PAS County Council CIL Seminar – Preparations for CIL

Virtual team of officers from a range of services were tasked to work on preparation of
County Council for CIL in 2010
Included reports and presentations to County Members and Local Committees and
workshops for officers
Focus was on working with the authorities who wished to take CIL forward whilst
providing regular updates to County Members and reports to Local Committees.
Local Committees are made up of County and District/Borough Members but were
County Committees rather than true joint Committees
Some authorities were eager to work with the County Council particularly those who
utilised the Surrey Planning Infrastructure Scheme (PIC) a s106 tariff that raised a
significant amount of contributions in those areas for both authorities
Elmbridge were the first authority to adopt PIC in Surrey in 2007
To date nearly £14M of County contributions have been collected in the seven of the
eleven authority areas who adopted the PIC scheme, or elements thereof.

Elmbridge were the first authority to both adopt and commence collection of CIL, in
April 2013, and governance arrangements were put in place in relation to how CIL
would be allocated and spent
For the strategic CIL monies a Strategic Spending Board of five Members has been
established by Elmbridge and the first meeting took place on 29th September 2014
A number of bids were made to the Board and the following were successful –

Long Ditton Schools safety measures
Fairmile Lane safety improvements
Stoke Road speed management measures
Oxshott speed management measures
Burhill Primary School expansion

The one scheme that was not found to be acceptable was a cycle path
scheme at £330,000 which was considered too expensive and it was felt did
not meet the needs of the local population

With regard to the spending of the ‘meaningful proportion’ of CIL which has
to be handed down to communities, settlement-specific Spending Boards
have been created for the designated seven settlement areas, the release of
such funds being contingent on having a clear delivery plan in place
•
Elmbridge have collected £2M and invoiced for a further £1M since adoption
•
Although Epsom & Ewell have commenced the collection of CIL detailed
discussions have yet to take place as regards how the governance
arrangements will work going forward and what role the Local Committee will
have in the process
•
To date only one other authority are considering the governance model they
wish to adopt

Woking have yet to commence the collection of CIL but detailed discussions have
taken place as regards how governance will operate in their area and a report is being
taken to the newly constituted Joint Local Committee on 3rd December which will seek
to introduce a process whereby the Joint Local Committee will determine the spending
of CIL, once the CIL regime is in operation.
Clearly there are a number of different models for governance that could be introduced
by each of the authorities but at present it is considered that the Woking model is one
that appears to offer the most open and transparent collaborative process for deciding
which schemes the CIL monies should be used to support.
The authorities in Surrey are at different stages in their preparations for CIL and as a
result the adoption and collection of CIL will be subject to a variety of timescales and
could, as a result, affect the ability of the County Council to support development in
each of the areas by securing and providing infrastructure within the required
timeframe.

The Horley Master Plan (HMP) is a comprehensive and co-ordinated strategy
to deliver 2,600 new homes supported by an extensive package of
infrastructure and service improvements
As part of the HMP the County Council and Reigate & Banstead BC
identified a range of public transport, highways, education, recreation and
community improvements that would be required which includes both
developers direct provision, such as on site infrastructure, as well as financial
contributions towards infrastructure and service improvements
To date two Section 106 agreements (S106) have been completed for the
NE Sector (710 dwellings) and a further agreement has been negotiated for
the NW Sector (1,510 dwellings) with other contributions being secured
through the Horley Infrastructure Tariff, which is a tariff paid on every new
residential unit on the smaller sites (380 units).

As part of its commitment to the HMP, the County Council has already defrayed
considerable expenditure to deliver a number of key infrastructure and service
improvements in advance of developer contributions being received
The Borough Council is proposing to introduce differential rates for residential
development including a levy of £120 per on new homes in urban areas and a higher
levy of £180 per sqm for the NWS
The purpose of a higher rate for the NWS is to ensure that in the unlikely event that the
latest S106 is not signed, or the Developer Consortium resubmits a fresh application
for the development after CIL has been adopted, sufficient monies can still be secured
for the identified infrastructure in order to deliver the HMP
Under this scenario, the Councils would continue to secure some elements of the
infrastructure from the NWS through S106, whilst other elements would be pursued
through CIL, but with a formal agreement with the Borough as to how CIL receipts will
be allocated (top sliced) to ensure that the identified package of HMP infrastructure
and services are funded
