Civil engineers have to deal with more and more issues around contracts, so it's vital to understand how the
law and practices work.
This course is designed to improve your understanding of contracts. It covers contractual conditions, their
legal framework and the management procedure you need to successfully complete projects.
Course aims



To explain the English legal system and its application to civil engineering contracts.
To explain the contents of the contract documents, the contract procedure, the reasons why disputes
arise and how they can be resolved.
To prepare candidates for the ICE Law and Contract Management Examination.
Why take part?
The course is suitable for engineers and associated professionals in both civil engineering and construction. It
can be seen either as support for project management or the first stage for qualification as an arbitrator. The
course has been approved by the ICE as being a suitable preparation for their examination. The full course
(including examination preparation) will require of the order of 120 hours of study time. The course will follow
the ICE's published syllabus.
If you’re working towards your Chartered Professional Review, passing the exam will help to develop your
commercial awareness.
For graduates on approved training schemes, the course could be worth up to five days' approved training per
module (at the discretion of your supervising civil engineer)
Lecturers
The law lectures are given by an experienced university law lecturer. The contract procedure lectures are
given by a range of practitioners from across the industry, dealing with their areas of expertise.

Course Outline
There are two modules, and each has its own exam:
1. Law module
o is divided into Law of Contract, Law of Tort and Law of Evidence. Upon completion, you'll
have a solid understanding of the legal framework in which the Conditions of Contracts sit.
2. Management of contracts module
o is aimed at graduate engineers with practical experience. It will concentrate on questions
around the NEC4 family of contracts and the Infrastructure Conditions of Contact.

We have held our prices for 2017-18 courses and as such the following rates apply. Please note that it is the
individual delegates’ responsibility to confirm if they are the 2 nd or 3rd delegate from their company and pay the
appropriate fee. ICE will not reimburse any misbooked rates and will review all 2 nd and 3rd delegate rates to
confirm they meet ICE requirements.

ICE is offering modules 1 and 2 as individual short courses each of 11 weeks in length. The costs for each
module are as listed below:
Module 1: Law (September – December 2017)
£311 fee per delegate
Module 2: Contract management (NEC4) (January – March 2018)
£455 fee per delegate (additional cost covers the ECC bundle of NEC4 contracts given to each
delegate)

Content
In the Law Module (English legal system) the way in which the law affects the Engineer as employer,
employee, contractor, and consultant and as a party to arbitration will be considered. Topics include:

An introduction to the English legal system


Contract: Principles of contract law with particular reference to construction contracts.
Tort: Principles of civil liability relating to negligence, nuisance and the concept of strict liability, with
the emphasis on case law relevant to the building and construction industry.
Employment law and insurance: Aspects of the law regulating employer and employee relations,
trade unions, industrial injuries, welfare and safety at work.

The Contract Management Module of the course will focus on the material required for Module 2 of the ICE
examination. Participants will be able to discuss actual problems they encounter in their professional work as
far as these coincide with the course content. Topics to be covered include:









principles governing the preparation,
formation and control of civil engineering contracts,
with special emphasis on the suite
of contracts in the New Engineering Contract (NEC4);
tendering procedure
people involved
with the contract and their responsibilities;
payment procedures;
disputes and their resolution.
ICE Examination
The Institution’s examination is held annually in June. It consists of two papers;


Paper 1 (Law)
Paper 2 (Contract Management).
Experienced engineers can substitute Paper 3 for Paper 2. Students may choose to sit the ICE’s Civil Engineering Law
and Contract Management Examination. There is no strict requirement to sit the examination to complete this course.
