MEMORANDUM FOR COOPERATION IN THE FIELD OF EUROPEAN INTEGRATION AND WITH THE EURO-ATLANTIC STRUCTURES BETWEEN THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA AND THE GOVERNMENT OF THE REPUBLIC OF BULGARIA The Government of the Republic of Moldova and the Government of the Republic of Bulgaria, hereinafter referred to as the "Parties", Guided by the spirit and the provisions of the framework Treaty on Friendly Relations and Cooperation between the Republic of Moldova and the Republic of Bulgaria, signed on 7 September 1992, Noting the existing cooperation within the United Nations, the Council of Europe, the Organization for Security and Cooperation in Europe, the Euro-Atlantic Partnership Council, the Black Sea Economic Co-operation, and other international organizations and regional fora, Noting the positive impact of the European Union enlargement on the stability and security in Europe, Confirming the importance of the necessary instruments for the avoidance of appearance of new divisional lines in Europe, Aiming to promote closer bilateral relations and cooperation in support of the implementation of European and Euro-Atlantic values and standards as well as of strengthening the Euro-Atlantic and regional security, stability and cooperation, Taking into account the Accession Treaty of Bulgaria to the European Union, the Agreement for Partnership and Cooperation between the Republic of Moldova and the European Communities and their Member States and Republic of Moldova - EU Action Plan, Taking note of the membership of the Republic of Bulgaria in the North Atlantic Alliance and the intention of the Republic of Moldova to expand cooperation with NATO and to implement an Individual Partnership Action Plan (IPAP), Have agreed as follows: Article 1 The Parties shall be committed to promote mutual cooperation in the field of European integration and with the Euro-Atlantic structures aimed at successful development of the partnership between the Republic of Moldova and the European Union, and to support an enhanced participation of the Republic of Moldova in the Euro-Atlantic Partnership Council and the Partnership for Peace. The Parties confirm their readiness to continue their active cooperation within the Organization for Security and Cooperation in Europe, (OSCE) and they shall do their best to strengthen the role of the OSCE and the efforts of the international community towards the settlement of the Transnistrian conflict. Article 2 The Parties shall cooperate to improve the activities aimed at full exploitation of the possibilities for the Republic of Moldova in the context of enhancing its relations with the European Union. The Parties shall cooperate in the field of European integration, in particular: 1. Efficient implementation of the Republic of Moldova - European Union Action Plan provisions; 2. Strengthening the institutional structure through capacity building, i.e. sharing of experience in reformation process and training of the state officials in the field of European integration. 3. Informing the civil society about the process of the European integration; 4. Making popular the achievements of the both Parties in the field European integration by the conduct of joint consultations, conferences, initiatives and other activities; 5. Harmonization of legislation with that of the European Union. Article 3 The Parties shall cooperate in the fields of visa policy, border control and migration. The cooperation shall be carried out trough consultations, coordination and technical and administrative assistance for: 1. Exchange of information on legislation in force and practices; 2. Building of information systems in the fields of visa policy, identity documents and border control; 3. Physical and technical security of identity documents; 4. Training of experts in the above-mentioned areas. Article 4 The Parties shall work together with the aim to contribute to the strengthening of the Euro-Atlantic Partnership and to the successful development and implementation of the Individual Partnership Action Plan (IPAP) of the Republic of Moldova. The Parties shall cooperate, inter alia, in the following areas: 1. Regular consultations on issues of the Euro-Atlantic Partnership and on Euro-Atlantic and regional security issues of mutual interest; 2. Cooperation within the framework of SEEGROUP and NATO's South East Europe Initiative; 3. Sharing information, experience, and expertise in the area of security and defense policy, defence institutions building; security sector reform; civil emergency planning; military base closure and resettlement and retraining of military personnel, and others, as appropriate; 4. Promoting bilateral and regional cooperation in fighting illegal trafficking of arms, human beings; organized crime; international terrorism, and proliferation of WMD; 5. Administrative capacity building and training of civil servants and military officers for the; purposes of efficient participation in the EAPC/PfP structures and activities; 6. Adapting legislation and promoting best practices in the field of security and defence to meet national needs and commitments undertaken in the context of the Partnership for Peace; 7. Public diplomacy and developing communication strategies to inform society on international security and Euro-Atlantic Partnership issues; 8. Encouraging cooperation among relevant NGOs and academic institutions. Article 5 The Parties shall cooperate in the areas defined in Article 2, Article 3 and Article 4 implementing the following means and methods in their relations: 1. Exchange of information and experience, and practical cooperation between the Parties in the field of European integration and the Euro-Atlantic structures; 2. Exchange of experience regarding the mechanisms for coordination, monitoring and evaluation of national implementation instruments, concerning the reformation process, in the context of alignment with the European Union standards; 3. Planning joint events, such as expert meetings, workshops, conferences, round tables, etc. with participation of officials and experts of the two countries; 4. Training through organizing seminars, courses and internships on issues of European integration and Euro-Atlantic structures and encouraging participation of experts from each Party in international and national seminars and courses organized by the other Party; 5. Developing joint initiatives and projects; 6. Exploring possible twinning mechanisms; 7. Exploring possible expert exchanges in areas of mutual interest, taking into account the available resources of both Parties. Article 6 The Parties may develop annual Plans for the implementation of this Memorandum. Article 7 Each Party may present the results of their mutual cooperation to a third Party having previous mutual agreement of both Parties and in accordance with the provisions of their existing national legislation. Article 8 Nothing in this Memorandum shall prejudice other existing or future agreements concluded between the Parties. This Memorandum does not affect the rights and the obligations of the Parties under any other international agreements. The either Party in conformity with its national legal and administrative provisions, and with its competence and available resources will carry out the implementation of this Memorandum. Article 9 The differences in the interpretation and application of this Memorandum will be settled through reciprocal consultations between the Parties. Article 10 This Memorandum shall enter into force on the date of its signature. This Memorandum shall remain in force for a period of three years. The validity term of the Memorandum may be renewed thereafter by mutual written agreement of the Parties. Article 11 Amendments and additions to this Memorandum can be made by mutual written agreement of the Parties. Article 12 After the expiration of the validity term of this Memorandum its provisions shall continue to be applied with respect to ongoing projects and contracts until their completion, unless otherwise agreed by the Parties. This Memorandum is drawn up in Chisinau on /0 ЛСбЫ/ 2006 in two original copies, each in Moldovan, Bulgarian and Engtfsh languages, all text being equally authentic.
