This Section D1 sets out the rights and obligations between the Shipper and GRTgaz in respect of access to
the Title Transfer Points (PEGs), of the determination of quantities and of balancing rules at such points.

G RT ga z o bl i g a t i o ns
Subject to the provisions of the Appendix D1.1, of the Chapter “Disruption of the continuity of service”
from Section A, and subject to compliance with the provisions of Decree 2004-251 of March 19, 2004 on the
public service obligations in the gas sector, GRTgaz undertakes to take off the quantities of Gas made
available by the Shipper at one or more Title Transfer Points, and to make available to the Recipient at each
of the Title Transfer Points, the quantities of Gas that the Shipper wishes to deliver, within the limits and
conditions defined in this Contract.

S h ipper’s obligations
The Shipper undertakes to a balancing obligation, on a daily basis, on each of the Balancing Zones. The
provisions relating to this balancing obligation is described in the present Section D1.

G en er a l
Title Transfer Points (PEGs) are virtual points where the Shipper trades daily energy quantities:
with other shippers through OTC transactions in the relevant Balancing zone;
with GRTgaz through gas purchases aimed at covering the needs of the Network, and through
purchases/sales of gas for the purpose of the residual balancing of the Network;
with the clearing house of the Exchange at the PEG of the relevant Balancing Zone for the daily
energy quantities relating to the transactions ordered by the Shipper via the electronic platform of
the Gas Exchange (Powernext Gas).
There are two (2) Title Transfer Points, each attached to one of the two (2) Balancing Zones.
On the North PEG, exchanges must be between H-gas and H-gas, or L-gas and L-gas.

Access subscriptions to Title Transfer Points (PEG) are annual and start on the first (1st) calendar Day of any
Month. In the case of a booking request within the month, the fixed access charge is due from the first (1st)
day of that Month. The minimum prior notice period between the Auxiliary Service request and actual
“access to the Title Transfer Point” is seven (7) Working Days.
Acces subscriptions to the North Title Transfer Point (North PEG) allows an access to both H-gas and L-gas
trades.

Each day, the Daily Quantity Taken Off or Delivered by GRTgaz at a given Title Transfer Point is equal to
the Daily Quantity Scheduled by GRTgaz at that point.

The provisions applicable to Nominations, scheduling (matching process) and allocations of quantities and,
more generally, to the use of the IT system for the operational management of daily transmission at Title
Transfer Points, are described in GRTgaz Operational Network Code, in Doc. E.1.2 (Appendix D1.1).

9.1
S h i pp e r b a l a n c i n g
BALANCING OBLIGATIONS
The Shipper undertakes to make all reasonable efforts to ensure that, for each Balancing Zone, and in the
particular case of the North Zone for each Gas quality, each Day the Daily Quantities Taken Off and
Delivered by GRTgaz are equal.
Hereunder, the Shipper Daily Imbalances must be zero, failing which the Shipper is liable to pay imbalance
penalties pursuant to Sub-clause 9.3.
9.2
CALCULATION OF DAILY IMBALANCES
On each Day D, for each Balancing Zone Z, the difference, between, on the one hand:

the total Daily Quantities Taken Off at the Title Transfer Point attached to the Balancing Zone Z
and, for the North PEG, to the Balancing Section corresponding to H-gas or L-gas quality.
and, on the other hand,

the total Daily Quantities Delivered at the Title Transfer Point attached to the Balancing Zone Z
and, for the North PEG, to the Balancing Section corresponding to H-gas or L-gas quality,
divided by one point zero zero two six (1.0026), makes up, if positive, the Daily Imbalance Excess for Day D
on Balancing Zone Z, stated as EXBD(D,Z) and, if negative, the Daily Imbalance Deficit for Day D on
Balancing Zone Z, stated as DEBD(D,Z),
where one point zero zero two six (1.0026) is equal to the quantity of energy expressed in MWh (GCV)
divided by the quantity of energy expressed in MWh (GCV 25°C).
9.3
FINANCIAL MANAGEMENT OF IMBALANCES
The Daily Imbalance Excess or Daily Imbalance Deficit for Day D is purchased (respectively sold) by GRTgaz
on the basis of Price Reference P2, calculated on the basis of the sale-purchase transactions concluded by
GRTgaz on the Gas Exchange.
9.3.1
REFERENCE PRICE P1 FOR WEEK DAYS
If the Day D is a Week Day, for each Balancing Zone Z, the Reference Price P1 for each Week Day (D, Z) is
equal to : the average of the Day-Ahead component and the Within-Day component defined below,
weighted by the maximum Day-Ahead (respectively Within-Day) intervention volumes.

