CIRCULAR
DETAILING A NUMBER OF ARTICLES OF THE GOVERNMENT’S DECREE
NO.19/2016/ND-CP ON GAS BUSINESS DATED MARCH 22, 2016
Pursuant to the Government’ Decree No. 95/2012ND-CP defining functions, rights,
responsibilities and organizational structure of The Ministry of Industry and Trade;
Pursuant to the Government’s Decree No.19/2016/ND-CP on gas business dated March 22,
2016;
The Minister of Industry and Trade hereby issues this Circular detailing a number of articles of
the Government’s Decree No.19/2016/ND-CP on gas business dated March 22, 2016.
Chapter I
GENERAL PROVISIONS
Article 1. Scope and regulated entities
1. This Circular details a number of articles of the Government’s Decree No.19/2016/ND-CP on
gas business dated March 22, 2016.
2. This Circular applies to traders under the Law on Commerce; gas importers, entities producing
and processing dedicated gas for their own interest and other organizations or individuals
participating in gas business.
Article 2. Interpretation
1. Principal refers to every LPG importer, exporter or distributor or LPG general agent
distributing LPG to agents.
2. Agent refers to every LPG general agent or LPG agent supplied by LPG principal.
3. LPG supply chain refers to a chain of LPG general traders, LPG agents, LPG business
facilities of LPG general traders and traders.
4. LPG distribution channel includes bottled LPG shops, LPG distribution stations, and LPG
filling stations for vehicles, LPG general agents and agents.
5. Label is used for distinguishing goods or products of different organizations or individuals.
6. Copy may be:
a) Certified true copies (if it is official dispatch or document submitted by post); or
b) Copies enclosed with an original document for comparison (if the document is submitted
directly); or
c) Scanned copies (if the document is submitted online)
Article 3. LPG agency agreements
Every LP agency agreement shall be concluded in writing on the principle of voluntarism and
equality. The LPG agency agreement shall include:
1. The name, address and TIN of the LPG agent and principal; types of agents; quantities,
categories and quality of LPG; selling prices and purchase prices; management and exchange for
LPG bottles; commissions, agency costs, methods of payment and date of payment.
2. Responsibilities of both parties for the quality and quantity of LPG, quality control and joint
liabilities for the quality and quantity of LPG sold by their LPG supply chains of the LPG
wholesaler or LPG general agents, and commitments stated in the agency agreement.
3. The agency agreement shall be valid for at least 12 months.
Article 4. LPG selling prices
1. Every LPG wholesaler has the right to decide the wholesale prices and retail prices within
their distribution channel.
2. LPG business facilities of the LPG general agent and agent shall publish LPG selling prices
and comply with the selling price schedule under the regulations of the LPG wholesaler.
3. The retail price is considered as basis for calculating the agency cost and commission for LPG
agents within the administration of the LPG wholesaler.
Article 5. Registration for dedicated gas production, importation and processing
1. Gas traders shall submit their applications for dedicated gas import, production and processing
to the Ministry of Finance using the Annex 01 enclosed herewith directly or by post by October
30 of every year.
2. According to traders’ applications, the Ministry of Industry and Trade shall publish lists of
dedicated gas- importing, gas-producing and gas-processing entities on their website.
Article 6. LPG/LNG import and export by LPG/LNG producing and processing entities
1. Every processing and producing entity wishing to import or export LPG/LNG shall submit 01
application to the Ministry of Industry and Trade directly or by post. Documents requested in the
application:
a) An application form for Certificate of Eligibility for LPG/LNG import and export using the
Annex 02 enclosed herewith;
b) Copies of the Enterprise Registration Certificate;
c) Proofs of the availability of quality laboratories that are leased or owned or jointly owned by
the applicant;
d) Copies of the Certificate of Tank Inspection and proofs of the availability of storage tanks that
are owned jointly owned or leased by the applicant;
dd) Proofs of the availability of LNG pump systems or gasification systems (for LNG producing
and processing entities).
2. Within 30 working days from the date of receipt of the valid application, the Ministry of
Industry and Trade shall consider granting the Certificate of Eligibility for LPG/LNG Import and
Export to the applicant. In case of rejection, the Ministry of Industry and Trade shall send the
applicant a written notice in which reasons for rejection shall be specified.
