SPORTS CAMBRIDGE COMMUTER CHALLENGE OFFICIAL RULES NO PURCHASE NECESSARY TO ENTER OR WIN ELIGIBILITY CAMBRIDGE COMMUTE CHALLENGE (the “Contest”) is open only to legal residents of the fifty United States and District of Columbia, who are at least eighteen years of age or older at the time of entry. Contest is void where prohibited or otherwise restricted by law. Employees, directors and officers of Cycling Sports Group Inc., Cannondale Sports, Dorel Sports (“Sponsor”) and “Ride with GPS” (Collaborator”) and any of their respective affiliates, franchisees, parents, subsidiary companies, and advertising and promotion agencies and members of the immediate families (spouses, parents, children, and siblings and their respective spouses, regardless of where they reside), and/or those living in the same household, of any of the foregoing are not eligible. By participating in the Contest, you agree that you have read and understand these Official Rules, as posted at: http://cannondalesportsstore.com/commute. HOW TO ENTER • • • Registration Dates: May 1-28, 2015 Contest Dates: June 1 - August 10, 2015 Registration is IN-STORE only. No late entries will be accepted. Registration Requirements: • • • • Participants must sign up within the Cannondale Sports Store in Cambridge, MA. There are no online or over-the-phone sign ups permitted Participants must be 18 years of age or older Participants must fill out application form and waiver form Participants will be required to download the Ride with GPS app on their smart phone and create a profile. (Ride with GPS application requires iOS 7.0 or later) BY SUBMITTING AN ENTRY TO THE CAMBRIDGE COMMUTE CHALLENGE YOU AGREE TO HAVING READ AND UNDERSTOOD THE OFFICIAL RULES AND YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS WHICH SERVE AS A BINDING AGREEMENT BETWEEN YOU AND THE SPONSOR. Tracking Commutes: Once registered, participants can begin tracking their commutes as of June 1, 2015 using the Ride with GPS App. To “Track” a commute, participants must record their trip on the Ride with GPS App. Once you've started your trip with the App, you'll have the option to stop once your destination is reached. You’ll then be prompted to "Save or Delete” your ride. Just save the ride and input the phrase “CSCC” in the ride name. The phrase CSCC will allow us to track everybody’s commutes. Record commutes without the phrase “CSCC” in the name will not be counted. CAMBRIDGE COMMUTER CHALLENGE 1 SPORTS CAMBRIDGE COMMUTER CHALLENGE Commute vs. Casual Ride: A commute has two points---a start and a finish. A casual ride begins and ends in the same place and has only 1 point. Think of it as replacing a car drive with a bike ride to get to a destination counts as a commute. If you have no destinations other than your house, then it is a ride, not a commute. WINNER SELECTION Compiling Commutes: Cannondale Sport Store employees will be in charge of compiling and totaling individual commutes for participants. Participants are not required to compile and keep track of their commutes—Cannondale Sports store employees will keep track of everything. The information extracted from each ride will be total distance and total time. These two stats, in addition to the total number of commutes, will serve as the prize categories. At the end of the contest (August 10, 2015), every participant’s commutes will be tallied and the top 3 participants for each category will win the designated prizes. The potential winner will be notified on or about August 13, 2015. PRIZES • • • 1ST PLACE 2ND PLACE 3RD PLACE 2015 CANNONDALE URBAN BIKE 2015 SCHWINN SIGNATURE URBAN BIKE $150 CANNONDALE SPORTS SHOPPING SPREE Categories: (1st, 2nd and 3rd places are awarded in each category – total of nine (9) winners) • • • Most total miles ridden Most time spent riding Highest total number of rides A participant cannot win a prize in multiple categories. Prizes have no cash value and cannot be redeemed for cash or store credit. The average retail value of the 1st, 2nd and 3rd prizes is $760; $440; and $150 respectively. No prize substitution, cash substitution, or assignment or transfer of prizes is permitted, except by Sponsor. Odds of winning depend upon the number of eligible entries received during the Contest Period. Many will enter only nine will win. The winner should allow 6 to 8 weeks from notification for delivery of any prizes. Delivery and use of the prize is subject to the prize winner’s completion of all documentation and conditions required by law or otherwise required by Sponsor. In the event the prize winner does not confirm these conditions in writing within twenty (20) calendar days of notification and in the manner specified by the Sponsor, an alternate prize winner may be selected. Each entrant agrees (and the prize winner or his or her parent or legal guardian, if the winner is a minor in jurisdiction in which her or she lives, must confirm in writing) that neither Sponsor, Collaborator