Include a copy of the resident consultation letter when returning your application form and response information. ‐ Complete the application form, ensuring all details are true and correct. ‐ Return the application form to the address provided on page 4. 1 Section 1 – General Information Enfield Council wants to encourage residents, if they wish to, to organise and hold regular play streets in their communities. Not all roads in the borough are suitable and we have to be sensible as to which roads can be closed regularly to allow play to take place. Furthermore, as it is a community centred event, it is important that all affected residents are aware of the proposal and the majority support the idea. This application pack should contain all the information you require in order to make an application. If you are unsure of anything, please do not hesitate to contact us. What is a Play Street Order? A Play Street Order will permit you to close a road for the sole purpose of children’s play. It is essential that an order is in place before a road can be closed. A Play Street Order will allow the closure of a road on monthly intervals, for a period of no more than up to 12 months. Major roads and bus routes are exempt from the Play Street Scheme. Enfield Council will determine which roads these are. Any Traffic Regulation Order (TRO) or other statutory provision which is currently in force on the road(s) to be closed will remain in force during the closure, unless specified to the contrary on the Play Street Order. On-street parking can only be restricted where it is currently restricted through an existing Traffic Regulation Order. The Order only allows the road(s) to be closed on the dates and times specified. No closure may be of more than three hours. The Order is created entirely for the sole purpose of children’s play and does not authorise the placement of any structure on the highway. What will it cost? In order to reduce costs to the council, Enfield Council process all the traffic orders for play streets at the same time on an annual basis. There is no cost for providing the temporary traffic order or for supplying signs and barriers, providing your application is received to meet the annual deadline. Please see the section on the application process below. 2 The Application Process - Important All applications are processed annually by the council between January and March each year, allowing play street orders to run from April onwards. We must receive your application by 31st December the preceding year to allow time for consideration of the application and to process the traffic order. Applications can be made at other times, but a charge will be made for processing the traffic order. Consultation You must consult with all affected residents and provide the results of your consultation. A letter template is provided as a guide within this document. Please be aware that the majority of the affected residents within the proposed road need to be in agreement with the closing of the road for the purposes of a play street. Making a Decision on Your Application When deciding whether to approve this application the Council will take into account the specific arrangements, location and importance of the road including traffic, parking, vehicular access and proximity of local green spaces and parks. It will consider the strength and validity of any objections on their merits. The decision on whether to approve the application is made by the Cabinet Member for Environment. Traffic Control Enfield Council will provide the appropriate traffic management requirements needed to ensure the road is properly closed to traffic and, if appropriate, a diversion route is signed. All road closures in Enfield will be with the correct signing and barriers, complying with legislation. The use of wheelie bins and other types of home- made barriers or signs will not be permitted. At the end of the play street scheme, the signs and barriers will be collected by the Council. Where regular closure of the street has been arranged, it will be the responsibility of the organiser to safely store the barriers between events and erect them on each occasion. 3 Changes to Arrangements Enfield Council will use its best endeavours to ensure that regular closures of a road can be made. However, certain circumstances, out of the council’s control, may have a detrimental impact on the council’s highway network management duties, which may result in the temporary suspensions or postponements of the planned play street closures. Enfield Council reserves the right to cancel any Play Street Order if the closures are not implemented in accordance with its requirements or if the activities are not carried out or supervised in a safe manner. Enfield Council also reserves the right to cancel any play street order if it receives significant objections from residents, which effectively change the balance of opinion demonstrated in the original application on which approval was given. Office hours - 9.00am to 5pm Monday to Friday. 4 Section 2 - Your Responsibilities This section sets out your responsibilities and by making an application you agree to comply with them. You must consult with all affected properties. Please keep a copy of all correspondence and results. Your application must be received by 31st December for any events after April the following year. Application at other times must be made three months in advance of the first event date. To ensure a smooth and straightforward process, please make sure you provide all information requested on the application form. This includes a copy of your resident consultation letter and as much information to demonstrate that you have undertaken a thorough consultation. It is the responsibility of the event organiser(s) to manage the event and ensure a sufficient risk assessment has been undertaken and acted upon prior to the event. Road closure points must be marshalled. Any barriers must be removed immediately for the access of emergency services or other residents if required. Vehicular access and egress for all residents/businesses along the road or properties accessed by the road must be maintained during any closure period. No activity requiring any form of license (under the Licensing Act 2003) may be undertaken when the Order is in force. Please frequently monitor the whereabouts of the children playing and ensure the safety of the children is your main priority. If any issues arise throughout the closure, please deal with them in an appropriate manner, Enfield Council wishes to ensure all residents affected by the play street are satisfied with the arrangements. For regular play street closures, you must safely and securely store all barriers and signs provided by Enfield Council between events and set up and take them down in accordance with the times of the play street order. Not everyone may wish to partake in the scheme. Their wishes must be respected and organisers should ensure an acceptable level of noise is maintained throughout the times the play street is in operation. The road must be kept free of debris and any apparatus used must be removed from the road and any litter cleared prior to the road being reopened. The event organiser will be responsible for meeting the full cost of any damage to the public highway, street furniture, traffic management equipment supplied by the council, or other loss/damage suffered by it, also any claims made against it as a result of the making of the Order which arise from your negligence OR if you represent an organisation, the negligence of your organisation’s member/officers. Enfield Council strongly recommends that you take out Public Liability Insurance for the duration of your road closure. 5 Section 3 - Consultation Letter Template and Survey Form The following letter template is provided as a guide.