Chapter II
APPLICATIONS FOR CERTIFICATES OF ELIGIBILITY FOR GAS BUSINESS
Article 7. Applications for Certificates of Eligibility for LPG/LNG/CNG import and export.
1. The applications for Certificates of Eligibility for LPG/LNG/CNG import/export using the
Annex 03 enclosed herewith; and
2. Copies of the Enterprise Registration Certificate; and
3. Proofs of the availability of wharves that are owned jointly owned or leased by the applicant;
copies of the Certificate of Storage Tank Inspection and proofs of the availability of the storage
tank is owned, jointly owned or leased by the applicant.
4. LPG importers/ exporters shall provide the following additional documents:
a) Copies of the Certificate of Bottle Inspection; copies of the Certificate of Label Registration;
and
b) Copies of Certificates of Eligibility for LPG bottling or contracts for LPG bottling; and
c) Lists of distribution channels, copies of Certificates of Eligibility for provision of LPG to
bottled LPG shops, or Certificates of Eligibility for LPG vehicle filling, or Certificate of
Eligibility to Operate LPG Filling Station, or sale contracts with industrial customers and LPG
agency agreements.
5. LNG/CNG importers/ exporters shall provide the following additional documents:
a) Proofs of the availability of LNG/CNG tank trucks or LNG/CNG pipelines owned, jointly
owned or leased by the applicant; and
b) Copies of the Certificate of Eligibility to Operate LNG/CNG filling station or Certificate of
Eligibility for LNG/CNG vehicle filling.
Article 8. Applications for Certificates of Eligibility for LPG/LNG/CNG distribution
1. The application for Certificates of Eligibility for LPG/LNG/CNG distribution made using the
Annex 05 enclosed herewith; and
2. Copies of the Enterprise Registration Certificate; and
3. Copies of the Certificate of Tank Inspection and proofs of the availability of storage tanks
owned, jointly owned or leased by the applicant;
4. LPG distributors shall provide the additional documents specified in clause 4, Article 7 hereof.
5. LPG distributors shall add copies of the Certificate of Eligibility to Operate LPG Filling
Station.
6. LNG distributors shall add copies of the Certificate of Eligibility to Operate LPG Filling
Station or Certificate of Eligibility for filling LNG/CNG to vehicles.
7. CNG distributors shall provide the following additional documents:
a) Documents evidencing the availability of LNG/CNG tank trucks or LNG/CNG pipelines
owned, jointly owned or leased by the applicant; and
b) Copies of the Certificate of Eligibility to Operate LNG/CNG Filling Station or Certificate of
Eligibility for LNG/CNG vehicle filling.
Article 9. Applications for Certificates of Eligibility for LPG Bottling
1. An application form for Certificates of Eligibility for LPG Bottling made using the Annex 07
enclosed herewith; and
2. Copies of Certificates of Eligibility for LPG import and export, or the Certificate of Eligibility
for LPG distribution; and
3. Proofs of the compliance with the development planning for gas facilities and the construction
permit issued by the competent authority; and
4. Copies of Certificates of testing or calibration of measuring instruments in compliance with
laws on measurement; and
5. Proofs of compliance with requirements for fire prevention; and
6. Copies of Certificates of Inspection of filling equipment, pipelines systems, tanks and
auxiliary equipment; and
7. Copies of Certificates of Inspection of machines and equipments required to satisfy the filling
station’s safety requirements; and
8. Copies of processes of LPG bottling, LPG tank trucks filling, machine/equipment operation,
incident tackling and occupational safety.
Article 10. Applications for Certificates of Eligibility for LPG/LNG/CNG vehicle filling
1. The application for Certificates of Eligibility for LPG/LNG/CNG vehicle filling using the
Annex 09 enclosed herewith; and
2. Proofs of the compliance with the gas facility development planning LPG/LNG/CNG and
construction permit granted by the competent authority; and
3. Copies of Certificates of testing or calibration of measuring instruments in compliance with
laws on measurement; and
4. Proofs of compliance with requirements for fire prevention; and
5. Copies of Certificates of Inspection of machines and equipments required to satisfy the safety
requirements of LPG/LNG/CNG filling stations for vehicles.
6. Copies of the Certificate of Eligibility for LPG import and export, or Certificate of Eligibility
for LPG distribution, or Certificate of Eligibility for LPG general agent (for LPG filling stations).
