept no liability in the event of injury or death of an occupant due to any event. 27. Headphones: a. Renters must not drive while wearing any device that limits the Renter's ability to hear, see, and otherwise judge driving conditions. Further information is available in Carhood's Privacy Policy. -9- 29. Damage: a. Carhood does not review the condition of the Vehicle when it is returned from a rental, as this is not a service that Carhood provides. The Vehicle's owner will review the condition of the Vehicle when they return from their trip. If they discover any new damage, Carhood will search through its records to determine at what point it occurred. For this reason, Carhood may notify you of damage and charge you for any damage caused to the Vehicle up to 6 months after your rental. 30. Rental Start: a. The Renter must contact Carhood when they arrive at their destination airport or other location by phone or smartphone application or by other method specified in their Rental Confirmation. Carhood will inform them of their available transportation options to get to the Carhood facility where they can pick up their Vehicle. 31. Extensions: a. A Renter may call Carhood to see if a vehicle is available for an extended time period. If the Renter wishes to extend the rental and it is available, they will be assessed any additional charges for the new rental days based on current market pricing, with a minimum of one extra day worth of charges. Your original price is not the prevailing price if you wish to extend. The prevailing price is always the currently listed price on the Site. If an extension is not available, the Vehicle must be returned at the original return time. 32. Cancellation: a. Cancelling rentals at least 24 hours before scheduled pickup can be done without any penalty unless otherwise specified. After this time, rentals are refundable excluding one days rental charge. b. Changes to a rental length or time period can be made any time until the scheduled pick up time with no fee except any price difference as calculated by current prices at the time of the change (no refund will be issued for difference in price if the rental is changed with 24 hours of rental start). c. After the scheduled pickup time, changes are no longer permitted and if the Vehicle is not picked up, the value of the booking (maximum 3 days) is lost. For bookings greater than 3 days a refund of the remaining days will be issued. Refunds are calculated by the total amount paid divided by the number of rental days. 33. Returns: a. Renters are ultimately responsible for returning a Vehicle to the Carhood facility they collected the Vehicle from and will be charged significant fees associated with the transportation cost, administration and handling if you do not comply. These charges often exceed $1,000. Once you return the Vehicle, you will then be dropped off at a nearby airport or other transportation hub of your choosing following a post-rental vehicle inspection. - 10 - 34. Late Returns & Failure to return: a. Returning a Vehicle late will result in a fee of $20 per hour for the first two hours and $40 per hour for each subsequent hour, up to a maximum $200 per day. Renters must make every effort to inform Carhood immediately when they know they will be late returning their Vehicle. If a Renter does not return a Vehicle within 48 hours of the conclusion of the scheduled rental period or Carhood has any reason to suspect you do not intend to return the Vehicle, you will not return the Vehicle within a reasonable amount of time, or have intent to defraud Carhood, Carhood will report the Vehicle as stolen to the police. You release Carhood from all liability resulting from doing so. 35. One Way Rentals: a. One-way rentals (picking up at one location and returning at another) are not permitted. 36. No Shows: a. A No Show is defined as failing to arrive within two hours of your scheduled pickup time, or, if you have provided us with valid flight information (air carrier and flight number), failing to arrive within one hour of the at-gate arrival of that flight. A "No Show" will result in your reservation being cancelled and does not entitle you to a refund. If you wish to rebook, there is no guarantee that your originally quoted rate will be available. 37. Locked Compartments and Auxiliary Equipment: a. You are not permitted to open any locked individual compartments in an Owner's Vehicle, including the glove box. b. Auxiliary Equipment: Vehicles are often equipped with auxiliary equipment such as a tow hitch, bike, ski, luggage, or kayak rack or stand, or other accessories. Renters are not entitled to a discount or price refund due to the presence of this equipment, nor may they remove or request removal of such equipment. 38. Responsibility: a. Carhood, its subsidiaries, subcontractors, and operating units (Companies) are not responsible for consequential damages or indirect loss should any of the Companies fail to meet their obligations in connection with a rental transaction. Similarly, you are not responsible for consequential damages or indirect loss should you fail to meet your obligations in connection with the transaction. 39. Impounding of Vehicles: If a Vehicle is impounded during your rental, you will be fully responsible for any towing and storage fees and the fee for the release of the Vehicle from the compound that arise as a result of the impounding, unless the impound was caused by an issue completely outside of your control (such as the registration being expired). It will be your responsibility to assist Carhood and/or the owner to retrieve the Vehicle, or to do it yourself, if it is possible. If Carhood has to arrange for the release of a vehicle from impound a $150 administration fee will be applied. - 11 - 40. Payments for Damage and Accidents – Damage Waiver Cover: a.
