Appendix 2 - Criteria for Applicants
1. The Beaminster Area scheme supports the re-use or conversion of existing (vacant, redundant or unused) rural buildings within the parishes of Beaminster,
Cheddington, Mapperton, Mosterton and South Perrot.
2. The Beaminster Area scheme is not notified to the European Commission under State Aids rules. This means that applicants seeking to support the conversion of
rural buildings must do so under the de minimis block exemption to the EU rules. Essentially this requires that a company may not receive more than EUR 200,000
(approx. £190,000) of aid in total over a rolling 3-year period from all public sources. Further information about state aid is available on the Department for
Business Innovation and Skills website.
3. In addition to ensuring that aid for the conversion of rural buildings complies with de minimis rules, grants will be awarded according to the following:









Grants are awarded on an entirely discretionary basis.
Grants will only be awarded where planning consent has been obtained, and may be withdrawn if consent is not secured within six months of any conditional
offer
The maximum level of grant assistance that would normally be expected to be made available from the Beaminster Area scheme is 25%; the minimum
investment in a project is £10,000.
In exceptional circumstances the council may make additional awards as follows:
o 5% of total project cost or 25% identified items cost (whichever is the lower to a max £7k) for investment in renewable/low carbon technologies1 or
where the applicant has secured a renewable loan from the Carbon Trust, and or
o 5% of total project cost cost (to max £7k) for projects achieving vg and above BREEAM assessment
Support is limited to the conversion of vacant, derelict or unused buildings for employment uses – defined for the purposes of this guidance as classes A2
(financial and professional services), B1 (light industrial or office use), B2 (general industrial), B8 (storage or distribution) and D1(c) (education) of the Town
and Country Planning (Use Classes) Order 19872.
Grants can cover both speculative and non-speculative (i.e. pre-let, pre-sold or for owner occupation) developments.
Speculative schemes should be of high quality, fitted out to shell standard and suitable for a wide market of potential occupiers.
Non-speculative schemes may be adapted to suit end user requirements.
Eligible costs include:

o Ancillary works in accordance with planning consent

A maximum return on capital employed of 15%.
8. All costs will be scrutinised in proportion to their scale to ensure value for money. This would normally be achieved by, for instance, obtaining competitive quotes, or
taking the advice of a Quantity Surveyor.
9.
Applicants are required to ensure that premises are used productively, and maintained to a satisfactory standard for 5 years after the last payment of the grant.
10. Where applicants are leaseholders, grants will only be awarded where t he lease has at least 5 years left to run, and where the applicant provides evidence that
the freeholder has agreed to the proposed work being carried out.
11. Grants will not be made for the conversion of buildings into holiday lets.
12. Grants should not be made for normal repairs, or for any work required by statutory notice.
13. Grants will only be made to property developers if at the time of application they demonstrate their intention to retain the property for at least 5 years. This does
not preclude the disposal of the property within 5 years if a developer’s circumstances change; in that case the council will apply the claw back provisions outlined
at paragraphs 14 and 15 below.
14. Grants will only be paid in arrears (whether interim or full claim), and on the basis of actual expenditure. Claimants will be required to support their claims with
evidence of what has been spent. If costs are lower than estimated at application stage, the grant award will be reduced proportionately. Receipted accounts or a
Certificate of Costs must be signed by a member of an institute or association that is a full member of the Construction Industry Council. Before making the final
payment, the council may wish to verify that the work has been completed, if necessary through inspection of the property beforehand.

15. If grant recipients want to alter, sell, dispose of or change the use of grant aided premises during the 5 years following the last payment of grant, they are required
to seek the council’s agreement. In these circumstances, the council may exercise its right to claw back the grant on a sliding scale as follows:

16. Clawback should also operate if a higher level of profit, higher values or lower costs than forecast in the application/appraisal is apparent at the date of review.
Clawback provisions will be incorporated in all offer letters.
17. These provisions will need to be legally secured by an appropriate means, e.g. by Charge or restriction on title. Legal advice may be required to determine the
most appropriate form.
18. All applications will be subject to an independent external technical appraisal to assess validity of costs and propose a grant award such that return on capital
employed does not exceed 15%.
19. The award of grant is discretionary and the decision of the council is final. Applications are by time limited invitation and may be considered competitively with other
applications received. Decisions will be based on the technical appraisal, achievement of BReEAM standards or other environmental criteria and delivery of wider
council objectives.
20. Applications can be submitted at any time and will be determined there times pa according to the following time table:
Applications submitted by 12 March 2010 will be normally determined by end of April 2010,
19 June by the end of July and
13 November by the end of December
21. Funds are strictly limited, and all applicants are required to register their interest in order to avoid disappointment through oversubscription.