Where the applicant is granted the Certificate of Eligibility for LPG general agent, he/she shall
submit a copy of the Certificate of Eligibility for LPG general agent.
7. For LNG/CNG filling stations, the following documents shall be added:
a) Copies of Certificates of Eligibility for LNG/CNG import and export, or the Certificate of
Eligibility for LNG/CNG distribution; and
b) Copies of Certificates of Inspection of filling equipment, pipelines systems, tanks and
auxiliary equipment; and
c) Copies of processes of LNG/CNG tank truck filling, machine/equipment operation, incident
tackling and occupational safety.
Article 11. Applications for Certificates of Eligibility to Operate LPG/LNG/CNG Filling
Station
1. The application for Certificates of Eligibility for Operate LPG/LNG/CNG Filling Station
using the Annex 11 enclosed herewith; and
2. Proofs of the compliance with the development planning for LPG/LNG/CNG filling stations
and Construction Permit granted by competent authorities; and
3. Copies of Certificates of testing or calibration of measuring instruments in compliance with
laws on measurement; and
4. Proofs of compliance with requirements for fire prevention.
5. Copies of the Certificate of Eligibility for LPG import and export, or Certificate of Eligibility
for LPG distribution, or Certificate of Eligibility for LPG general agent (for LPG stations)
Where the applicant is granted the Certificate of Eligibility for LPG agent, he/she shall add a
copy of the Certificate of Eligibility for LPG agent.
6. Copies of Certificates of Eligibility for LNG/CNG import and export, or the Certificate of
Eligibility for LNG/CNG distribution (for LNG/CNG stations);
Article 12. Applications for Certificates of Eligibility for LPG general agents
1. An application for the Certificate of Eligibility for LPG general agent made using the Annex
13 enclosed herewith; and
2. Copies of the Enterprise Registration Certificate; and
3. Proofs of bottled LPG and LPG bottle warehouses owned, jointly owned or leased by the
applicant; and
4. Copies of the Certificate of Eligibility to Sell LPG to bottled LPG shops, or Certificate of
Eligibility to Operate LPG Filing Station, or Certificate of Eligibility for LPG vehicle filling; and
5. Lists of LPG distribution channels and LPG agency agreements; and
6. Copies of LPG agency agreements with LPG wholesalers
Article 13. Applications for Certificates of Eligibility for LPG agents
1. An application for the Certificate of Eligibility for LPG agent made using the Annex 15
enclosed herewith; and
2. Copies of Certificate of Enterprise/Collective/ Business Household Registration; and
3. Copies of the Certificate of Eligibility to Sell LPG to bottled LPG shops, or Certificate of
Eligibility to Operate LPG Filling Station, or Certificate of Eligibility for LPG vehicle filling;
and
4. Copies of LPG agency agreements with LPG wholesalers or LPG general agents.
Article 14. Applications for Certificates of Eligibility for selling LPG to bottled LPG shops
1. An application for the Certificate of Eligibility to Sell LPG to bottled LPG shops made using
the Annex 17 enclosed herewith; and
2. A copy of Certificate of Enterprise/Collective/ Business Household Registration; and
3. Copies of the Certificate of Eligibility for LPG import and export, or Certificate of Eligibility
for LPG distribution, or Certificate of Eligibility for LPG general agent; and
Where the applicant is granted the Certificate of Eligibility for LPG agent, he/she shall add a
copy of the Certificate of Eligibility for LPG agent to the application; and
4. Proofs of compliance with requirements for fire prevention; and
5. Copies of Certificates or similar documents on completion of occupational safety, fire
prevention and firefighting training; and
6. For dedicated bottled LPG shops, proofs of the compliance with approved planning for
dedicated bottled LPG shop locations shall be added.
Article 15. Applications for re-grant, adjustment, extension and revocation of Certificates
of Eligibility
1. The application for re-granted of Certificates of Eligibility includes:
a)The application form for re-grant of the Certificate of Eligibility made using the Annex 19
enclosed herewith; and
b) The original (if any) or copy of the Certificate of Eligibility.