or Facebook or any of their respective members, managers or related financing parties, officers, directors, employees, representatives, agents, successors or assigns (collectively the “Released Parties”), shall be held liable CAMBRIDGE COMMUTER CHALLENGE 2 SPORTS CAMBRIDGE COMMUTER CHALLENGE for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part directly or indirectly, from acceptance, possession, misuse, use or non-use of any prize or participation or inability to participate in this Contest, or while traveling to, preparing for or participating in any prize-related activity. The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize awarded. Other prize restrictions, conditions, and limitations may apply. GENERAL CONDITIONS 1. The laws of the United States govern this contest. Void where prohibited. All federal, state and local laws and regulations apply. This contest is not to be used in connection with any form of gambling. The prize will be awarded and/or delivered only to a U.S. resident at a street address within the United States. The prize winner is responsible for all state and federal income taxes and all other fees and surcharges of whatever kind applicable to his or her prize. Except where legally prohibited, the prize winner grants (and agrees to confirm that grant in writing) permission for Sponsors and Sponsors’ advertising and promotional agencies, and those acting under the authority of each, the right to use the prize winner's name and/or likeness in perpetuity for advertising and/or promotional purposes in all media now known or hereafter discovered, worldwide and on the World Wide Web, without notice, review, approval, or additional compensation. 2. Delivery and use of the prize is subject to the prize winner’s proof of eligibility and completion of all documentation and conditions required by law or otherwise required by Sponsor. Each entrant agrees (and each prize winner, or parent or guardian on behalf of a minor winner, must confirm in writing) that Sponsor or any of Sponsor’s members, affiliates, subsidiaries, suppliers, printers, distributors, advertising and promotional agencies, and each of their respective officers, directors, employees, representatives and agents, will have no liability whatsoever for and shall be held harmless by an entrant against, any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse, use or non-use of any prize or participation in this contest, or while traveling to, preparing for or participating in any prize-related activity. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize awarded. Restrictions, conditions, and limitations apply. Conduct and Decisions: All decisions by Sponsor are final. Persons who violate any rule, gain unfair advantage in participating in the contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the contest and its decisions regarding same shall be final. If the conduct or outcome of the contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the sponsor, reserve the right to terminate this contest, or make such other decisions regarding the outcome as it deems appropriate. Sponsor reserves the right to and may waive any of these rules in its sole discretion. 4. Limitations of Liability: Sponsor is not responsible for: (1) incorrect or inaccurate transcription of entry information or late, lost, stolen, illegible, incomplete, misdirected or postage-due entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; (2) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any Web site or service; (4) unauthorized human intervention in any part of the entry process or the Contest; (5) electronic or human error which may occur in the administration of the Contest or the processing of entries. 5. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEB SITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT OR OTHER PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 6. Disputes: Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the laws of the State of Connecticut; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Contest, if any, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the parties in connection with the Contest shall be governed by, and construed in accordance with, the laws of the State of Connecticut, USA, without giving effect to any choice of law or conflict of law rules. All federal, state, provincial and local laws apply. Offer void where prohibited by law. Subject to all federal, state, local laws and regulations. No substitutions, cash equivalents, or transfer of prizes permitted except at the sole discretion of the Sponsor who reserves the right to substitute a prize of equal or greater value if advertised prize is unavailable. 7. Winner’s List: For the name of the winner, available after the winner has been confirmed by the Sponsor, mail a self-addressed, stamped envelope by August 31, 2015 to: the Cambridge Commuter Challenge Winner, 1 Cannondale Way, Wilton, CT. 06897. 8.
