APPRAISAL
Definition of Fair Market Value as per Ohio
Jury Instruction
 Fair Market Value is the amount of money
which could be obtained on the market at a
voluntary sale of the property. It is the
amount that a purchaser who is willing, but is
not required to buy, would pay and that a
seller who is willing, but not required to sell,
would accept, when both are fully aware and
informed of all the circumstances involving
the value and use of the property.

 ODOT will not take possession of
your property unless: You have
been paid the agreed purchase
price

EMINENT DOMAIN
 If an agreement cannot be reached
 An action will be filed in the Court of
Common Pleas
 ODOT deposits with the Clerk of Courts at
least the amount of the appraisal
 Once deposited those funds can be
withdrawn
 Negotiations may continue at all times
 Jury of peers will decide the amount of the
award