2. The application for adjustments includes:
a)An application form for adjustment to the Certificate of Eligibility made using the Annex 19
enclosed herewith; and
c) Copies of the Certificate of Eligibility; and
c) Documents as proofs of changes in business line registration, addresses; operation scale or
conditions or information related to whom the registration is made in his/her name.
3. Within 30 days prior to the expiry date of the Certificate of Eligibility, the trader wishing to
keep operating shall submit an application for extension to the State competent authority. The
application for extension includes:
a) An application form for extension of the Certificate of Eligibility made using the Annex 19
enclosed herewith; and
c) A statement of commitment to satisfy requirements for the Certificate of Eligibility.
Chapter III
IMPLEMENTATION ORGANIZATIONS
Article 16. Responsibilities of Domestic Market Departments
The Domestic Market Department shall:
1. Take charge of and cooperate with relevant agencies to provide guidance on the
implementation of this Circular.
2. Take charge of and cooperate with relevant agencies to inspect the qualifications, grant, regrant, adjust or grant extension of the Certificate of Eligibility for Gas Business using the
Annexes 04 and 05 enclosed herewith and revoke the granted Certificates.
Article 17. Responsibilities of relevant agencies
1. Vietnam E-commerce and Information Technology Agency shall take charge of and cooperate
with the Domestic Market Department and Ministerial offices to make the gas business public
and transparent, and publish lists of dedicated gas importing, producing and processing entities
on the Ministry of Trade and Industry's website.
2. Affiliates of the Ministry of Industry and Trade shall take charge of and cooperate with the
Domestic Market Department to inspect and supervise the application of this Circular within
their jurisdiction.
Article 18. Responsibilities of Departments of Industry and Trade
Every Department of Industry and Trade shall:
1. Take charge of and cooperate with relevant agencies to inspect the qualifications, grant, regrant, adjust or grant extension of the Certificate of Eligibility for Gas Business using the
Annexes 08, 10, 12, 14, 16 and 18 enclosed herewith and revoke the granted Certificates.
2. Take charge of and cooperate with relevant agencies to provide training in business gas safety
and grant Certificates of Completion of Training courses.
Article 19. Responsibilities of LPG gas traders
1. Every LPG wholesaler shall:
a) Register for their LG distribution channel and notify the Ministry of Industry and Trade of
their product label using the Annex 20 enclosed herewith by March 30 of every year;
b) Publish the retail prices of their gas distributional channel on their website or on means of
mass media;
c) Notify all units within their distribution channel and the Department of Industry and Trade of
changes in retail prices (if any) in writing.
2. Every LPG general agent and agent shall:
a) Register for their LG distribution channel at the Department of Industry and Trade where their
headquarters is located using the Annex 21 enclosed herewith by March 30 of every year.
b) Submit the schedule of retail prices to the Department of Finance and Department of Industry
and Trade where the LPG business facility is located.
Article 20. Responsibilities of principals
Every principal shall:
1. Fulfill their commitments stated in the agency agreement; ensure the legitimacy of the
supplied LPG and enable to supply the full required LPG volume to LPG general agents and
agent within the administration.
2. Provide instructions on nameplates of agents within their administration; provide their agents
with invoices and documents, and pay commissions under the agency agreement.
3. Inspect the compliance with regulations on LPG business and agency regulations; jointly take
liabilities for agents’ violations related to the principal’s responsibilities.
4. Receive their own LPG bottles back and refund deposits on LPG bottles.
5. Cooperate with State regulatory authorities to manage LPG general agents and LPG agents
under the law on LPG business.
Article 21. Responsibilities of agents
Every agent shall:
1. Sell LPG at the prices decided by the principal.
2. Comply with regulations of laws on HSE, fire prevention, measurement and quality of LPG.
3. Manage LPG bottles in accordance with current national technical regulations and standards,
and relevant legislative documents.
4. Undergo the supervision, inspection and instructions by the principal and State competent
authorities.
5. Every LPG business facility/LPG agent shall put up their nameplate which specifies: The
name of LPG agent, Certificate of Eligibility No., name of LPG wholesaler.
6. Do not receive LPG or bottled LPG that fails to satisfy the quality, volume and requirements
for being sold on the market.
Article 22. Entry into force
1. This Circular enters into force from May 15, 2016.
2. Any issues arising in connection to the implementation of this Circular should be promptly
reported to the Ministry of Industry and Trade. /.
