Definitions
Inthisdocument:
“Activity”or“Activities”meansactivitiescarriedoutattheGymoratanylocationatwhichtheHangaroffers
servicesandactivitiesandincludesbouldering(orclimbing)onstructuresreachingheightsof16feetfromthe
floor,slack-lining,yogaandothergroupandindividualfitnessandexerciseclasses,anduseofweightsincluding
freeweights.
“Gym”meanstheboulderinggymfacilityownedandoperatedbytheHangarinSechelt,BritishColumbia.
“Hangar”meansthe[TheHangarClimbingLoungeLtd.]doingbusinessastheHangarClimbingLoungeand
includesallstaff,owners,contractors,volunteers,directorsandaffiliates.
“Member”meansaVisitorwhoisalsopayingforamembershipattheHangar.
“Minor”meansapersonwhoisyoungerthan19yearsoldandisunderthecareofaparentorlegalguardian
whosignsthisReleaseandWaiverAgreementonhisorherbehalf.
“Visitor”meansanyperson,whetheradultorMinor,whovisitsanactivityareaoftheHangarorparticipatesin
anActivityattheGymoratanysiteorlocationatwhichtheHangarisofferingActivities,includingbutnot
limitedtooutdoorclimbingareasorportableclimbingwalls,andincludesindividualswhocometoobserve
Activities.
AssumptionofRiskforActivities
TheActivitiesattheHangarareinherentlydangerousandcreatetheriskofinjurytopersonandproperty.
TheHangarandHangarstaffdonotbelay,spotorotherwisemanageVisitor’sActivities.EachVisitorisresponsiblefor
assessinghisorherownskilllevelandmanaginghisorherownActivitiesandrisks.Anyequipmentrentedbythe
HangartoaVisitorisprovidedonan“as-is”basiswithoutanywarrantybytheHangarastothesuitabilityofthe
equipmentforitsintendedpurposeoritscondition.
ByinitialinghereIacknowledgethat:
• Iamawarethattherearerisks,dangersandhazardsassociatedwiththeActivities,includingbutnot
limitedtofalls,breakageorfailureofwall-mountedholds,failureofequipmentandtheriskofbeingstruck
byotherVisitorswhoareclimbing;
• IacknowledgeandacceptthattheHangardoesnotsuperviseorotherwisemanagethesafetyofmy
ActivitiesortheActivitiesofotherVisitors;
• IacknowledgethattheHangardoesnotassesstheskillorabilitylevelofotherVisitorsandmakesno
representationorwarrantyastotheirskill,abilitylevelorsafety;and
• Ifreelyacceptandassumeallrisks,dangers,lossesandhazards,includingtheriskofpersonalinjury,
death,lossofordamagetopropertyandallrelatedlossesordamage,nomatterhowcaused,arisingfrom
orrelatedtoallActivities,includingActivitiescarriedoutwithequipmentrentedfromtheHangar.

Waiverofrighttosueandreleaseofliability
InconsiderationfortheHangarallowingmeuseoftheGymandtheabilitytoparticipateintheActivities,thereceipt
andsufficiencyofwhichconsiderationIherebyacknowledge,Iagreeasfollows:
• IwaiveanyandallclaimsthatIhaveormayhaveinthefutureagainsttheHangarforanyloss,damage,injury
orharmofanykindarisingfromorrelatedtomyparticipationinanyActivitiesofferedbytheHangar;
• IreleasetheHangarfromanyliabilityorobligationtoprovideanycompensationinanyformwhatsoeverfor
anyloss,damage,injuryorharmofanykindarisingfromorrelatedtomyparticipationinanyActivitiesoffered
bytheHangar;
• IacknowledgeandacceptthatIamwaivingandreleasingmyrightsforallformsofpotentiallegalclaims
againsttheHangar,whetherarisinginnegligence,tort,contract,statute(includingtheOccupiersLiabilityAct),
commonlaworotherwise,andthatthiswaiverandreleasespecificallyappliesbutisnotlimitedtolegalclaims
relatedtoinjuriesarisingfromboulderingandclimbing;and
• IagreetofullyindemnifyandcompensatetheHangarforanyloss,damage,injuryorharmofanykind,
includinglegalfeesorcosts,resultingfrommyparticipationinActivitiesofferedbytheHangar.

ThissectiononlyappliestoMembers.ItdoesnotapplytoVisitorswhoarepayingfordrop-inonly.
Membersareentitledto24-houraccesstotheGym,includingafterregularbusinesshours.Iacknowledgeandagree
that,fortheconsiderationofbecomingaMemberattheHangar,thereceiptandsufficiencyofwhichconsiderationI
herebyacknowledge,Iacknowledgeandagreetothefollowing:
• TheHangardoesnotprovideanysupervisionoftheGymafterregularbusinesshoursandhasnoobligationto
providesuchsupervision;
• TheHangardoesnotprovideanysafety,medicaloremergencyservicesattheGymafterregularbusiness
hours;
• IamfullyandsolelyresponsibleformyownsafetyandpropertywhileengagedinanyActivityattheGymafter
regularbusinesshours,andIacceptandacknowledgethattheHangarhasnoresponsibilityorliability
whatsoeverforanyharm,damageorlossImayincurwhileengagedinanyActivityattheGymafterregular
businesshours;

IwillfamiliarizemyselfwithandobservetheHangar’sRulesandGuidelinesatalltimesincludingafterregular
businesshours;and
IwillfullyindemnifyandcompensatetheHangarforanyloss,damage,injuryorharmofanykind,including
legalfees,resultingfrommyparticipationinActivitiesattheHangarafterregularbusinesshours.

TheHangarperiodicallyusesimages,includingphotosandfilm,ofVisitorsparticipatinginActivitiesforpurposesof
advertisingtheHangar’sbusinessandinformingthepublicoftheActivitiesofferedattheGym.Theseusesinclude,but
arenotlimitedto,postingontheHangar’swebpage,distributionthroughsocialmedia,andinclusioninprinted
brochures.
IconsenttothereproductionandusebytheHangarofphotographs,videosandotherimagesandsoundrecordingsof
meforthesepurposeswithoutcompensation.IreleasetheHangarandfromanyclaimofviolationofanypersonal
and/orproprietaryrightImayhaveinconnectionwithsuchrepresentationoruse.

• ThisReleaseandWaiverAgreementhasfulllegaleffectassoonasIsignit.
• IunderstandthateachtimeIvisittheGymoractivitysiteatwhichtheHangaroffersActivitiesfromthedateof
thisagreementforwardIwillbeboundbythetermsandconditionsofthisReleaseandWaiverAgreement.
• IfIamsigningthisReleaseandWaiverAgreementonbehalfofaMinor,Ihavethelegalcapacityastheparent
orguardianofthatMinortomaketheacknowledgements,releasesandwaiverssetoutaboveandI
understandthatallofthetermsofthisReleaseandWaiverAgreementwillapplytotheMinor.
• ThisReleaseandWaiverAgreementfullydescribesandsetsoutallofmylegalrightsasagainsttheHangar
relatedtoanypossibleclaimfordamage,lossorharmofanykindrelatedtoanyActivityIparticipateinatthe
GymorotherlocationofferedbytheHangar.
• ThisReleaseandWaiverAgreementisbindingonme,anyMinoronwhosebehalfIamsigningtheAgreement,
andmyheirsandsuccessors.
• ThelawsofBritishColumbiawillgoverntheinterpretationandapplicationofthisReleaseandWaiver
Agreement.
• IamnotrelyingonanyadditionalverbalorwrittenrepresentationorstatementmadebytheHangarin
enteringintothisReleaseandWaiverAgreement.
