RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY, AND PARENTAL CONSENT AGREEMENT In consideration of the Youth Dreamers, Inc. allowing me and/or my minor child to participate in the Youth Dreamers, Inc. 5-on-5 Basketball Tournament Fundraiser, I, for myself, and on behalf of my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make the following contractual representations. I understand the nature of a 5-on-5 Basketball Tournament Fundraiser event and that I and/or my minor child am qualified, in good health, and in proper physical condition to participate in such Activity. I acknowledge that if I and/or my minor child believe event conditions are unsafe, I and/or my minor child will immediately discontinue participation in the Activity. I fully understand that 5-on-5 Basketball Tournament Fundraiser event involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the "releasees" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for liabilities, losses, costs, and damages I and/or my minor child incur as a result of my and/or my minor child’s participation in the Activity. I, for myself and/or my minor child, hereby release, discharge, and covenant not to sue Youth Dreamers, Inc.,its respective administrators, directors, agents, officers, volunteers, employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) from all liability, claims, demands, losses, or damages on my account and/or my minor child’s account caused or alleged to be caused in whole or in part by the negligence of the "releasees" or otherwise, including negligent rescue operations; and I further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my and/or my minor child's behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the releasees from any loss, liability, damage, or cost (including attorneys fees) which any may incur as the result of such claim. The team captain or designated parent, if applicable, is expected to aid in controlling teammates’ and team followers’ conduct and to represent his/her team as spokesperson in case of appeals to the court official. Poor sportsmanship could result in penalties against the team in either the Technical, Intentional, or Flagrant foul categories. Failure to comply with the Spirit of the Tournament, with acts such as fighting, taunting, intimidating or verbally attacking a tournament official, player or spectator may lead to removal of that player, team and/or spectator from the tournament. Any ejection from the entire tournament will result in a suspension from the next year’s Tournament, at a minimum. Only team captains and coaches will be able to voice a complaint or raise an issue with Basket ball tournament officials. Decisions made by tournament officials are final, and are not subject to review by video or other recordings, or other sources. The tournament is open to all players ages 17 and up. Because space and time is limited, players intended to participate in the tournament must: a) Pay $20 tournament registration fee per person or $110 for a team of five with one alternate b) Read, understand, & sign the Tournament Rules & Regulations team registration form c) Sign the Basketball Tournament Liability Release and Waiver d) Turn-it-in to Tournament officials via mail or in person before April 14, 2012 Number of Players Each team may consist of a maximum of 6 players and a minimum of 5 players. A team may have only 5 players on the court at any time. All games must start with at least 5 players on each team. The first team to score 13 points with a margin of 2 points wins that game or 25 minute time period, whichever comes first. UNIFORMS: Entry fee includes a t-shirt to wear as team jersey.
