The processing of your application will be speeded by the provision of spatial information in GIS format. The preferred method of submission is an ESRI GIS shapefile. The co-ordinate and datum (ideally WGS84) must be specified on this form. If you are not able to create an ESRI GIS shapefile, co-ordinates must be supplied within an Excel spreadsheet as WGS84 Decimal Degrees. If you are unable to submit co-ordinates as either a shapefile or on the Excel sheet, please record this below and give further details of the way in which co-ordinates have been provided. Marine works - guidance notes 1. Crown Estate Scotland Crown Estate Scotland manages leasing of the seabed out to the 12 nautical mile territorial limit, as well as around half of the foreshore, 37,000 hectares of rural land and commercial properties. The foreshore and seabed within Crown ownership is no different to any other land and our permission is required before use is made of it. As with any other landowner we issue leases, licences and consents for activities and developments on our land, such as: Ports and harbour development Coastal protection and flood defence works Cables and pipelines Offshore energy installations Dredging and dumping of material from, and onto, the seabed Filming on Crown Estate Scotland foreshore Laying of moorings Laying of outfall and intake pipes Temporary works Rents and charges are made for use of our land and the revenue surplus from Crown Estate Scotland is paid to the Scottish Government. 2. Scope of guidance notes These guidance notes have been prepared to assist applicants obtain our consent for marine works. 3. Pre-application stage For significant works, you are strongly advised to contact Crown Estate Scotland before starting the application process. Our local agents and marine officers have excellent local knowledge and will be able to discuss your proposals prior to the formal submission of your application. 4. Application form An application form should be completed for all development proposals and returned to Bidwells who manage the application process on behalf of Crown Estate Scotland. A completed form should provide all the basic information needed to assess your proposal but any additional supporting information you can provide may speed up the application process. Please also note that should work commence on our land without consent, legal action may be taken to remove the works and to recover the costs incurred. 5. Application process Once an application has been received it will be checked against our records to check the extent to which your proposal affects assets managed by Crown Estate Scotland and existing Crown Estate Scotland customers. You will be advised whether enough information has been supplied and whether the information is sufficient to be accepted as an application or whether further information is needed. Provided enough information is supplied in the application and there are no conflicts with existing customers, our managing agents will discuss the most suitable type of agreement for your proposal. 6. Other consents An agreement from Crown Estate Scotland enables you to occupy the relevant seabed. In addition, you are likely to need consent from statutory authorities. It is your responsibility to obtain these and our agreement is conditional on all other necessary consents being in place. Depending on the type of development proposed you may need statutory consents from the Scottish Government (through Marine Scotland), your local authority and Harbour Authority (where appropriate). Other consent may however be required, for example SEPA consent for discharges from an outfall, or approval from SNH if in an area of nature conservation interest and you should satisfy yourself that all necessary consent have been obtained for your proposal. 7. Agreements and charges The precise form of agreement to be used will be dependent on the proposed activity/development and our Managing Agents will discuss this with you. An agreement with Crown Estate Scotland is a legally binding document and you may wish to seek legal advice at an early stage. Please note that as with any landowner we charge for occupancy of our land and this applies to both private and commercial uses. The rent payable will depend on many factors and our managing agents will discuss this with you. Where necessary, the applicant will also be responsible for meeting the costs incurred in the preparation of plans, solicitors’ fees and surveyors’ fees. This would include costs incurred even if the proposal is abandoned before being completed. An agreement will be prepared once the type of consent and terms have been agreed and will require signing by both parties. 8.
