Sellers Agents

In a traditional brokerage system, all real estate agents are on the seller’s side of the transaction. They are agents for the
seller and have a duty to represent the sellers best interests including negating the best price possible and structuring the
transaction to the sellers advantage.

Under a listing agreement with the seller, a sellers agent acts solely on behalf of the seller
·
The seller authorizes a sellers agent to work with buyers agents as outlined in the listing contract.
·
A sellers agent will disclose to the seller know information about the buyer which may be used to the benefit of the seller.
Buyers Agents
·
Under a buyers agency agreement with the buyer, a buyers agent acts solely on behalf of the buyer.
·
A buyers agent will negotiate the best possible priced and structure the transaction to the buyers advantage.
·
Buyers agents will disclose to the buyer know information about the seller which may be used to benefit the buyer.
Dual Agents
·
A dual agency relationship exists when the buyer (client) wishes to purchase property that is listed with their buyer’s agent.
·
The agent then becomes a mediator for both the buyers and sellers.
·
The dual agent cannot disclose the price the seller is willing to accept, the price the buyer is willing to pay or any other
confidential information that may put one party at a disadvantage.
Designated Agency
·
A buyer or seller with a designated agency agreement is represented by agents specifically named in the agreement.
·
Any agents of the firm not named in the agreement do not represent the buyer or seller.
·
The named “Designated” agent acts solely on behalf of his or her client and may only share confidential information about
the client with the agent’s supervisory broker who is also named in the agreement.
·
Other agents in the firm have not duties to the buyer or seller and may act solely on behalf of another party in the transaction
