BUTLER UNIVERSITY ATHLETE AGENT PROGRAM REGISTRATION GUIDELINES Butler University Athletic Department Hinkle Fieldhouse 510 West 49th Street Indianapolis, IN 46208 Phone: (317) 940-9630 INTRODUCTION Butler University is committed to operating its athletics program in full compliance with NCAA and Big East rules and regulations as well as the laws of the State of Indiana. Butler University is responsible for ensuring individuals and groups representing the institution’s athletics interests also comply with all applicable rules and regulations. This brochure is designed to provide agents, advisors, and other interested individuals with basic information related to the Butler University athlete agent policy and registration procedure, as well as the applicable rules and laws that regulate the conduct of agents in the State of Indiana. It is the agent’s responsibility to understand and follow the applicable rules and laws at all times. Butler University strictly prohibits any contact between an athlete agent and a Butler University studentathlete unless the agent holds a current and valid certificate of registration as an athlete agent issued by the Indiana Attorney General’s Office as well as an approval of agent’s registration application by the Butler University Compliance Office. Application Athlete agents desiring to contact and represent Butler student-athletes must submit a fully completed Agent/Advisor Initial Registration Application to the Compliance Office. The submission of an application constitutes an agreement by the agent to follow all applicable Butler University policies, NCAA rules, and State of Indiana laws related to athlete agents. Please contact the Compliance Office to request a copy of the application. II. Evaluation The Butler Compliance Office shall notify the agent in writing as to confirm when and if the application has been approved or denied. The Compliance Office may also request additional information at that time. III. Approval When an agent’s application is approved, the agent’s name, application, and publications/contact information shall be included in a portfolio of approved registered agents held in the Compliance Office and available for review by all Butler University student-athletes. After an agent receives notice that the application has been approved, the agent shall be permitted to have contact with the Butler University student-athletes identified in the application. Additional contact with any Butler student-athletes not named in the application must be requested in writing to the Compliance Office before contact is allowed. IV. Renewal/Update Responsibility Agent registration with Butler shall be valid for two years from the date of notice of acceptance by the Compliance Office. It is the responsibility of the agent to renew their registration before the expiration of the two-year period by submitting the completed Agent/Advisor Registration Renewal Application. Note: If there are any material changes to the information disclosed in the registration application during the two-year period of valid registration, it is the responsibility of the agent to contact the Compliance Office with the necessary corrections and updates. Duties and Obligations of the Agent All potential athlete agents, financial advisors, or attorneys for student-athletes are required to abide by all pertinent Butler University policies, NCAA bylaws, and Indiana Uniform Athlete Agents Act laws at all times. It is necessary to be familiar with certain NCAA rules and regulations and the effect on studentathlete’s eligibility if they are not followed. Important policies, rules, and laws are summarized below. Indiana Uniform Athlete Agents Act An athlete agent may not predate or postdate an agency contract with a Butler University studentathlete or fail to notify the student-athlete of the loss of eligibility after signing an agency contract. An athlete agent may not provide false or misleading information to Butler University or any Butler University student-athlete. An agent must provide all necessary information required by Butler or the Indiana Uniform Athlete Agent Act. If a Butler University student-athlete with remaining eligibility voluntarily chooses to forego his or her remaining eligibility and enter into a contract with an agent: The agency contract must contain all provisions described in the Indiana Uniform Athlete Agents Act (IC 25-5.2-2-8). Specifically, the contract must contain the written notice of warning to the student-athlete concerning the potential loss of eligibility. At least ten (10) days before an athlete agent enters into an agency contract with a Butler University student-athlete, the agent and student-athlete are required to provide written notice of the existing contract to the Athletic Director, Compliance Office, and the student-athlete’s head coach. NCAA Rules and Regulations [Bylaw 12.3 ] Athlete agent conduct may jeopardize the eligibility of a Butler University student-athlete: An athlete agent may not enter into a verbal or written agreement with a student-athlete with remaining eligibility for the purpose of marketing the student-athlete’s athletics ability or reputation in a specific sport. The prohibition also applies to any agreement of future representation after the studentathlete has exhausted his or her eligibility. An agent or person associated with an agent may not provide benefits or gifts to a student-athlete with remaining eligibility or the student-athlete’s relatives or friends. Impermissible benefits and gifts include, but are not limited to, money, transportation, clothing, or gifts of any kind, regardless of value. Note for Lawyers and Financial Advisors NCAA rules permit student-athletes to consult with financial advisors and lawyers to receive legal advice and/or financial advice. However, if the lawyer or financial advisor engages in any marketing of the student-athlete’s athletics ability or reputation, or plays any role in negotiations for a contract, he or she will be considered an athlete agent under Butler University policies as well as NCAA bylaws and the student-athlete will forfeit his or her remaining eligibility. Potential Penalties Failure to comply with Butler University policies, NCAA rules, and the Indiana Uniform Athlete Agents Act may result in the following actions taken against the agent: Revocation of the agent’s registration with Butler University and a ban of all future contact with Butler University student-athletes. Civil penalty not to exceed twenty-five thousand dollars ($25,000) for each violation from the State of Indiana. Restriction, suspension, or revocation of certificate of registration of an athlete agent by Indiana Attorney General’s Office Civil lawsuit by Butler University against the agent for any damages caused by violations of the Indiana Uniform Athlete Agents Act