for the North Balancing Zone – H-gas Balancing Section and for the South Balancing Zone:
o the weighted average of the prices of the transactions concluded by GRTgaz for delivery on
Day D at the North Title Transfer Point, respectively at the South Title Transfer Point, for the
Day-Ahead timeframe,
o in the absence of transactions concluded by GRTgaz, the Powernext Gas Spot EOD (End-OfDay) for the Day-Ahead timeframe corresponding to delivery on Day D at the North Title
Transfer Point, respectively South Title Transfer Point ;
for the North Balancing Zone – L-gas Balancing Section:
the sum of the price defined above for the North Balancing Zone – H-gas Balancing Section and
sixteen cents per megawatt-hour (0.16 EUR/MWh).
The Within-Day component is equal to:

for the North Balancing Zone – H-gas Balancing Section and for the South Balancing Zone:
o the weighted average of the prices of the transactions concluded by GRTgaz for delivery on
Day D at the North Title Transfer Point, respectively South Title Transfer Point, for the
Within-Day timeframe,
o in the absence of transactions concluded by GRTgaz for the Within-Day timeframe, to the
price reference determined by Powernext for the Within-Day timeframe corresponding to
delivery on Day D at the North Title Transfer Point, respectively South Title Transfer Point.
This price reference will be determined using the Powernext Gas Spot EOD price reference
method with parameters specific to the Within-Day timeframe, but only insofar as the
market conditions allow, i.e. if the market is open and if it is not necessary to set up a price
committee, as defined by Powernext.

for the North Balancing Zone – L-gas Balancing Section:
the sum of the price defined above for the North Balancing Zone – H-gas Balancing Section and
sixteen cents per megawatt-hour (0.16 EUR/MWh).
Should the Within-Day component be not provided by Powernext at the North Title Transfer Point,
respectively South Title Transfer Point, the Reference price P1 (D, Z) is equal to the Day-Ahead component
as previously defined.
9.3.2
REFERENCE PRICE P1 FOR WEEK-END DAYS
If the Day D is a Week-End Day, for each Balancing Zone Z, the Reference price P1 for each Week-End Day
(D, Z) is equal to:

for the North Balancing Zone – H-gas Balancing Section and for the South Balancing Zone:
o the weighted average of the prices of transactions concluded by GRTgaz for the Week-End
period containing Day D at the North Title Transfer Point (respectively South Title Transfer
Point),
o in the absence of transactions concluded by GRTgaz, to the Powernext Gas Spot EOD (EndOf-Day) for the week-end timeframe corresponding to delivery on Day D at the North Title
Transfer Point, respectively at the South Title Transfer Point ;

for the North Balancing Zone – L-gas Balancing Section:
the sum of the price defined above for the North Balancing Zone – H-gas Balancing Section and
sixteen cents per megawatt-hour (0.16 EUR/MWh).
9.3.3
REFERENCE PRICE P2 (GENERAL CASE)
Each Day D, for each Balancing Zone Z, the Daily Imbalance Excess as defined in Sub-clause 9.2, if it exists
and with the exception of the quantity defined in Sub-clause 9.3.4, is purchased by GRTgaz from the
Shipper at a price equal to:
TQJA2(D,Z) = P2A(D,Z) x EXBD(D,Z)
Each Day D, for each Balancing Zone Z, the Daily Imbalance Deficit as defined in Sub-clause 9.2, if it exists
and with the exception of the quantity defined in Sub-clause 9.3.4, is purchased by GRTgaz from the
Shipper at a price equal to:

TQJA2(D,Z) is the amount in Euros owed by GRTgaz to the Shipper for Day D and Balancing Zone Z

TQJV2(D,Z) is the amount in Euros owed to GRTgaz by the Shipper for Day D and Balancing Zone Z

EXBD(D,Z) is the Daily Imbalance Excess for Day D, for the Balancing Zone Z, expressed in MWh
(GCV 25°C) and specified in Sub-clause 9.2

DEBD(D,Z) is the Daily Imbalance Deficit for Day D, for the Balancing Zone Z, expressed in MWh
(GCV 25°C) and specified in Sub-clause 9.2;

P2A(D,Z) is equal to the Reference Price P1(D,Z), for Day D, defined in Sub-clause 9.3.3, multiplied
by a coefficient of zero point seven (0.7)

P2V(D,Z) is equal to the Reference Price P1(D,Z) , for Day D, defined in Sub-cause 9.3.3, multiplied
by a coefficient of one point three (1.3).
9.3.4
REFERENCE PRICE P2 (CASE OF FORCE MAJEURE)
If, for a Balancing Zone Z, all or part of the Daily Imbalance Excess (respectively the Daily Imbalance Deficit)
results from an event or a circumstance as described in “Force majeure” Clause of Section A, or if GRTgaz is
responsible for triggering it, including where due to the application of “Safety and Operational
Instructions” Clause of Section A, the price P2A(D,Z) (respectively P2V(D,Z)) used to calculate TQJA2(D,Z)
(respectively TQJV2(D,Z)) is replaced by the price P1(D,Z) defined in Sub-clause 9.3 for the quantity under
consideration.
It is understood that the application of the above Sub-clause is limited to the Day D during which the event
or circumstance occurring was notified by the Shipper to GRTgaz or by GRTgaz to the Shipper, as the case
may be, and the day immediately following.
It is expressly agreed that should GRTgaz provide an erroneous value for a Quantity Taken off or a Quantity
Delivered, or does not provide such value, unless such error or absence results from a material breach of
GRTgaz, GRTgaz will not be liable under the terms of this sub-clause, and as a consequence shall not grant
the Shipper any right to bring a claim in respect thereof.
